I 10 WHEREAS the Township of Bayham and the Village of Vienna have entered into an agreement to provide fire protection and it is necessary to ratify and confirm the said agree- ment . THEREFORE the Municipal Council of the Corporation of the Village of Vienna enacts as follows : 1 . THAT the agreement between the Township of Bayham and the Village of Vienna dated the 15th . day of _April , 1982 , a true copy of which agreement is hereto attached and forms part of this By-law , be and the same is hereby ratified and confirmed . DAY OF May , 1982 . /0f514A-4A-41049 ,// Reeve SEAL 211.0. 742.2L-4-L Clerk { 4 THIS AGREEMENT made in duplicate : his 1st . day of April , 1982 , BETWEEN TPE TOWNSHIP OF BAYHAM , hereinafter called The Party of the First Part , AND THE VILLAGE OF VIENNA , hereinafter called The Party of the Sec 7)nd Part : WITNESSETH that 'the Parties hereto mutually agree in respect to fire 410 protection p rovlderi by the Party of the First Part to the Party of the Second Part: as follows : - 1 . ollows : - 1 . The Party of the First Part agrees to provide the services of the Township ' s Fire Department and vehicles for fire protection for the Party of the Second Part , such services to be subject to prior calls and the Party of the First Part shall not be held responsible for the failure of any part of the said services . 2 . The Party of the Second Pert agrees to pay to the Party of the First Part , for the above services , on the following basis : - ( a ) During the term of this agreement , the sum of Two Thousand Dollars ( $ 2 , 000 . ) which sum shall be the cost of one ( 1 ) fire call . Each additional call shall be at the rate of Seven HurdrLd Dollars ( $ 700 . ) . 3 . The Partyof the First Part shall nor/ responsible s onsible for providing I p p 8 any additional fire fighting equipment from other municipalities unless Officials of the Party of the Second Part request same in which case the Party of the Second Part shall be responsible for any additional fee that might be charged by the other municipality , provided however there shall be no charge for additional fire fighting equipment called under a mutual aid agreement in effect in the County of Elgin . 4 . Charges arising from false alarms where it is not necessary to remove any equipment from the vehicles of the Party of the First Part shall be subject to negotiation between the Parties . 5 . This agreement shall he for a term of three ( 3 ) years commencing January 1 , 1982 , and subject to the provisions of. Section 6 shall be 11 binding upon the Parties , their successors and assigns 6 . BE IT ENACTED by the Municipal Council of the Corporation of the Village of Vienna that all actions by the said Council by by- laws and resolutions for the year commencing December 1 , 1981 through November 30 , 1982 be and the same are hereby approved and confirmed . WHEREAS Section 39 ( 4 ) of By- law provides for accounts in default for six months may result in water service being disconnected . AND WHEREAS six months is deemed to be an excessive period of time for water usirs to be in default . THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF VIENNA : 1 . THAT Section 39 ( 4 ) of By-law No . 744 be amended to read "Payment to the Corporation of accounts for the supply of water shall be made at two month intervals . Rates for water supply shall be due when billed . A ten percent penalty shall be charged on all accounts not paid in full on or before the 30th . day after the date upon which accounts are rendered . Accounts in default for sixty ( 60 ) days after the rendering of 4. the said account may result in water service being disconnected under authority of Sub-section 3 of Sectiou 27 of The Public Utilities Act , R . S . O . 1980 and no further water supplied to said premises . WHEREAS By- law No . 778 providing for the construction of the Chapel Street Municipal Drain under the provisions of the Drainage Act , was passed by the Municipal Council of the Corporation of the Village of Vienna on the 10th . day of June , 1982 . AND WHEREAS ' THE AMOUNT SPECIFIED IN THE SAID By- law as the Village of Vienna ' s share of the cost for the construction of the said drain wa $ 8 , 870 . AND WHEREAS the amount specified in the said By- law as the Townshi . of Bayham ' s share of the cost of the constriction of the said drain was $ 2 , 230 . AND WHEREAS the actural cost of the work all expenses included was I l0 062 . 29 to which a grant of $ 129 . 93 has been a lied to a ri - $ � PP agri - cultural lands leavinga net cost of $ 9 , 932 . 36 , being $ 1 , 167 . 64 less than the estimated cost . AND WHEREAS IT IS PROVIDED BY The Drainage Act , that such surplus funds shall be decreased in pro rata proportions t0 the assess - ments contained in the original By- law each year during which the debentures have t0 run . ' THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF VIENNA : 1 . THAT the sum of $ 170 . 12 being the amount over estimated as assessed against lands as provided in By- law 778 be and the same is hereby decreased in pro rata proportions to the assessments as contained in the said By- law each year during which the debentures have to run . THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE VILLAGE OF VIENNA : 1 . THAT the sum of $170 . 12 being the amount over estimated as assessed against lands as provided in By- law 778 be and the same is hereby decreased in pro rata proportions t0 the amounts are shown on the schedule of assessments hereto attached and which form a part of this By- law . 2 . THAT THE SUM OF $ 997 . 52 being the amount over estimated as assessed against roads as provided for in By- law No . 778 be and the same is hereby decreased in pro rata proportions to the roads assessed in By- law No . 778 , said amount is hereby shown in the schedule of assessments , hereto attached and which form a part of this By- law . 3 . THAT the said sum of $ 1 , 167 . 64 shall be deducted from the amount of the total assessments contained in By- law No . 778 and the debenture to be issued as provided for in By- law No . 778 shall be as provided for in By- law No . 778 . 4 . THIS BY-LAW COMES INTO FORCE ON THE FINAL PASSING THEREOF , AND MAY BE CITED AS THE "CHAPEL STREET MUNICIPAL DRAIN AMENDING BY- LAW" .
