THE CORPORATION OF THE VILLAGE OF PORT BURWELL
A By-law to provide for taking the votes of the qualified
electors of the Village of Port Burwell on a certain proposed
by-law and a certain question;
'HEREAS By-law No. £z of the Corporation of the
Village of Port Burwell passed on the day of
Clw24 provides for submitting for the assent of the
electors of the Corporation qualified to vote on money by-laws,
a certain proposed money by-law entitled "A By-law authorizing
the borrowing of Forty Thousand dollars upon debentures for
10 the purpose of purchasing the electrical distribution system
of the Hydro Electric Power Commission of Ontario within the
limits of the Corporation of the Village of Port Burwell;"
AND WHEREAS By-law No. of the Council of the
Corporation passed on the yLv day of Cc.-C Sal,
19 , provides for submitting for the opinion of the electors
of the Corporation qualified to vote on money by-laws the
following question, that is to say, "Are you in favour of
securing a supply of electrical power or energy from The Hydro-
Electric Power Commission of Ontario?"
NOW THEREFU:LE THE COUNCIL OF TH.; CORPORATION OF THE
VILLAGE OF PORT BURWELL enacts as follows:-

3. A copy of the proposed money by-law or: a synopsis
of the proposed money by-law and a statement of the said
question, and the notice required by the Municipal Act, R.S.O.
1950, chapter 24.3, shall be published in the following news-
paper on the days hereinafter mentioned, that is to say: The
St. Thomas Times Journal, November 6, 13 and 20th.

attend at his office in the Council Chamber in the Village
of Port Burwell and, if requested so to do, shall appoint in

desirous of promoting the proposed money by-law or voting in
the affirmative on the said question, and a like number on
behalf of the persons interested- in and desirous of opposingthe
prpposed money by-law or voting/the negative on the said question;

A By-law to provide for the submission of a certain
question for the opinion of the municipal electors of the
Village of Port Burwell.
WHEREAS the Council of the Corporation of the Village
of Port Burwell deems it advisable to submit to the vote of
the municipal electors of the Corporation a question as to
whether the said electors are in favour of the establishment
of a Public Utilities Commission for the Village of Port Burwell,
the members to be elected for a two year term commencing with
the Commission to be elected for the year 1956, one-half of
the Commissioners to be elected each year;
NOW THEREr'ORE THE COUNCIL OF THE CORPORATION OF THE

OF ONTARIO, hereinafter called "the
Commission"
OF THE FIRST PART,

PORT BURWELL, hereinafter called "the
Corporation"
OF T z SECOND PART,
WHEREAS the Corporation has applied to the Commis-
sion under The Power Commission Act, R.S.O. 1950, Chapter
281, and amendments thereto, (hereinafter called "the said
Act") for a supply of electrical power, and the Commission
acting under the said Act is willing to enter into an agree-
ment for the supply of electrical power to the Corporation
upon the terms and conditions hereinafter appearing;
AND WHEREAS the council of the Corporation on the
day of )77 - 1954 passed
By-law No. 4 / authorizing the entering into an agreement
with the Commission for such purpose upon such terms and con-
ditions, and the execution of the agreement by the Corporation;
NOW THEREFORE THIS AGREEMENT WITNESSETH that subject

to the said Act and for the considerations herein contained
the parties hereto covenant and agree as follows:-
1. THE COMMISSION AGREES:
(a) To reserve for and deliver to the Corporation at
the earliest possible date one hundred and sixty kilowatts
(160 kw) of electrical power;
1.(b) At the expiration of reasonable notice in writing
which may be given by the Corporation from time to time during
the continuance of this Agreement, to reserve for and deliver
to the Corporation additional electrical power, but if the
additional power should not be available when requested by
the Corporation, the Commission shall have a reasonable time
to make it available;
l.(o) To deliver the power hereunder at the point of
delivery defined as the point where the Commissionts 8,000
volt line on Chatham Street is intersected by the northerly
limit of the Corporation, or at such other point or points
as may be agreed upon;
l.(d) To deliver the power hereunder as commercially con-
tinuous twenty-four (24) hour power every day in the year,
except as otherwise provided in this Agreement;
l.(e) To use at all times first-class, suitable apparatus
and plant, and to exercise all due skill and diligence so as
to secure the satisfactory operation of the plant and apparatus
of the Corporation.
2. PE CORPORATION AGREES:
(a) To take the
power covered by this Agreement in ao-
cordance with the terms hereof and to prepare for the receipt
and use of the power so as to be able to receive power when

the Commission is ready to deliver it;
2.(b) To pay the Commission in each year the cost to the
Commission, as determined by it, of supplying and delivering
electrical power to the Corporation hereunder, including the
Corporation's proportion as adjusted by the Commission of all
costs incurred for the purposes of this Agreement, and with-
out limiting the generality of the foregoing, the followingi-
(i) The cost of operating, maintaining, renewing
and insuring the works and the cost of ad-
ministration of the Commission;
(ii) Interest and expenses of debt service and
interest credited on the balances remaining
from time to time to the credit of reserve
accounts established under the authority of
the said Act;
(iii) An annual sum sufficient to form in 40 years
with interest at four per cent per annum, a
{ sinking fund for the repayment of the
advances made by the Province of Ontario under
the said Act for the cost of the works, for
the repayment of any other indebtedness
incurred or assumed by the Commission in
respect of the cost of the works, and for
the restoration of any reserve or other funds
of the Commission utilized for the payment of
the cost of the works; and
(iv) An amount to be determined by the Commission
for the purposes of sections 13 and 15 and
clause d of section 14 of the said Act,
and to make payment in twelve (12) monthly instalments based
on estimated rates fixed by the Commission; the cost to be
determined by the Commission after the close of the fiscal
year and the difference between the said cost and the amount
paid by the Corporation in the said twelve (12) monthly in-
stalments to be paid by the Corporation to the Commission on
receipt of bill therefor or to be credited to the Corporation,
as the case may be;
2.(c) To pay all amounts payable by the Corporation in
lawful money of Canada, at the offices of the Commission in
Toronto. Bills for power hereunder shall be paid not later

than ten (10) days after the date of rendering thereof. If
any bill remains unpaid for fifteen (15) days the Commission
may, in addition to all other remedies and without notice,
discontinue the supply of power to the Corporation until said
bill is paid. No such discontinuance shall relieve the Cor-
poration from the performance of the covenants, provisoes and
conditions herein contained. All payments in arrears shall
bear interest at the rate of five per cent (5%) per annum;
2.(d) To take power exclusively from the Commission during
the continuance of this Agreement;
2.01)). To pay for three-fourths of the power ordered from
time to time by the Corporation or held in reserve for it as
herein provided, whether it takes the same or not. If in any
month the Corporation takes power so that the highest average
amount of power taken for any twenty (20) consecutive minutes
in that month exceeds three-fourths of the amount ordered by
the Corporation or held in reserve, then the Corporation shall
pay for the greater amount as if taken during the whole month;
2.(f) If in any month the Corporation takes power so that
the average or integrated demand for any twenty (20) con-
secutive minutes is in excess of the amount of power ordered
and held in reserve for the Corporation as provided in clause
1 hereof, the taking of the excess shall constitute there-
after an obligation on the part of the Corporation to pay for
and on the part of the Commission to hold in reserve and
deliver power increased by the excess to the extent, if any,
allowed by the Commission, all in accordance with the terms
and conditions of this Agreement; in any event the Corporation
shall pay for power for the said month as if the excess had
been taken for the whole month;
2.(g) At all times to take and use the electrical power

in such manner that the ratio of the kilowatts to the kilovolt
amperes (read simultaneously) is unity, but when this is not
possible the Corporation shall pay for ninety per cent (90%)
of the maximum kilovolt amperes (considered as true power or
kilowatts) when the said ninety per cent (90%) is in excess
of the maximum kilowatts taken; the maximum in kilowatts or
kilovolt amperes shall be taken as the maximum average or
integrated demand for any twenty (20) consecutive minutes;
2.(h) To use at all times first-class, suitable standard
commercial apparatus and plant to be approved by the Commission,
and to operate and maintain the apparatus and plant so as not
to cause more than minimum disturbance or fluctuation to the
Commission's power supply or system, and to exercise all due
skill and diligence so as to secure satisfactory operation of
the plant and apparatus of the Commission and of the
Corporation;
2.(i) To co-operate with the Commission at all times by
all means in its power to fulfil the objects of this Agreement
and of the said Act and to advance the purposes of the
Commission.
3. This Agreement shall be binding on the parties here-
to upon the execution thereof, and shall continue in force for
a period of forty (40) years commencing on the date when power
is first delivered by the Commission to the Corporation hereunder.
4. (a) The power hereunder shall be alternating, three-phase,
having a frequency of approximately twenty-five (25) cycles per
second and a nominal voltage of approximately eight thousand
volts (8,000 v.), or such other voltage as may be suitable, sub-
ject to ordinary variations from the said voltage of approximately
ten per cent (104) and from the said frequency of approximately
five per cent (5%);

"Power" shall mean electrical power and except
where the context requires a different meaning shall also
mean and include energy;
4.(b) The maintenance by the Commission of approximately
the agreed voltage at approximately the agreed frequency at
the point or points of delivery shall constitute the supply
of power involved herein and a fulfillment of all operating
obligations of the Commission hereunder, and when the voltage
and the frequency are so maintained the amount of power, its
fluctuations, load factor, power factor, distribution as to
phases and all other characteristics and qualities shall be
under the sole control of the Corporation;
4.(c) In case the Commission shall at any time or times
be prevented from delivering the power or any part thereof
by any cause reasonably beyond the Commission's control, in-
cluding without limiting the generality thereof, strike,
lockout, riot, fire, insurrection, hurricane, civil commotion,
flood, invasion, explosion, the Queen's enemies or act of God,
than the Commission shall not be bound to deliver power during
such time or times; the Commission shall be prompt and
diligent in removing the cause of such interruption and when
the cause of interruption is removed the Commission shall,
without any delay, deliver the said power; no such interruption
shall release the Corporation from any obligation under this
Agreement;
4.(d) The Commission shall have the right at reasonable
times and, when possible, after reasonable notice has been
given to the Corporation, to discontinue the supply of power
to the Corporation for the purpose of safeguarding life or
property or for the purpose of operation, maintenance, replace-
ment or extension of the Commission's apparatus, equipment or

works, but all such interruptions shall be of a minimum dur-
ation and, when possible, arranged for at a time least
objectionable to the Corporation; no such interruption shall
release the Corporation from any obligation under this
Agreement.
•5. The engineers of the Commission or any of them,
or any other person or persons appointed by the Commission
for the purposes of this clause, shall have the right from
time to time, during the continuance of this Agreement, to
inspect the apparatus, plant and property of the Corporation,
and take records at all reasonable hours.
6. The Commission shall, at least annually, adjust
and apportion the amounts payable by the Corporation to the
Commission under this Agreement.
7. The Commission shall be a trustee of all property
held by the Commission under this Agreement for the Corpora-
tion and other municipal corporations supplied by the Commis-
sion, but the Commission shall be entitled to a lien upon the
said property for all moneys expended by the Commission under
this Agreement and not repaid to it. At the expiration of
this Agreement the Commission shall determine and adjust the
rights of the Corporation and other municipal corporations
supplied by the Commission, having regard to the amounts paid
by them, respectively, under the terms of their agreements
with the Commission and such other considerations as may appear
equitable to the Commission and are approved by the Lieutenant-
Governor in Council.
8. Where any municipal corporation is taking power from
the Commission at the time of application for a supply of power
by any person within the limits of the corporation, the Commis-
sion shall not supply power to such person without the written

consent of the corporation; no power shall be supplied by
the Corporation to any railway for motive purposes or to any
electrical distributing company without the written consent
of the Commission, but the Corporation may sell power to any
other person or persons or manufacturing companies within
the limits of the Corporation, provided that such power shall
not be sold for less than coat, nor shall there be any dis-
crimination as regards price and quantity.
9. If differences arise between municipal corporations
to which the Commission is supplying power the Commission may,

upon application, fix a time and place and hear all representa-
tions that may be made by the parties, and the Commission shall,
in a summary manner, when possible, adjust such differences,
and such adjustments shall be final. The Commission shall have
all the powers that may be conferred upon a Commissioner ap-
pointed under The Public Inquiries Act, R.S.O. 1950, Chapter
308.
10. This Agreement shall extend toy be binding upon and
enure to the benefit of the successors and assigns of the
parties hereto.
11. Any waiver by either party or failure to exercise
any right or enforce any remedy shall be limited to the
particular instance and shall not be deemed to extend to any
other matter under this Agreement or in any way affect the
validity of this Agreement.
IN WITNESS WHEREOF the Commission and the Corporation
have caused this Agreement to be executed by the affixing of
their corporate seals attested by the signatures of their

VILLAGE OF PORT BURWELL
October 1954 - By-law 55 passed to hold election to establish the will
of Municipal Electors. The ballot read "Are you in favour
of the establishment of a Public Utilities Commission
for the Village of Port Burwell, the members to be elected
for a two year term commencing with the Commission to be
elected for the year 1956, one half of the Commissioners
to be elected each year?" .
March 1955 - By-law 61 passed to enter into agreement between Hydro
Electric Power Commission of Ontario and the Village of
Port Burwell.
Debentures paid by Village.
Power Corporation Act:
Section 96 gives Hydro authority to prescribe bookkeeping systems,
account keeping, returns, information system.
Section 101 funds collected above current operating requirements
with approval of Hydro may be used for certain purchases.
Public Utilities Act:
(Definition does not include sewer works) .
Section 8 Tie Corporation fixes water rates.
Section 26 All Municipal Corporations owning or operating Public
Utilities (None other can) .
Section 27 Council by by-law sets management , maintenance, conduct
of officers and rates etc.
Section 34 Surplus receipts shall quarterly be turned over to
Council, or oftener if Council objects.
Section 35 Of only Hydro is the utility surplus to be turned over
to Treasurer for certain uses.
Section 36 paragraph 7 and 9: The Commission needs assent of Council
and in certain cases the electors for sale, lease or disposal of
any property.
Section 37 Village has provided for entrusting the construction,
and the control, and management of energy distribution and may with
assent of electors provide for entrusting of water (and sewer system) .
Section 39 Waives electors assent .

Houses where Viotuals are sold to be eaten therein and Places for the
Reception, Refreshment or entertainment of the Public.
The Council of the Village of Port Burwell enacts as follows;
1. No person, firm or Corporation shall keep, operate or maintain a
victualling house, ordinary or house where fruit, fish, oysters, clams
or victuals are sold to be eaten therein or a place where food and drink
are served to the public or for the lodging, reception, refreshment or
entertainment of the public in the Village of Port Burwell unless a lic-
ense therefore shall have been first obtained from the Clerk dB the
Village of Port Burwell
2. Licensee may be issued under this By-law to permit of the keeping,
operating or maintaining of such houses, ordinaries, add places, subject to the
requirements in connection with the issue of same as hereinafter set
out as follows;
(A) A Restamnant Lioense.
(B) A Refreshment or Dairy Bar License
(C) An Ice Cream Stand License.
3• !very person, firm, or Corporation to whom a license is issued under
this By-law shall pay to the Clerk of the Corporation of the Village of
Port Burwell; on obtaining,
(A) A restaurant License,. a fee of two dollars.
(B) A Refreshment License, a fPe of Two Dollars.
(C) An Ice Cream Stand License, a fee of One Dollar.
and every such License shall expire on the last day of December follaaing
the issue thereof. It is understood that this By-law does not preclude
the right of the Village to impose a business tax.
4. Application for such lieensle shall be made in writing to the Clerk of
the Village of Port Burwell on forms to be provided by him and approved
by the Medical Officer of Health of the rlgin St. Thomas Health Unit.

5. The Clerk of the Village of Port Burwell shall issue any such licenses
until he shall have received a certificate from the said Medioal Officer
of Health that the house, ordinary PUI or place for which the License it
to be granted have been inspected by him or his representatives and is
satisfactory to him and in conformity with the provisions of this By-law
for the type of License desired.

7. No keeper or operator of any such house, ordinary or place where fruit
fish, oysters, clams, victuals, foods and drink are sold to be eaten therein
shall suffer or permit any vagrant, drunken or disorderly person or persons
of loose or immoral character to be or remain therein nor shall suoh keeper
or operator permit any disorderly conduct to take place therein.
8. It shall be the duty of the keeper or operator of every such house, ord-
inary or place mentioned in this By-law to see that the provisions of this
By-law are carried out, and any such keeper or operator permitting any violation
of any of the provisions hereof shall be subject to the penalties hereinafter
imposed

shall be subject to revocation at any time by the Council in its discretion,
or on the recommendation of the Y^dioal Officer of Health.

as a restaurant.

and drink, must be properly lighted and ventilated and all plumbing
constructed must be satisfactory to the Medical Officer of Health or
inspectors sating under his authority.
12. All MOM rooms, apartments or places in every house, ordinary or
place set apart for the storage of food or food stuffs shall be properly
lighted and ventilated and must at all times be kept in a atriotly
sanitary condition.
13. All rooms, apartments or places in every house, ordinary or place used
for the purpose of cooking or the preparation of foodstuffs or ice creams
shall be used exclusively for that purpose, and no such rooms or apart-
ments Shall be situate, boated or in the basement of said house, ordinary
or place without the written consent of the !loam]. Officer of Health.
14. All rooms in every house, ordinary, apartment or place used for cooking
and preparing or serving of foodstuffs or ice cream shall have floors and
walls so constructed as to exclude, rats, mice vermin, eto., and kept in a
state of good repair. Floors must be either of impervious material or of
hardwood with tight joints or covered with linoleum.
15. No dogs, cats, or other animals shall be allowed in any house, ordinary
apartment or place where food or ice cream is kept or prepared.
16. The rooms in every house, ordinary, apartment or place must be kept
in a strictly sanitary condition at all times. The malls and ceilings
of any apartments or rooms used for looking and preparing foodstuffs or ice cream
shall be painted light color with enamel finish or whitewashed. If painted
they shall have two coats of paint, which must be renewed at least every two
years. If whitewashed, the whitewashing must be renewed every six months.
17. The portion of the walls os said rooms for six feet from the floor must
be so constructed and finished as to be capable of being thoroughly cleansed
with soap and water as frequently as may be required to keep them clean at
all times.

18. All furniture, tables, counters, ranges, stoves, etc. , and all appliances
in such rooms shill be so arranged as to permit of ready and easy cleaning
and all utinsels, implem$n#s, furniture, and other appliances shall be kept
and maintained in a clean and sanitary condition.
19. No alseping-rooms, lavatories or washrooms shal be within the room or
apartments used for the preparation or cooking of foods or ice cream for the
storing of foods, nor shall they communicate directly with such rooms, but
tither with the open air, or through a properly ventilated and lighted
passageway.
20. To wearing apparle, boots, shoes, or other wearing effebts not being worn
shall be kept in any kitchen, or place where food or ice cream is prepared, and
suitable place seperate from said roome, shall be provided for such clothes.
21. All such houses, ordinaries, apartments, restaurants, or places shall
maintain for the used of cooks, helpers and others engaged in the preparation
or cooking or serving of footle, sanitary toilet and washing facilities
satisfactory to the ti'edical Officer of Health.
22. Any person so engaged visiting any sanitary convenience must always care?
fully wash the hands with soap and water before returning to his or her duties.
23. No parson shall work or be employed In or about any ahoh house, ordinary
apartment, restaurant, kitchen or place due ng the time in which there is any
communicable disease in his home, nor thereafter until the quarantine has been
removed by the Health Unit. No person shall be employed in or about any such
house, ordinary, apartment, restaurant, kitchen or place wile is suffering
from any communicable disease.
24. If any sleeping places are located on the same floor as the Restaurant
theyshall be well ventilated and lighted and must not communicate directly
with the aforesaid rooms.

26. All working men and employees, while engaged in the handling or peep-
aration of food or ioe cream shall be provided with ilippers or shoes, and
a suit of washable material, trMch shall be used for that purpose only.
Those garments must be kept clean at all times.
26. All said houses, ordinaries, apartments, restaurants, or places shall
provide, in places where foodstuffs or ice cream are kept, prepared, cooked
or served to oustomes, full protection frok dust, dirt, flies, and vermin, by
glass oases, where necessary, or wire screens and other modern methods, and
shall cause the abatement and destruction of flies and vermin whenever found.
27. All such houses, ordinaries, apartments, restaurants or places shall be
equipped with covered metallic cans for retaining and keeping their garbage
and haste in a sanitary eonditionwhioh shall be ke-t in such plaoe and manner
as will preclude nuisance and contamination of the kitchen and such rooms from
odors, and all such refuse must be removed from the premises at least once in
every twenty-four hours.
28. All such houses, ordinaries, apartments, restaurants or places shall be
provided with a store-room or suitable place for the keeping of food and
foodstuffs; and all refigerators shall be kept thoroughly cleaned in all parts
and drained in a sanitary manner, but no refigerator shall drain by direct
communication with any suer.
29. No dry sweeping shall be permitted in any house, ordinary, apartment
restaurant or place where food or ice oream is prepared or served for human
consumption.
30. Restaurant =II kitchens and other rooms connected -therewith and ref-
resment and Dairy Bars shall be provided with ample facilities for washing
and sterlising all utins-la, and with a proper supply of hot and cold water.
Sinks may be of porcelain, cast iron, enamelled, wood lined with 14 ounoel
copper. There must be two or more where necessary. The section used for
sterlising must be at least twelve inches deep and of sufficient else to do
the work properly. Sinks must be put in place in a secure manner. All work
done in connection with waste pipes and water pipes must be tO the satis-
faction of the Medical Officer of Health.
31. Milk and butter shall be kept in an ice-box or refigerator separate from
meat, vegetables and other articles of food.
32. All kitchen and dining-rem floors shall be carefully mopped and cleaned
or oiled at least once In every twenty-four hours.
33. All knives, forks, spoons, dishes and other tableware shall be thoroughly
washed and cleaned to the satisfaction of the Medical Officer of Health,
34. No table linens, anpkins, etc. shall be permitted to be used for a
second person.
35. All roosts and apratments in shah houses, ordinaries, restaurants, or places
where foodstuffs or ice cream are stored, prepared, cooked or served shall be
adequately screened and protedted from dust and flies from April 1st. to
November 15th in each year.
36. No clothe or towels shall be used for washing, wiping or drying table
MU or counter tops after a reasonable degree of soiling. In cases of repeated
failures to comply Faith this provision the Medical Officer of Health or the
Sanitary Inspector may require the use of table cloths or paper serviettes
to cover such tables or counters.
37. No cloths or towels shall be used for the drying of dishes and, or
outl ,ry after a reasonable degree of soiling and wetting.
38. gash basins and toilets for use of the public must be thoroughly 'mashed and
a suitable sterlising solution applied to all sources of human contact at least
once a day. The floors and walls must at all times be kept clean. Single service
towels, or paper towels, may be used. In places where odors occur, a suitable
deodorant must be used.

40. No fruit, fish, oysters, clams, victuals, foods, or drink other
than milk and milk products, soft drinks and bottled drinks, sandwiches
confectionery, ice cream and ioe cream dishes shall be served in or
from any house, ordinary or place licensed as a Refreshment or dairy Bar.

41. Sections numbered 1 - 9 inclusive and Sections numbered
11, 13, 14, 15, 16, 17, 18, 19, 20, 22, 23, 24, 25, 28, 27, 28, 29,
32, 35, 36, 38, and sections 41 to 44 inclusive of this By-law shall
apply to persons, houses, ordinaries, places or vehicles licensed
as an ice cream stand,
42. No fruit, fish, oysters, clams, victuals foods or drinks other
than ice cream and bottled drinks ( soft ) shall be served in or from
any house, ordinary place or vehicle lio need as an Ice Cream, Stand
and then only from and Ice Cream or soft drink Cabinet.
43. No Ice Cream or drinks may be served in a house, ordinary or place
licensed as an Ice Creme Stand except from a container disposed of after
being used once or from its original bottle container, and no such
container may be used more than one timo.
44. Any persons convicted of a breach of any of the provisions of this
By-1ati shall forfeit and pay, at the discretion of the convicting
1agistrate, a penalty not exceeding the sum of fifty dollmma for each
offence, exclusive of costs, and in default of payment of the said
penalty and costs forth with, the said penalty and coats, or the costs only,
may be levied by distress and sale of the goods and chattels of the offender
and in case of there being no distress found of which such penalty can be
levied, the convicting ?agistrate may commit the offender to the common
Goal of the County of Elgin, rith or without hard labour, for any period
not exceeding six calendar months unless the said penalty and coat ( if any)
including the cost of the said distress 01012211 and of the committal and
conveyance of the offender to the said goal are sooner paid.

A By-law to regulate the keeping of Domestic Foil within the limits of
the Village of Port Burwell Ont.
WHEREa8 Section 388 ( 1 ) Sub-Section 1 of the Municipal Aot ( R.S.O.
1950 Chapter 243 ) provides that
By-laws may be passed by the Councils of Local Municipalities, for the
regulating and keeping of Domestic Fowl, or pigeons, or cattle, goats,
swine,rabbits, mink, foxes, or other animals, or kennels for the based".

And WHEREAS it has been deemed expedient by reason of claim having been
made on the Village for payment for Fowl ( killed by dogs, or other
animals ) that were allowed to run at large.
Now THEREFOR the Hunioipalrgr Counoil of the Village of Port Burwell in
the County of Elgin, enacts as follows/
1. That all Domestic Fowl be confined in a proper shelter or runway,
constructed of suitable mire mesh, high enough, or with a ceiling that
the Foal cannot fly over, and strong enough to resist the depraditions
of outside animals.
2. That this Munddipality shall not be responsible for any Fowl that are
killed or maimed whilst running at large, outside such described regular
enclosure, whether such Fo i escaped accidently, or nem: released int..
entionally.
3. When the perpaItrators of the Act are nuknown, and only then, when
the aggregate weight of the Fowl killed ]6L NELSO, in such enclosure
exceeds fifty pounds in all xill the Village be responsible, and only
then MS after positive proof,,, that the enclosure was deliberately
broken into from the outside.
4. When the owner of the dog or animal involved MIMI in the killing
is known to the Plaintiff, such knowledge should be given to the Clerk
of the Municipality immediately, when legal proceedings will be instit-
uted, and the defendant if found guilty of neglect or other wilful cause
shall be required by law to make restitution in full to the Plaintiff
through the Municipality.
5. PENALTYFOR VIOLATION OF THIS ORDXNANCE
The Owner who releases his or her Fowl intentionally, so as to cause
a Public nuinsanoe, in contravention of this By-law shall be prosecuted
before a Police Magistrate, and when convicted, a fine of not more than
fifty dollars, and not less than ten dollars, shall be imposed , recovera-
ble under the Summary Convictions Act.

to meet until the taxes are collected the current expenditures of the Municipality
for the year, including the amounts required for the purposes mentioned in subsection
(1) of section 339 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest,which may be
paid in advance or otherwise, at a-rate not exceeding 5 per centum per annum.
2. All sums borrowed pursuant to the authority of this by-law,as well as all other sums
borrowed in this year and in previous years from the said Bank for any or all of the
purposes mentioned in the said section 339, shall, with interest thereon, be a charge
upon the whole of the revenues of the Municipality for the current year and for all
preceding years as and when such revenues are received.
3. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

A By-law to provide for submitting a certain proposed
by-law for the assent of the qualified electors of the Village
of Port Burwell;
WHEREAS a proposed money by-law of the Council of
the Corporation of the Village of Port Burwell entitled "A By-
law authorizing the borrowing of Forty Thousand dollars upon
debentures for the purpose of purchasing the electrical dis-
tribution system of the Hydro Electric Power Commission of
Ontario within the limits of the Corporation of the Village of
Port Burwell," requires the assent of the electors of the
Corporation qualified to vote on money by-laws;
NOW THEREFORE THE COUNCIL OF TH1] CORPORATION OF THE
VILLAGE OF PORT BUFUhLL enacts as follows:-
1. There shall be submitted for the assent of the
electors of the Corporation qualified to vote on money-by-laws,
the proposed money by-law of the Council of theCorporation
entitled "A By-law authorizing the borrowing of Forty Thousand
doll. re upon debentures for the purpose of purchasing the
electrical distribution system of the Hydro Electric Power

A By-law to provide for the submission of a certain
question for the opinion of the qualified electors of the
Village of Port Burwell.
HLHEAS the Council of The Corporation of the Village
of Port Burwell deems it advisable to submit to the vote of
the electors of the Corporation qualified to vote on Honey by-
laws, a question as to whether the said electors are in favour
of securing a supply of electrical power or energy from The
Hydro-Electric Power Commission of Ontario;
