Motion Moved by: Deputy Mayor Southwick Seconded by: Councillor Breyer Be it resolved that the Council of the Corporation of the Municipality of Bayham directs staff to apply for a grant opportunity from the Federation of Canadian Municipalities' Municipal Asset Management Program for the Municipality of Bayham 2017 Comprehensive Asset Management Plan; Be it therefore resolved that the Municipality of Bayham commits to conducting the following activities in its proposed project submitted to the Federation of Canadian Municipalities' Municipal Asset Management Program to advance our asset management program: 1) Request for Proposals for Asset Management Plan Update; 2) Establish Asset Level of Service Policies; 3) Establish Asset Funding Strategies; 4) Redefine the `State of the Infrastructure', and; 5) A Municipality of Bayham 2017 Comprehensive Asset Management Plan. CALLTO ORDER Mayor Ens called the public meeting to order at 7:30 p.m. and asked those in attendance for the Planning Public Meeting regarding an Official Plan Amendment and Rezoning to place their name and contact information on the sign-in sheet provided at the podium. 2. CHAIRMAN'S REMARKS ON THE PURPOSE OF THE MEETING The Chairman stated the purpose and effect of the proposed amendment. 4. PURPOSE AND EFFECT OF THE PROPOSED AMENDMENT A. Application submitted by the Municipality of Bayham The purpose of this By-law is to change the land use designation on a 596 m2 (0.15 acres) parcel of land from "Residential" to Institutional" in the Official Plan of the Municipality of Bayham and to to change the zoning regulations on 1,615 m2 (0.4 acres) of land in the Institutional (I) Zone and Village Residential (R1) Zone to a Special Institutional (1-4) Zone including: to change the zoning regulations on a 596 m2 (0.1 ac) parcel of land from a Village Residential (R1) Zone to a Special Institutional (1-4) Zone in order to recognize the existing use of the lands as one museum zone; to provide relief from the rear yard setback of 4.0 m (13 feet) where 0.1 m (0.4 feet) is provided for the existing building; to provide relief from the minimum exterior side yard requirements of 3.0 m (10 feet) where 2.7 m (9 feet) exists and from a minimum interior side yard of 3.0 m (10 feet)where 1.3 m (4 feet) exists; and, to allow 2017 Council Minutes May 18, 2017 for: the location of an accessory structure in the front yard; to allow for the structure to be in the required side yard; and, to allow the same accessory structure to be closer than the main building to the street in Zoning By-law Z456-2003. The subject lands are located on the southeast corner of Robinson Street and Pitt Street in the village of Port Burwell known as 18-20 Pitt Street. The effect of this By-law will be to to change the lands designation and zoning in order to recognize the existing use and to permit the installation of an historic wheelhouse on the lands in the front yard and within the required exterior side yard setback; one Port Burwell Marine Museum zone; and, to provide for relief from the exterior and interior side yard and rear yard setback regulations. 5. C07 SUBJECT: DZ license driver training with the Township of Malahide BACKGROUND: New requirements have been brought forward by the Ministry of Transportation of Ontario (MTO) for Class D driver's licenses. One of the changes directly impacting the fire service is that all training must now be done under a recognized authority rather than being done in-house. This change comes into effect in 2018. Malahide Fire & Emergency Services has an instructor on staff and the Township of Malahide has undertaken becoming an MTO certified entity. DISCUSSION: Utilizing the services of Malahide would be significantly less costly than the alternative, which is sending each new firefighter out to a truck driving school. It would be cost prohibitive to require recruits to obtain their DZ license as a condition of employment as a volunteer firefighter. The MTO rules require that should training be executed externally, municipalities must put a bylaw in place authorizing other municipalities to become the trainer and record keeper for all trainees. Other Elgin fire departments are taking part in the shared service model. RECOMMENDATION 1. THAT Report FR-03/17 be received for information; 2. AND THAT the Fire Department utilize the services of the Township of Malahide to train Bayham firefighters as required to obtain their DZ driver's license; 3. DISCUSSION: A meeting was held with the Engineer, Drainage Superintendent and land owners in the proposed drain location on March 23, 2016. Surrounding land uses are commercial to the north, vacant to the west and residential to the east and south. 3. The proposed amendments shall be consistent with the Provincial Policy Statement 2014 (PPS). Section 1.5.1 of the PPS indicates that the vitality of settlement areas shall be promoted and social interaction should be fostered. The proposed improvement to the museum property is consistent with the PPS, as the vitality of Port Burwell is promoted by offering residents and visitors a better physical and visual connection to the areas past and by fostering social interaction in this popular tourism and beach area. 4. The proposed amendments shall also be consistent with the Elgin County Official Plan. Section A5.3 of the Elgin County Official Plan promotes upgrading existing tourist destination uses. Section C1.5 Downtown Areas encourages the preservation and enhancement of cultural and historic features. The proposed improvements to the Museum site, with the addition of an historic wheelhouse artifact(the bridge and steering wheel structure of a ship), is consistent with the Elgin County Official Plan. 5. Section 4.5 of the Official Plan of the Municipality of Bayham sets out the policies for Villages and "Institutional" land use designation is permitted in the Village of Port Burwell. The proposed amendment improves tourism and promotes the cultural heritage of the area and provides the opportunity to update the land use policies to reflect the existing use of the lands, and so is consistent with the Official Plan of the Municipality of Bayham. 6. The application proposes to change the zoning of the lands from Residential (R1) Zone and Institutional (I) Zone to a Special Institutional Site-specific (1-4)Zone in order to recognize the existing use of the lands zoned residential to the east and to permit the installation of an accessory structure within the required setbacks and to provide for the future merging of the lands into one property. Museums and Accessory Uses are permitted in the I Zone. Site- specific zoning provisions are required to allow for the following: • To provide relief from the rear yard setback, Section 24.8, of 4.0 m (13 feet) where 0.1 m (0.4 feet) is provided for the existing building; • To provide relief from the minimum exterior side yard setback, Section 24.7, of 3.0 m (10 feet)where 2.7 m (9 feet) exists • To provide relief from the minimum interior side yard of 3.0 m (10 feet)where 1.3 m (4 feet) exists; and, • To allow for the relaxation of requirements in Section 4.2 b)-d): installation of an accessory structure in the front yard; to allow for the structure to be in the required side yard; and, to allow the accessory structure to be closer than the main building to the street. The parcels are considered one lot for the purposes of zoning. The rear yard along the east property line and the exterior side yard along the frontage on Pitt Street. The northern corner of the proposed Wheelhouse is within the setback requirements for lands, however, the proposed location is in line with the northern wall of the existing Museum building and the southern end is in line with the minimum setback to the south property line and so is considered to be an acceptable location for the wheelhouse. There is an existing shed on the south side of the parking lot that is within the side yard setback requirement. The existing shed is located within the minimum side yard setback from the neighbouring residential lot but does not significantly impact the neighbouring lot as the house is oriented to the south of the lot and there is a fence between the properties, therefore, a relaxation of the setback requirements is acceptable in this instance. The proposed by-law amendment is considered to be sound land use planning and therefore is in compliance with the general intent and purpose of the Zoning By-law of the Municipality of Bayham. 7. C-07/E09 SUBJECT: WELLINGTON STREET DRAIN BACKGROUND: The purpose of this report is to hold a Public Meeting to consider Spriet Associates Engineer's Report#216224 received from Spriet Associates dated April 27, 2017 and filed with the Clerk on May 8, 2017. On August 22, 2016 a petition for drainage was filed with the Clerk from Ed Bradfield, Bayham's Road Operations Supervisor. On September 15, 2016, Council appointed Spriet Associates to make an examination of the drainage area and prepare a report for Council's consideration. On May 18, 2017 Council decided to proceed with Notices under the Drainage Act and directed the Clerk to mail a Notice of Public Meeting to all interested parties. A Notice of Public Meeting dated May 19, 2017, pursuant to Chapter D17, Section 41 of the Drainage Act was prepared; and this Notice confirmed that the Municipality will hold a Public Meeting on Thursday June 1, 2017 at 8:00 p.m. to consider the proposed construction of the drainage works known as the Wellington Street Drain. The Notice of Public Meeting and a copy of the Engineer's Report were mailed to: (a) Every landowner within the area requiring drainage. (b) Clerk of every other local municipality in which any land or road that is assessed for the drainage works, or for which compensation or other allowances have been provided in the report is situate. (c) Any public utility, railway company or road authority that may be affected. (d) Long Point Region Conservation Authority. (e) The Ministry of Natural Resources. (d) The Director, of the Ministry of Agriculture, Food and Rural Affairs. Pursuant to Section #42 of the Drainage Act, Council of the initiating municipality shall give an opportunity to any person to withdrawal from the petition, sign the petition or speak to the matter. If, at the end of such Council meeting, the petition contains a sufficient number of names to comply with Section #4, the Council may proceed to adopt the report by giving two readings by Council to the Provisional By-law and set the date for the first sitting of the Court of Revision. In addition, any owner of land assessed for maintenance or repair may appeal from the assessment contained in the Wellington Street Drain report # 216224, which was served upon them by regular mail on May 23, 2017. DISCUSSION: Following the engineer's presentation at the Public Meeting, landowners and all other affected parties are given the opportunity to voice their concerns relating to any aspect of the report. If for any reason the report should be reconsidered, Council may refer the report back to the engineer. In addition landowners in the area requiring drainage shall be given an opportunity to withdraw or add their names to the petition. This shall include affected Municipalities if their lands or roads are within the area requiring drainage. If the petition does comply with Section 4, Council may proceed to adopt the report by giving two readings to the attached Provisional By-Law. RECOMMENDATION 1 THAT in accordance with Sections 44 to 46 of the Drainage Act, Council of the Corporation of the Municipality of Bayham hereby adopts Spriet Associates report#216224 dated April 27, 2017, referred to as the "Wellington Street Drain" report; 2. The consultation process provided municipalities, industry, subject matter experts and members of the public with an opportunity to offer their input and views on the proposed changes. The Ministry welcomed the feedback and I was pleased with the frank responses with respect to septic systems. I have always felt that there are sufficient protections in place to mitigate against septic system failures. Since 1997, there has been a requirement for owners of septic tanks and treatment units to clean out their systems when the working capacity is one-third full. This will continue to be in effect. Mr. Mayor, Councillors, and Mr. Shipway, this letter is to ask , because of our 150 th Birthday of Canada, is it possible to get the flowers in our planters in Port Burwell and Vienna, watered this year. As you know, the flowers and plants are expensive, and without the watering , the money we put into it is wasted. The Horticultural Society is trying to help make, the Community in Bayham, a place of color and smiles. We did have a few meetings with Mr. Shipway a while back, and we were throwing out ideas on how to Beautify Bayham. We know the talks are not over, so until there is a, rule of sorts, could you see your way clear, to help us and together, the opportunities are ours within Bayham. We are also looking for a spot to plant a tree, NATIVE TO OUR AREA. We have a grant, and we are asking for your help, to find a place to plant it, within Bayham, in Port Burwell, or Vienna. Because of the rules of the grant, we have to plant it there. We where thinking of the green area, just east of the pier. If that is ok, please let us know, because of the improvements you are making, we are not sure if that would be a good spot. As long as we are talking, we are also planting in the cenotaph on Erieus St and have done a few improvements, in and around the cenotph, the planters have been painted, the benches have been fixed, and stained, etc. the only thing we are asking is , the boardwalk, where the benches are, is rotten. If we could get the wood for it, we can rebuild it. Also the border around the cenotaph, which are stone blocks, need to be reset and secured in place, so they will not come apart again. Although the SCC's servery is slightly larger than the bar area in the VCC, the VCC also has a stage to accommodate the needs of renters on its main floor. It's understandable that Council would want to factor in operating costs when considering this proposal. The VCC has managerial and custodial costs upwards of$20,000. Costs to pay a facility manager and custodian are not applicable to the SCC while The Straffordville Hall Foundation's operating agreement with the municipality is in effect. In the event that Council chooses to move forward with a kitchen renovation to the SCC in the future, the rates could be realigned with VCC's entire facility rental rates. I encourage Council to recognize the inequity in rental rates, and consider making revisions that reflect equity among amenities and square footage being offered by community facilities. The second concern is the current Community Partner's rate reduction. In the recent past, rate reductions did somewhat obstruct rental revenues; there wasn't a specific criteria that was put in place to determine who should qualify for these reductions. In previous years, our municipality did not face the same level of financial arrears; and as a result, Councils of the past were especially generous in offering rate reductions for community facility bookings. Current Council has since been required to implement measures to reduce expenses. Rate reductions and fee waivers were affected by this action. Current Council members have questioned where to draw the line for groups that would qualify for rate reductions. The suggestion below would propose a clearer understanding of what a Community Partner should embody when developing criteria for the reduction rate. Community Partners should include Non-profit or Charitable organizations who contribute to the community at large through fundraising initiatives, and services provided to the community. This could include but not be limited to: Vienna Lions Club, Vienna Lioness Club, The Straffordville Community Committee, Bayham Beachfest Committee, The Bayham Historical Society, The Straffordville Hall Foundation, Straffordville & Port Burwell School Councils and Parent Committees. Community engagement is imperative in creating safe and inclusive communities. These community partners strive to enhance the lives of the residents they serve. They have enhanced municipal facilities and parks through financial contributions and volunteer work, educated our residents on local history, organized and funded our Santa Claus parade & Easter Egg hunts for our youth, offered family-oriented entertainment and festivals that engage all members of the municipality. This creates a sense of community pride and cohesion. Their efforts to create this improved quality of life should be compensated through affordable rental rates so they may continue to exist within our neighbourhoods, fundraise, and provide events that support community-wide engagement. Community Partners incur a great amount of expenses to be able to fundraise and host the large events in our community. A substantial fee reduction would be helpful in keeping fundraising costs down so groups could make the most of fundraising profits. The many fundraising events held by these groups in our community centres are host to countless residents of our own municipality; but also host to residents of neighbouring municipalities, towns, and counties. All of which, could be considered as potential renters of Bayham's municipal facilities. A suggestion for the Community Partner Rate for Community Facilities: 75% reduction in rate fees *This rate should apply for group meetings as well as fundraising activities. I would encourage Council recognize the importance of having community partners in our municipality, their impact on quality of life in the community, and reflect upon the many ways these committees and groups give back to this wonderful municipality. I ask that Council contemplate adopting a refined definition of the term Community Partner and consider implementing changes to the Community Partner Reduction Rate. Agreement No. 0063-03 outlines the provisions of road maintenance provided by the Municipality of Bayham on Elgin County Roads. Agreement No. 0063-03 expires December 31, 2017. A copy of the February 15, 2017 report of Mr. Peter Dutchak, Elgin County Deputy Director of Engineering Services is attached hereto as Appendix 'A'. Elgin County staff plans on meeting with the area Road Supervisors and the County Solicitor during the coming months to review the existing agreement with a goal of extending the term and making only minor improvements where necessary. Correspondence from the Council of the Corporation of the Township of Malahide concerning the County Road Maintenance Agreement is attached hereto as Appendix 'B'. DISCUSSION As outlined by the Township of Malahide, the current County Road Maintenance Agreement was a significant departure from the previous agreements. The most significant changes were to the specific terms of agreement. The goal of all parties during the last negotiation was to better clarify the terms and conditions in order to remove some of the generality and ambiguity from the contract. The current agreement better defined the scope of services, and the respective roles and responsibilities. Pursuant to Section 4.10 of the current agreement the County has final decision in the event of a dispute or discrepancy: Notwithstanding that set forth in paragraph 4.4 above, the parties further agree as follows: that in the event of a dispute as to the interpretation of the Scope of Services prescribed by the County for the Elgin System, the decision of the County Superintendent shall prevail. This is relevant and fair as Section 39(1) of the Ministerial Order made by Allan Leach on May 15, 1997 reads as follows: The County shall maintain ownership and control of the road system which is vested in the County and over which the County has jurisdiction under the Municipal Act or any other Act. That being said, to continue the trend of improved clarity, staff would propose the following alterations to the existing County Road Maintenance Agreement, largely pertaining to Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services which will provide a limit on lower tier responsibilities and offer reciprocating clauses and indemnity which currently only the lower tiers offer the County. The further clarity should be mutually beneficial to all parties. COUNTY ROAD MAINTENANCE AGREEMENT REVISION CONSIDERATIONS: 1) Section 1.1 (ii)—ensure any and all schedules are provided in digital, fully renderable colour PDF format. 2) Section 2.1 —definitions a. Add the following terms to be defined: i. County ii. Municipality iii. Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services 3) Section 4.4— incorporate a County responsibility as follows: a. Subject to paragraph 4.9 below, the County covenants to perform Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services upon those Road Allowances and bridge/culvert facilities identified in Schedules "A" and "B"hereto, at all times utilizing competent supervisors and workers properly trained in the delivery of road maintenance and repair services as contemplated by this Agreement. 4) Section 4.5— reword to incorporate a County responsibility and end of Municipal responsibility as follows: a. Major Maintenance/Capital Works and/or Road Maintenance/Repair Services in addition to the Scope of Services identified in Schedule "C"may be performed by the Municipality by mutual agreement between the Municipal Superintendent and the County Superintendent. In the event that Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services are required by the County, the County Superintendent shall identify such Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services to the Municipal Superintendent and the Municipality, through the Municipal Superintendent and the Municipality, shall have the option of either seeking to perform such Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services or declining to perform such Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services. If the Municipality chooses to seek to perform such Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services, the Municipal Superintendent shall prepare and deliver a written cost estimate to the County Superintendent, who shall have the option of either accepting the said cost estimate or rejecting such estimate, in which former case, the accepted estimate shall constitute the mutual agreement for such Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services between the parties as referred to above. In the event that the Municipality, in the first instance, rejects the opportunity to seek to perform such Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services or the County, in the second instance, rejects the written estimate prepared and delivered by the Municipal Superintendent, then in either such instances, the County shall be responsible to arrange for the Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services to be performed by a third party contractor other than the Municipality. In those circumstances where the Municipal Superintendent is of the opinion that certain Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services are of an emergency nature and that such notice to the County Superintendent is not practical and, as such, the Municipal Superintendent shall have the right to arrange for and complete those emergency services and shall thereafter notify the County Superintendent within the next working day of the services so provided. The Municipality shall prepare and deliver an invoice to the County for such Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services, including any such emergency services, in accordance with paragraph 5.2 below and the County shall pay such invoice in accordance with paragraph 5.3 below. 5) Section 4.8— incorporate communication of warranty period on County Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services so the Municipality does not conduct works on projects that should be covered under warranty. a. Without limiting the maintenance obligation of the Municipality as set out above or herein, the parties acknowledge and agree that the Municipality shall not be called upon to maintain and/or repair a County road, bridge/culvert facility or highway bridge/overpass pursuant to this Agreement where such County road, bridge/culvert facility or highway bridge/overpass has been constructed and/or reconstructed by the County or a subcontractor retained by the County to a condition which would fail to meet established County standards for such County road, bridge/culvert facility or highway bridge/overpass or contract requirements for such construction and/or reconstruction. To ensure the Municipality is not called upon to conduct services on a County road, bridge/culvert facility or highway bridge/overpass that has been constructed and/or reconstructed by the County or a subcontractor retained by the County to a condition which would fail to meet established County standards for such County road, bridge/culvert facility or highway bridge/overpass the County shall advise the Municipality of the warranty period for Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services and where Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services are required during said warranty period the responsibility for coordination, maintenance and repair of said Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services shall be that of the County. 6) Section 4.11 — incorporate a corresponding County responsibility for Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services. a. The County hereby acknowledges and agrees that Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services undertaken upon County Roads pursuant to this Agreement shall at all times satisfy the obligations to maintain and/or repair County Roads as established pursuant to the Municipal Act, 2001 (Ontario). The County hereby further acknowledges and agrees that its Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services are of a nature and of a quality to satisfy all statutory obligations to maintain/or repair a highway. 7) Section 9.2 — reword to incorporate reciprocating County covenant and reference to applicable legislation. a. The Municipality shall maintain records of its activities undertaken pursuant to this agreement in accordance with the timeframes established in the respective municipal records retention by-law, approved in accordance with the Municipal Act, 2001. S.O. 2001, Chapter 25, as amended, and further thereto, shall allow access to such records to the County Superintendent or his or her delegate, limited only by the provisions of the Municipal Freedom of Information and Protection of Privacy Act R.S.O. 1990, Chapter M.56. The County hereby indemnifies and saves harmless the Municipality its employees, agents, contractors and councillors from any and all claims, demands, losses, costs, damages, actions, lawsuits or other proceedings by whomsoever made, sustained, or prosecuted which may arise either directly or indirectly by any act, neglect or refusal of the County, its servants, employees, agents, invitees or contractors to maintain or repair any Major Maintenance/Capital Works and/or additional Road Maintenance/Repair Services on a County Road in accordance with the terms of this Agreement. 9) Section 11.2 and Section 11.2 — reword depending on County intention a. If County is only going to `reserve the right to approve subcontractors' as outlined in Section 11.1, remove 'upon receiving approval from the County Superintendent' from Section 11.2. If the County intends to approve every subcontractor modify Section 11.1 to indicate said approval is required, not just a County `reserved right'. 10)Section 13.1 — Municipal Address a. Municipality of Bayham 56169 Heritage Line, PO Box 160 Straffordville, ON NOJ 1Y0 Fax: (519) 866-3884 TOWNSHIP OF MALAHIDE CORRESPONDENCE 1) Fence Line-to-Fence line Vegetation Control — County Proposal a. The County of Elgin Staff propose the inclusion of full width roadside mowing and brushing, from roadside shoulder to property line on all the County roads on a three year cycle. This would equate to completing one-third (1/3) of all County roads each year. The Township Staff have no objection to this proposal; subject to the County of Elgin fully funding the program. The Township currently contracts out roadside grass cutting and vegetation control. In an effort to secure better pricing and to provide some stability to the program, the Township has traditionally tendered for a 3 year period. The roadside grass cutting contract is currently out for tender. The tender documents have been prior to release to include provisional items to address this increase in level of service. It is anticipated that there will be increased costs during the period where the program is being established. This is due to the type of vegetation likely to be encountered during the first 3 years of the program. The Township Staff anticipate that a combination of mowing and brushing activities will be required. It is anticipated, that that once the program is established, the ongoing cost to deliver the program will stabilize. Bayham staff generally concur with the assessment provided by Malahide staff. Bayham staff would respectfully recommend the County provide a communication contact and a document outlining the road maintenance provisions considered in clearing County highways fence line to fence line which may be provided to the public seeking explanation of said practice. 2) Bike Lane Maintenance Costs — County-Malahide Proposal a. Firstly, Malahide Staff wish to recognize that the newly constructed bike lanes are a welcome addition to Malahide road network; and the County should be recognized for this initiative and encouraged to continue with the recommendations of the Elgin St. Thomas Cycling Master Plan. To their credit, the County of Elgin Staff from the inception of the bike lanes have recognized that, along with increased capital costs, the bike lanes will likely have additional maintenance costs and monitoring responsibilities. The County, thus far, has paid for those maintenance items that can be definitively related to the maintenance of the bike lanes. During the development of the bike lanes, the County Staff and the Township Staff agreed to undertake regular maintenance and to monitor the ongoing costs so as to develop a funding model that could be included in the new agreement. It would appear that this is being addressed. The Township Staff have no objection to incorporating bike lane maintenance into the new agreement; subject to it being fully funded by the County. The Municipality of Bayham does not presently have any bike lanes or experience to base assessment of the proposal on. That being said, in theory Bayham staff concur with the assessment provided by Malahide staff. 3) Sidewalks — Malahide Proposal a. Currently, sidewalks are not addressed in the agreement. The Township Staff would like to see the obligation for sidewalks that are on County Roads become a County responsibility. Currently, the County does not undertake any capital or maintenance obligations for sidewalks. Under the current arrangement, if a lower tier municipality receives a request for sidewalks on a County road, the County's position is that the obligation to install and maintain the sidewalk is at the lower tier municipality's expense. The Township Staff feels that the obligation to provide sidewalks on Elgin County roads should rest with the County. Most jurisdictions recognize that the road allowance is no longer exclusive for motor vehicles and that their scope of responsibilities includes the provision of infrastructure for pedestrians and cyclists. The Township Staff feels that this obligation to provide this service has been imposed onto the lower tier municipalities. In many cases, it is an onerous and costly task to provide this infrastructure. In Malahide, sidewalks on County roads have been constructed to a higher standard than would be seen on a local road. From the Staffs perspective, it would appear that the most demand for sidewalks is on Elgin County roads. This was especially evident during the development of the Springfield Sidewalk Master Plan. Where, in most cases, residents/pedestrians were satisfied to share the local roads with cars and bicycles, they were not willing to do so when they reached the County roads. The County road typically sees higher traffic volumes with increased truck traffic. The need for sidewalk to provide adequate separation is of greater importance. Pedestrian safety on County roads was a major element of the [Malahide] Sidewalk Master Plan. Given the County's position of not providing sidewalks, it left the Township with little choice but to develop infrastructure on County property. It is likely that this trend will increase. Malahide Staff propose the inclusion of sidewalk maintenance within the County of Elgin road allowances as a part of the agreement. With provincially legislated accessibility requirements and the increasing interest in the Elgin-St. Thomas Health Unit's Active Elgin initiative, the Township Staff feels that the County should take the lead on all pedestrian facilities within their road allowances. The relevant Sections of the Municipal Act, 2001, S.O. 2001, c. 25, pertaining to sidewalks and upper tier and lower tier relations are as follows: 55(1) An upper-tier municipality is not responsible for the construction and maintenance of sidewalks on its highways and the lower-tier municipality in which the highways are located is responsible for the construction and maintenance of the sidewalks and has jurisdiction over that part of the highway, unless the municipalities agree otherwise. 2001, c. 25, s. 55 (1). 55(2) A lower-tier municipality that is responsible for the construction and maintenance of the sidewalks on upper-tier highways is liable for any injury or damage arising from the construction or presence of the sidewalk to the same extent and subject to the same limitations to which a municipality is liable under section 44 in respect of a sidewalk on its own highway. 2001, c. 25, s. 55 (2). 55(3) A lower-tier municipality may, with the agreement of the upper-tier municipality, construct a sidewalk or other improvement or service on an upper-tier highway and the lower-tier municipality is liable for any injury or damage arising from the construction or presence of the sidewalk, improvement or service. 2001, c. 25, s. 55 (3). Section 20(1) of the Municipal Act, 2001, S.O. 2001, c. 25, pertaining to Joint Undertakings, is also relevant to a potential financial contribution from the County towards sidewalk maintenance and capital costs: 20(1) A municipality may enter into an agreement with one or more municipalities or local bodies, as defined in section 19, or a combination of both to jointly provide, for their joint benefit, any matter which all of them have the power to provide within their own boundaries. 2001, c. 25, s. 20 (1). Township of Malahide staff outline sound reasoning for potential financial contribution to lower tier municipalities for the provision and maintenance of sidewalks on County roads. Specifically the reference to provincially legislated accessibility requirements and the increasing interest and benefits from the Elgin-St. Thomas Health Unit's Active Elgin initiative. Bayham staff are of the opinion that an annual County contribution towards sidewalks is desirable and would work to achieve common goals, however it must be understood any such financial contribution would be made based on political merit as a grant, and not any defined legislative grounds. Utilizing annual sidewalk maintenance, capital costs and amortization an annual sum can be calculated. It would be prudent to include the following considerations: 1) The County only provides an annual financial allocation for sidewalks and does not assume ownership or maintenance responsibility from the lower tier. 2) The lower tier retains the decision authority to install or not install a sidewalk within a County right of way. RECOMMENDATION 1. THAT Report CAO-36/17 re County Road Maintenance Agreement be received for information; 2. AND THAT the Council of the Corporation of the Municipality of Bayham direct staff to proceed with County Road Maintenance Agreement negotiations as outlined within Report CAO 36/17. 3. DISCUSSION / CONCLUSION: Elgin's local municipalities have been maintaining the County Road system since 1997 under formal agreements. The agreement was substantially revised in 2013 after many years of experience. The new agreement has been very successful by defining responsibilities, allowing flexibility to municipalities to determine how services are delivered and providing sufficient funding to maintain the County road system. The current agreement expires at the end of 2017 and therefore a revised agreement must be created and executed to extend the term and make minor improvements. Staff plans on meeting with the area Road Supervisors and the County Solicitor during the coming months to review the existing agreement with a goal of extending the term and making only minor improvements where necessary. Once a draft agreement is prepared, staff will report back to Council and seek approval to circulate the draft agreement to our municipal partners for their comments. Funding is delivered through a process that allows the Ontario Trillium Fund to respond flexibly and effectively to the broad and deep need for community-oriented capital funding across Ontario. Types of supported projects must achieve measured impact in the community. Specifically, the purpose of Ontario Trillium Fund Capital Stream is to: Enhance access to community spaces, programs, activities and services, and facilitate community members' full participation in the life of the community; ii. Promote energy efficiency and contribute to environmental outcomes by 'greening' community spaces; iii. Enhance and build community spaces that support Ontario Trillium Fund Priority Outcomes; iv. Enhance the efficiency and effectiveness of programs and make better use of technological resources. Grant amounts range from $5,000 to $150,000 with a project duration up to one (1) year. The Capital Stream deadline is October 25, 2017. DISCUSSION The Ontario Trillium Fund — Capital Stream program is historically significantly over subscribed, with projects that have strong performance metrics selected for approval. DISCUSSION All above noted items with the exception of trail signage has been completed. In compliance with applicable Accessibility Regulations staff sought the expertise of Elgin County Museum and Archives staff to develop the signage attached hereto as Appendix 'A'. The signage is draft and requires revisions to pictures and finer points but does pay tribute to the historical use of the corridor and also comply with relevant legislation. Staff seek Council direction to proceed to design sign frames and install signage within the corridor allowance at Tunnel Line, Teall Nevill and Port Burwell. Should Council direct staff to proceed, staff would also respectfully recommend an approximate four (4) car structured parking area at Tunnel Line and Teall Nevill, similar to the rope and post design at the East Beach Parking Lot, to keep persons within the corridor allowance. PURPOSE The purpose of the official plan amendment is to change the land use designation for 596 m2 (0.1 acres) of land from "Residential"to"Institutional" in the Official Plan of the Municipality of Bayham, which would facilitate a change in zoning on the same lands from the Village Residential (R1) Zone to a Special Institutional (1-4) Zone. MAYOR CLERK THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2017-059 A PROVISIONAL BY-LAW TO PROVIDE FOR DRAINAGE WORKS IN THE MUNICIPALITY OF BAYHAM IN THE COUNTY OF ELGIN KNOWN AS THE WELLINGTON STREET DRAIN WHEREAS the Engineer Spriet Associates on behalf of the Municipality of Bayham in accordance with Section #78(1) of the Drainage Act, R.S.O. 1990, requests that the following lands and roads be drained by drainage works: Part Lots 13 and 14, Concession 1, Municipality of Bayham AND WHEREAS, the Council of the Municipality of Bayham has procured Engineer Report No. 216224, prepared by Spriet Associates, dated April 27, 2017, which is attached hereto as Schedule "A", and forms part of this By-Law. AND WHEREAS the estimated total cost of constructing the drainage work is $47,300.00; AND WHEREAS the Council is of the opinion that the drainage of the area is desirable; NOW THEREFORE the Council of the Municipality of Bayham enacts as follows: 1. Engineer Report No. 216224, dated April 27, 2017 and attached hereto, is hereby adopted and the drainage works as therein indicated and set forth are hereby authorized and shall be completed in accordance therewith. 2.1 The Corporation of the Municipality of Bayham may borrow, on the credit of the Corporation, the amount of$47,300,00 being the amount necessary for construction of the drainage works. 2.2 The Corporation may arrange for the issue of debentures on its behalf for the amount borrowed less the total amount of, (a) grants received under Section #85 of the Act; (b) commuted payments made in respect of lands and roads assessed within the municipality; (c) monies paid under Subsection #61(3) of the Act; and monies assessed in and payable by another municipality, and such debentures shall be made payable within five (5) years from the date of the debenture and shall bear interest at a rate not higher than the rate charged by a chartered bank of Canada. By-law No. 2017-1059 -2 - A special equal rate sufficient to redeem the principal and interest on the debentures shall be levied upon the lands and roads as set forth in the attached Schedule "A" to be collected in the same manner and at the same time as other taxes are collected in each year for five (5) years after the passing of this by-law. 4. For paying the amount of$40,468.00 being the amount assessed upon the lands and roads belonging to or controlled by the municipality, a special rate sufficient to pay the amount assessed plus interest thereon shall be levied upon the whole rateable property in the Municipality of Bayham in each year for five (5) years after the passing of this Provisional By-law to be collected in the same manner and at the same time as other taxes are collected. 5. All assessments of$250.00 or less are payable in the first year in which the assessment is imposed. 6. This By-law comes into force on the passing thereof and may be cited as the "Wellington Street Municipal Drain".
