A BY-LAW TO PROVIDE FOR THE 19_6EXPENDITURES ON ROADS OR STREETS
IN THE VILLAGE OF_P _ __IN THE COUNTYre„OF—_g l
WHEREAS under The Highway Improvement Act a by-low to provide for expendi-
tures on roads or streets may be submitted annually to the Minister of Highways for
approval.
THEREFORE the Council of the Corporation of the said Town/Village enacts as .
11.11 follows:

(1) The sum of $ ___s hereby estimated as the expenditure
upon the construction and maintenance of the roads and bridges under its jurisdiction
during the year 19.81_ as follows:

(2) The said monies shall be expended on work performed in accordance with
The Highway Improvement Act.
(3) The clerk shall transmit duplicate copies of this by-law to the district office
of the Municipal Roads Branch, Department of Highways, not later than March 31st, of
the said year.
(4) The approval of the Ontario Municipal Board shall be obtained before any
expenditure is authorized or work commenced which will be financed by the issue of
debentures or monies raised in a subsequent year.

REGULATE THE SPEED OF MOT R VEHICLES IN THE VILLAGE OF PORT BURY ELL
1. No motor vehicle after entering the Village tirnits shall be driven on any
Streets or Highways at a greater rate of speed than 30 miles per hour.
2. No motor vehicle entering the designated limits of Memorial Park shall be
driven at a greater rate of speed than 15 miles per hour.
3. All vehicles must come to a full stop at all stop signs before proceeding.
4. Every person violating the provisions of this by-law shall incur the
penalties of sub-section 4 of section 26 of the Riehway Traffic Act. and
sub-section 3 of section 41.

Whereas the Council of said Village enact as follows :
(1) Collection to be made every Monday except on holidays thence collection
will be made the following day.
(2) All garbage must be wrapped and placed in waterproof container
preferably garbage cans .
All cardboard boxes of garbage must be kept covered and dry.
No larger containers of ashes than five gallons .
5 Garbage strewn around by dogs will not be cleaned up.
6 Do not put out anything that can be burnt, burn it yourself.
7 Do not jam cardboard boxes in cans, they are hard to remove.

/ RESTRICTING SPEED OF MOTOR VEHICLES
. WHEREAS subsection la of section 2$ of The Highway Traffic Act
. (R S ,O. 1950, Chapter 167) authorizes the council of a township
by by-law to prescribe a speed limit of 25 miles per hour for
motor vehicles driven upon highways under its jurisdiction in
any built-up area within the municipality;
AND WHEREAS "built-up area" is defined in section 1 of the said
Act as follows:
"built-up area" means the territory contiguous to a highway
not within a city, town, village or police village where,
( i ) not less than fifty per cent of the frontage upon
one side of the highway for a distance of not less
than 600 feet is occupied by dwellings, buildings
used for business purposes, schools or churches, or
( ii) not less than fifty per cent of the frontage upon
both sides of the highway for a distance of not less
than 300 feet is occupied py dwellings, buildings
used for business purposed", schools or churches, or
(iii) not more than 600 feet of the highway separates any
territory described in subclause i or ii from any
other territory described in subclause i or ii,
and signs are displayed as required by the regulations ;
AND WHEREAS each of the highways or portions of highways described
in section 1 of this by-law is in a built-up area as so defined;
AND WHEREAS it is deemed expedient that the speed of vehicles on
the said highways or portions of highways within the !14 94121! of

Whereas the Council of the
(hereinafter called the "Municipality") deems it necessary to borrow the sum

expenditures of the Municipality for the year;

hereby enacts as follows:
1. The Head and the Treasurer are hereby authorized on behalf of the Municipality to
borrow from time to time by way of promissory note from THE CANADIAN BANK
OF COMMERCE a sum or sums not exceeding in the aggregate $5000.00
to meet until the taxes are collected the current expenditures of the Municipality
for the year,including the amounts required for the purposes mentioned in subsection
(1) of Section 341 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest,which may be
paid in advance or otherwise,at a rate not exceeding per centum per annum.
2. All sums borrowed pursuant to the authority of this by-law,as well as all other sums
borrowed in this year and in previous years from the said Bank for any or all of the
purposes mentioned in the said Section 341, shall, with interest thereon, be a charge
upon the whole of the revenues of the Municipality for the current year and for all
preceding years as and when such revenues are received.
3. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

SCHEDULE "A" TO BYLAW NO. 1?5 OF THE CORPORATION OF THE
ILL%:GL OF PORT BURNELL
AGREEMENT FOR THE PRELIMINARY WORK on a WATER WORKS PROJECT
BETWEEN:
ONTARIO WATER RESOURCES COMMISSION
(hereinafter called "the Commission")
OF THE FIRST PART
- and -
THE CORPORATION OF THE V ILLAGE OF PORT BUR%ELL
(hereinafter called "the Municipality'')
OF THE SECOND PART
WHEREAS the Ontario Municipal Board has given a
tentative approval to the Municipality's entering into an
agreement with the Commission for the provision of water
supply facilities by the Commission for the Municipality
and has authorized the Municipality to expend certain monies
in connection with preliminary work thereon;
AND WHEREAS this Agreement is to provide for the
performing of certain preliminary work and the payment of
the costs thereof in the event that the venture 'should fail
by the failure to obtain final approval of the Ontario
Municipal Board; and for the execution of a project agree-
ment if the said final approval should be obtained;
WITNESSET H:
1. The Commission shall.,
(a) retain Consulting ,.ngineers for the preparation
of working plans and specifications and call
tenders; and
(b) carry out necessary incidental work in
preparation for the project which may include
surveying, acquisition of property, and test
boring;
all for the project described in Schedule "C" r.o
Bylaw No. '"
2. The Municipality shall give such assistance as may
be required in negotiation and acquisition of any
necessary land and easements.
3. In the event the venture should fail as aforesaid
the Municipality shall pay or reimburse tha
Commission all costs incurred by the Commission
as a consequence of paragraph 1 up to and includ-
ing the time of final rcce ip t of tenders and the
application for the approval of the Ontari3
Municipal Board.

4. As and when the final approvals of the Ontario
Municipal Board are obtained from time to time
for the stages into which the project described
in Schedule "C" to Bylaw No. may
be broken for the purpose of calling tenders,
• the Municipality'shall at, such times execute
Agreements with the C ommfssion substantially
the same as the.Agreement attached hereto as
Schedule "A" for such stages.

BETWEEN : ONTARIO WATER RESOURCES COMMISSION
(Hereinafter called "The Commission")
1111 OF THE FIRST PART
- and -
THE CORPORATION OF THE VILLAGE OF PORT BURWELL
(Hereinafter called "The Municipality")
OF THE SECOND PART
WHEREAS the Municipality has requested the Commission to
provide water supply facilities for the Municipality and its
inhabitants;
AND WHEREAS the Commission has agreed so to do;
AND WHEREAS the Council of the Municipality has on the
day of 19 passed Bylaw No. authorizing
the entering into this Agreement and the execution of this
Agreement by the Municipality.
THIS AGREEMENT WITNESSETH that in consideration of the
premises and the covenants, conditions and payments hereinafter
set forth, the parties hereto respectively agree under Section
39 of The Ontario Water Resources Commission Act, R.S.O. 1960,
c. 281, as follows:
Section A - Construction (Structures and Assets)
1. The Commission shall construct, acquire or provide at its
own expense, a water works project in accordance with the
Schedule attached hereto which water works project will b.
identified as Project No.
2. All property acquired or provided by the Commission for
the purposes of this Agreement shall be and remain the
property of the Commission until ownership thereof is
transferred by the Commission as hereinafter provided.
Section B - Maintenance and Operation
3. The Commission shall provide for the management and contrc
operation and maintenance of the said water works project,
but the Commission shall have the right to shut off or
reduce the amount of water supplied to the Municipality in
4110 cases of emergency or breakdown or when it may be necessar'
in maintaining or extending the system, but the Commission
shall endeavour wherever possible to give to the Municipal.

4. The Municipality shall, if an as required by the
Commission, pass bylaws for the regulation and control
of the use of water and the conservation of water within
the Municipality.
S. The Municipality shall not permit any party not located
within the limits of the Municipality to connect to or
obtain water from the said water works project except
with the approval of the Commission.
6. The Municipality shall not permit any connection to the
Municipality's distribution system directly or indirectly
from other sources of supply nor shall the Municipality
permit contamination to gain entrance to the Municipality's
water mains. In the event that either of these
contingencies should occur, then the Municipality shall
immediately take such steps as may be necessary to
terminate such connection or contamination.
Section C - Charges
7. The Municipality agrees in accordance with Section 40 of
The Ontario Water Resources Commission Act, R.S.O. 1960,
c. 281, to pay to the Commission the following sums:
(a) In each calendar year during the currency of this
Agreement, commencing with the calendar year in
which occurs the date of completion of the said
water works project,
(1) The proportion payable by the Municipality, as
adjusted by the Commission of the total amount
of interest and expenses of debt service payablc.

of all borrowings of the Commission from time
to time outstanding and heretofore or hereafter
made by the Commission for the purpose of
meeting the cost or estimated cost of all
water works projects and sewage works projects
at any time heretofore or hereafter acquired,
provided or constructed or in course of
acquisition, provision or construction by the
Commission pursuant to any agreement or
agreements, or for any other purpose of the
Commission respecting such projects including
the refunding or repayment in whole or in part
of any such borrowings;
(11) The total cost to the Commission in each such
year of the operation, supervision, maintenance,
repair, administration and insurance of the
said water works project; and
(111)The total amount in each such year placed by
the Commission to the credit of a reserve
account for renewals, replacements and
contingencies in respect of the said water
4110 works project; but not exceeding l 7. in any
one year of the cost of the said w ter works
project.
(b) In each calendar year for THIRTY years commencing
with the calendar year in which occurs the date of
completion of said water works project, such sum as

would be necessary with interest compounded annually
thereon at the rate per annum specified in paragraph
2 of subsection 1 of Section 40 of The Ontario Water
Resources Commission Act, K.S.O. 1960, c. 281, to
form at the expiry ofTHIRTryears a fund equal to
the cost of said water works project.
(c) The Commission shall not call on the Municipality to
pay any share of the debt due the Commission by any
other Municipality which has already been apportionec
and allocated to such other Municipality and the
1111 payment which is in arrear.
8. (a) The Municipality shall pay the Commission quarterly
and not later than the 15th days of March, June,
September and December in each year the sums due by
the Municipality, all in accordance with Section 42
of The Ontario Water Resources Commission Act, R.S.O.
1960, c. 281.
(b) In each calendar year, the Commission shall deliver
to the Municipality a statement showing how the
charges, adjustments and allocations are made up.
Section D - General
9. (a) This Agreement shall remain in force for THIRTY
calendar years following the date of completion of
the said water works project and shall continue in
force thereafter until all obligations of the
Municipality to the Commission have been discharged
to the satisfaction of the Commission, as evidenced
by a certificate under the seal of the Commission.
Thereafter, the assets of the Commission acquired or
provided solely for the said water works project
shall, at the option of either party to this
Agreement, be transferred to the Municipality.
(b) Where, however, the project serves municipalities or
persons other than the Municipality party to this
Agreement, neither shall this Agreement terminate nor
shall the ownership of the said assets be transferred
unless and until it is shown to the satisfaction of
the Commission that, in addition,
(1) All the obligations to the Commission of such
other participants have been discharged,
(11) The Municipality party to this Agreement has
relieved and will indemnify the Commission from
any obligations which the Commission may have
arising in any way out of the participation in
the project by such other participants; and
(111)The Municipality party to this Agreement has
agreed with each of such other participants as
to the terms and conditions under which the
4110 Municipality party to this Agreement will take
over the assets as aforesaid.
10. (a) The Commission may,but only after prior consultation
with the Municipality party to this Agreement, permit
any other municipality, person or persons to connect
directly or indirectly to its water works project on
such equitable terms and conditions as the Commission
may think fit, and it shall not be held that the

water works project contemplated under this Agreement
is exclusively for the purposes of the Municipality
party to this Agreement. And for such purpose the
Commission shall have power to extend, alter or
enlarge the water works project as it deems necessary
provided that no additional capital costs therefor
shall be charged hereunder to the Municipality party
to this Agreement.
(b) In the event that the Commission shall permit any
other municipality, person or persons to connect as
aforesaid, the Commission in readjusting the
proportion payable by the Municipality party to this
Agreement shall have regard, inter alia, to the amount
of capital costs of the water works project already
paid off, to the age of the project and to the needs
of. the party or parties so permitted to connect,
subject to the right of the Municipality to arbitrate
the same under Section 40 (3) of The Ontario Water
Resources Commission Act, R.S.O. 1960, c. 231.
11. The appropriate share of earnings on the Ontario Water
Resources Commission Reserve Account and on the investment
thereof shall be allocated and credited to the reserve
account referred to in clause 7, in accordance with Sectio-
43 (3) of The Ontario Water Resources Commission Act,
R.S.O. 1960, c. 231.
12. Anything herein contained to the contrary notwithstanding,
each and every of the provisions of The Ontario Water
Resources Commission Act, R.S.O. 1960, c. 231, any
substitutions therefor or amendments thereto, and
regulations thereunder shall be terms of the within
Agreement, and this Agreement shall be read and construed
as if such provision had been written herein, and in the
event of any conflict, ambiguity or inconsistency between
any provision of this Agreement and any provision of the
said Act or regulations, the Act or regulations shall
prevail.
IN WITNESS WHEREOF the Commission and the Municipality have caused
this Agreement to be executed by the affixing of their corporate
seals attested by the signatures of their proper officers duly
authorized in that behalf.

Being a Bylaw to renumber certain
By-laws in order to avoid numerical
duplication
Whereas Section 102 of the Municipal Act RSO 1990 c. M.45 provides that a council may pass
by-laws governing the operations of the municipality and
Whereas the numerical sequence of certain by-laws passed between 1945 and 1992 have used the
same numbers.
The Council of the Village of Port Burwell hereby deems it necessary to change the numbering of
the following by-laws as follows;
1. BY-LAW 86-08 being a Bylaw to Appoint a By-law Enforcement
Officer, shall be changed to BY-LAW 86-01. By-law 86-08 being a
by-law to set the Rates and Levies for 1986 shall remain.
2. BY-LAW 86-12 being a by-law to Designate the Old Baptist Church
as a Historical Building, shall be changed to BY-LAW 86-18. By-law
86-12 being a by-law to authorize the expropriation of Land shall
remain.
3. BY-LAW 86-14 being a by-law to appoint a Building Official, shall
be changed to BY-LAW 86-19. By-law 86-14 being a by-law to
Amend By-law 86-13, the Zoning By-law shall remain.
4. BY-LAW 230 being a by-law to Set the Rates and Levies for 1969,
shall be changed to BY-LAW 125. BY-LAW 230 being a by-law for
the Roads Expenditure shall remain.

5. BY-LAW 87-15 being a by-law for Licensing and the Regulation of
Taxi Cabs, shall be changed to BY-LAW 87-27. By-law 87-15 being
a by-law to Authorize Offer to Settle shall remain.
6. BY-LAW 88-12 being a by-law to Grant Ownership of the Sewage
Works shall be changed to BY-LAW 88-25. By-law 88-12 being a
by-law to Allow Encroachment at 22 Pitt Street shall remain.
7. BY-LAW 89-04 being a by-law to Authorize the Lease of Harbour
Lands with the Department of Fisheries and Oceans shall be changed
to BY-LAW 89-06. BY-LAW 89-04 being a by-law to Adopt an
Official Plan for the Village of Port Burwell shall remain.
8. BY-LAW 89-13 being a by-law to Appoint a Plumbing Inspector
shall be changed to BY-LAW 89-16. BYLAW 89-13 being a by-law
to set the Water and Sewer Rates shall remain.
9. BY-LAW 90-11 being a by-law to Appoint a Deputy Fire Chief shall
