THE CORPORATION OF THE

BY-LAW 2017-042
BEING A BY-LAW TO DEEM PART OF LOTS 6 AND 7 OF REGISTERED PLAN 12, EAST
OF ROBINSON STREET, BEING PARTS 2 AND 3 OF REGISTERED PLAN 11R-8622,
FORMER VILLAGE OF PORT BURWELL, MUNICIPALITY OF BAYHAM, COUNTY OF
ELGIN NOT TO BE A REGISTERED PLAN OF SUBDIVISION FOR THE PURPOSES OF
SUBSECTION 50(3) OF THE PLANNING ACT
WHEREAS the Council of the Corporation of the Municipality of Bayham has authority pursuant
to subsection 50(4) of the Planning Act, R.S.O., 1990, as amended, to designate a plan of
subdivision for the purposes of subsection 50(3) of the Planning Act;
AND WHEREAS the lands described below are currently lots within a registered plan of
subdivision that has been registered for more than eight years;
NOW THEREFORE, the Council of the Corporation of the Municipality of Bayham hereby deem:
1) Part of Lots 6 and 7 of Registered Plan 12, east of Robinson Street, being Parts 2 and 3
of Registered Plan 11 R-8622, former Village of Port Burwell, Municipality of Bayham,
County of Elgin, not be a registered plan of subdivision for the purposes of subsection
50(3) of the Planning Act;
2) THAT this By-law shall come into full force and take effect on the date it is registered in
the land registry office for the County of Elgin.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED this 4th day of May 2017.

RE: DEEMING BY-LAW NOTICE

SUBJECT LAND: Plan 12 Lots 6 and 7 E Robinson St RP 11R8622 Parts 2 and
3, Municipality of Bayham, Village of Port Burwell
TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham passed By-
Law No. 2017-042 on the 4th day of May 2017 under subsection 50(4) of the Planning Act and
issues this Notice of Passing of a By-law, as required under subsection 50(29) of the Planning
Act.
AND TAKE NOTICE that By-law 2017-042 applies to lands known as Part of Lots 6 and 7 of
Registered Plan 12, east of Robinson Street, being Parts 2 and 3 of Registered Plan 11 R-8622
to not be a registered Plan of Subdivision for the purposes of subsection 50(3) of the Planning
Act.
THIS BY-LAW was registered at the Elgin County Land Registry Office on July 11, 2017 as
Instrument Number CT142216 for the County of Elgin, and is now effective. A copy of By-law
2017-042 and the Land Registry Office receipt are enclosed for your reference.
ANY PERSON TO WHOM this notice was sent may file an appeal respecting the amendment
or repeal of the By-law, and will be given an opportunity to be heard by Council with respect to
this matter. The last day of filing an appeal with the Clerk for the Corporation of the Municipality
of Bayham is Tuesday, August 22, 2017.
