THE CCPPGRATI ON OF THE VILLAGE OF VIENNA
BY-LAW NO . 92-1
BEIIJO A BY-LAW to regulate the supply of water
and . the price thereof from the communal water
system in the Village of Vienna .
WHEPEAS Section 8 , 12 , & 27 of the Public Utilities Act P . S .O .
1980 Chapter 423 authorizes the Corporation to pass by- l aws
illAD regulate the supply of water and affix the prices to fire
paid thereof ;
AND WI:EPLAS under By- law No . 719 , the Corporation of the Village
of Vienna , on September 23 , 19 75 entered into an agreement with
her Majesty the Queen , light of Ontario , as represented by
the Minister of the Envi onmen t for the supply of water to the
Municipality ;
AND WHEREAS the Council of the Corporation of the Village of
Vienna on April 11 , 1991 passed By- law No . 91- 3 which imposes
metric water rates on all users of the water system ;
ANL WHEREAS it is deemed expedient by the Council of the
Corporati cn of the Village of Vienna that said water By- law
No . 91- 3 be rescinded , and new water rates based on metered
water consumption be imposed against each user of the system
provided with water s e rvi Ce ;
NOW THEREFORE pursuant to Sections 8 , 12 , & 27 of the Public
Utilities Act , R .S .O . 1980 , Chapter 423
TIIE COUNCIL of the Corporation of the Village of Vienna
, ENACTS AS FOLLOWS :
1 . A water rate is hereby imposed upon the owners or occupants
of lands which are supplied with water is a consequence of
the entering into of the above mentioned agreement .
2 . A water user rate shall be charged against each user of the
water system , at a consumption rate of :
a ) For domestic users in the Village a of Vienna ; $ 1 . ] 9 per

cubic metre of metered water consumption , with a
minimum charge of $ 32 . 10 every two months (bi-monthly) ;
b ) For commercial users in the Village of Vienna ; $ 1 . 33
per cubic metre of metered water consumption , with a
minimum charge of $ 35 . 95 bi-monthly ;
c) For domestic users outside theCorporation limits of
the Village of Vienna ; $ 1 . 33 per cubic metre of metered
water consumption ,with a minimum charge of $ 35 . 84 hi-
monthly ;

d) For commercial users outside the Corporation limits of
the Village of Vienna ; $ 1 . 47 per cubic metre of metered
water consumption , with a minimum charge of $ 39 . 80
bi-monthly .
3 . Payment for the supply of water shall he made at hi-monthly
intervals for users and shall be due when billed . A ten ( 10
percent penalty shall be charged on all accounts not paid
in f ul l on or before the 20th day of the month in the
month which the accounts are billed .

4 . A service charge of $ 15 . 00 shall be levied for connection ,
shutting off , or turning on , any water service .
5 , A service charge of $15 . 00 per call will be levied for
collecting unpaid water bills .
6 . An application fee of $5 . 00 will be levied for registering
new water meters with the Municipality , as well as for
transferring the registration of those already in use .
7 . A water meter charge of $ 140 . 00 will be levied for new
meters installed ,

THIS AGREEMENT made in duplicate this day of , 1992 .
BETWEEN :
CORPORATION OF THE VILLAGE OF VIENNA ,
( herein called the "Vienna* )
of the First Part
- and -
DEAN MARCEL ROBILLARD and TRACEY LEE CARRUTHERS , of the
Village of Vienna , in the County of Elgin ,
( herein called the "Owner" )
of the Second Part
WHEREAS the Owner is the registered owner of lands and premises
in the Village of Vienna , County of Elgin being more particularly
described as Lot 13 and the westerly 140 feet of Lot 14 , both
east of Elm Street , Plan 54 ;
AND WHEREAS the building constructed on the lands above described
encroaches on Elm Street in the Village of Vienna as shown on the
survey dated January 23 , 1992 by Kim S . Husted , Ontario Land
Surveyor ;
AND WHEREAS the Owner has requested Vienna to allow the use and
maintenance of the said encroachment for such period of time as
the said building remains in its present location ;
AND WHEREAS Vienna is of the opinion that allowing such use and
maintenance would not be against the public interest .
NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of
the premises and the sum of ONE DOLLAR ( $ 1 . 00 ) of lawful money of
Canada , now paid to Vienna by the Owner the receipt whereof is
hereby acknowledged , the Parties hereto agree as follows :
1 . The Owner shall be allowed the use and maintenance of
that portion of the building which encroaches on Elm Street as
set out on the attached survey provided that the use and
maintenance of such portion shall at all times be at the Owner ' s
risk .
2 . The Owner , their successors and assigns , as owners and
occupiers from time to time of the said lands described above

will at all times indemnify and save harmles- Vienna of and from
all costs , losses , and damages which Vienna may suffer , be at or
be put to for or by reason of or on account of the existence of
the said encroachment or the use or maintenance of the said
encroachment or anything which may arise by reason of the use and
• maintenance of the said encroachment or by reason of the
existence , use , maintenance or repair or I +ck of repair of the
said encroachment .
3 .
Upon the demolition of the said building encroaching on r
as aforesaid , this Agreement shall be terminated and shall be of
no force and effect whatsoever .
4 . This Agreement shall be binding upon the Owners, their
successors and assigns , as owners and occupiers from time to time
ox. the said lands and premises and the covenants herein contained
shall be deemed to run with the said lands and premises and bind
the owners and occupiers thereof from time to time .

BEING A BY-LAW to adopt the current estimates
and strike the rates of taxation for the year 1992
WHEREAS the Council of the Village of Vienna in accordance
with the Municipal Act consicioreel the estimates of the

Municipality and of the Boards thereof , and- by virtue of
the Municipal Act , The Ontario Unconditional Grants Act
and the Education Act , P . S . O. 1900 , it is necessary that
the following sums be raised by means of taxation for
the year 1992

ratio that the number of months remaining in the current year
after the month in which the notice provided for herein , is
delivered or sent , bears to the number twelve , and shall }%e
entered in the Collector ' s Rol ] and collected in the same
manner as if the assessment had been made in the usual way and
more particularly described as follows

6 . There shall be imposed as a penalty for nonapay'en t of
taxes or any class or instalment thereof on thin cue date

as specified in Clause 3 of this By- law , as the case may
be a percentage charge of one and one quarter percent 0 . 25 % )
cn the first day next after the appropriate clue date , which
shall be the first 41zty of default and an ac'ditional penalty

411 the first day of each calendar month thereafter in which
said default continues , but not after December 33 in the
year in which the said taxes are levied . Thereafter , anc1

8 . In respect to the payment of ` taxes by tenants of lands
owned by the Crown or in which the Crown has an interest
provision is hereby provided that where any such tenant has
been employed either within or. outside the municiy l i ty ) y
the same employer for not less than thirty ( 30 ) clays , such
employer shall pay over to the Treasurer or * Col lector on
demand out of any wages , salary or other remuneration clue
to such employee , the amount then payable for taxes under

this by-law and any such payment shall relieve the employer
from any liability to the employee for the amount so raid .
9 . This By-Law shall come into force and take effect on the
day it receives final approval .

1. PURPOSE
The purpose of this Amendment is to change the land use designation on a parcel
of land from "Future Development" to "Residential" in the Official Plan of the
Village of Vienna.
2. LOCATION
The property affected by this Amendment is comprised of approximately 2.3
hectares (5.6 acres) and is situated on the north side of Main Street (Creek
Road) in the Village of vienna. The lands subject to change in designation from
Future Development to Residential comprise approximately 0.6 hectares (1 .6
acres) with the balance of the subject lands remaining in the Floodway
designation.
3. BASIS OF THE AMENDMENT
The subject lands are situated in an aesthetic setting across Main Street from the
Big Otter Creek. There is an existing dwelling on the southeast corner of the
subject lands, and except for this dwelling, the subject lands are essentially
vacant agricultural lands.
The subject lands were originally part of a larger farm holding to the east and
north. Additional dwellings and farm buildings remain on this farm which is a
viable cash crop operation.
The rationale for this Amendment is to recognize the creation of a new
residential lot which will include a severance and consolidation of lands in both
the Floodway and Future Development designations. In so doing, a buildable
area can be established on that part of the lot which has historically been
designated Future Development pending redesignation to and rezoning to
Residential.
It is intended that this Official Plan Amendment will be implemented by a
corresponding Zoning By-law Amendment. The By-law would restrict the
establishment of all buildings to an area at the rear of the subject lands which is
above the 600' contour elevation.
4. DETAILS OF THE AMENDMENT
1) Schedule Al Future Land Use of the Official Plan of the Village of
Vienna, is hereby amended by changing from "Future Development"
to "Rcsidrnrf9l", those lands outlined in heavy solid lines on the

THE Council of the Corporation of the Village of Vienna, in accordance with the
provisions of the PLANNING ACT, hereby enacts as follows:
•
1. THAT Amendment No. 1 to the Official Plan of the Village of Vienna consisting
of the attached text and map schedule is hereby adopted
2. THAT the Clerk is hereby authorized and directed to make application to the
Minister of Municipal Affairs for approval of the aforementioned Amendment
No. I to the Official Plan of the Village of Vienna.
3. THAT no part of this By-law shall come into force and take effect until approved
by the Minister of Municipal Affairs.

The purpose of this Amendment is to change the land use designation on a parcel
of land from "Future Development" to "Residential" in the Official Plan of the
Village of Vienna.
2. LOCATION
The property affected by this Amendment is comprised of approximately 2.3
hectares (5.6 acres) and is situated on the north side of Main Street (Creek
Road) in the Village of vienna. The lands subject to change in designation from
Future Development to Residential comprise approidmately 0.6 hectares (1.6
acres) with the balance of the subject lands remaining in the Floodway
designation.
3. BASIS OF THE AMENDMENT
The subject lands are situated in an aesthetic setting across Main Street from the
Big Otter Creek. There is an existing dwelling on the southeast corner of the
subject lands, and except for this dwelling, the subject lands are essentially
vacant agricultural lands.
The subject lands were originally part of a larger farm holding to the east and
north. Additional dwellings and farm buildings remain on this farm which is a
viable cash crop operation.
The rationale for this Amendment is to recognize the creation of a new
residential lot which will include a severance and consolidation of lands in both
the Floodway and Future Development designations. In so doing, a buildable
area can be established on that part of the lot which has historically been
designated Future Development pending redesignation to and rezoning to
Residential.
It is intended that this Official Plan Amendment will be implemented by a
corresponding Zoning By-law Amendment The By-law would restrict the
establishment of all buildings to an area at the rear of the subject lands which is
above the 600' contour elevation.

12.3.2.2 Permitted Uses. Buildings and Structs
Existing uses, buildings and structures as of the date of passing of
this By-law;
A driveway to provide vehicular access to the R1-2 Zone."
4. THAT By-law No. 90-12 as amended, is hereby further amended by deleting from
the Floodway (FW) Zone and adding to the Special Floodway (FW-2) Zone those
lands enclosed in heavy solid lines and marked FW-2 on Schedule "A" to this By-
law, which schedule is attached to and forms part of this By-law.
5. THIS By-law comes into force:
a) where no notice of objection has been filed with the Village Clerk within
the time prescribed by the Planning Act, 1983 and regulations pursuant
thereto, upon the expiration of the prescribed time; or
b) where notice of objection has been filed with the Village Clerk within the
time prescribed by the Planning Act, 1983 and regulations pursuant
thereto, upon the approval of the Ontario Municipal Board.

WHEREAS IT is desirous to provide a By- law having reference
to the impounding and keeping of livestock ,
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF
VIENNA, pursuant to the Municipal Act R. S . O. 1960 , Section 379
and :menchents thereto , and the Pounds Act R. S . O. Chapter 299 ,
R.S . O. , 1960 ENACTS AS FOLLOWS :
1 . Except as varied by this by- law , The Pounds Act , Chapter 299 ,
M.O., 1960 shall be in force in the Village of Vienna .
2 . a . No person shall permit any horse , bull , ox , cow , mule , sheep .
410goat , pig , or other cattle , geese or other poultry , of which
he is the owner , or which he shall be in possession or in
charge of keeping , to run at large or trespass within the
limits of the Village of Vienna.
• b . Such Pound Keepers as is designated by the Corporation from
time to time shall retain any such livestock under the
provisions of this by-law and The Pounds Act , R . S . O . 1960 .
3 . The following fees and costs shall be charged by the Pound
Keeper of the Municipality in carrying out the provisions of
this by- law and The Pounds Act , namely :
a. For every horse , bull , ox , cow , mule , sheep , goat , pig
or other cattle - per head - impounded - per day $5 . 00
For geese and other poultry 1 . 00
b . The following fee schedule will be charged for
feeding per day :
For feeding horse , bull , ox , cow , mule , sheep , goat
or pig or other cattle - per head - $5 . 00
For feeding geese or poultry - per head - 1 . 00
c . The cost of advertising any number of cattle , sheep ,
horses , goats or any other animal , or poultry impounded
at one time .
d . The cost of selling animals or poultry impounded .
4 . No person shall tether or hobble any horse or cow or other
animal upon the Public Highways of this Municipality .
5 . Any animal being at large or trespassing in the Village of
Vienna may be impounded and , if not claimed within Ten Days ,
or if the fines , damages and expenses are not paid , may be
sold .

by-law is guilty of an offense , and on conviction is liable
to a fine of not more than $2 ,000 . 00 , exclusive of costs ,
for each offense .

BEING a By-Law to authorize the Reeve and Acting Clerk of the
Municipality to execute a Contract with Great Lakes Triple "R"
Consulting in conjunction with the Village of Vienna for a Waste
Diversion Plan .
WHEREAS Great Lakes Triple "R" Consulting has submitted a proposed
budget setting out their estimated costs and anticipated revenues
for the municipalities of the Township of Bayham and Village of
Vienna .
AID WHEREAS the said Great Lakes Triple "R" Consulting has
submitted an Agreement of Confidentiality With Respect To
Disclosures concerning information received for the purpose of
preparing and evaluating a plan for waste diversion .
AND WHEREAS it is now necessary to execute a Contract with the said
Great Lakes Triple "R" setting out certain terms .
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
ASH I P OF BAYHAM : -
1 ) That the Reeve and Actifig Clerk are hereby authorized to
execute a Contract with Great Lakes Triple "R" Consulting for
the provision of services in formulating and executing a Waste
Diversion Plan together with an Agreement for Confidentiality
With Respect to Disclosures .
2 ) That the said Contract includes services provided in
conjunction with the Village of Vienna .
3 ) That the said Contract together with the Agreement for
Confidentiality and a proposed budget be attached hereto
forming Schedules "A" , "B" and "C" respectively to this By-
Law .

CONFIDENTIALITY WITH RESPECT TO DISCLOSURES
CONCERNING :
The Township of Bayham's Waste Diversion Plan (herein referred to as the
"PLAN").
This will serve to confirm our understanding and undertaking with respect to
information to be received by us concerning the PLAN which, for the purposes of this
undertaking, will be referred to as "Restricted Information".
We acknowledge that you regard all Restricted Information to be valuable and that
disclosure to us is to be on the basis of strict confidentiality. We further acknowledge that
your willingness to make disclosure to us of Restricted Information is for the sole purpose
of enabling us to appraise and evaluate the PLAN.
In consideration of your allowing us access to Restricted Information, we
undertake and agree that we will not, without your express prior consent, disclose by any
means to any third party and will maintain complete secrecy with respect to any Restricted
Information received from you or from anyone on your behalf, including maps, drawings,
diagrams, reports, results of tests, specifications, formulae, instructions, measurements and
calculations and that all information received from you touching or concerning the PLAN
and it's capabilities shall be deemed to be Restricted Information unless you expressly state
otherwise prior to making any disclosure.
We will adopt every reasonable means to ensure that all Restricted Information
received by us, in whatever form, remains confidential and will observe whatever security
measures are required to attain this end.
However, it is understood that this undertaking on our part shall not extend to any
information which we can demonstrate (I) was publicly available or known to us prior to
our receiving it from you, or (ii) has following disclosure by you, become publicly
available due to no fault of ours or has become known to us from another source without
any apparent secrecy obligation to us.
In conclusion, we acknowledge that any disclosure of Restricted Information shall
not operated to grant or be construed as any license or option therefore under any existing
or future patent obtained with respect to the PLAN.

This agreement shall be construed and governed by the Laws of the Province of
Ontario. The parties have agreed that this document be drawn up in English.

BEING A BY-LAW to govern the procedure of. Counci l ,
the calling of meetings , and the conduct of membe rs .
THE COWCIL OF THE CORPORATION OF THE VILLAGE OF VIFNNA
ENACTS AS FOLLOWS :
1 . In this By- law :
( a) "The Village " means the Municipal Corporation
of the Village of Vienna ;
(b) "Council " means the Council of the Village ;
(c) " Reeve" means the head of Council ;
(d) "Member" means a member of Council ;
(e ) "Clerk " means the Clerk of the Village ;
(f ) " Recorded Vote "• means the recording Iof the name
and vote of every member voting on any matter
or question ;
(g ) "Substantive Motion " means any motion except
one of the following :
( i ) to refer;
(ii ) to amend ;
(iii) to lay on the table ;
(iv) to postpone indefinitely or to a day certain ;
(v) to adjourn ;
(h) " Rules of Procedure " means the rules and regulations
provided in this by- law ;
( i) "Quorum" means a majority of the whole number of
members required to constitute the Coun ci 1 .
GENERAL
2 . (1 ) The rules and regulations contained in this by-
law shall be observed in all proceedings of
the Council and shall be the rules and regulations
for the order and dispatch of business in the
Council , in Boards , or any other body of the
Village thereof . The rules and regulations
contained herein may he suspended by a vote of
two-thirds of the Council Members present . In
any case for which provision is not made here-
•
in , the procedure to be followed shall be , as
near as may be , that set out in Roberts Rules
of Procedure .
(a ) . The public shall not be excluded from any
meeting of the Council , or from any meeting
of a Board or other body of the Village ex-
cepting that portion named " Legal and Personnel "
as declared by the Reeve or Chairperson .
REEVE
3 . The Reeve shall be entitled to vote at any meeting .
411 COUNCIL MEETINGS
4 . (1 ) Place - Meetings of the Council shall be held

the Council from time to time for such purpose .
(2 ) Regular Meetings - shall be held at the hour of
8 : 00 p .m . on the Second Thursday each month ,
excluding statutory holidays , unless otherwise
designated by resolution of the Council .

4 . ( 3) The Reeve may at any time summon a special
meeting of the Council and shall summon a
special meeting of the Council when requested
to do so by a majority of the members . In the
absence of the Reeve , a special meeting may
be called by the Clerk on a requisition from
the majority of the members of the Council .
CALLING OF MEETING TO ORDER
5 . As soon after the hour fixed for the holding of the
meeting of the Council as a quorum is present , the
Reeve shall take the Chair and call the meeting to
o T der .
ABSENCE OF REEVE

6 . In case the Reeve does not attend within fifteen ( 15 )
minutes after the time appointed for a meeting of the
Council , the Clerk shall call the Members to order
and the Council Members by resolution shall appoint
an Acting peeve from among the Members present , who
shall preside until the arrival of the Peeve . While
so presiding , the Acting Reeve so appointed shall
have all the powers of the Reeve .
NO QUORUM
7 . If no quorum is present one-half hour after the time
appointed for a meeting of Council , the Clerk shal ]
record the names of the Members present and the meet-
ing shall stand adjourned until the day of the next
regular or special meeting .
8 . Beginning at the first meeting of Council the order
of procedure shall be as follows :
(a) Filing of Certificates and Declarations of
Office in accordance with the Act ;
(b ) Appointment of Boards and Committees and such
other personnel as' Council deems expedient and
necessary .
APPOINTMENT TO BOARDS OR COMMITTEES
9 . ( a) Where lay members are required to serve on
any Board , Committee or other body , Council
may advertise the positions in the localmedia
prior to making the appropriate appointments ,
(b) Each Board or Committee shall appoint the time
and place of its meetings provided that it shall
not meet while Council is meeting .
(c ) A quorum of a Board or Committee is a majority
of the voting members of the Board .

411 11 . It shall he the duty of the Reeve or other pre-
siding Officer to :
(a ) open the meeting of Council by taking the Chair

(b ) receive and submit , in the proper manner , all
motions presented by the Members of Council ;
( c) put to vote all questions , which are duly moved
and seconded , and to announce the result ;
(d) decline to put to vote , motions which infringe
upon the rules or procedure ;
(e ) restrain the Members , when engaged in debate ,
within the rules of order ;
( f ) enforce on all occasions , the observance of
order and decorum among Members ;
(g ) call by name , . any Member persisting in breach
of the rules of order of the Council , thereby
ordering him or her to vacate the Council
Chamber ;
(h) authenticate by his or her signature , when
necessary , all by- laws , resolutions , and
minutes of Council ;
( i ) inform the Council on any point of order as
seems necessary ;
( j ) represent and support the Council declaring
its will and implicitly• obeying its decisions
in all things ;
(k ) if he or she considers it necessary because of
grave disorder , the Peeve may adjourn the
sitting without question put , or suspend the
sitting for a time to be named by him or her .
DUTIES OF MEMBERS OF COUNCIL
12 , (a ) to attend all meetings of Council and
Committees when so designated and to come to
order when called to do so by the Peeve or
other preseiding Officer ;
(b) to submit motions and resolutions in the
proper manner ;
( c) to vote on all questions whd ch are duly moved
and seconded ;
(d) to debate within the rules of order ;

RULES OF DEBATE IN COUNCIL
13 . ( 1) Every Member previous to speaking to any
question or motion shall rise from his or
her seat and address the Reeve .
(2 ) When two or more Members rise to speak , the
Reeve shall designate the Member who has the
floor , who shall be the Member who , in the
opinion of the Reeve , first rose .
( 3) Every Member present at a meeting of the Council
when a question is put shall vote thereon unless
prohibited by Statute , in which case it shall
be so recorded .
(4 ) If any Member present at a meeting of the Council
when a question is put , and either a Recorded
or an Unrecorded Vote is taken , does not vote ,
he or she shall be deemed as voting in the
negative except where he or she is prohibited
from voting by Statute .
( 5 ) When a Recorded Vote is requested by a Member ,
or is otherwise requiree , the Clerk shall
record the name and vote of every Member on
any matter or question .
( 6 ) If a Member disagrees with the announcement of.
the Reeve that a question is carried or lost
he or she may , but only immediately after the
declaration by the Reeve , object to the Peeve ' s
declaration and require a Recorded Vote to be
taken .
( 7) When the Reeve calls for the vote on a question ,
each Member shall occupy his or her seat and
shal ] remain in his or her place until the
result of the vote has been declared by the
Reeve , and during such time no Member shall
walk across the room or speak to any other
Member or make any noise or disturbance .
(8 ) When a Member is speaking , no other Member shall
pass between him or her and the Chair , or
interrupt him or her except to raise a point
of order .
(9 ) Any Member may require the question or motion
under discussion to be read at any time during
the debate , but not so as to interrupt a
Member while speaking .
( 10 ) No Member shall speak more than once to the
same question without leaveof the Council ,
except that a reply shall be allowed to be
made only by a Member of the Council who has
presented the motion to the Council , but not
by any Member who has moved an amendment or

ALL MOTIONS shall he in writing and signed
by the mover and seconder.
(14 ) In all unprovided cases in the proceedings of
the Council or in the Committee of. the Whole ,
the matter shall be decided by the Reeve ,
subject to an appeal to the Council upon a
point of order .
( 15) If the Reeve or Presiding Officer desires to
leave the chair for the purpose of taking part
in a debate or for other reasons , he/she shall
call one of the members of the Council to fill
his/her place until he resumes the Chair .

14 . ( 1 ) The Reeve shall preserve order and decide
questions of order .
( 2 ) ( a) When a Member rises to point of order , he/
she shall ask leave of the Peeve to raise a
point of order and after leave is granted he/
she shall state the point of order to the
Reeve and sit down and remain seated until.
the Reeve shall have decided the point of
order.
(b) Thereafter , a Member shall only address the
Chair for theur ose of appealing p to the
Council from the Reeve ' s decision .
(c) If no Member appeals , the decision of the
Reeve shall be final .

( 3) Where a Member considers that his /her integrity
or the integrity of the Council as a whole has
been impugned , he/she may as a question of privi-
lege , rise at any time , with the consent of the
Reeve for the purpose of drawing the attention of
the Council to the matter .
( 4 ) "Point of Order" means the raising of a question
by a Member with the view o f , calling attention to
any► departure from the Standing Orders or the
customary modes of proceeding in debate or in the
conduct of the Council ' s business .
"Point of Information " means directing a request to
the Chair , or through the Chair , to another member
11/ or to the staff , for information relevant to the
business at hand , but not related to parliament-
ary procedure .
" Parliamentary Enquiry" means directing a question
to the Chair to obtain information on a matter of
•
parliamentary law or the rules of the Council
bearing on the business at hand in order to assist
a Member to make an appropri ate motion , raise a
point of order or understand the parlia' entary
situation or the effect of a motion .
"Question of Privilege " means the raising of a
question which concerns a Member of Council , or
the Council collectively , in respect of the
following matters , namely :
( a) When member believes that another member
has spoken disrespectfully towards him or
the Council co l lecti've 1 y ;
(b) When a member believes that his comments
have been misunderstood or misinterpreted
by another' member or members .
( 5 ) Whenever any point of order , parliamentary
enquiry or question of privilege arises , it
shall be immediately taken into consideration .
( 6 ) When a point of information is raised , the Chair
shall answer the question or direct the question
to the appropriate member of Council or staff ;
the reply shall be made through the Chair .
CONDUCT OF MEMBERS OF COUNCIL
15 . ( 1 ) No Member shall :
(a) speak disrespectfully of the Reigning
Sovereign , of any Royal Family , or of the
10 Governor-General , or of the Lieutenant-
Governor of any Province , of any Member of.
the Senate , of the .House of Commons of
Canada , or of the Legislative Assembly of
the Province of Ontario ;
(b ) speak on any subject other than the
subject in debate ;
(c) disobey the rules of the Council or a
decision of the Reeve or of the Council
on a question (s ) of order or practice , or
upon the interpretation of the rules of
the Council , and in • case a member
persists in any such disobedience after
having been -called to order by the Reeve ,
the Reeve may forthwith put the question ,
no amendment , adjournment or debate being
allowed , " that such member be ordered to

leave his or her seat for the duration
of the meeting of the Council " , but if
the Member apologizes he may , by vote of
the Council , be permitted to retake his/
her seat .
( d) If a Member desires to leave a meeting of
Council prior to adjournment , and not re-
turn thereto ; he/she shall so advise the
Reeve or the presiding officer and his /her
departure shall be recorded .

(2 ) No person except members , appointed officials of
the Village and the Media shallbe allowed to
come within the Council enclosure or speak from
the Gallery during the sittings of the Council
unless permitted by the Reeve or the Council
upon reference .
16 . AGENDA IN COUNCIL
( 1) •Order of Business - The Clerk , in consultation
with the Reeve shall have prepared and printed
a list of items in the order of topics set out
as in the order of business in Section 10 here-
of , for the use of each Member at each meeting .
(2 ) Minutes -
( a) Minutes shall record :
(i ) the place , date and time of meeting ;
( ii ) the naives of the presiding officer or
officers and the record of the attend-
ance of the Members ;
( iii ) the reading , if requested , correction
and adoption of the Minutes of prier
meetings :
(iv) all other proceedings of the meeting
without note or comment .
(b ) It shall be the duty of the Clerk to ensure
that the Minutes of the last regular meeting
and the reports from a31 special and standing
committee meetings held more that five ( 5 )
days prior to a regular meetl ng , together with
the Agenda prepared in accordance with Section
16 ( 1 ) delivered to each member not less than
twenty-four ( 24 ) hours before the hour appoint-
ed for the holding of such regular meeting .
411 ( c) Such Minutes or Reports as referred to in
clause (b ) of this paragraph may he adopted
by Council without having been read at the
meeting considering the question of their
adoption , and in other cases , the Minutes or
Reports shall be read prior to consideration
of adoption .
( 3) Delegations
( a) Persons desiring to verbally present infor-
mation on matters of fact or make a request
of Council shall give notice to the clerk
not less than three ( 3 ) days before the
co hence ent of the meeting of Council and
may be heard on leave of the Reeve or other
presiding officer of Council , hut shall he
limited in speaking to not more than ten ( 10 )
minutes , unless time is extended by the Reeve .

time for questions from Council members .
(b) A delegation applying to be heard must
give three ( 3 ) days notice , and submit
the subject to he discussed , and the
Clerk will allot the required ten ( 10 )
minutes for the presentation . Fvery
delegation must have an appointed spok eq-
person .
( 4 ) Communications
( a) Every communication , including a
411 petition designed to be presented to
the Council , shall be legibly written
or printed and shall not contain any
impertinent or imrroper matter or
language and shall be dated and signed
by at least one person and filed with
the clerk .

(b) Every petition or communicat ! on shall
be delivered to the Clerk not less
than three ( 3 ) days before the commence-
ment of the meeting of the Council , an0
i f , in the opinion of the Reeve and
Clerkany communication received up to
time of the meeting is of importance ,
it may be presented as a communication
at that meeting .
(c) Subject to the decision of. the Peeve
under Paragraph (b ) hereof , the Clerk shall
either present each member with a copy of the
substance thereof , or read the substance
thereof to the Council , hut any L*ember may
require the reading of part or all thereof .
( 5 ) Committee Reports
The Chairperson or Vice-Chairperson of a
Committee or Board , or any of ..her Member cesiq-
nated shall present the Committee or Board Peport
to the Council . ThetCounci l may accept , reject ,
amend , table or refer back any or all of the
Report .
( 6 ) Unfinished Business
The items listed in the order of the topics
set out in the Agenda of prior meetings
which have not been disposed of by Council ,
and the date of their first appearance on
the Agenda shall be noted and repeated nn
I/ each subsequent agenda until disposed of
by Council , unless removed from the agenen
by leave of the Council .

( 7) Reading of By- laws and Proceedings thereon
( a) Every By- law shall be introduced upon
motion by a member of the Council
specifying the title of the By- law .
(b ) Every By- law when introduced , shall be
in typewritten form , and shall contain
no blanks except such as may be required
to conform to accepted procedure or to
comply withthe provisions of any Act .
(c) Every By- law shall have three readings
previous to its being passed .

(d) The first and second reading of a By-
law shall be decided without amendment
or debate .
(e) In proceedings in Committee of the

(g ) The Clerk shall endorse on all By- laws
enacted by Council , the date of the

ment , it shall be forthwith ordered to
be read the third time at such time as
may be appointed by Council .
( j ) Every By-law which has been Onacted by
the Council shall be numbered and dated
and shall be sealed with the seal of
the Corporation and signed by the Reeve ,
and the clerk and shall be deposited try
the Clerk in his office for safekeeping .
17 . MOTIONS
( 1) Notices of Motion
The, motion shall be submitted to the Clerk
in writing over the signature of the Mover
and shall be complete and correct .
( 2 ) Seconding
A Motion must be formally seconded before
the presiding officer can put the question
or a motion be recorded in the Minutes .
( 3) Presentation of Motion by Reeve
When a Motion is presented in Council in
writing , it shall be read , or if it is a
410 motion which may be presented orally , it
shall be stated by the Peeve before debate .
( 4 ) Ultra Vires
A Motion in respect of a matter which is
ultra vires the jurisdiction of Council ,
shall not be in order .
( 5 ) Withdrawal
After a Motion is read , or stated by the
Reeve it may be withdrawn at any time be-
fore decision or amendment by Mover and
Seconder .

17 . (6 ) Priority of Disposition
A motion properly before the council for
decision must receive disposition before
any other motion can be received except
motions in respect of matters listed in
paragraphs 13 ( 13 ) ( a) ane (b ) .
( 7) Peference to a Committee
A motion to refer a matter under discussirn
by the Council to a Committee of the Council
shall prec ltice all amendments of the main
question until it is decided .
( 8) Amendment
A motion to amend :
(a) shall ba presented in writing ;
(b) shall receive disposition of Council
before a previous amendment or the
question ;
(c) shall admit of only one motion to
amend such amendment ; any further
amendment must be to the main
question ;
(d) shall be relevant to the question
to he received ;
(e ) shall not be received proposing a
direct negative to the question ;
( f) may contain a separate and distinct
disposition of a question ;
(g) shall he put in the reverse order
tc that in which it is moved .
(9 ) The previous Question
A motion for the previous question :
( a) cannot he amended ;
(b) cannot be proposed when there is an
amendment under consideration ;
( c) . when resolved in the affirmative ,
requires that the question be put

(d) can only be moved in the fo l l owi ng

20 . ( 1) The Council may choose to move into the
Committee of the Whole wherever questions
will be asked of staff or where reports
are being made by someone from outside
of the Council or at any other time when
free discussion of an item is deeired
and the Council so decides .
(2 ) The Peeve shall be the Chairperson of
the Committee of the Whole .
( 3 ) The Peeve may appoint another Member of
the Committee to act as Chairperson
while he/she is speaking to a question or
while he/she is temporarily absent from
the meeting .
( 4 ) When a Committee Peport is being dis-
cussed in Committee of. the Whole , the
111 Chairperson , Vice-Chairperson or other
Member of the Committee shall take
the Chair.
( 5 ) The Chair person shall Maintain order
in the Committee of the Who3e and re-
port the proceedings to the Council .
( 6 ) The rules governing the procedure of
the Council and the conduct of Members
of Council shall be observed in
Committee of the Whole so far as they
are applicable , provided that :
( a) the number of times of speaking
on any question shall not be
limited unless a Member moves that
the vote be now taken ;

mitted , but in case of an equal division of
votee , the Chairperson shall not have any

be deemed to have been decided in the

( 2 ) The rules in respect of the introduction of
new business in the Council and the hearing
of delegates shall not apply to Standing
and other Committees of the Coun ci l other
than the Committee of the Whole Council .
( 3 ) ( a) If there be no quorum present thirty

THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF VIFNNA
ENACTS AS FOLLOWS :
1 . In this By-law =
( a) "The Village " means the Municipal Corporation
of the Village of Vienna ;
(b) "Council " means the Council of the Village ;
(c) " Reeve" means the head of Council ;
(d) "Member" means a member of Coun ci l ;
(e ) " Clerk " means the Clerk of the Village ;
410 . (f ) " Recorded Vote " means the recording of the name •
and vote of every member voting on any matter
or question ;
(g ) "Substantive Motion " means any motion excert
one of the following : •
( i ) to' refer;
(ii ) to amend ;
(iii ) to lay on the table ;
(iv) to postpone indefinitely or to a cry certain ;
(v) to adjourn ;
(h ) " Rules of Procedure " means the rules and regulations
provided in this by- law ;
( i) "Quorum" means a majority of the whole number of
members required to constitute the Coun ci 1 .
GENERAL
2 . (1 ) The rules and regulations contained in this by-
law shall be observed in all proceedings of
the Council and shall be the rules and regulations
for the order and dispatch of business in the
Council , in Boards , or any other body of the
Village thereof . The rules and regulation
contained herein may he suspended by a vote of
two-thirds of the Council Members present , In
any case for which provision is not made here-
in ,in , the procedure to be followed shall be , as
•
near as may he , that set out in Roberts Rules
of Procedure .
(a ) . The public shall not be excluded from any
meeting of the Council , or from any meeting
of a Board or other body of the Village ex-
cepting that portion named " Legal and Personnel "
as declared by the Reeve or Chairperson .
REEVE
3 . The Reeve shall be entitled to vote at any meeting .
COUNCIL MEETINGS
4 . (1 ) Place - Meetings of the Council shall be held
lirlre Council Chambers adopted and used by
the Council from time to time for such purpose .
(2 ) Regular Meetings - shall be held at the hour of
8 : 00 p .m . on the Second Thursday each month ,
excluding statutory holidays , unless otherwise
designated by resolution of the Council .

4 . ( 3) The Reeve may at any time summon a special
meeting of the Council and shall summon a
special meeting of the Council when requested
to do so by a majority of the members . In the
absence of the Reeve , a special meeting may
be called by the Clerk on a requisition from
the majority of the members of the Council .
CALLING OF MEETING TO ORDER
5 . As soon after the hour fixed for the holding of the
meeting of the Council as a quorum is present , the
Reeve shall take the Chair and call the meeting to
order .
ABSENCE OF REEVE

6 . Inthe Reeve does not attend within fifteen f ee 15

minutes after the time appointed for a meeting of the
Council , the Clerk shall call the Members to order
and the Council Members by resolution shall appoint
an Acting Reeve from among the Members present , whn
• shall preside until the arrival of the Peeve . While
so presiding , the Acting Reeve so appointed shall
have all the powers of the Reeve .
NO QUORUM
7 . If no quorum is present one-half hour after the time
appointed for a meeting of Council , the Clerk sha l l
record the names of the Members present and the meet-
ing shall stand adjourned until the day of the next
regular or special meeting .
8 . Beginning at the first meeting of Counci l - the order
of procedure shall be as follows :
(a ) Filing of Certificates and Declarations of
Office in accordance with the Act ;
(b ) Appointment of Boar is and Committees And such
► other personnel as Council deems expedient and
necessary .
APPOINTMENT TO BOARDS OR COMMITTEES
9 . ( a) Where lay members are required to serve on
any Board , Committee or other body , Council
may advertise the positions in the local media
prior to making the appropriate appointments .
(b) Each Board or Committee shall appoint the time
and place of its meetings provided that it shall
not meet while Council is meeting .
(c ) A quorum of a Board or Committee is a majority
of the voting members of the Board .
I/ ( d) Council may at any time appoint a Committee to
enquire into and report on any matter .

DUTIES OF THE REEVE
11 . It shall be the duty 0 the Reeve or other pre-

• (a ) open the meeting of Council by taking the Chrir
and calling the members to order ;
(b ) receive and submit , in the proper manner , all
motions presented by the Members of Council ;
( c) put to vote all questions , which are duly moved
and seconded , and to announce the result ;
(d ) decline to put to vote , motions which infringe
upon the rules or procedure ;
(e ) restrain the Members , when engaged in debate ,
within the rules of order ;
( f ) enforce on all occasions , the observance of
order and decorum among Members ;
(g ) call by name , any Member persisting in breach
of the rules of order of the Council , thereby
ordering him or her to vacate the Council
Chamber ;
(h) authenticate by his or her signature , when
necessary , all by- laws , resolutions , and
minutes of Council ;
i inform the Council on anypoint of order as

RULES OF DEBATE IN COUNCIL
13 . ( 1) Every Member previous to speaking to any
question or motion shall rise from his or
411 her seat and address the Reeve .
(2 ) When two or more Members rise to speak , the
Reeve shall designate the Member who has the
floor , who shall be the Member who , in the
opinion of the Reeve , first rose .
( 3) Every Member present at a meeting of the Council
when a question is put shall vote thereon unless
prohibited by Statute , in which case it shall
be so recorded .
(4 ) I f anyMemberpresent at a meetingof the Council

when a question is put , and either a Recorded
or an Unrecorded Vote is taken , does not vote ,
he or she shall be deemed as voting in the
negative except where he or she is prohibited

or is otherwise required , the Clerk shall
record the name and vote of every Member on
any matter or question .
( 6 ) If a Member disagrees with the announcement of.
the Reeve that a question is carried or lost
he or she may , but only immediately after the
declaration by the Reeve , object to the Peeve ' s '
declaration and require a Recorded Vote to he
taken .

( 7 ) When the Reeve calls for the vote on a question ,
each Member shall occupy his or her seat and
shal ] remain in his or her place until the
result of the vote has been declared by the
Reeve , and during such time no Member shall
walk across the room or speak to any other
Member or make any noise or disturbance .
( 8 ) When a Member is speaking , no other Member shall

interrupt him or her except to raise a point

(9 ) Any Member may require the question or motion
under discussion to be read at any time during
the debate , but not so as to interrupt a
Member while speaking .
(10 ) No Member shall speak more than once to the

except that a reply shall be allowed to be

presented the motion to the Council , but not
by any Member who has moved an amendment or

( 11 ) No Member without leave of the Counci 1 , shall

longer than four minutes .
( 12) (a ) A Member may ask a question only for the
purpose of obtaining information relating
to the matter under discussion and such
question must be stated concisely and
asked only through the Reeve .
(b) Notwithstanding paragraph (a) , when a
Member has been recognized as the next
speaker , then immediately before speaking
such Member may ask a question of or
through the Reeve on the matter under
discussion but only for the purpose of
!IIti obtaining information , following W . ich
the Member may speak .
( 13 ) (a) The following matters and motions with
respect thereto may he introduced orally
without written notice and without leave ,
except as otherwise provided by these
rules of procedure :
(i ) a point of order or persona ] privilege ;
(ii ) presentations or petitions ;
(iii ) to adjourn ;
(iv) to refer ;
(v) to lay on the table ;
(vi ) to move that a question be rut .
(b) The following motions may be introduce&
without notice and without leave , hut such
motions shall be in writing signed by the
mover and seconder except as otherwise
provided by these Rules of Procedure :
(i ) to amend ;
(ii ) to suspend the Rules of Procedure ;
(iii ) to postpone indefinitely or to a day
certain ;
(iv) to go into Committe of the Whole .
(c) Except as provided by paragraph ( a ) above ,
ALL MOTIONS shall he in writing and signed
by the mover and seconder .
( 14 ) In all unprovided cases in the proceedings of
the Council or in the Committee of. the Whole ,
the matter shall be decided by the Reeve ,
subject to an appeal to the Council upon a
point of order .
( 15) If the Reeve or Presiding Officer desires to
leave the chair for the purpose of taking part
in a debate or for other reasons , he/she shall
call one of the members of the Council to fill •
his/her place until he resumes the Chair .

14 . (1 ) The Reeve shall preserve order and decide
questions of order .
( 2 ) ( a) When a Member rises to point of order , he /
she shall ask leave of the Peeve to raise a
point of order and after leave is g r. an to d he j
she shall state the point of order to the
• Reeve and sit down and remain seated until •
the Reeve shall have decided the point of
order .
(b) Thereafter , a Member shall only address the
Chair for the purpose of appealing to the
Council from the Reeve ' s decision .
(c) If no Member appeals , the decision of the
Reeve shall he final .

( 3) Where a Member considers that his /her integrity .
or the integrity of the Council as a whole has
been impugned , he/she may as a question of privi-
lege , rise at any time , with the consent of the
Reeve for the purpose of drawing the attention of
the Council to the matter .
( 4 ) "Point of Order" means the raising of a question
by a Member with the view o f , calling attention to
any departure from the Standing Orders or the
customary modes of proceeding in debate or in the
conduct of the Council ' s business .
"Point of Information" means directing a request to
the Chair , or through the Chair , to another member
or to the staff , for information relevant to the
' business at hand , but not related to parliament-
ary procedure .
" Parliamentary Enquiry" means directing a question
•
to the Chair to obtain information on a matter of
parliamentary law or the rules of the Council
bearing on the business at hand in order to assist
a Member to make an appropriate motion , raise a
point of order or understand the parliamentary
situation or the effect of a motion .
"Question of Privilege " means the raisingof a
question which concerns a Member of Council , or
the Council collectively , in respect of the
following matters , namely :
( a) When member believes that another member

spoken disrespectfully towards him or

the Council collective ] y ;
(b) When a member believes that his comments
have beep misunderstood or misinterpreted
by another member or members .
( 5 ) Whenever any point of order , parliamentary
enquiry or question of privilege arises , it
shall be immediately taken into consideration .
( 6 ) When a point of information is raised , the Chair
shall answer the question or direct the question
to the appropriate member of Council or staff ;

CONDUCT OF MEMBERS OF COUNCIL
15. (1) No Member shall :
(a) speak disrespectfully of the Reigning

Sovereign , of any Royal Family , or of the
Governor-General , or of the Lieutenant-
Governor of any Province , of any Member of.
the Senate , of the ;House of Commons of
Canada , or of the Legislative Assembly of
the Province of Ontario ;
(b) speak on any subject other than the
subject in debate ;
(c) disobey the rules of the Council or a
decision of the Reeve or of the Council
on a question (s ) of order or practice , or
upon the interpretation of the rules of
the Council , and in • case a member
persists ASL any such disobedience after
having been called to order by the Peeve ,
the Reeve may forthwith put the question ,
no amendment , adjournment or debate being
allowed , " that such member be ordered to

the Member apologizes he may , by vote of

( d) If a Member desires to leave a meeting of

turn thereto , he/she shall so advise the
Reeve or the presiding officer and his /her
departure shall be recorded .
(2 ) No person except members , appointed officials of
the Village and the Media shall be allowed to
come within the Council enclosure or speak from
the Gallery during the sittings of. the Council
s unless permitted by the Peeve or the Council
upon reference .
16 . AGENDA IN COUNCIL
( 1) .Order of Business - The Clerk , in consultation
with the Peeve shall l have prepared and printed
a list of items in the order of topics set out
as in the order of business in Section 10 here-
of , for the use of each Member at each meeting .
( 2 ) Minutes -
E ( a ) Minutes shall record :
(i ) the place , date and time of meeting ;
( ii ) the names of the presiding officer or.
officers -and the record of the attend-
ance of the Members ;
( iii ) the reading , if requested , correction
and adoption of the minutes of prim
meetings ;
(iv) all other proceedings of the meeting
without note or comment .
(b) It shall be the duty of the Clerk to ensure
that the Minutes of the last regular meeting
and the reports from a31 special and standing
committee meetings held more that five ( 5 )
days prior to a regular meeting , together with

the Agenda prepared in accordance with Section
16 ( 1 ) delivered to each member not less than
twenty-four ( 24 ) hours before the hour appr int -
� ed for the holding of such regular meeting .
( c) Such Minutes or Peports as referred to in
clause (b ) of this paragraph may he adopted
by Council without having been read at the
meeting considering the question of their
adoption , and in other cases , the Minutes or
Reports shall be read prior to consideration
of adoption .
( 3) Delegations
( a) Persons desiring to verbally present infor-
mation

of Council shall give notice to the Clerk
not less than three ( 3 ) days before the
commencement ,-of the meeting of Council and
may be heard on leave of the Reeve or other
presiding officer of Council , hut shall he

(b) A delegation applying to he heard must
give three ( 3 ) days notice , and submit
the subject to he discussed , and the
Clerk will allot the required ton ( 10 )
minutes for the presentation . Fvery
delegation must have an appointed spokes-

( 4 ) Communications
(a) Every communication , including a
petition designed to he presented to
411 the Council , shall be legibly written

or printed and shall not contain any
impertinent or imrroper matter or
language and shall be dated and signed
by at least one person and filed with
the clerk .

(b) Every petition or communication shall
be delivered to the Clerk not less
than three ( 3 ) days before the commence-
mont of the meeting of the Council , and
if , in the opinion of the Reeve and
Clerkany communication receives' up to
time of the meeting is of. importance ,
it may he presented as a communication
at that meeting .
(c) Subject to the decision of the Peeve
under Paragraph (b ) hereof , the Clerk shall
either present each member with a ccpy of the
substance thereof , or read the substance
thereof to the Council , but any Member may
require the reading of part or a l l thereof .

( 5 ) Committee Reports
The Chairperson or Vice-Chairperson of a
Committee or Board , or any of ..her Member desig-
nated shall present the Committee or Board Peport
to the Council . The iCounci l may accept , reject ,
amend , table or refer hack any or all of the
Report .
( 6 ) Unfinished Business
The items listed in the order of the tr pi cs
set out in the Agenda of prior meetings
which have not been disposed of by Council ,
and the date of their first appearance on
the Agenda shall be noted and repeated on
411 each subsequent agenda until disposed of
by Council , unless removed from the agenda
by leave of the Council .
( 7) Reading of By- laws and Proceedings thereon
( a) Every By- law shall be introduced upon
motion by a member of the Council
specifying the title of the By- law .
(b ) Every By- law when introduced , shall he
in typewritten form , and shall contain
no blanks except such as may be required
to conform to accepted procedure or to
comply withthe provisions of any Act .
(c) Every By- law shall have three readings
previous to its being passed .

the Council shall be numbered and dated
and shall be sealed with the seal of
the Corporation and signed by the Peeve ,
and the Clerk and shall be deposited by
the Clerk in his office for safekeeping .
17 . MOTIONS
( 1 ) Notices of Motion
The motion shall be submitted to the Clerk
in writing over the signature of the Mover
and shall be complete and correct .
(2 ) Seconding

A Motion must be formally seconded before
the presiding officer can put the question
or a motion be recorded in the minutes .
( 3) Presentation of Motion by Reeve
When a Motion is presented in Council in
writing , it shall be read , or if it is a
111 motion which may be presented orally , it
shall be stated by the Peeve before debate .
( 4 ) Ultra Vires
A Motion in respect of a matter- which is
ultra vires the jurisdiction of Council ,
shall not he in order .
( 5 ) Withdrawal •
After a Motion is read , or stated by the
Reeve it may he wi the rawn at any time be-
fore decision or amendment by Mover and
Seconder .

( 2 ) The Peeve shall be the Chairperson of
the Committee of the Wh o l e .
( 3 ) The Reeve may appoint another member of
the Committee to act as Chairperson
while he/she is speaking to a question or
while he/she is temporarily absent from
the meeting .
( 4 ) When a Committee Peport is being dis-
cussed in Committee of the Whole , the

Member of the Committee shall take

debate and a motion to rise without reporting
shall always be in order and shall take
precedence over any other motion , and if
carried , the subject referred to the
Committee shall be deemed to have been
disposed of in the negative , subiect how-
ever , to its reconsideration if Council

21 . ( 1 ) The Committee Chairperson or in his /her

mitted , but in case of an equal division of
