A By-law to limit the increases in taxation. for the years
1993 to 1996 inclusive for certain properties in the •
Village of Vienna which result from changes in
assessment .
WHEREAS Section 363 of the Municipal Act , R . S . O . 1990
2pterM . 45 , provides that Councils of municipa ties
may pass by-laws placing limits on the amount of
increases and decreases in taxation arising from a
general assessment on a basis different from that for the
previous year ' s taxes .
* -- NOW THSRSii'ORB the Council of the corporation of the r village of Vienna enacts as follows :
1 . This by-law shall apply to each separately assessed
parcel of rateable property in the Village in Cldsa
" 2 " ( multi-residential ) for which taxes have
increased in respect to that parcel , by at least 10
percent , as a result of the county-wide reassessment h
implemented for purposes of taxation in 1993 .
2 . Except for the tax adjustments specified under
clauses 3 , 4 , and 5 , the taxes payable on each parcel
. of rateable property in Class " 2 " ( multi -
residential ) , for the years 1993 to 1996 inclusive ,
shall be based on the application of .all mill rates
for Village , County and school purposes applied to
the assessment upon each property as contained in the
last returned assessment roll each year .
• � 3 . The taxes payable in 1993 on each property specified �
in clause 1 . shall be adjusted by deducting 75 per
cent of the total increase in taxes solely,
attributable to the reassessment undertaken in 1992 .
4 . The . taxes payable in 1994 on each property specified
in clause 1 . shall be adjusted by deducting 50 per
cent of the total increase in taxes solely
attributable to the reassessment undertaken in 1992 .
5 . The taxes payable in 1995 on each property specified
in clause 1 . shall be adjusted by deducting 25 per
�cent of the total increase in taxes solely
attributable to the reassessment undertakes in 1992 .
6 . There shall be . no tax adjustment applied in respect
to the properties spAoifie!l .in clause 1 . in 1996 , and
thereby the full amount of the increase attributable
� to the county-wide reassessment shall be payable in
1996 . .
7 . In the event that the assessed value of a separately
assessed parcel in class " 2": is revised downwards for

redetermine the extent of tax adjustment under

WHEREAS the Council of the Village of Vienna in accordance
with the Municipal Act considered the estimates of the

any additional taxes payable as a result of additions to

ratio that the number of months remaining in the current year

THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
BAYHAM ENACTS AS FOLLOWS.
1. THAT the Reeve and Clerk be and are hereby authorized to execute an Agreement with
the Village of Vienna for the provision of fire protection to the Village of Vienna.
2. THAT the said Agreement is attached hereto as Schedule 'A' and forms a part of this

WITNESSETH that the Parties hereto mutually agree in respect to fire protection provided by
the Township to the Village as follows:
1. The Township agrees to provide the services of the Township's Volunteer Fire
Department and vehicles for fire protection for the Village, such services to be subject
to prior calls and the Township shall not be held responsible for the failure of any part
of the said services.
2. The Village agrees to pay to the Township, for the above services on the following basis:
(a) Each year during the term of this agreement, the sum of Twenty Five Hundred
Dollars (52,750.00) which sum shall be the cost of one (1) fire call.
(b) Each call in addition to the call noted in clause 2(a) shall be at the rate of Two
Thousand Dollars ($2,000.00 ) per call.
3. The Township shall not be responsible "for providing any additional fire fighting
equipment from other municipalities unless Officials of the Village request same in which
case the Village shall be responsible for any additional fee that might be charged by the
other municipality, provided however there shall be no charge for additional fire fighting
equipment called under a mutual aid agreement in effect in the County of Elgin.
4. Charges arising from false alarms where it is not necessary to remove any equipment
from the vehicles of the Township shall be subject to negotiation between the parties.
S. This agreement shall be for a term of three years commencing January 1 , 1993 and
subject to the provisions of Section 6, shall be binding upon the Parties their successors
and assigns.
6. The agreement may be terminated at any time by either party giving ninety (90) days
written notice to the other Party.
THIS AGREEMENT is duly executed by the parties hereto.

BEING A BY -LAW to stop-up and close the portion of •
the ALLEY between Union Street and Pine Street , Registered
Plan 54 , designated as Parts 3 and 4 , Reference Plan
11R5413 , Village of Vienna , Countyof Elgin .

WHEREAS it is deemed expedient in the interest of the
Corporation of the Village of Vienna , hereinafter called
the corporation , that the original road allowance set
out and described as the portion of the alley between
Union Street and Pine Street , Registered Plan 54 ,
designated as Parts 3 and 4 , Reference Plan 11R5413 ,

Village of Vienna , County of Elgin , be stopped up and
closed and the lands sold to the adjoining land owners

AND WHEREAS notice of this by- law has been posted up for
at least one month in six of the most public places in the
immediate neighbourhood of the said road allowance °f
AND WHEREAS the Council of the said Corporation has heard
in person or by' his counsel , solicitor or agent , all
persons claiming that their land will prejudicially he
affected by this by- law , and who has applied to be heard

NOW THEREFORE the Council of the Village of Vienna enacts

as follows :
1 . That upon and after the passing of this by- law , all
that portion of the road allowance for the alley set
1 out and described above , be and is hereby stoppec9 up
- 410 and closed .
2 . All that part of the said road allowance shall be sold
to the adjoining property owners .
3 . The Reeve and Clerk of the Corporation are hereby
authorized to sign and execute such deeds or other
documents as may be necessary to effect conveyance of
that part of the said road allowance herein before des-
cribed and which has been stopped up and closed .

.‘ WHEREAS Section 298 ( 1) ( c) of the Municipal Act , R. S . O. 1980
Chapter 302 , authorizes a municipality to close by by- law

any highway within its jurisdiction
AND WHEREAS Section 298 ( 1) (d ) of the said Municipal Act , authorizes
a Municipality by by- law to convey the highway so closed

AND WHEREAS Section 316 of the said Municipal Act authorizes
a municipality by by- law to set the price at which the closed
highway is to be sold and further give the abutting owner or
owners the right to purchase the said land
AND WHEREAS it is deemed expedient that a by- law be passed
pursuant to the above Section 316
THEREFORE , THE COUNCIL OF THE VILLAGE OF VIENNA ENACTS AS
FOLLOWS :
1. That the portion of tip alley between Union Street and
Pine Street , Registered Plan 54 , designated as Part 3 ,
Reference Plan 11R5413 , Village of Vienna , Countyof Elgin ,

be sold to the abutting owner Madeline Soper , for the seam of
$2 . 00 plus legal fees , survey fees and all other costs incurred
to complete the transaction .
