The Head and the Treasurer are hereby authorized on behalf of the Municipality to borrow from time to time by way of promissory note from THE CANADIAN BANE OF COMMERCE a sum or sums not exceeding in thglaggregate t5,000.00 to meet until the taxes are collected the current expenditures of the Municipality for the year,including the amounts required for the purposes mentioned in subsection (1) of Section 341 of the Municipal Act, and to give on behalf of the Municipality to the Bank a promissory note or notes sealed with the Corporate Seal and signed by the Head and Treasurer for the moneys so borrowed, with interest,which may be paid in advance or otherwise,at a rate not exceeding 5i per centum per annum. 2. All sums borrowed pursuant to the authority of this by-law,as well as all other sums borrowed in this year and in previous years from the said Bank for any or all of the purposes mentioned in the said Section 341, shall, with interest thereon, be a charge upon the whole of the revenues of the Municipality for the current year and for all preceding years as and when such revenues are received. 3. The Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the moneys hereafter collected or received either on account or realized in respect of taxes levied for the current year and preceding years or from any other source which may lawfully be applied for such purpose. OF BY-LAW AND AGREEMENT OF THE VILLAGE OF PORT BURWELL By-Law Number Xa of 1 THE COR:'ORATION OF THE VILLAGE OF PORT BURWELL 11) Ij A By-Law authorizing The Central Pipe Line Company, Limited, to lay down maintain and use pipes and other necessary works for the transmission and distribution of gas on, in, under, along or across any highway under the juris diction of the Council of The Corporation of the Village of Port Burwell, together with the right to bring in, distribute, sl ,ply, and sell gas. BE IT THEREF9HE ENACTED by the Council of The Corporation of the Village of as follows :-- C.1'r' ✓ PoR'r F3I114yNELL (— Full right, power, permission, consent and authority of r the Municipaity. , 41"INNALLY P,,s F L the day of 4-947 WHEH}:A, the Central Pipe Line CompanyLimited, (herein- after referred to as "the (;ompany" and whch term shall in- clude its successors and a signs) is engaged in the busine��s of producingpurchasing, transmitting, distributing, supply- ing and settling gas. AND WHEREAS the Company has requested the Council of the Corporation of the Villava of Port Burwell to grant it a franchise to transmit distribute supply and rell gas in and through the Village of Port Burwell (hereinafter called"the Municipality") for fuel, and other purposes. AND WHEREAS the Council deems it advisable to grant the said request subject to the terms and conditions hereinafter set forth the authority is hereby given, granted, conferred and assured unto the Company its aucces-ore and assigns to lay down maintain anal use pipes and other necessary works for the transmis^ion and distribution of gas on in, under, along or acroer any highway under the jurisdiction of the Council of the Municipality, including therein the right from time to time and at any time to construct, lay, maintain, repair, renew, remove, replace use and operate in, through, upon, under, along and across the same or any of them or any parts of them such transmission and distribution mains to- ;� gether with the right from time to time and at all times to dk !!! ' use and operate a gas distribution system in the Municipalit/OF li Any of the above described work performed upon any such h !ghway or any part or parts thereof shall be performed with all reasonable expedition so that the highway or any part or parts thereof shall not be torn up or obstructed for any unnecessary length of time an after each entry upon a high- way for any of the pur -ores above set forth, the Company shall at its own expense and with all reasonable expedition, restore the highway at the point of entry as closely as reasonably practicable to the condition in which it existed at such point II • immediately prior to such entry. The Company shall indemnify and save harmless the Municipality from and against all loss, costs damages and expenses which the Municipality may bear, sutler or be put by reason of or in consequence of any negligence or default on the part of the Company, its agents, and employees, in the construction, operation and maintenance of the pipes or works laid or operated under this By-Law or in the doing of anything A by the Company under the .towers conferred won it by t is By- PAGE 2. The rights and privileges, duties and obligations arisi out of this By-Law and the Agreement schedule "A" hereto annexed shall be subject to any applicable statute order and direction of any governmental authority havingjurisdiction in the premises and now or hereafter in effect uring the term of this By=Law. The rights and privileges hereby granted shall continue and remain ,n force for a period of twenty years from the date hereof and for so long thereafter as any of the pipes, lines and works laid or operated under this By-Law are in use for the transmission, distribution, of gas in the Municipality. "Highway" means ani includes a common and public highway, street, ally sidewalk and any other structure inci- �� ',i '� dental thereto now or at any time during the term of this By- Law under the jurisdiction of the Municipality. (b) Motor vehicle includes automobile, motor cycle and any ot0er vehicle propelled or driven otherwise than by muscular power; but does not include the cars of electric or steam railways or other motor vehicles running only upon rails, or a traction engine, farm tractor or road-building machine. (c) Park means the standing of a vehicle, whether occupied or not otherwise than temporarily for the purpose of and while actually engaged in loading or unloading. (d) Street or Highway includes a common and plblic highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles. (e) Through Highway means any highway or part of a highway designated as such by the Minister or by-law of a Munici- pality approved by the Department, and every such highway shall be marked to comply with the regulations of the Department. (f) Traffic includes pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances either 411/1 singly or together while using any street for the purposes of travel. • (g) Vehicle means a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but not including the cars of electric or - 2 - steam railways running only upon rails. PART LL - PARKING 2. Method of parking (1) Parallel No persons shall park a vehicle on any side street other than a one-way street unless on the right-hand side of the street having regard for the direction in which the vehicle had been proceeding and unless the right-front and right- rear wheels or runners of the vehicle are parallel to and distant respectively not more than six inches from the edge of the roadway. (2) Angle Where angle parking is permitted, no person shall park a vehicle except at an angle of forty-five degrees with the edge of the roadway and so that the front end of the vehicle is nearest to the edge of the roadway. (3) One -Way Streets Where parking is permitted on a one-way street a person may park a vehicle facing only in the direction in which it was proceeding and with the left-front and left-rear wheels parallel to and distant not more than six inches from the edge of the roadway, provided that this provision shall not apply where parking on the right-hand side of a one-way street is specifically authorized by by-law. (4) Parking Prohibited (1) In Specified Places 10 No person shall park a vehicle in any of the following places: On a sidewalk. In front of a public or private driveway. Within an intersection. Within ten feet of a fire hydrant. On a crosswalk. Within twenty feet of a crosswalk at an intersection. Between a safety zone and the adjacent curb or within twenty feet of points on the curb immediately opposite the ends of 10 a safety zone. On any bridge, or in any subway, or the approaches thereto. 7* On any street in such a manner as to obstruct traffic. In such a position as will prevent the convenient removal of - 3 - any other vehicle previously parked or standing. Rate of Speed at Certain Places (a) No motor vehicle shall be operated at a greater rate of speed than fifteen miles per hour upon the highways within the limits of the public park known as "Community Memorial Park". 411 (b) The following highways and oarts of highways in the Village of Port Burwell are designated as being within the limits of the public park known as "Community Memorial Park". (a) All roads in the West Park except Chatham Street which are south and west of Chatham and Wellington Street. t - 4 - (b) Brock Street from Strachan Street to Robinson Street. • (c) Hagerman Street from Robinson Street to Strachan Street. (d) Strachan Street. from Hagerman Street to Brock eStreet. PART V - MISCELLANEOUS, PENALTIES, ETC. 5. Voluntary Payment of Penalties (1) Where a vehicle is found parked or driven in contra- vention of the parking or stopping provisions of this by-law • the police officer so finding the vehicle shall issue a summons or attach to the vehicle a parking ticket in the form of a serially numbered notice stating: (a), The license number and concise description of the vehicle, (b) That the vehicle is unlawfully parked, (c) The date, time, place and nature of the alleged offense, (d) That the owner or operator thereof may report to the Clerk of the Village within two days exclusive of Sundays and Holidays after the day when the ticket is attached to make a voluntary payment of the penalty in the amount of Two Dollars ( 12.00) for parking offenses of a restrictive nature, or Three Dollars (43 .00) for parking offenses of prohibited nature, or Five Dollars • (45.00) for stopping offenses, double parking offenses or offenses involving the blocking of a lane or highway. (e) That in the event offailure to so report and make such payment, a summons will be issued under the Summary Convictions Act. 0 (2) The parking ticket shall be prepared in triplicate and the Police Officer shall attach one copy to the vehicle and deliver the other copies to the Village Clerk or • Treasurer or other designated Official. (3) The owner or operator of the vehicle, may, within two days exclusive of Sundays and Holidays, after the day when the ticket is attached to the vehicle report to the J . . ve' - 5 - Office of the Clerk of the Village or the Treasurer, or other designated Official, and to pay such Clerk, Treasurer • or any person designated by him to receive such payments, the sum of Two Dollars (42.00) for parking offenses of a restrictive nature or Three Dollars (r$3 .00) for parking 111 offenses of a prohibitive nature or Five Dollars (05.00) for stopping offenses, double parking offenses or offenses involving the blocking of a lane or driveway which shall be accepted as the payment of penalty in full satisfaction _in respect of the alleged offense and a receipt therefore • shall he given to the person making the payment. (4) If a voluntary payment is not made in accordance with the procedure provided in subsections (1) to (3 ) of this Section, the procedure of the Summary Convictions Act shall apply and the penalties sheik be recoverable under the Ontario Summary Convictions Act. (5) Penalties Any person violating any of the provisions of this by-law shall be subject to a penalty of not more than Ten Dollars (; 10.00) for the first offense and not more than Twenty- five Dollars ($25.00) for every subsequent offense exclusive of costs, and all such penalties shall be recoverable under the Ontario Summary Convictions Act. (6) Ontario Highway Traffic Act to Govern The provisions of this by-law shall be subject to the pro- visions of the Ontario Highway Traffic Act and amendments • thereto.
