Fv MR-25• 59-3399 BY-LAW NO. 132 A BY-LAW TO PROVIDE FOR THE 1962 EXPENDITURES ON ROADS OR STREETS TOWN Port Burwell IN THE VILLAGE OF COUNTY Elgin THE DISTRICT OF WHEREAS under The Highway Improvement Act a by-law to provide for expendi- tures on roads or streets may be submitted annually to the Minister of Highways for approval. The Head and the Treasurer are hereby authorized on behalf of the Municipality to borrow from time to time by way of promissory note from THE CANADIAN BANK OF COMMERCE a sum or sums not exceeding in the aggregate = to meet until the taxes are collected the current expenditures of the Municipality for the year, including the amounts required for the purposes mentioned in subsection (1) of Section 341 of the Municipal Act, and to give on behalf of the Municipality to the Bank a promissory note or notes sealed with the Corporate Seal and signed by the Head and Treasurer for the moneys so borrowed, with interest, which may be paid in advance or otherwise, at a rate not exceeding per centum per annum. 2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums borrowed in this year and in previous years from the said Bank for any or all of the purposes mentioned in the said Section 341, shall, with interest thereon, be a charge upon the whole of the revenues of the Municipality for the current year and for all preceding years as and when such revenues are received. 3. The Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the moneys hereafter collected or received either on account or realized in respect of taxes levied for the current year and preceding years or from any other source which may lawfully be applied for such purpose. A municipal fire department is hereby established established. under thr�authorit"f the Municipal Act to be known as Name. the..Volunteer Fire Der nrtment. Composition. 2. The department shall consist of a Chief, a Deputy Chief, a Chief Instructor, two Captains, and not less than sixteen firefighters. Qualificitions. 3. Every member of the brigade shall bd a physically fit male resident of the municipality, of good reputation, and eighteen years of age or over; and not more than sixty-five years of age for the chief, and sixty years of age for other officers, and fire fighters, and every member of the department shall be required to pass a medical examination prior to admittance and once every year there- after at the expense of the municipality. Appointment 4. - (1) The Chief shall be appointed by by-law / and passed by the council and shall hold office until such / admiegion. by-law is rescinded. (2) All officers and fire fighters shall be appointed by the council upon the recommendation of the chief, and shall serve a probationary period of six months before permanent appointment. The chief shall require every application for appointment as fire fighter to be in writing on forms to be supplied by the department. The chief shall examine every application and forward it to council with his recommendation. Suspension, 5. The chief may suspend any officer or fire fighter etc. for insubov nation, inefficiency, gross misconduct, or repeated failure to attend practices or fires; the chief shall refer such suspension to the council, together with his report and recommendations, for such action as it may deem advisable. Cost. 6. The annual cost of operating the department shall be included in the annual estimates of the municipality and the clerk shall so notify the chief at least two weeks prior to the date on which the municipal estimates are to be considered; and the chief shall submit within one week thereafter his estimates for the expenditures necessary during the forthcoming year for the operation and maintenance of the department so that they may be considered together with all other municipal estimates -2- Estimates. 7. The estimates, as submitted by the chief, shall be in the form required by the treasurer and shall include the amounts to be paid for: (a) the services of the fire fighters; (b) uniforms, clothing allowances w4 personal equipment for the fire fighters; 0(c) offige supplies and equipment and clerical assi ance; Rev. Stat. (d) The Workmenls Gompensation Act or benefit plan ✓ c.204 approved by the Worimen's Compensation Board; (e). Liability and insurance premiums; v , . (f) contributions to'any pension plah for full-time J fire fighters nn who are members of the department; (g) membership in4expenses of beoresentatives attending ✓ meetings of associations of fire marshals, fire chiefs or fire fighters or any fire college or fire school conducted by the Fire Marshal; (h) the purchase of new fire apparatus and fire fighting equipment; / (i) the purchase of new fire alarm and communication systems and equipment; 0 ) the normal operation, maintenance and repair of / fire apparatus, fire fipfiting equipment and fire alarm and communications system and equipment; / (k) the normal operation, maintenance and repair of ✓ the fire hall; (1) the cost of altering, re -building or constructing any fire hall; (m) any amount charged to the fire department for ✓ hydrant rentals or water supplies; and (n) any other items charged to the fire department. Salaries. 8. Salaries and allowances to the officers and fire fighters shall be determined by the council. Calls 9. The brigade shall not respond to any fire calls outside outside the limits of the municipality, except, - municipality. (a) with respect to any fire which in the opinion of the chief threatens any property within the municipality; (b) to a municipality, or municipalities with which an agree- ment has been entered into to provide fire protection on a mutual aid basis or under any organized county mutual aid plan; or (c) to a municipality with which an agreement has been entered into to provide fire protection at an annual rate or at a fee per call; or (d) where an agreement to provide fire protection on an annual rate or fee per call basis has been entered into with a company, organization or person whose property is ituated outside the municipal limits and distant not more ;han fifteen miles therefrom. • • -3- Duties 10. - (1) The chief sh411 have full charge of the conduct of chief. and general operation of the department, including fighting a fire, responding to , fire alarm, at drills or practices, and the c..re and maintenance of the fire hall and all apparatus, equipment and supplies. . (2) The chief shall, - (a) maintain proper decorum, discipline and efficiency of the department at fires, alarms and practices and in the discharge of all depart- ment duties insofar as they have a bearing on the efficiency of the department or the c-are and maintenance of the'f ire hall, apparatus, equipment and supplies; (b) regularly inspect for fir- hazards all manu- facturing and mercantile premises,churches, schools, institutions, public buildings and places of public assembly, and on request inspect residences, and designate any officer or fire fighter as fire pre- vention inspector, to assist in such duties; A (c) maintain a book to record the attendance of members of the department at fires rnd practices, the prrticulars of every fire call and every fire reported to the department and the apparatus, equipment and supplies used for each fire cell, and any breakages, shortages or deficiencies in the apparatus, equipment and supplies, and any other information that may be required from time to time by the council; (d) submit a retort to the council annually, or more often if requested, outlining the activities of the department and the losses in life and property suffered by fire; (e) submit a report to the council immediately of any injuries to members of the der),)rtment that occur while on duty, and in collaboration with the clerk of the municipality forward a report of such injury on the prescribed "Form" to the workmen's Compensation Board; (f) submit P. retort to the council immediately of any breakages, shortages, or deficiencies in the apparatus, equipment and supplies, and any occurrences requiring, the suspension of any member of the department; and (g) report promptly all fires to the Fire to rshal of 0ntprio on the printed forms supplied for such purpose and otherwise comp;y with the previsions of the Fire Marshals Act and Regulations thereunder and other provincial laws for which the fire chief is the enforcing officer. 0 -4- Duties of U.
