C-07/E09 SUBJECT: CENTRE STREET DRAIN — NORTH AWARD CONTRACT BACKGROUND: The purpose of this report is to recommend the acceptance of the lowest complete tender bid for the provision of drainage works for the Centre Street Drain - North. The final reading was given to Provisional By-Law No. 2017-078 that provides for the construction of the Centre Street Drain — North on October 5, 2017. The estimated cost of construction as per Spriets report # 213217 is $ 56,915.00. Tender forms were prepared by Spriet Associates. The tender invite notice provided for a closing date of October 10, 2017 at 12:00 pm. The following tenders were received by closing: 1. VanBree Drainage and Bulldozing Limited (received Tender Form and Certified Cheque in the amount of$7,880.00) tender in the amount of $69,700.00 (plus HST) to commence work on or before April 1, 2018 and to complete work on or before July 31, 2018. 2. Froese Excavating Ltd. (received Tender Form and Certified Cheque in the amount of $14,241.16) tender in the amount of$126,028.00 (plus HST) to commence work on or before January 2, 2017 and to complete work on or before February 2, 2017. (Dates are as submitted on Form of Tender) DISCUSSION: The engineer's estimated cost for construction of the works as contained within the report is $56,915.00. Section 59(1) of the Drainage Act states that where the contract price exceeds 133% of the engineer's estimate of the contract price, Council of the initiating municipality is required to call a meeting to deal with the necessary modifications. The lowest tender bid amount was $69,700.00 which is under 133% of Engineers estimate; therefore the tender of the lowest bidder can be accepted. RECOMMENDATION 1. The two pieces are to be consolidated with the adjacent existing residential parcels to the southwest of the subject lands. The subject lands are described as Concession STR Part Lot 124, known municipally as 8984 Plank Road. The subject lands are designated "Residential” on Official Plan Schedule "B" Straffordville: Land Use and Constraints. The lands are zoned Village Residential (R1) on Schedule "F" Straffordville in Zoning By-law No. Z456-2003. Elgin County Land Division Committee will consider the application on November 1, 2017. DISCUSSION: The proposal suggests severing to add to the adjacent parcels previously severed from this property in 2005. The planner's memorandum dated October 5, 2017 analyzes the applications subject to the Elgin County Official Plan, Bayham Official Plan and Zoning By-law policies. The applications meet the criteria for the boundary adjustment policies subject to the recommended conditions. We have completed our review of the consent application submitted by Johan and Anna Banman for lands located at 8984 Plank Road, east side and south of Sandytown Road in the village of Straffordville. The applicant is requesting consent for severance of 1,987 m2 (0.4 acres)_of land; and for severance of 1,485 m2 (0.3 acres) of land and to retain 5003 m2 (1.2 acres) of land. The intent of the proposed is to consolidate each severed portion with the adjacent existing residential parcels to the southwest of the subject lands. The lands are designated Residential on Schedule "B" Straffordville: Land Use and Constraints. The lands are zoned Village Residential (HR) on Schedule "F": Straffordville in Zoning By-law Z456- 2003. 2. The land intended to be severed is the vacant south eastern half of the lot. The retained lot is irregularly shaped, having a lot frontage of 20 m (66 feet) and a lot depth of 117 m (384 feet), to remain unchanged. The retained parcel comprising of a single family dwelling, a shed and a coop. Severed parcel#1 comprises of the southernmost portion of the lands to be severed and is intended to be consolidated with the adjacent residential parcel to the west, comprising of a single detached dwelling. Severed parcel #2 squares off the southern boundary of the retained lands and is intended to be consolidated with the adjacent residential parcel, comprising of a single detached dwelling and accessory garage/shed. No construction has been proposed on the lands. The newly expanded parcels, subsequent to consolidation, will be approximately the same depth as the three parcels to the south, aligning with the boundary of the settlement area of Straffordville. 3. The Elgin County Official Plan Section El General Development Policies includes policies for consent applications. Section E1.1.3.2 Boundary Adjustments indicates that consent is permitted for the purpose of modifying a lot boundary without creating a new lot. The applicant proposes to sever the lands for lot addition to the existing residential lots, without the creation of a new lot. The proposed boundary adjustment will not affect the viability of the use of the properties affected due to the retained lands having adequate remaining land area for continued residential use, also creating a less irregular lot configuration while enhancing the two enlarged properties. The current lot configuration and the proposed change does not affect the viability of the agricultural parcel to the east. The proposed consent is in conformity to the Elgin Official Plan based on the above policies. According to Statistics Canada, there are 1.17 million employers in Canada and of these, 98 per cent are considered small businesses. These small businesses are the backbone of our economy and employ over 90 per cent of working Canadians. In East Ferris our businesses are owned by hard-working individuals who have taken risks, worked long hours away from their families and have created many employment opportunities for their employees. The proposed tax changes jeopardize the viability of their small businesses. The changes target their ability to save and protect their company against potential —and often inevitable — economic downturn and, in turn, protect their employees'jobs. They inhibit how an entrepreneur chooses to compensate family members and plan for succession of the family business to their next generation. The entrepreneurial spirit requires the fortitude to risk everything that you have, and running a small business is not without significant risk. Overall, the rules are clearly viewed as a punishment to small business owners and an expropriation of the earnings of their savings. Small business owners generate jobs and wealth, without their entrepreneurial spirit and willingness to risk, the economy would be stagnant. The proposed rules are not closing loopholes -they fundamentally change the taxation of small businesses. We would respectfully request that you share these concerns with the Minister of Finance and seek his support in having them reviewed and addressed. CARRIED c) LPRCA PARKS UPDATE Staff provided an update on the status of the safety review at Haldimand by the Electrical Safety Authority (ESA). The ESA is satisfied with the work done to date and staff is preparing the tender for the next phase of the upgrades. The water systems at Norfolk created difficulties for the staff before the Civic Holiday long weekend due to a major storm. Deer Creek is closed for the season although the 12 seasonal campers remain until October 15th. The TD Grant Trail project is ongoing at Backus. Board members were invited to participate in the volunteer day. Waterford North is still waiting for Hydro One to deliver a plan to upgrade the hydro system to the park. CARRIED f) NDMP REPORT LPRCA is mandated by the Province to operate and maintain a flood forecasting and warning system. LPRCA takes part in municipal emergency response systems by providing information to the flood coordinators to aid in decision making, as well as, issuing flood bulletins to provide early notice to municipal flood coordinators, emergency responders and the public. The existing equipment is dated and has not kept pace with technology and the current standards of practice in Ontario. Staff would like to apply to the National Disaster Mitigation Program to upgrade the flood forecasting and warning system. MOTION A-208/17 moved: R. Geysens seconded: M. Since AECOM had completed the safety reviews for both dams, and had indicated an intent to prepare a proposal, staff requested AECOM to complete and submit said proposal. This includes greater flexibility in setting the vacancy/ excess land reduction rate on commercial and industrial properties. The local treasurers agree that vacancy/excess land ratios should be unchanged for 2017, but are processing changes for future years. Delaying ratio changes until next year but announcing those changes in 2017 will give proper notice to businesses of changes to their taxes. DISCUSSION: Properties that are left vacant/excess land for extended periods of time undermine their communities as the properties become derelict and the rural downtowns become less appealing to consumers. The current policy of providing a reduction/rebate for being vacant/excess land rewards properties that are negatively affecting their business neighbours. Currently the county share of the vacancy/excess land reduction is approximately $80,000 and municipal partners would have an approximate equal value. Starting in 2018, the local treasurers are recommending that the vacancy/excess land program be eliminated. The county's Community Improvement Plan (CIP) program could be provided ongoing annual funding of$80,000 as a result of the increased taxes received by the elimination of the vacancy/excess land program. The CIP scoring matrix could be modified to prioritize vacant/excess land buildings. Investments in upgrading vacant/excess land buildings will likely have the greatest impact for every CIP dollar spent. Upgraded vacant/excess land buildings are ultimately more likely to become occupied. By reducing the number of vacant/excess land buildings, all businesses should benefit as the communities become more appealing to consumers. A separate report will be brought forward later this year to discuss changes to the CIP scoring matrix based on the experience gained during its first year in operation. The proposed changes to the scoring will include a vacancy/excess land component. Once the CIP changes are finalized, the Economic Development department will conduct information sessions for owners of vacant business properties. These sessions will have two objectives: • to inform that $80,000 annually for the CIP program will be funded through the elimination of the vacancy rebate; and, • to educate about how the CIP program grants can be used to upgrade vacant facilities. Counties that decide to modify the program must notify the Minister of their intent to utilize this flexibility and provide details of the proposed changes along with a council resolution. Changes to the rebate and reduction programs will be implemented through regulation for each municipality. RECOMMENDATIONS: THAT the vacancy/excess land rebate program be eliminated starting with the 2018 taxation year; and, THAT the tax ratio on vacant/excess land commercial and industrial properties be set to the same ratio as the occupied classes starting with the 2018 taxation year; and, THAT Council notify the province of the elimination of the vacancy/excess land rebate/ reduction programs starting with the 2018 taxation year; and, THAT copies of the resolutions from the Vacancy/Excess Land Reduction/Rebate report dated September 8, 2017 be forwarded to local municipalities; and, THAT the local municipalities be requested to send out a notification letter with the next tax bill notifying vacant/excess land property owners of the elimination of the rebate/ reduction program; and, THAT information/education seminars be conducted to inform local businesses of the availability of Community Improvement Plan (CIP) grant funding to upgrade vacant facilities funded by the elimination of the vacancy rebate; and, THAT $80,000 be added to the Community Improvement Plan (CIP) budget for consideration in the 2018 budget deliberation. All of which is Respectfully Submitted Approved for Submission Jim Bundschuh Julie Gonyou Director of Financial Services Chief Administrative Officer Alan Smith General Manager of Economic Development Ontario Ministry of Finance VACANT UNIT REBATE AND VACANT/EXCESS LAND SUBCLASSES January 2017 Since 1998,the Vacant Unit Rebate and Vacant/Excess Land Subclasses have provided tax rebates and reductions to property owners who have vacancies in commercial and industrial buildings or land. • Vacant Unit Rebates:The Vacant Unit Rebate provides a tax rebate to property owners who have vacancies in commercial and industrial buildings. This application-based program is administered by municipalities. The current rebate is 30%of the property tax for vacant commercial space and 35%for vacant industrial space. • Vacant and Excess Land Property Tax Subclass: Commercial and industrial properties or portions of these properties in the Vacant and Excess Land Property Tax Subclasses are taxed at a fixed percentage rate below the tax rate of the broad class. These properties are discounted at 30%to 35%of the full Commercial and/or Industrial rate. Currently, upper- and single-tier municipalities may choose to apply the same percentage of relief(between 30%- 35%) to both the commercial and industrial property classes. NEW MUNICIPAL FLEXIBILITY FOR 2017 AND FUTURE YEARS The Province has reviewed the Vacant Unit Rebate and the Vacant/Excess Land Subclasses in consultation with municipal and business stakeholders. In response to municipal and other stakeholders' requests, the Province is now moving forward with providing municipalities broad flexibility for 2017 and future years. This change, announced in November 2016, is intended to allow municipalities to tailor the vacant rebate and reduction programs to reflect community needs and circumstances,while considering the interests of local businesses. In order to provide the most flexibility for municipalities, changes to the rebate and reduction programs will be implemented through regulation. Upper-and single-tier municipalities that have decided to change the programs can notify the Minister of their intent to utilize this flexibility and provide details of the proposed changes along with a council resolution. To support implementation of changes to the vacant rebate and reduction programs, municipalities should review the attached checklist prior to submitting a request for changes to the Minister. IMPLEMENTATION Municipalities wishing to utilize the flexibility available to them must submit details of proposed changes to the Minister along with a council resolution by one of the following dates to ensure amendments are included in a regulation as soon as possible. • March 1, 2017 • April 1, 2017 • July 1, 2017 Municipalities will be notified when the regulation implementing the requested changes has been enacted. Note that in two-tiered municipalities, any program changes to be implemented will be an upper-tier municipal decision, consistent with the flexibility currently available to upper-tier municipalities, to determine the rebate and reduction percentage between 30%and 35%. The Province has an interest in continuing to ensure tax competitiveness and consistency for taxpayers and as such,the Minister will consider proposed program changes within this context. Disclosures of Pecuniary Interest: none The Chair introduced the Source Protection Program Manager for the Lake Erie Source Protection Region, Martin Keller, from the GRCA. Mr. Keller provided some history and background on the Source Water Protection Program, the Source Protection Committee, and the process completed to date including the development of the Proposed Source Protection Plan. M. Keller noted that the Walkerton water tragedy of 2000 led to the development and implementation of a multi-barrier approach to protecting drinking water from source to tap. He added the Clean Water Act, 2006 sets out the first step in the multi-barrier approach, the protection of drinking water at its source. The Source Water Protection Program has identified sources of municipal drinking water, risks to those sources from contamination or overuse, and how those risks can be mitigated or eliminated. Long Point Region, Grand River, Kettle Creek and Catfish Creek conservation authorities partnered to create the Lake Erie Region Source Protection Region. It is one of 19 source protection regions across the Province going through the same process. The Lake Erie Region Source Protection Committee is the body that has guided the development of the Proposed Source Protection Plan. The Committee consists of 25 members representing a variety of interests, including: municipal representatives; economic interest representatives from the agricultural, business and industry and aggregate sectors; public interest representatives and First Nations representatives. 4. New Business a) Source Protection Authority Responsibilities LPRCA exercises the powers and duties of a Source Protection Authority, while the Grand River Conservation Authority is the lead Source Protection Authority within the local Source Protection Region. The Source Water Protection Program Manager reports to the Lake Erie Region Management Committee, which is comprised of the four Chairs and four General Managers of the conservation authorities within the Lake Erie Region. Responsibilities include submitting key documents to the Province, completing annual progress reports, assuring that documents are made available to the public, and implementing policies where they are identified as the implementing body. The Program to date has been funded by the province but long-term, sustainable funding has yet to be committed. Discussion included how Source Protection Plan policies will be implemented, the effects of Plan policies on zoning, and how the Province has considered previous Source Protection Authority comments regarding implementation and stewardship support. CARRIED b) Source Protection Plan Submission The first Proposed Long Point Region Source Protection Plan was submitted to the Ministry of Environment in 2012. In 2014, the Ministry suggested that revisions be made to the Proposed Plan to meet Clean Water Act, 2006 requirements. New or updated information about the Municipality of Bayham's Richmond system and the northern Tillsonburg wellfields were amongst the updates included in an Amended Assessment Report. Updates made to the Assessment Report and Source Protection Plan went through the required consultations and were subsequently released by the Source Protection Committee to the Long Point Region Source Protection Authority. These documents are now to be submitted to the Ministry of Environment and Climate Change for approval. Discussion ensued about the public consultation process and notifications, and the comments other Source Protection Authorities have included in their submissions to the Ministry. Work to include removing all non-functional roof penetrations (old heat pipes etc.) b. Repair of any damaged wood when steel removed etc. (if any). On Friday July 28, 2017 RFT 16-04, Public Works Garage Roof Replacement was issued. No bids were submitted during the initial tender period with Contractors informing the Municipality they were too busy to take on the works, even though seven (7) Contractors attended the site meeting. After further discussion with the Municipal Engineers the Municipality issued RFT 17-03 Straffordville Public Works Facility Renovation Project which included both the interior and exterior works Council directed staff to issue tender for. Generally the scope of works for the combined tender is as follows: 1) Phase 1 a. Removal and replacement of the existing steel roof including eaves trough, fascia, soffits and downspouts. i. Work to include removing all non-functional roof penetrations (old heat pipes etc.). ii. Repair of any damaged wood when steel removed etc. (if any). 2) Phase 2 a. Remove contaminated insulation where required. b. Remove deteriorated drywall where required. c. Encapsulate all ceiling drywall with interior metal liner panel. i. Ceiling in shop would be interior metal liner panel versus drywall. d. Remove wood paneling and replace deteriorated walls with interior metal liner panel and refine the layout of Bay 1 workspaces. e. Replace interior galvanized water pipes. f. Replace interior corroded electrical (where required). g. Barrier free washroom on main floor and an accessible exterior entry door (appropriate door hardware throughout). DISCUSSION RFT 17-03 Straffordville Public Works Facility Renovation Project closed on October 12, 2017 with bids as follows: BIDDER BID Drier Construction Group Ltd. $308,327+HST Franklin Construction Ltd. $345,626.90+HST SDI Builders Ltd. $351,000+HST Reid & DeLeye Contractors Ltd. $390,764.69+HST The Engineer Team recommends moving forward with award of the Public Works Facility Renovation Project to Drier Construction Group in the amount of$308,327+HST. For Council information the cost to replace the exterior roof, with the same method as currently exists, included in the Drier Construction Group bid price is $32,395.00+HST. To upgrade to the VicWest Elite metal roofing system, similar to the new roof on the Straffordville Community Centre would be an additional $26,965.00+HST. This addition would bring the total project cost to $335,292+HST. The roof works are intended to be completed by December 1, 2017 with the remainder of works completed by April 30, 2018. The July 20, 2017 resolution contemplated funding the works, with an upset limit of$350,000, as follows: THAT Report CAO-44/17 re 8354 Plank Rd. — Public Works Garage be received for information; AND THAT staff be directed to tender for Phase 1 Works, as outlined within Report CAO 44/17, with funding from proceeds from the sale of 31 Elizabeth St, Port Burwell Ontario. AND THAT staff be directed to tender for Phase 2 Works, as outlined within Report CAO 44/17, with funding from proceeds from the sale of 31 Elizabeth St, Port Burwell Ontario and 9344 Plank Rd, Straffordville Ontario. AND THAT should 9344 Plank Rd. not be sold prior to commencement of Phase 2 works staff be directed to utilize the Building Vehicle Reserve $30,000 and OMPF Reserve $213,866 to fund Phase 2 AND THAT if OMPF Reserves are utilized for Phase 2 staff be directed to allocate proceeds from sale of 9344 Plank Rd. to the OMPF Reserve when received.
