SAS by By-law number 60, the Municipal Corporation of the Township of Bayham was requested to pass a '"y-law to raise the sum of Twenty-five Hundred Dollars, and to issue debentures In respect thereto for the installation of lighting system in the streets of the said Police Village of Port Burwell, ARID WMAS the said Municipal Corporation of the Township of Bayham has passed By-law number P% p for the purposes aforesaid, ALA WMMS the said debentures therein provided are to be paid in ten equal annual instalments of $ 331.66 by the Police Village of Port Burwell. 11017 THEREFORB THE WNICIPAL CORPORATION OF WE POLICE VILLAGE OF PORT 3JRMU enacts as follows;- 1. That the said By-law as passed by the 11unicipal Corporation of the Township of 3ayham is hereby ratified, confirmed and approved of. 2. The sum of $ 331.66 being the amount required to be raised annually for the payment of the debentures and interest shall be levied and raised annually by a special rate sufficient therefore over and above all other rates on all the rateable property iu the Police Village of Port Burwell, `at the same time and in the same manner as other rates. 3. The trustees of the Police Village of Port Burwell shall in any year during the currency of the said debentures before the striking of the rate by the Council of the Township of Bayhaa furnish to the Clerk of the said Township a statement shaving in detail the amount to be levied upon the rateable repayment of the said debentures, and for such Worm or services and the maintenance thereof for the supply of light. The Head and the Treasurer are hereby authorized on behalf of the Municipalityto • borrow from time to time by way of promissory note from THE CANADIAN BANK OF COMMERCE a sum or sums not exceeding in the aggregate $5i000a00 to meet until the taxes are collected the current expenditures of the Municipality for the year, including the amounts required for the purposes mentioned in subsection (1) of section 339 of the Municipal Act, and to give on behalf of the Municipality to the Bank a promissory note or notes sealed with the Corporate Seal and signed by the Head and Treasurer for the moneys so borrowed, with interest, which may be paid in advance or otherwise, at a rate not exceeding 5 per centum per annum. 2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums borrowed in this year and in previous years from the said Bank for any or all of the purposes mentioned in the said section 339, shall, with interest thereon, be a charge upon the whole of the revenues of the Municipality for the current year and for all preceding years as and when such revenues are received. 3. The Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the moneys hereafter collected or received either on account or realized in respect of taxes levied for the current year and preceding years or from any other source which may lawfully be applied for such purpose. CLERK By -Law No 64 CORPORATION OF T E VILLAGE OF PORT BURWELL ONT. Being a by-law to levy the rates 7 taxes for tre year 1955 and to provide for the collection thereof. 'Whereas the Council of the said Village provided for the making of the assesement of the Municipality prior to the 30th day of Sept. 1954 as the assessment in which the rate of taxation for the year 1955 should be levied. And whereas the assessment =1 value of the rateable property as finally revised, T1MH0C=X1KMKXXMXjXZjKXKxV3F XNKXMMYXXU in the Corporation of the Village of Port Burwell amounts to t378,158 And whereas the assessment Roll containing the assessment as ZZM ffiZ$N made aforesaid was revised, corrected and passed by the Court of Revision of the Villa:-e of tort Burwell on November loth. 1954. And whereas there were no appeals from the Court of Revision or that all appeals from the Court -of Revision have been heard and decided. And whereas it is expedient to adopt the said assessment as the ass- dssment on which the rate of taxation for the year 1955 shall be levied. • And whereas it is expedient and necessary to levy on the whole rateable property accordin torrthe ast revised assessment roll of the said Village the sum of or the general purpose of the said Village for the current year, for the payment of the County rate for the current year and for the pwrpose of defraying part of the expense of Public and High school education and other purposes. Therefore the Council of the Corporation of the Village of Port Burwell enacts as follows; . That the assessment contained in the assessment roll fo the Village of Port Burwell prior to Sept. 30 1954 and as revised, corrected and passed by the Court of Revision and County Judge, be, and the same is hereby adopt and confirmed as the 1st revised assesement roll for the Village on which t rate of taxation for the year 1955 shall be levied. 41. XC 2. All taxes or other special rates shall be paid into the offi:e of the Collec4or or Treasurer of the Village of Port Burwell,or into the Branch of the Canadian Bank of Commerce at Port Burwell Ont. • 6. Taxes shall become payable one-half on or before July 19th 1955 and one- half on or before december 19th. 1955. 7. C le rk . n U 0 0 BY-LAW NO...::.... f, THE CORPORATION OF THE VILLAGE OF PORT BURWELL A By-lpw authorizing the borrowing of Forty Thousand Dollars upon debentures for the purpose of purchasing the electrical dis- tribution system of the Hydro Electric Power Commission of Ontario within the limits of • the Corporation of the Village of Port Burwell. WHEREAS it is expedient t6 borrow for the purpose of purchasing the electrical distribution system of the Hydro Electric Power Commission of Ontario within the limits of the Corporation of the Village of Port Burwell, a sum not exceed- ing Forty Thousand Dollars (440,000.00) upon the credit of the Corporation, to issue debentures therefore bearing interest at the rate of Four per centum (4%) per annum payable annually • and to provide for the discount and the expenses incidental to negotiation and sale of such debentures; AND WHEREAS it is expedient to' make the principal of the said debt repayable in annual instalments during the period of years next after the date of issue of such debentures, of such amounts respectively that, with the interest in respect of the debt, the aggregate amount payable for principal and interest in each year shall be, as nearly as possible, the same; AND WHEREAS the amount of the whole rateable property of the municipality, according to the last revised assessment roll thereof is $378,308.00. • AND WHEREAS the amount of the existing debenture debt of the Corporation, exclusive of local improvement debts se- cured by special rates or assessments, is $ 14,200.09 and no part of the principal or interest of such debt is in arrear; AND WHEREAS by Order dated the Nineteenth day of May, 1955, PFD 3155-55 the Ontario Municipal Board has approved the purpose of the said borrowing and the passing of all requisite by-laws, including debenture by-laws; • THEREFORE the Council of the Corporation of the Village of Port Burwell enacts as follows: 1. For the purpose aforesaid the Corporation shall borrow upon the credit of the Corporation a sum not exceed- ing Forty Thousand Dollars, - 2 - ($40,000.00) and shall issue debientures therefore in sums of not less than $100.00 each. Each debenture shall bear interest at the rate of Four per centum (4%) per annum payable annually and shall have coupons attached thereto for the payment of such • interest. 2. All the debentures shall bear the same date, shall be issued at one time and within two years after the day on which this By-law is passed, may bear any date within such two years and shall be made payable in annual instalments during the period of Twenty years next after the date of issue thereof, and the respective amounts of principal and interest payable in each of such years shall be the amounts so designated in • Schedule "A" hereto annexed. $. The debentures shall be payable as to both principal and interest in lawful money of Canada and may be made payable at in such place or places/Canada as shall be designated thereon. 4. The said debentures shall be sealed with the Seal of the Corporation and signed by the head of the Council, or by some other person authorized by by-law to sign the same, and by the Treasurer. The said interest coupons shall be signed by the Treasurer and his signature thereon may be written, stamped, lithographed or engraved. 5. Commencing in the year 1956 and thereafter in each year in which an instalment of principal of the said debt and • interest become due, the Corporation shall levy and raise the specific sum shown for the respective year in the fourth column of the said Schedule. Such sum shall be levied and raised by a special rate sufficient therefore, over and above all other rates, upon all the rateable property in the municipality. 6. The said debentures may contain a clause providing for the registration thereof pursuant to Section 335 of The Municipal Act. • 7. Pending the sale of the said debentures, the head of the Council and the Treasurer may raise for the purposes aforesaid by way of loan on such debentures any sum or sums of money not exceeding in all the sum hereby authorized to be borrowed and may hypothecate such debentures for such loan. I 8. The Corporation shall have the right, at its option to redeem that portion of the said debentures maturing in the Twentieth year on any date prior to maturity at the places • where and in the moneys in which the said debentures are expressed to be payable, upon payment of the principal amount thereof to- gether with interest accrued to the date of redemption and upon giving previous notice of said intention to redeem by advertising once in the Ontario Gazette and once in a daily newspaper of general provincial circulation, published in the City of Toronto and once in a local newspaper, such notice to be advertised as aforesaid at least thirty days before the date fixed for re- demption. Notice of intention so to redeem shall also be sent by post at least thirty days prior to the date set for such redemp�ion to each person in whose name a debenture to be redeemed is registered at the address shown in the De- benture Registry Book.
