AND TAKE NOTICE that the Council of the Corporation of the Municipality of Bayham will hold a public meeting on Thursday, May 4, 2017 at 7:30 p.m. in the Municipal Council Chambers, 56169 Heritage Line, Straffordville, to consider a proposed Zoning By-law and Official Plan amendment under Section 34 of the PLANNING ACT. THE PURPOSE of this By-law is to change the land use designation on a 2,013 m2 (0.5 acres) of land from "Commercial" to "Residential" designation in the Official Plan of the Municipality of Bayham; and to change the zoning on the same lands from Local Commercial (C2) Zone to a Village Residential (R1) Zone in Zoning By-law Z456-2003. The subject lands are located on the north side of Wellington Street, on the east side of Victoria Street and the west side of Elizabeth Street, and known as 34 Victoria Street and 49 Wellington Street. THE EFFECT of this By-law will be to allow residential use on the lands and to allow for future residential development on the 34 Victoria Street property which currently comprises of a single car garage with no residence subsequent to approved consent to sever the lands in 2015. ANY PERSON may attend the public meeting and/or make a written or verbal representation in support of or in opposition to the proposed amendments. BACKGROUND: A consent application was received from the Elgin County Land Division Committee submitted by Lloyd G. We have completed our review of the consent application submitted by Lloyd McQuiggan & Sons Trucking Inc. for lands located at 53900 Calton Line, north side, east of County Road 43 and the Hamlet of Calton. The applicant is requesting a lot addition to sever 740 m2 (0.18 acres) of unused agricultural land and merge it with an abutting residential parcel to square off the property and to retain 24 ha (60.4 acres)of agricultural land. The lands are designated Agriculture, Natural Gas Reservoir and Natural Hazard on Schedule "Al" Municipality of Bayham: Land Use of the Official Plan. The lot addition lands are zoned Agriculture(A1) and the parcel being added to is zoned Rural Residential (RR) on Schedule "Al", Map No. 10 in Zoning By-law Z456-2003. 2. The subject lands are agricultural lands which are not farmed, including a small row of deciduous trees and mowed grass, which lie between the residential property and the farm field. There is one existing dwelling on the residential lands. The surrounding uses are agricultural to the west and residential to the south with a ravine to the north and east. 3. Section E1.2.3 of the Elgin County Official Plan indicates that consents may be allowed where they are consistent with the Provincial Policy Statement 2014(PPS), the County Official Plan, and the local Official Plan, the following paragraphs outline relevant aspects of these documents. 4. Section 2.3.4 Lot Creation and Lot Adjustments of the PPS indicates that minor lot adjustments are permitted and therefore the proposed lot addition is consistent with the PPS. 5. Section E1.2.3.4 Lot Creation on Lands in the Agricultural Area of the County Official Plan supports minor boundary adjustments that do not result in the creation of a new lot. The purpose of the proposed consent is to add lands to a residential lot through a minor boundary adjustment and therefore is consistent with the County Official Plan. 6. Section 8.7.1 of the Bayham Official Plan states that consents may only be granted by the Elgin County Land Division Committee and that the local Municipality, the Municipality of Bayham in this instance, shall provide comment on all consent applications. The severed lands are designated "Agricultural" in the Bayham Official Plan. Section 2.1.9 Minor Lot Adjustments and Section 8.7.2.5 indicate that minor lot additions or adjustments are permitted in agricultural areas as long as no new lot is created. The applicant has requested Council consider the rezoning prior to applying for consent from Elgin County to divide the 40 ha (100 acres) parcel into two equal farm parcels of 20 ha (50 acres). A public meeting was held April 6, 2017 with three attendees (Darryl Buti, Alex Buti and Appointed Agent David Roe) and no public comments received. At the time writing this report no additional applicant or public comments have been received. PURPOSE AND EFFECT The purpose of this By-law is to change the zoning regulations on a 40 ha (100 acre) parcel in the Agricultural (Al-A) Zone to an Agricultural (A1) Zone in Zoning By-law Z456-2003. The zone change is requested in order to support a proposed land severance of the 40 ha farm into two equal farm parcels, with a separate consent approval required through Elgin County Land Division Committee application. The subject lands are located on the south side of Tunnel Line, east of Godby Road known as 57629 Tunnel Line. The effect of this By-law will be to allow for the splitting of an agricultural parcel of 40 ha (100 acre) into two 20 ha (50 acre) parcels by changing the zoning from Al-A to Al. The change is requested to allow the son of the owner to purchase the westerly parcel, including the dwelling he lives in on the lands, for growing higher return crops than the cash crops grown on the subject lands and on Ms. Buti's other 60 ha farm in the Township of Houghton. DISCUSSION Staff and planner are not supportive of the purpose and effect of the zoning amendments as per the Option 1 Recommendation in this report. Background: The subject lands are located within Concession 2, part Lot 27 with frontage onto Tunnel Line. The lands have a frontage of 410 metres and a lot area of 40.47 hectares.The lands contain two existing dwellings,a garage,two barns,two greenhouses, 6 old style tobacco kilns and several bulk style tobacco kilns. Most of the agricultural buildings are in various states of disrepair. The owner, Mr. Rose Buti lives in the older farm house and her son Darryl Buti lives in the new farm house built in 1967. Mrs. Buti and her late husband grew tobacco on this farm since the late 1950's. Mrs. Buti owns another former tobacco farm located in Norfolk County, in the geographic Township of Houghton. That farm is 60 hectares in size. The farms are presently used for growing cash crops, corn and beans in rotation. Mr. Buti's son, Darryl would like to purchase the westerly 20 hectares (which contains the house he lives in) and grow higher return crops. However, a rezoning will be required to facilitate such a severance. Official Plan and Zoning Affecting the Subject Lands The lands are designated Agricultural by the Municipality of Bayham Official Plan and are zoned Al-A by By-law Z456-2003 of the Municipality of Bayham. Provincial Policy Statement(2014) (PPS) The lands are within an area considered to be prime agricultural areas. The following section is relevant to the proposed rezoning and future severance. Section 2.3.4.1 of the PPS with respect to lot creation. 2.3.4.1 Lot creation in prime agricultural areas is discouraged and may only be permitted for; a) agricultural uses,provided that the lots are of a size appropriate for the type of agricultural use(s) common in the area and are sufficiently large to maintain flexibility for future changes in the type or size of agricultural operations; Elgin County Official Plan The following policy is relevant to the proposed rezoning and future severance. E1.2.3.4 Lot Creation on Lands in the Agricultural Area In accordance with the intent of this Plan to maintain and protect the agricultural resource of the County and direct the majority of new residential growth to settlement areas or existing vacant building lots, new lots may be permitted if the local Official Plan supports their creation and if a) the lot is to be severed to create a new farm lot and both the retained and severed parcels each have a lot area of about 40 hectares; or as established in the local planning documents or, Municipality of Bayham Official Plan The following policy is relevant to the proposed rezoning and future severance. 2.1.6 Division of Agricultural Parcels 2 2.1.6.1 It is a policy of this Plan to discourage the division of large farms into smaller holdings and to encourage continued farm use. However, the severance of surplus farm dwellings pursuant to the process of farm consolidation shall be permitted in accordance with the policies of Section 2.1.7 of this plan. 2.1.6.2 The assembling and disassembling of agricultural land into more efficient or more productive farming units may be permitted. In considering applications to divide agricultural parcels of land the Municipality shall have regard to: a) The need to discourage the unwarranted fragmentation of farmland; b) The agricultural capability of the land; c) The type of agricultural activity engaged in and proposed to be engaged in; d) Both the severed and retained parcels must be sufficiently large enough to permit flexibility for future changes in the type or size of the farming operation, in order to meet changing economic conditions; e) The severed and retained parcels are both suitable for the type of agriculture use(s) common in the area and the farm size is appropriate for the type of agriculture operation proposed; f) The requirements of the Planning Act; g) The minimum farm parcel size as established in the Zoning By- law; h) The Minimum Distance Separation Formula I. Planning Comments The Planning Documents do not set a minimum size for agricultural parcels.While the policies generally discourage the creation of parcels less than 40 ha, they do permit agricultural severances to lesser sized parcels subject to certain criteria. These are,that lots are to be size appropriate for the type of agricultural uses common in the area and large enough to be flexible for future change. In this case, two things should be considered; firstly the size of agricultural parcels in the area are made up of many parcels less than 40 ha and indeed many of the parcels are 20 ha or less in size (see attached map). Secondly,the types of crops grown in this area of the County are often speciality type crops, including vegetables and fruit crops namely as asparagus, cucumbers,peppers, raspberries and blueberries. Potentially, there are other speciality crops that could be grown such as ginseng and hops that could also be grown.The attached table shows the gross income from growing these speciality crops when compared to typical field crops such as grain corn,soybeans etc. The gross return per area is 10x higher with many of the speciality crops. 3 Historically, Bayham has a history of growing many of these speciality crops and also of having agricultural parcels which are less than 40 hectares. The smaller agricultural parcel sizes provide flexibility for farmers,where larger sized parcels would not be affordable. Smaller parcel size also enables other farm operations to expand in smaller increments. In many ways the smaller parcel size (in the area of 20 hectares) provide the agricultural industry with more flexibility. What is being proposed,is in my opinion, consistent the relevant planning policies. In summary, I am satisfied that the intent of the PPS and the official plans are being maintained. We have completed our review of an Application for a Zoning By-law amendment, submitted by Ms. Rose Buti, for a property located at 57629 Tunnel Line south side, west of Highway 55. The applicant is requesting a zoning by-law amendment to change the zoning on a 40 ha (100 acres) parcel of land from Agriculture (Al-A) Zone to Agriculture (A1) Zone in order to meet minimum lot area regulations for consent to sever the lands into two equal farm parcels of 20 ha (50 acres), to be considered by the Elgin County Land Division Committee. The applicant has requested that Municipal Council offer consideration for rezoning prior to applying for consent from Elgin County. The subject lands are designated as Agriculture and Natural Heritage on Schedule "Al" Land Use of the Official Plan of the Municipality of Bayham. The lands are currently zoned Agricultural (Al-A) and LPRCA Regulation Limit on Schedule"A" Map No. 15 in Zoning By-law Z456- 2003. 2. The 40 ha (100 acres) property has 410 m (1,345 ft) of lot frontage on Tunnel Line and a lot depth of 1,020 m (3,346 ft). The property comprises of two single family dwellings, one on each proposed farm lot in proximity to Tunnel Line. The easterly dwelling is included in the existing farm cluster with two barns, a garage, a shed and several old and new tobacco kilns. Surrounding land uses are agricultural to the west, south and east, and agricultural and residential to the north. 3. The subject lands are located in a designated agricultural area. Section 2.3.4 Lot Creation and Lot Adjustments of the Provincial Policy Statement, 2014 (PPS) indicates that lot creation is permitted in agricultural designations, however, the lots must be of sufficient size to maintain flexibility for future changes in agricultural operations. Although the applicant has included some analysis of the region regarding multiple farms of 20 ha in the region, and as further analyzed below, only approximately half of the subject lands is suitable for cultivation. Therefore the proposed zoning application is not consistent with the policies of the PPS. 4. Section 2.1.6 Division of Agricultural Parcels of the Official Plan sets out the criteria for the consideration of the proposed severance and zoning. The plan policy is to discourage the division of large farms into smaller holdings and to encourage continued farm use. From an examination of recent aerial photographs it is evident that the entirety of the IBI Group is a group of firms providing professional services and is affiliated with IBI Group Architects IBI GROUP MEMORANDUM 2 Municipality of Bayham—April 5,2016 lands are not suitable for farm production. There is a medium sized woodlot on the southern portion of the lands and rolling wooded areas in the northwestern and western areas of the lands. Approximately half of the land is therefore unsuitable for farming, divided somewhat evenly between the east and west portions. The approval of this amendment could result in two undersized farm parcels which in future may be undesirable for farming due to the limited arable lands available for cultivation. Upon initial review a recommendation for severance of a surplus farm dwelling only including the lands around the existing dwelling to the west was offered as the preferred alternative to the current proposal, however, the applicant decided to proceed, in contradiction to our interpretation of the Official Plan policy described above. 5. In addition, Official Plan Section 2.1.6.2 indicates that the assembling and disassembling of agricultural land into more efficient or more productive farming units may be permitted subject to the following criteria: a) The need to discourage the unwanted fragmentation of farmland. The applicant indicates that their son wishes to grow specialty crops on the western portion of subject land. Such justification does not warrant fragmentation of the farmland. b) The agricultural capability of the land. As described above, approximately half of the land is unsuitable for farming and so the proposed farm parcels may be incapable of remaining viable for agricultural use in the future. c) The type of agricultural activity engaged in or proposed to be engaged in. The applicant has indicated that the farm operation includes a 60 ha (148 acres) farm parcel in neighbouring Norfolk County and the farm operation lands are currently used for growing cash crops, corn and beans in rotation. The owner's son would like to purchase the easterly lands, on which he resides, to grow higher return crops. Although the lands may be more productive with specialty crops the specialty crops could be produced without fragmentation of the farm parcel. d) Both the severed and retained parcels must be sufficiently large enough to permit flexibility for future changes in the type or size of the farming operation, in order to meet changing economic conditions. As outlined above, severance of this parcel may not provide sufficient cultivatable lands to meet changing economic conditions. e) The severed and retained parcels are both suitable for the type of agriculture use(s) common in the area and the farm size is appropriate for the type of agriculture operation proposed. ElginCou n ty- April 11, 2017 For immediate release County Budget Delivers Lower Than Anticipated Tax Rate CENTRAL ELGIN —At its February, 2017 meeting, Elgin County Council approved a $63,929,053 operating budget, with a 4.9 per cent levy increase in County taxes representing a 2.8% increase on the average home or approximately $41. It is a priority of Council to maintain and expand service levels for residents whilst being able to achieve affordable taxes. The County has been able to do this, despite significant revenue losses of over $5 million in OMPF and Ford property tax, through the use of reserves and measured tax increments over ten years. The 2016 operating surplus and cost reductions in public health and social services more than offset cost increases in hydro and Canada Pension Plan (CPP) resulting in a 0.1% improvement over the previously planned increase. In 2017, Council will continue several initiatives committed to in the 2016 Budget, including a new building for Terrace Lodge residents, investment in high speed fibre broadband, a $3.5 million grant to the St. Thomas Elgin General Hospital and a Community Improvement Plan (CIP). These service enhancements include $30 million of expenditures to rebuild Terrace Lodge, as well as investing into the County's economic growth through the $1 million Community Improvement Plan (CIP) and the $0.5 million SWIFT broadband project. New service improvements for 2017 include $1 million expenditure for an Elgin County Heritage Centre, a $100,000 loan and enhanced lease payments to Southwold for the new library, as well as committing to ongoing funding of the Clean Water initiative. In addition, the County is upgrading Wonderland Road from a lower volume local road to a higher volume county road. This year will result in a tax increase on the average property (across all classes) of 3.9%, which is 0.1 % below the previously planned 4% increase. The increase on the average household will be $41, which is only a 2.8% increase as a result of tax shifts between property classes. DISCUSSION: Council's strategic vision has been to maintain service levels while achieving an affordable tax increase. Council's commitment to service is evident through the funding Council has provided to programs and projects valued by the County's residents. These programs and projects span the gambit from health care to economic development to infrastructure to the environment. The funding highlights are as follows: 1. $30 million rebuild of Terrace Lodge and capital maintenance projects for Elgin Manor and Bobier Villa of$8.0 million over the next ten years. 2. $2.25 million granted to the St. Thomas Elgin General Hospital through 2017 with a further$1.25 million in contributions planned for a total of$3.5 million by 2022. 3. $1 million in CIP funding to improve streetscapes and improve the economic outlook for the County's businesses. 4. Two satellite offices for the Elgin Business Resource Centre (EBRC) to assist the County's budding entrepreneurs and help create local jobs. 5. $0.5 in funding to attract government and private sector support for high speed internet (SWIFT). 6. The county roads will receive $9.1 million in 2017 capital budget funding, with a further$104 million for the next nine years focused on timely investments in existing infrastructure to ensure the lowest possible lifecycle costs. The 2017 capital plan includes rehabilitation of Wonderland Road, Vienna Line and Sparta Line. 7. Purchase of$3.2 million of books for libraries over the next ten years as well as a $0.1 million loan and $28,000 annual lease increase for new the Shedden library. 8. $40,000 grant to the Clean Water Initiative will now be made on-going. In the last number of years, affordable tax increases have been achieved, despite significant revenue losses of over $5 million in OMPF and Ford property tax, through the use of reserves and measured tax increases over ten years. Council strategically planned a low to moderate use of reserves to allow a series of 4% increases on the average property continuing through 2020 to rebalance the budget. Through the ten-year plan, Council has been focused on ensuring the long-term financial stability of the County. If timely capital investments are not made to infrastructure, replacement costs will be substantially greater in the future. Although the use of reserves can allow for a short-term loss in municipal position (comparable to owner's equity at a personal level), an ongoing reduction in municipal position through insufficient taxation and neglected infrastructure will ultimately materialize as costly asset replacements and even higher tax increases. Utilizing grants such as Ontario Community Infrastructure Fund (OCIF) and Canada Cultural Spaces Fund, as well as capital surpluses, for important projects to maintain a sound municipal position is therefore prudent. An increase in OCIF base funding of$1.6 million over three years, a Canada Cultural Spaces Fund grant of$0.5 million and $1.0 million 2016 capital surplus will allow Council to build a Elgin County Heritage Centre and upgrade Wonderland Road to a higher volume road while continuing with key life-cycle capital maintenance action on the county's other infrastructure. All this can be done without the need for an incremental tax increase. The primary changes to the county's operating cost in 2017 are increases for hydro and reductions in Public Health and Social Services budgets. In addition, the cost increases in subsequent years of the ten-year plan for Canada Pension Plan (CPP) will be partially offset by the 2016 operating surplus. The net of these various changes allows for a 0.1% reduction in the previously planned tax increases of 4.0% down to a 3.9% increase on an average property. This 3.9% increase on taxation of existing buildings, as shown on Attachment I, results in a levy increase from the 2016 level of$30.8 million of$1.2 million. In addition, new building construction (growth in county residents) will add a further$0.3 million of levy (1%) for a total levy of$32.3 million. As a result of the 2016 reassessment cycle (affecting 2017-2020 taxation years), the residential class benefits from a tax burden shift between classes. The benefit of this is only slightly mitigated by a provincially mandated change in the multi-residential ratio. The province is mandating through a levy restriction that the previous ratio for multi-residential of 2.3458 be lowered to below 2.0 (the levy restriction would take a few years to bring the ratio down to the provincially mandated target). Optionally, the entire reduction can be done proactively by Council in 2017 thereby avoiding the complexities associated with dealing with a levy restriction. The local treasurers are recommending a ratio of 1.9999 for 2017 to avoid these complexities. With a multi-residential ratio of 1.9999 for 2017, the overall benefit to the residential class of tax burden shifts will be 1.1% (as compared to an estimated change of 1.2% if the levy restriction option were chosen). The 3.9% increase on an average property translates into a 2.8% increase on the average household based on the 1.1% tax shift burden, or $41 per household higher than the prior year taxes (see Attachment I). In addition to the multi-residential change, the province has introduced changes to property taxation that included flexibility in setting the vacancy reduction rate on commercial and industrial properties. The local treasurers are in agreement that vacancy ratios should be unchanged for 2017, but by the spring a report will be presented to Council with recommendations for changes for future years. Delaying ratio changes until next year but announcing those changes early in 2017 will give proper notice to businesses of changes to their taxes. The final tax policy change introduced by the province impacting the County is the introduction of a new Landfill property class requiring a new tax ratio be set. The only properties for Elgin County in this new class are within Payment-In-Lieu (PIL), meaning payments between different government bodies. The province has provided strong indications that the result of the new class/ratio will be revenue neutral within Elgin. Once the province has made its final decisions on the treatment of this class, staff will provide a separate report explaining the outcome and Council can then approve the new tax ratio as dictated by the province. Provided that the province maintains their current position that the result will be revenue neutral, only Schedule A (Ratios) & C (Tax Rates) would have to be modified to include the ratio/rate for the new landfill property class. The current ten-year plan sees the municipal position growing at a rate of 1.3% from $198 million in 2016 to $225 million in 2026. Although this rate of growth is somewhat below the rate of inflation, staff is confident that cost efficiencies resulting from new technologies (e.g. micro-surfacing) should allow the County's assets to be maintained with the investments contained within the 2017 ten-year capital plan. RECOMMENDATIONS: THAT the 2017 proposed budget, which includes the operating budget, the capital budget and grants, be approved with a levy of$32.3 million or 2.8% on the average household; and, THAT the multi-residential ratio be reduced to 1.9999 to avoid provincially imposed levy restrictions; and, THAT the necessary by-law be prepared once the landfill tax ratio calculation is available from the province.
