THAT By-law No. 73$ being a By-law to appoint Municipal Officers
for the year 1976 through authority vested in Municipal Councils
by the Municipal Act .
1111 THEREFORE be it enacted by the Municipal Council of the
Municipality of Vienna :

Whereas the Council of the Village of Vienna
(hereinafter called the "Municipality") deems it necessary to borrow the sum
of $ 10 , 000 . 00 to meet, until the taxes are collected, the current
expenditures of the Municipality for the year ;

Therefore the Council of the Villare of Vienna
hereby enacts as follows :
1. The Head and the Treasurer are hereby authorized on behalf of the Municipality to
borrow from time to time by way of promissory note from CANADIAN IMPERIAL BANK
OF COMMERCE a sum or sums not exceeding in the aggregate $10 ) 000 . 00
to meet until the taxes are collected the current expenditures of the Municipality
for the year, including the amounts required for the purposes mentioned in subsection
(1) of &Diction 329 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest at such rate
as may be agreed upon from time to time with the Bank.
2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums
borrowed in this year and in previous years from the said Bank for any or all of the
purposes mentioned in the said Section 329, shall, with interest thereon, be a charge
upon the whole of the revenues of the Municipality for the current year and for all
preceding years as and when such revenues are received.
3. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

By-LAW NO. 734
BEING A by-LW to sat out regulations respecting the issuance
of building permits.
WHEREAS subsection 2 of Section 5 of The Building Code Act ,
1974, empowers municipal councils to pass by-laws and regulations
respecting building permits;
RTHERVORE , the Council of The Corporation of the
v Z - a r-n o " V „r- a enacts as follows ;
Section 1, Alia7
1 . 1 . This by-law may be cited as "The Building By-Law".
Section 2
2. 1 . gomaymp OF PERMITS
2.1 .1 . Classes of Permits with respect to the construction
and deaol i t i on of buildings shall be as set out in Schedule "A" to
this By-law.
2. 2 . APPI.ICATIt FCR
2 . 2 . 1 . To obtain a permit the owner or his authorised
agrat shall file an application in writing by completing the
prescribed forms available at the offices of the municipality.
2. 2. 2. Except as otherwise permitted by the chief
official , every application shall
(a) identify and describe in detail the work and occupancy to be
covered by the permit for wick applieition is aide;
(b) describe the land on which the work is to be done , by a
description that will readily identity and locate the
building lot ;
411 ( c ) be accompanied by complete plead and ,.citications as
described in Subsection 2. 3 . ;
(d) state the valuation of the proposed work and be s000mpanied
by the required fee;
C.) state the names, addresses and telephone numbers of the owner,
architect , engineer or other designer and constructor;
(f) be accompanied, where applicable, by a written acknowledgement
of the owner that he has retained the architect or professional
engineer to carry est - !" ald review of the construction , as
described in Section 24 etthii Regulations, and ;

( g) be signed by the osier or his authorised agent who shall
certify the truth of the contents of the application.
2. 2.3 • An application for a permit may be deemed to have
been abandoned and cancelled 6 months after the date of filing ,
unless such application is being seriously proceeded with.
2.3 .1 . Sufficient information shall be submitted with each
application for a permit to enable the chief official to determine
whether or not the proposed work will conform with the Act , the
Regulations thereunder and any other applicable law.
2. 3 . 2. Plans shall be drawn to scale upon paper, cloth or
other durable material .
2•3 . 3 • Plans, specifications and information furnished
with the application shall be in numbers as prescribed by the
municipality.
2. 3 .4. Unless otherwise permitted by the chief official ,
site plans shall be referenced to a current plan of survey ,
certified by a registered Ontario land surveyor, and a copy a
such survey shall be submitted.

2.4.1. When , in order to evedite work , a permit far a
portion of the building in desired prior to the issuance at •
permit for the whole project , application shall be made and fees
paid for the complete project , and aorplato p3Amm and specifications
covering the portico of work for which immediate approval is desired
shall be filed with the chief official.
2.4. 2. Should a permit be issued for part of a building the
bolder of such permit may proceed but. the municipality gives no
assurances that permits required for the remainder of the project
will be granted.
Section 3 JIML
3 .1 . Flea for a required permit shall be in accordance with
schedule WAN to this By].ay.
3.2. Where the tNa are based an the cost or valuation
of the proposed work , such valuation shall mean the total cost of
all work regulated by the permit including cost of professional
and related aerriep.

3 . 3 . The chief official shall place a valuation as the
cost of work and if the permit applicant or holder disagrees with
this valuation, the prescribed fee shall be paid before the issue
of the permit . Upon completion of the work, if the actual cost of
the work was lass than the valuation placed by the chief official ,
an audited statement may be submitted detailing the cost of all
component parts of the work. The chief official shall , if the
I/ statement contains the cost of all component parts of the work upon
which the valuation was required to be based, value the work in
accordance with this statement and issue the appropriate refund .
3 . 4. In the case of the non-commencement of any project
and wan written request , the chief official shall determine the
amount of refund of permit fees, if any , that may be returned to
the permit holder, in accordance with Schedule "B" to this By-Law.
Section 4 R IiTIiS
4 .1 . The owner or his authorised agent shall notify the
chief official at least two business days in advence of the stages
of construction specified in Section 2.10 at the Regulations.
Section 5 All brallaws inconsistent with this bar-law are hereby
deemed to be repealed.

Being a By-Law to confirm all actions of the Council of the
Village of Vienna for the year 1976 .
Be it therefore enacted by the Municipal Council of the
Corporation of the Municipality of the Village of Vienna ,
that all •actions by the said Council , by By-Law and
Resolutions for the year 1976 , be and the same are hereby
approved and confirmed .
