ADJOURNMENT -$AYHAdvz jj _pv • REPORT o .;.y CAO pPortunity Is..io�► TO: Mayor & Members of Council FROM: Paul Shipway, CAOICIerk DATE: August 1, 2017 REPORT: CAO-53/17 SUBJECT: PHASE 1A- STORMWATER MANAGEMENT IMPROVEMENTS ROBINSON STREET REHABILITATION (BROCK STREET TO THE BEACH) - CONTRACT NO. 20170619 BACKGROUND On Friday July 7, 2017 RFT— Phase 1A— Stormwater Management Improvements — Robinson St. Rehabilitation (Brock St. to the Beach) — Contract No. 20170619 was issued, a copy is attached hereto as Appendix 'A' (included is a diagram of the improved Robinson St. turning radius for large vehicles and a visual depiction of the bio-swale). RFT— Phase 1A— Stormwater Management Improvements— Robinson St. Rehabilitation (Brock St. to the Beach) — Contract No. 20170619, closed on July 26, 2017 at 2:00 PM. DISCUSSION The results of RFT— Phase 1A— Stormwater Management Improvements — Robinson St. Rehabilitation (Brock St. to the Beach) — Contract No. 20170619 are as follows: VENDOR BID PRICE Oxford Civil Group $502,681.53+HST R.F. Almas Company Ltd. $436,537.74+HST Meritech Engineering, the Municipal Engineer managing the project has reviewed the submission and the Meritech Engineering recommendation letter is attached hereto as Appendix 'B'. The Meritech Engineering and Project Management fees on this proposed project are $34,399+HST. The 2017 Capital Budget included Capital Item PW-13 - Stormwater Management Improvements in the amount of$476,000. The Capital Item contained two components: 1) Detailed Design — Phase 1 - $117,130+HST 2) Phase 1A— Stormwater Management Improvements — Robinson St. Rehabilitation (Brock St. to the Beach) - $358,870+HST On May 18, 2017 the Council of the Corporation of the Municipality of Bayham passed By-law No. 2017-051, being a by-law to authorize the execution of an agreement with Her Majesty the Queen in Right of Ontario for the provision of Clean Water Wastewater Funding in the amount of$322,910.00. The R.F Almas Company Ltd. Bid Price includes Contingency Funds in the amount of$37,450+HST which may or may not be actually incurred during the project. Detailed Design Phase 1 is complete on budget. Phase 1A— Stormwater Management Improvements — Robinson St. Rehabilitation (Brock St. to the Beach) requires an allocation of funding in the amount of$84,966.72 to $122,416.72 depending on how much, if any, of the contingency is utilized during construction. The initial figure utilized for budgeting was completed prior to completion of Detailed Design for grant purposes. Detailed Design revealed the entire southern portion of the Robinson St. turnaround is built upon gabion baskets which complicates the project scope of work. Three options to fund the allocation include the following: 1) 2017 Surplus 2) OMPF Reserve 3) Gas Tax Reserve, Transfer Station Reserve Staff would respectfully recommend that at year end the allocation be made utilizing a combination of reserve allocation and in-year surplus, presented and allocated in the Treasurers year end staff report. The Treasurer concurs with the above noted funding proposal. Completing Phase 1 a of Phase 1 of the Stormwater Management Improvements is critical for two main reasons pertaining to future grants: 1) Provides the basis for the demonstration of incrementalism for the Stormwater Management Improvements in Port Burwell. Incrementalism is a key component of the OCIF Top-up Program that the Municipality is currently utilizing in Richmond and is eligible to make application for again in 2018. 2) Provides demonstrated improvements to water quality and control with the implementation of a bio-swale. This is an identified critiera within FCM funding, OCIF funding and the proposed Infrastructure Phase 2 Federal funding expected for the spring of 2018. ROAD CLOSURE To complete the works, Robinson St. from Brock St. to the Beach will be required to be temporarily closed during construction. Although complete closure of Robinson St. from Brock St. to the Beach is optimal, timing of grant funding announcement approval and deadlines to complete works prompted the engineer to make this recommendation. The contractor proposes the working days for the project to commence on or about September 25, 2017 and to continue for 20-30 days. RECOMMENDATION 1. THAT Report CAO-53/17 re Phase 1A— Stormwater Management Improvements — Robinson St. Rehabilitation (Brock St. to the Beach) — Contract No. 20170619 be received for information; 2. AND THAT staff be directed to bring forward a by-law, to enter into an agreement with R.F. Almas Company Ltd. in the amount of$436,537.74+HST for the provision of Phase 1A— Stormwater Management Improvements — Robinson St. Rehabilitation (Brock St. to the Beach) — Contract No. 20170619. 3. AND THAT staff be directed to provide notice of the Temporary Road Closure of Robinson St. from Brock St. to the Beach during construction. The following items are significant works included in the tender: 64 metres of storm sewer and appurtances, 2500 tonnes of granular road sub-base and base, 250 metres of concrete curb and gutter, 300 tonnes of base pavement, 200 tonnes of surface pavement, 200 square metres of concrete sidewalk and miscellaneous surface works such as installation of a bio-swale at the beach and landscaping. The tenders will be opened publicly at the Municipality of Bayham, 56169 Heritage Line, Straffordville at 2:15 pm, Local Time, on the date of closing. Digital copies of the Plans, Specifications and Tender documents can be obtained from Meritech Engineering via the contact information below. Should paper copies be required, these are available at the office of Meritech Engineering, 1315 Bishop Street North, Suite 202, Cambridge, ON N1 R 6Z2 for a non- refundable fee of$100.00 (includes HST)per set, made payable to Meritech Engineering. Documents may be picked up after 10:00 am on Monday, July 10, 2017. A Bid Bond in the amount$5,000.00 must accompany each Tender. The successful bidder will be required to furnish a 100% Performance Bond and a 100% Labour and Materials Payment Bond for the total value of the contract. The lowest or any tender will not necessarily be accepted. Council approval is expected approximately within two weeks of tender closing date and construction is anticipated to commence no sooner than September 5, 2017 pending approvals. 20 working days are allocated for substantial completion of the project and all work is to be completed by December 31, 2017.
