THAT the Reeve and Clerk be and are hereby authorized to execute an Agreement with the Township of Bayham to jointly operate a Fire Department. . 2. THAT the said Agreement is attached hereto as Schedule "A" and forms part of this by-law. 3. THAT this by-law shall come into full force and effect January 1 , 1996. CLERK File: Bylaws19604byl • Ay..r4 C r w SCHEDULE "A" TO BY-LAW NO. 96-4 AGREEMENT FOR THE OPERATION OF A JOINT FIRE DEPARTMENT r�- * THIS AGREEMENT made thi day of , 1996. BETWEEN : THE CORPORATION OF THE TOWNSHIP OF BAYHAM and THE CORPORATION OF THE VILLAGE OF VIENNA WHEREAS Section 207( 1 ) of the Municipal Act, R.S.O. 1990 Chapter M .45 allows for entering into Agreements with one or more municipalities to provided for the joint operation of fire departments, AND WHEREAS Section 210(31 ) of the Municipal Act, R.S . O. 1990 Chapter M .45 grants permission for two or more municipalities to establish, maintain and operate fire departments upon such basis as to the distribution of costs as the municipalities may agree, AND WHEREAS the parties hereto have passed respective by-laws for entering into this agreement, AND WHEREAS the parties hereto agree to jointly operate a Fire Department know as the Township of Bayham Fire Department, hereinafter called the "Department" for the purposes of providing fire protection in the areas defined in this agreement. AND WITNESSETH THIS AGREEMENT that in consideration of the covenants and terms herein, the parties hereto agree as follows: 1 . In this agreement: (a) "Fire Chief" means the Chief of the Bayham Fire Department (b) "Designate" means the person who, in the absence of the Chief, is assigned to be in charge of the particular activity of the depart and who has the same powers and authority as the chief (c0 "Response area" means the Township of Bayhani and the Village of Vienna as defined in Appendix A attached hereto and forming a part of this agreement .� (d) "Department" means the Bayham Township Fire Department Schedule "A" Page 2 (e) "Fire protection" means a range of programs designed to protect the lives and property of the inhabitants of the response area from the adverse effects of fires, • sudden medical emergencies or exposure to dangerous conditions created by man or nature and includes fire prevention and public education, rescue and suppression services as defined by Council Policy. • 2. The parties hereto agree that for the purposes of the financial terms and commitments to this agreement, that all operating costs shall be incurred as follows: (a) The Village of Vienna's annual contribution the the joint operation of the Fire Department shall be $4,000.00, with 50% payable on May 15 and the remaining 50% payable on December 15. (b) Additionally, the Village of Vienna will also be responsible for paying the wages of all firefighters attending any call within the corporate limits of the Village of Vienna. These fees shall be invoiced by the Township of Bayham in as soon as is practicable. 3. By the 15th of January in each year the Fire Chief shall submit in writing to each of the parties hereto, a draft budget for the operation of the Department for that year. This draft budget shall be considered at the Township Council's first February meeting. Representatives from the Village of Vienna shall be entitled to attend this meeting and participate in debate for consideration of the Fire Department budget. Final decision of the Fire Department budget is the responsibility of the Township Council. 4. It shall be the responsibility of the Council of the Township of Bayham for the preparation of draft by-laws, the formulating of policies, for and relating to the administration of the department. 5 . The Township of Bayhatn shall be responsible for providing adequate facilities and equipment for the operation of the Department. 6. The Fire Chief is authorized to purchase necessary parts and/or supplies and the necessary repairs conducted to keep the apparatus and equipment in proper operating condition in accordance with the Township of Bayham Purchasing Policy. 7. The Department shall endeavour to respond as soon as possible to all emergency calls within the Township of Bayham and the Village of Vienna with such apparatus and personnel as per policy established by the Standard Operating Procedures of the Township of Bayham Fire Department. 8. Despite Section 7 and any other Section in this agreement, no liability accrues to the other municipality or person for failing to supply the use of the fire-fighting equipment due to the equipment being in user-another area of the response area. 9. Should one of the parties wish to propose an amendment to this agreement,nt, such notice shall be given to all parties at least with 30 days prior to the Council meeting where the amendment(s) will be considered. Schedule "A" Page 3 10. In the event that either party wishes to cease participating in the agreement, they may do so provided that six (6) months written notice is given to the other party. The terminating party's fee shall be determined on a pro rata basis for the current years • levy. Should either municipality exercise the option to cease participating in the agreement all assets and equipment shall stay with the Township of Bayham. This shall include all materials and equipment that may have been purchased jointly unless otherwise specified and agreed to by both parties. 11 . The parties hereto shall execute such further assurances as may be reasonably required to carry out the terms thereof. • 12. So often as there shall be any dispute between the parties to this agreement or any of them with respect to anymatter contained in this Agreement including, but not limited sl?� g to the interpretation of this Agreement, the same shall be submitted to arbitration under the provisions of the Municipal Arbitrations Act and the decision rendered in respect of such proceedings shall be final and binding upon the parties to this Agreement. If for any reason the said arbitration cannot be conducted pursuant to the provisions of the Municipal Arbitrations Act, then the parties hereto shall agree to a single arbitrator and in the absence of agreement, such arbitrator shall be appointed by a judge of the Supreme Court of Ontario pursuant to the provisions of the Arbitrations Act or pursuant to any successor legislation. 13. Upon execution of this agreement, any existing agreements among the parties as amended with respect to fire protection shall forthwith become null and void. THIS AGREEMENT is duly executed by the parties hereto. Final decision of the Fire Department budget is the responsibility of the Township Council. 4. It shall be the responsibility of the Council of the Township of Bayham for the preparation of draft by-laws, the formulating of policies, for and relating to the administration of the department. 5 . The Township of Bayham shall be responsible for providing adequate facilities and equipment for the operation of the Department. 6. The Fire Chief is authorized to purchase necessary parts and/or supplies and the necessary repairs conducted to keep the apparatus and equipment in proper operating condition in accordance with the Township of Bayham Purchasing Policy. 7. The Department shall endeavour to respond as soon as possible to all emergency calls within the Township of Bayham and the Village of Vienna with such apparatus and personnel as per policy established by the Standard Operating Procedures of the Township of Bayham Fire Department. • 8. Despite Section 7 and any other Section in this agreement, no liability accrues to the other municipality or person for failing to supply the use of the fire-fighting equipment due to the equipment being in use in another area of the response area. 9. Should one of the parties wish to propose an amendment to this agreement, such notice shall be given to all parties at least with 30 days prior to the Council meeting where the amendment(s) will be considered. Schedule "A" Page 3 10. In the event that either party wishes to cease participating in the agreement, they may do so provided that six (6) months written notice is given to the other party. The terminating party's fee shall be determined on a pro rata basis for the current years levy. Should either municipality exercise the option to cease participatingin the agreement all assets and equipment shall stay with the Township of Bayham. This shall include all materials and equipment that may have been purchased jointly unless otherwise specified and agreed to by both parties. 11 . The parties hereto shall execute such further assurances as may be reasonably required to carry out the terms thereof. 12. So often as there shall be any dispute between the parties to this agreement or any of them with respect to any matter contained in this Agreement including, but not limited to the interpretation of this Agreement, the same shall be submitted to arbitration under the provisions of the Municipal Arbitrations Act and the decision rendered in respect of such proceedings shall be final and binding upon the parties to this Agreement. If for any reason the said arbitration cannot be conducted pursuant to the provisions of the Municipal Arbitrations Act, then the parties hereto shall agree to a single arbitrator and in the absence of agreement, such arbitrator shall be appointed by a judge of the Supreme Court of Ontario pursuant to the provisions of the Arbitrations Act or pursuant to any successor legislation. 13. Upon execution of this agreement, any existing agreements among the parties as amended with respect to fire protection shall forthwith become null and void. WHEREAS the Dog Licensing and Livestock and Poultry Protection Act, R. S.O. 1990, Chapter 123 and amendments thereto authorizes the Councilofthe Village of Vienna to pass by-laws for licensing and requiring the registration of dogs and for the imposing a license fee on owners of them; AND WHEREAS the Dog Licensing and Livestock Act authorizes the Council of the Village of Vienna to pass by-laws for seizing and impounding dogs running at large contrary to Cie by-law, and for selling dogs so impounded at such time and in such manner as is provided by the by-law; AND WHEREAS a dog shall be deemed to be running at large when found in any place other than the premises of the owner of the dog and not under the control of any person; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF VIENNA ENACTS AS FOLLOWS: 1 . In this By-law: (a) "Dog" means any dog, male or female; (b) "Owner" of a dog includes a person who possesses or harbours a dog, and "owns" and "owned" have a corresponding meaning; (c) "Running at large" means to be found in any place other than the premises of the owner of the dog, and not under the control of any person; (d) "Animal Control Officer" means such person who has been duly appointed by the Village to carry out and enforce the provisions of this by-law; (e) "Dwelling Unit" means a suite of rooms occupied or designed to be occupied as an independent and separate housekeeping establishment in which separate culinary and sanitary facilities are provided for the exclusive use of the occupants. (f) "Public Place" includes a highway within the meaning of the Highway Traffic Act, R.S.O. 1980, c. 198, a park within the meaning of the Public Parks • Act, R.S.O. 1980, c 417, recreation area, playground, municipal property or any other place to which the public is customarily admitted; 2. THAT no person shall suffer or permit any dog of which he/she is the owner or custodian to run at large or trespass on any property within the limits ofthe Village of Vienna 3. THAT every dog within the Village of Vienna, when not visibly confined or restrained to the dwelling or property of its owner or the person having the care and custody of same, shall at all times be restrained upon a leash in charge of same person Animal Control By-Law (2) 4. THAT prior to April 15 of each year, every owner of a dog over the age of three (3 ) months in the Village is required in each year to register the dog with the Village and obtain a license and pay the license fee for same as provided in this by-law ; 5. THAT the annual license fee payable by every owner of any dog over the age of three (3) months of age shall be $ 15.00 (a) Every person who is the owner of a dog within the limits of the Village of • Vienna, and who is residing temporarily or permanently within such Village shall cause such dog to be registered with the Dog Licensing Officer before the 15th day of April in each year, or within seven (7) days from the date on which such dog is acquired by such person, and upon payment of the applicable license fee prescribed shall receive from the Dog Licensing Officer a license and a tag, which shall expire on the 31st day ofl)ecxmber in the year which same is issued, and the owner shall keep such tag securely fixed on the dog at all times during the year and until a tag is procured for the following year. (b) Any person under Section (a), upon presentation, prior to April 15th, of proof of current vaccination for any dog to be licensed shall be entitled to a. $ 5.00 fee reduction for said dog. 6. Upon payment of the license fee for a dog, the Village shall furnish the owner with a dog tag bearing a serial number and the year in which it was issued. 7. A record shall be kept by the Clerk-treasurer of the Village, the Animal Control Officer, or by other such person designated by the Village for the purpose of dog tag collections, by by-law, showing the name and address of the owner and the serial number of the tag. 8. The Owner shall keep the tag securely fixed on the dog at all times except when the tag may be removed while the dog is being lawfully used for hunting in the bush. 9. No license issued under this by-law is transferable. 10. Every owner of a dog is required, when requested by the Animal Control Officer, to provide proof of holding a valid license for a dog, to produce the tag for the dog, or written receipt of payment of the license fee. 11 . The owner or keeper of an animal impounded for running at large shall be entitled to redeem such animal within 72 hours from the time of impoundment, exclusive of the day of impoundment, upon payment of damages, fees, fines and expenses according to law; • 12. Where possession of a dog seized and impounded has not been claimed by the owner pursuant to Section 11 hereof; the Animal Control Officer may sell or dispose of the dog as he in his discretion sees fit, or he may kill the dog in a humane manner and no claim for damages, compensation or costs may be made against him or the Village as a result thereof . j i Animal Control By-Law (3) 13. Where a dog seized and impounded under Section 11 hereof is injured or diseased, the Animal Control Officer may forthwith kill the dog in a humane manner without permitting the owner to reclaim the dog and without offering it for sale. Notwithstanding the foregoing, where the owner of the dog so requests, the Animal Control Officer shall transfer or cause to be transferred the dog, at the expense of the Owner, to a duly licensed veterinarian for treatment or disposal. The Animal Control Officer of the Village shall not be held liable to the owner of 411 the dog for damages, compensation or costs as a result of any action taken pursuant to this paragraph. 14. Every person who owns a dog shall remove forthwith any excrement left by the dog anywhere in the Village except the property of the owner unless that person is prevented from doing so as a result of a medically recognized physical disability or handicap. 15. No owner of a dog shall permit it, while on or off the property of the owner, to create a nuisance to other persons by loud or incessant barking. 16. No owner of a dog shall suffer or permit any such dog to fight with another dog, or do any damage whatsoever in any place, building or COUVelliqice to which the public has or is permitted to have access, including any highway, street, lane, park or public place. 17. Kennel Licenses are not issued in the Village of Vienna. 18. Every person who contravenes any provision of this By-law is guilty of an offense and, upon conviction thereof by a Court of competent jurisdiction pursuant to the provisions of the Provincial Offences Act, R. S.O. 1990, Chapter P. 33, as amended, or any successor legislation thereto, shall be liable to penalty as provided for therein. 19. RE r THE CORPORATION OF THE VILLAGE OF VIENNA BY-LAW NO. 96-07 A BY-LAW FOR licensing, regulating and governing TRANSIENT TRADERS and other persons whose names have not been entered on the assessment roll in respect of income or business assessment for the then current year, and who offers goods, wares or merchandise for sale by themselves or by a licensed auctioneer or otherwise or who offer them for sale in any other manner. AND FOR requiring Transient Traders and other persons whose names are not entered on the assessment roll or are entered on it for the first time, in respect of income or business assessment and who so offer goods, wares or merchandise for sale to pay a license fee before commencing 11, trade. This By-law is passed under provisions of the Revised Statutes of Ontario, Chapter 284, Section 283 and amendments thereto. For the purpose of paragraphs one and two: (a) Transient Traders shall include any person commencing business who has not resided continuously in the municipality for at least three months next preceding the time of commencing business there. NOTWITHSTANDING the provisions of Clause 1 of this By-law, any additional taxes payable as a result of additions to the roll pursuant to section 83 of the Assessment Act, R. S.U. 1980, shall be that portion of the account of taxes which would have been levied for the current year if the assessment had been made in the usual way, and that portion shall be in the ratio that the number of months remaining in the current year after the month in which the notice provided for herein, is delivered or sent, bears to the number twelve, and shall be entered in the Collector's Roll and collected in the same manner as if the assessment had been made in the usual way and more particularly described as follows: a ) If the assessment has been added to the Collector's Roll after June 30, the taxes shall be due and payable in one instalment on the last day of the month following the entry of the assessment in the Collector's Roll; and, b) Tithe business assessment has been added to the Collectors Roll after June 30, the business tax shall be due and payable in one instalment on the last day of the month following the day of entry of the assessment on the Collector's Roll. 3. The taxes shall be due and payable in two equal instalments as follows: AUGUST 29 and NOVEMBER 28/96 4. The Collector is hereby authorized to mail, deliver or cause to be mailed or delivered, the notice of taxes due, to the address of the residence or place of business of the person to whom such notice is required to be given. 5. Taxes shall be payable at par to the Corporation of the Village of Vienna at the Clerk's Office or by mail to P. O. Box 133, Vienna, Ontario NOJ 1 ZO. 6. There shall be imposed as a penalty for non-payment of taxes or any class or instalment thereof on the due date as specified in the Clause 3 of this By-law, as the case may be, a percentage charge of one and one quarter percent ( 1 .25%) on the first day next after the appropriate due date, which shall be the first day of default, and an additional penalty of one and one quarter percent ( 1 . 25%) shall be added on the first day of each calendar month thereafter in which said default continues, but not after December 3 in the year in which the said taxes are levied. Thereafter, and until the taxes are paid. interest shall be be added at the rate of 1 .25% per month. S • 7. The Clerk-Treasurer and Collector of Taxes are hereby authorized to accept part payment from the time to time on account of any taxes due, and to give a receipt for such payment provided that acceptance of any such payment shall not effect the collection of any percentage charge imposed and collectable under Clause 6 hereof in respect of non-payment of any taxes or any class of taxes or of any instalment thereof 8. In respect to the payment of taxes by tenants of lands owned by the Crown or in which • the Crown has an interest, provision is hereby provided the where any such tenant has been employed either within or outside the municipality by the same employer for not less than thirty (30) days, such employer shall pay over to the Treasurer or Collector on demand out of any wages, salary or other remuneration due to such employee, the account then payable for taxes under this by-slaw and any such payment shall relieve the employer from any liability to the employee for the amount so paid. 9.
