The subject lands are located on the north side of Chute Line, east of Plank Road known as 55720 Chute Line. The subject lands are zoned Institutional (I) Zone in the Zoning By-law No. Z456-2003 and designated "Institutional” in the Official Plan. The purpose of this By-law is to change the land use designation on 1,738 m2 (0.4 acres) of land from "Institutional" to "Residential" in the Official Plan of the Municipality of Bayham; and to change the zoning on the same lands from Institutional (I) Zone to Village Residential (R1) Zone in Zoning By-law Z456-2003. The subject lands are located on the east side of Snow Street, south side of Fulton Street known as 14 Snow Street in the Village of Vienna. The effect of this By-law will be to allow residential use on the lands in the former Edison Museum building. PUBLIC PARTICIPATION: As required by the Planning Act, the public meeting notice was circulated with no written comments received prior to the public meeting. The public meeting was held on October 19, 2017 at 7:30 pm at the Municipal Council Chambers, 56169 Heritage Line, Straffordville, with no agencies and only the Owner making an oral presentation at the public meeting. County of Elgin general procedural comments were received October 5, 2017. At the time of writing this report, no other written comments have been received. DISCUSSION: Please reference the planner's memorandum dated September 5, 2017 as attached providing a DS-63/17 Boeder 2 complete analysis of the proposal. We have completed our review of an application for an Official Plan and a Zoning By-law amendment, submitted by Adrian Boeder, for a parcel located at 14 Snow Street on the east side south of Fulton Street in the village of Vienna. The applicant is requesting an official plan and zoning by-law amendment for 1738 m2(0.4 acres)of land to change the designation from "Institutional"to"Residential"in the Official Plan and to change the zoning from an Institutional (I) Zone to a Village Residential (R1) Zone to allow for residential use. The subject lands are designated as"Institutional"on Schedule"C"Vienna: Land Use and Constraints of the Official Plan of the Municipality of Bayham and the lands are currently zoned Institutional (I) on Schedule"H"Vienna in Zoning By-law Z456-2003. 2. The parcel includes one residential dwelling and a shed, has a lot frontage of 40 m (131 feet) and a lot depth of 43 m (141 feet). Surrounding land uses are residential with an institutional parcel to the northwest (Vienna Community Centre). The lot and building were the former home to the Edison Museum. 3. The proposed amendments must be consistent with the Provincial Policy Statement 2014 (PPS). Section 1.1.3 indicates that settlement areas shall be the focus of growth and development, and that regeneration shall be promoted. The subject lands are located in a settlement area and the change from an Institutional use to a Residential use increases the residential density in an area where there is limited demand for additional Institutional uses and avoids the potential need to develop a residential dwelling on vacant lands without existing buildings or services. Therefore the proposed is consistent with the PPS based on promoting growth and intensification where infrastructure exists within a settlement area. 4. Elgin County Official Plan Section C1.1 encourages the enhancement of the character and identity of existing residential areas and promotes the efficient use of existing infrastructure. The proposed redesignation to residential would enhance the character of the area, by ensuring the maintenance and continued use of the existing building. It would also create intensification in an area with existing infrastructure in an existing built up area. Therefore, the proposed is consistent with the Elgin County Official Plan. 5. The Official Plan of the Municipality of Bayham Section 4.5 sets out the policies for Villages. According to section 4.5.1.2 residential land use is permitted in the Village of Vienna. Section 4.5.2.2 indicates that the Municipality supports residential intensification on under- utilized lots in residential designations with full services. A public meeting was held October 19, 2017 with no public comments received and only the appointed Agent David Roe making presentation. At the time of writing this report no additional applicant or public comments have been received. The purpose of this By-law is to change the zoning regulations on 700 m2 (7,500 ft2) of land in the Agricultural (Al-A) Zone to an Agricultural (A1) Zone and on 8.7 ha (21 acre) of land from Agricultural (A1) Zone to an Agricultural (Al-A) Zone in Zoning By-law Z456-2003. The subject lands are located on the north side of Carson Line, east of Talbot Line known as 57214 Carson Line. The effect of this By-law will be to fulfil the conditions of severance by consolidation of the agricultural zoning on the two parcels, subsequent to lot boundary adjustment approval by the Elgin County Land Division Committee. DISCUSSION The consent application was presented in Staff Report DS-39/17 and supported by Council on July 20, 2017 proposing to sever lands to add to the adjacent farm lands as a boundary adjustment. Staff and planner are supportive of the purpose and effect of the zoning amendments as per the recommendation in this report to satisfy the condition of consent. The retained lands will be rezoned to an Agricultural (Al-A) Zone and a portion of the severed lands, being the lot addition lands, to an Agricultural (A1) Zone. C-07 / D13.MART Roll # 3401-000-002-06600 SUBJECT: Rezoning Application — Martin Zoning By-law Z666-2017 BACKGROUND: Tim and Brenda Martin submitted a rezoning application to rezone a portion of their property at Plan 54 Lots 1, 2, 3, A, C & J, known municipally as 55720 Chute Line, A public meeting was held October 19, 2017 with no public comments received and only the appointed Agent David Roe making presentation. At the time writing this report no additional applicant or public comments have been received. The purpose of this By-law is to change the zoning regulations on 2.5 ha (6.2 acres) of land in the Open Space Site-Specific (052-4) Zone, located within a 10 ha (25 acre) parcel of land in the Open Space (0S2-4 and 0S2) and Holding Village Residential (R1(h2)) Zone, to an Open Space Site-Specific (0S2-XX) Zone in Zoning By-law Z456-2003. The subject lands are located on the north side of Chute Line, east of Plank Road known as 55720 Chute Line. The effect of this By-law will be to allow for the erection of an over-sized accessory building, with an increased maximum floor area and height, within a required yard for a residential use, primarily for the storage of recreational vehicles and property maintenance equipment. DISCUSSION The application appears to be in conformity with the Official Plan, however, not in conformity with the Zoning By-law as explained in detail in the planner's memorandum dated September 19, 2017 attached to this report. Staff and planner do not support the application as presented due to the excessive oversized floor area of 300 m2,where 65 m2 is permitted and the location being closer to the front property line than the dwelling at only 12 metres, where 34 metres is required. Staff Report DS-65/17 Martin 2 Option 1 recommendation reflects the staff and planner's comments. Option 2 is provided for Council's information based upon the considerations noted in the planner's memorandum should Council consider the over-sized accessory building to be acceptable. We have completed our review of an Application for a Zoning By-law amendment, submitted by Tim and Brenda Martin, for a property located at 55720 Chute Line, north side, east of Plank Road. The subject lands are currently zoned Open Space Site-Specific (OS2-4) and LPRCA Regulation Limit on Schedule "H"Vienna in Zoning By-law Z456-2003. 2. The subject lands are located within the southeast portion of a 10 ha (25 acre) parcel on the eastern edge of the Village of Vienna. The subject lands having a lot frontage of 183 m (600 feet) and a lot depth of 168 m (518 feet), the entire parcel having a lot frontage of 324 m (1,063 feet)and a lot depth of 247 m (810 feet).The property comprises of a single family dwelling. The dwelling and proposed accessory building are located in the southeast corner of the parcel which is relatively flat and the remainder of the parcel comprises of wooded creek valley lands. Surrounding land uses are agricultural to the south and east, including a residence across Chute Line and residential to the west beyond the wooded area. 3. The proposed amendment must be consistent with the Official Plan of the Municipality of Bayham. The Plan designation for the subject lands is Residential. Section 4 Settlement Area Policies of the Plan sets out the policies for development for the subject lands. Section 4.2.1.2 states that "the Municipality will place the highest priority on the location of new urban development in areas of the Municipality where full municipal services are readily available."Section 4.2.1.3 restricts major residential development until both sewer and water services can be provided, with allowance for limited infilling in built up areas. The subject lands are serviced with Municipal water but not sewer and are zoned for Open Space use not for future residential development, and limited demand for large (plan of subdivision) development is anticipated in this area of Vienna. The proposed amendment must comply with to the regulations of the Municipality of Bayham Zoning By-law. The subject lands are zoned Open Space Site-specific (0S2-4) in the By-law. The Site-specific regulations permit one single-detached dwelling and buildings and structures for the permitted uses,where typically a single-detached dwelling is prohibited in the OS zones. The proposed accessory building exceeds the maximum floor area, maximum height and locational regulations of the By-law.Although Section 25 Open Space (OS) Zone Regulations do not include regulations for the floor area of an accessory building, the recognition of residential use through site-specific OS2-4 regulations in Section 25.4.4 necessitates applying typical residential use regulations in a Village Residential (R1) zoning. In Section 10.11 Regulations for Accessory Buildings the maximum floor area for an accessory building under subsection c)is 65 m2 where 300 m2 is proposed, more than four times the size permitted.We do not consider this to be an acceptable excess above the regulation and therefore do not recommend approval of the proposed floor area. General regulations for Accessory buildings in Section 4.2 g) indicates that 6.0 m (20 feet) is the maximum height for an accessory building, therefore the request for increased maximum height to 6.7 m (22 feet), a typical size for buildings of this nature is considered acceptable. Section 4.2 includes additional regulations for accessory uses. Specifically, subsection d) states that accessory buildings shall not be located closer to the street than the main building is to that street. The proposed location of the accessory building is approximately 12 m from the front property line but the dwelling is located approximately 34 m to the front property line. 5. Based on our review of the application we do not support the requested Zoning By-law amendment from Open Space Site-specific (OS2-4) zone to Open Space Site-specific (0S2-XX) Zone for lands at 55270 Chute Line. 6. Should Council consider the over-sized accessory building acceptable, the following conditions shall be included in the By-law amendment: • The maximum floor area of the accessory building shall be 300 m2 • The maximum height of the accessory building shall be 6.7 m • The accessory building shall exclusively accommodate residential and personal use goods and materials • The location of the accessory building shall be no less than 34 m to the front property line. At the time of writing this report no additional applicant or public comments have been received. The purpose of this By-law is to change the zoning regulations on a 0.7 ha (1.8 acres) parcel and on a 3.8 ha (9.4 acres) parcel in the Agricultural Site-specific (A1-3) Zone to an Agricultural (A1) Zone in Zoning By-law Z456-2003. We have completed our review of an Application for a Zoning By-law amendment, submitted by Mr. Henry Reimer, for properties located at 55653 & 55663 Best Line south side, east of Talbot Line. The applicant is requesting a zoning by-law amendment to change the zoning on a 0.7 ha (1.8 acres) and a 3.8 ha (9.4 acres) parcels of land in the Agricultural Site-specific (A1-3) Zone to an Agricultural (A1) Zone. The subject lands are designated as Agriculture and Natural Heritage on Schedule "Al" Land Use; and Significant A.N.S.I, Significant Woodlands and Hazard Lands on Schedule"A2"Constraints of the Official Plan of the Municipality of Bayham. The lands are currently zoned Agriculture Site-specific (A1-3) and LPRCA Regulation Limit on Schedule "A" Map No. 2 in Zoning By-law Z456-2003. 2. The 0.7 ha parcel has a lot frontage and a lot depth of 85 m (278 feet). The property comprises of a single family dwelling, a greenhouse and a shed. The 3.8 ha parcel has 131 m (429 feet) of lot frontage and 226 m (741 feet) of lot depth. Surrounding land uses are agricultural to the north, south and east, and residential to the west. There is a creek valley running along the south and west sides of the larger parcel. 3. The larger parcel has been previously subdivided subsequent to lot creation dating back to 1990. The three parcels to the west were created at approximately the same time for residential development on large estate lots.A dwelling was never developed on this parcel as it was incorporated into the commercial greenhouse business, and dwelling on the smaller parcel being accessory to the greenhouse use. The parcels were never merged on title and so both are existing lots of record. The request is to remove previous site-specific provisions for commercial greenhouse use in the Zoning By-law, allowing for the full range of agricultural uses on the lands, previously prohibited by the site-specific regulations. The result would be to recognize the deficient lot area of the subject parcels, being less than the minimum in the Zoning By-law. The lands would remain in the agricultural designation allowing for future agricultural use. The preferred change would be to merge the parcels to create one parcel and permit one dwelling. Bayham Official Plan Section 2.2 Natural Heritage Resources must be considered due to a portion of the lands adjacent to the creek identified as Natural Heritage on Schedule A2 Constraints. According to Section 2.2.1.4 Municipal Council shall discourage development and site alteration in, or adjacent to natural heritage features and areas. The larger subject parcel abuts a tributary of Otter Creek, where the west and south boundary follows the centre of the creek/stream, and those lands should be protected from development. Policies in Section 2.2.3 Development Applications apply should any development occur on the lands and are subject to Conservation Authority permitting prior to development. 7. The proposed amendment must be in conformity with the general intent of regulations in the Zoning By-law. The lands are currently zoned Al-3 to permit the former commercial greenhouse, including plant nurseries, commercial greenhouses, garden centres and one single-detached dwelling unit as an accessory use, while prohibiting all the other permitted uses in the Al Zone. The proposed amendment to Al zoning would allow for the full range of permitted uses in the Al zone. The lots do not meet the minimum lot area or lot frontage for Al parcels of 20 ha (50 acres). The reason for the 20 ha minimum is to avoid fragmentation of agricultural parcels and to maintain the viability of the farm lands for future changes in agricultural practices. Section 5.2 Permitted Uses includes Single detached dwellings lawfully in existence as of the date of the passing of this Bylaw or one new single detached dwelling on a vacant lot subject to all other applicable regulations of this By-law. The existing lots do not create further agricultural fragmentation. The criteria in Section 2.1.8 Existing Lots of the Official Plan does permit one non-farm residence on existing lots of record, however conformity to the regulations of the zoning by-law is required in order to issue a building permit. Therefore the existing residence on the smaller parcel is in conformity with the regulations in Section 5.2 Permitted Uses regarding single-detached dwellings lawfully in existence. "41101.11.111 "47 REPORT 4.o �� CAO p�'uj'tunity Is.�o�► TO: Mayor & Members of Council FROM: Paul Shipway, CAOICIerk DATE: November 2, 2017 REPORT: CAO-69/17 SUBJECT: ASSOCIATION OF MUNICIPALITIES OF ONTARIO (AMO) — ELECTRIC TRUCK PILOT PROGRAM BACKGROUND: As outlined within Report CAO 63/17 re Municipal GHG Challenge Fund, presented to Council on October 5, 2017, the Province of Ontario launched the Municipal GHG Challenge Fund. The Municipal GHG Challenge Fund is designed to invest in local projects that will help to reduce greenhouse gas (GHG) pollution. This initiative is part of Ontario's Climate Change Action Plan and is funded by proceeds from the province's carbon market. The Municipal GHG Challenge Fund will support projects such as renewable energy and energy efficiency retrofits to municipal facilities and making energy-efficiency upgrades to drinking water or wastewater treatment plants, to achieve long-term and cost-effective pollution reductions. • Ontario is investing up to $100 million of proceeds from its carbon market in the Municipal GHG Challenge Fund in 2017/18. • Any Ontario municipality with a community-wide greenhouse gas emissions inventory, emissions reduction targets and a strategy to reduce emissions is eligible to apply. Municipalities may request up to $10 million per project. Projects that are currently underway are only eligible if they were initiated after June 1, 2016. • Municipalities with a population of less than 10,000 that do not have a community-wide greenhouse gas emissions inventory, reduction targets and a plan, may be eligible for the Very Small Municipalities Stream. • At least 30% of funded projects will be located in Small / Rural / Northern Municipalities (population < 100,000 or areas north of, and including, the districts of Parry Sound and Nipissing). • The province will contribute up to 100% of eligible costs; however, a higher score will be given to applicants that leverage funds for up to 50% of eligible costs (e.g., through federal/municipal governments, private sector, industry partners etc.). The Association of Municipalities of Ontario (AMO) will be submitting an application to oversee and administer a program whereby AMO will use the GHG Challenge Fund monies to purchase ten plug-in hybrid electric (PHEV) pickup trucks. Municipalities, which offer support of the application, will be loaned a truck at no cost for six months to test in their fleet. The program will run for three years, giving up to 60 municipalities the chance to participate. Data will be collected using FleetCarma modules from the PHEV truck and one other truck in the municipal fleet. Municipalities will have access to the full FleetCarma telematics system for both trucks. At the end of the trial municipalities will complete a survey and write a short case study about their experience. Local Authority Services (LAS) will create a report from the FleetCarma system comparing the two monitored vehicles for cost and GHG savings. Municipalities will be responsible for providing insurance as they would for a leased vehicle, and basic maintenance (oil changes, etc.). Tires and other wear items will be covered by the program. Wear and tear is expected, but significant damage will need to be repaired at the municipality's expense. DISCUSSION A plug-in hybrid electric (PHEV) vehicle uses battery power first, and switches to a backup gasoline engine once the batteries are depleted. Battery-only range on currently available PHEV trucks are around 40-60km. The trucks can charge on a normal 110v outlet. No special charging equipment is required, but the charge controller should be indoors (truck either indoors or outside a garage door). The trucks will be outfitted with a headache rack, hazard lights, bed liner, bedrail guards, tool box, first aid kit, etc. Most PHEV trucks can also act as a generator to power jobsites or events. Assuming a successful application AMO intends to have the trucks change hands in January and July to allow for summer and winter experience. With a support resolution as outlined within Report CAO 69/17 Bayham will have an opportunity for hands on experience with an electric vehicle to see if it will meets the needs of the Municipality without taking the financial risk or purchasing the same. Additionally, AMO projects the electric truck will be considerably cheaper to fuel and maintain than a typical fleet truck. The program will also provide the opportunity for a trial of the FleetCarma telematics system. Lastly, above all else the test will provide objective data to use when making future fleet procurement decisions. RECOMMENDATION 1. THAT Report CAO-69/17 re Association of Municipalities of Ontario (AMO)— Electric Truck Pilot Program be received for information; 2. AND WHEREAS municipalities purchase and maintain fleet vehicles in order to provide necessary services to their communities; 3. AND WHEREAS emerging electric vehicle and hybrid technologies have the potential to significantly improve the environmental impact of municipal fleets by reducing their GHG emissions; 4. AND WHEREAS municipal fleet managers make significant and costly decisions on the fleet vehicles they purchase and these vehicles may be part of municipal fleets for several years; 5. AND WHEREAS more data and information is necessary to encourage municipal adoption of new green technologies and to help make decisions about the most appropriate applications; 6. AND WHEREAS AMO is proposing to apply to the Municipal GHG Challenge Fund to procure electric trucks which will be loaned to participants in the pilot and members to test and measure usage; 7. NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Municipality of Bayham will participate in and support the AMO Electric Truck Pilot Project alongside other interested municipal governments, including by partnering with AMO in the application for grant funding from the Municipal GHG Challenge Fund. PURPOSE The purpose of the official plan amendment is to change the land use designation for 1,738 m2 (0.4 acres) of land from "Institutional" to "Residential" in the Official Plan of the Municipality of Bayham, which would facilitate a change in zoning on the same lands from an Institutional (I) Zone to a Village Residential (R1) Zone in the Municipality of Bayham Zoning By-law. The amendment is intended to accommodate a change in use of a former museum to a residential dwelling in an existing building. 2. LOCATION The area affected by this amendment is a rectangular parcel of land located on the east side of Snow Street and the south side of Fulton Street in the Village of Vienna and known municipally as 14 Snow Street. 3. BASIS OF THE AMENDMENT The subject lands are characterized as an underutilized institutional use, formerly used as a museum. Due to the closing of the museum and the lack of demand for institutional uses in Vienna and surrounding areas the lands have been sold for residential use. The proposed redesignation of the subject lands would meet the intent of Section 4.5.2.2 that supports residential intensification in villages on underutilized lots in residential designations with full services. Furthermore, the proposed meets the intent of Section 4.2.4.1 that encourages intensification and redevelopment in settlement areas on underutilized sites in order to efficiently utilize designated settlement area land and available municipal services. Based on the above sections the proposed changes are consistent with the Official Plan. The application is deemed to be in accordance with the Provincial Policy Statement 2014 (PPS) and the Official Plan of the County of Elgin. PPS Section 1.1.3 indicates that settlement areas shall be the focus of growth and development, and that regeneration shall be promoted. The proposed amendment is consistent with the PPS based on promoting growth and intensification where infrastructure exists within a settlement area. Elgin County Official Plan Section C1.1 encourages the enhancement of the character and identity of existing residential areas and promotes the efficient use of existing infrastructure. The proposed redesignation to residential would enhance the character of the area, by ensuring the maintenance and continued use of the existing building. It would also create intensification in an area with existing infrastructure in an existing built up area. 4. Z665-2017 GAGNON BEING A BY-LAW TO AMEND BY-LAW No. Z456-2003, AS AMENDED WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Zoning By-law No. Z456-2003, as amended; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Schedule "A", Map No. 2 by changing the zoning symbol on the retained lands from Agricultural (Al) Zone to Agricultural (Al-A) Zone, which lands are outlined in heavy solid lines and marked Al-A on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law. 2) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Schedule "A", Map No. 3 by changing the zoning symbol on the boundary adjustment lands from Agricultural (Al-A) Zone to Agricultural (Al) Zone, which lands are outlined in heavy solid lines and marked Al on Schedule "A" to this By-law, which schedule is attached to and forms part of this By-law. 3) THIS By-law comes into force: a) Where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or b) Where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board.
