CALLTO ORDER A. The Secretary-Treasurer called the meeting to order at 6:30 p.m. and asked for those in attendance for this meeting to sign in at the podium 2. APPOINTMENT OF CHAIRMAN Moved by: T. Southwick Seconded by: W. Casier THAT P. Ens be appointed Chairman of the Committee of Adjustment for consideration of Minor Variance Application A-02/17 submitted by Luc and Debbie Dujardin and Minor Variance Application A-03/17 submitted by Best Line Farms CARRIED 3. DISCLOSURES OF PECUNIARY INTEREST &THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 4. APPLICATIONS A. Minor Variance Application A02-/17 Dujardin - Request to grant relief from Zoning By- Law Z456-2003, Section 5.2- to permit Accessory Living Quarters which will allow the installation of an accessory bunkhouse of 11.5 m (38 feet) by 7.9 m (26 feet) to accommodate a total of nine (9) seasonal farm labourers and to recognize the two existing accessory bunkhouse buildings constructed over 35 years ago of 9 m (30 feet) by 6 m (20 feet) and 6 m (20 feet) by 6 m (20 feet) 2017 Committee of Adjustment Minutes April 6, 2017 B. Minor Variance Application A-03/17 Best Line Farms Ltd. — Request to grant relief from Zoning By-Law Z456-2003, Section 5.2 to permit a supplementary farm dwelling of 139 m2 (1,500 ft2) which will allow the existing dwelling to be deemed as a supplementary farm dwelling for the purpose of accommodating seasonal farm labourers 5. STAFF PRESENTATION A. Report DS-14/17 by Margaret Underhill, Secretary/Treasurer Committee of Adjustment re Minor Variance —A-02/17 Dujardin Secretary/Treasurer M. Underhill presented Report DS-14/17 and advised no public submissions were received B. Report DS-15/17 by Margaret Underhill, Secretary/Treasurer Committee of Adjustment re Minor Variance —A-03/17 Best Line Farms Ltd. Secretary/Treasurer M. Underhill presented Report DS-15/17 and advised no public submissions were received 6. PRESENTATIONS BY APPLICANT/AGENT A. None B. Gary Van Leeuwen provided information regarding the need for supplemental farm help which would be housed in the present house and the plan to build a new permanent home on the farm. 7. PUBLIC SUBMISSIONS A. None B. None 8. COMMITTEE QUESTIONS AND DISCUSSION A. None B. W. Casier inquired if there would be a change in the assessment to the farm dwelling. The Secretary/Treasurer advised MPAC would have to reassess from permanent dwelling to seasonal. 2017 Committee of Adjustment Minutes April 6, 2017 9. DECISION OF COMMITTEE (Motions) A. Decision Moved by: W. Casier Seconded by: E. Ketchabaw THAT the Committee of Adjustment Secretary-Treasurer's report DS-14/17 regarding the Dujardin minor variance be received; AND WHEREAS the Committee agrees that the proposed variance meets Section 45.1(1) of the Planning Act and this variance is considered minor; THEREFORE application A-02/17 submitted by Luc and Debbie Dujardin, pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: • Section 5.1 — Permitted Uses—to permit the placement of arT accessory bunkhouse building of 11.5 m (38 feet) by 7.9 m (26 feet) to accommodate a total of nine (9) seasonal farm labourers and to recognize the two existing accessory bunkhouse buildings constructed over 35 years ago of 9 m (30 feet) by 6 m (20 feet) and 6 m (20 feet) by 6 m (20 feet) in accordance with Section 2.1.10 of the Official Plan. Condition of Minor Variance: Subject to a Development Agreement with the Municipality of Bayham to be executed within 30 days of minor variance approval. CARRIED B. Decision Moved by: E Ketchabaw Seconded by: T Southwick THAT the Committee of Adjustment Secretary-Treasurer's report DS-15/17 regarding the Best Line Farms Ltd. minor variance be received; AND WHEREAS the Committee agrees that the proposed variance meets Section 45.1(1) of the Planning Act and this variance is considered minor; THEREFORE application A-03/17 submitted by Best Line Farms Ltd., pursuant to Section 45 of the Planning Act for minor variance, is granted to allow relief from Municipality of Bayham Zoning By-law Z456-2003: • Section 5.1 — Permitted Uses —to permit the existing dwelling of 139.3 m2 (1500 sq. ft.) to be deemed as a supplementary farm dwelling for the purpose of accommodating seasonal farm labourers in accordance with Section 2.1.10 of the Official Plan. Breyer THAT the Committee of Adjustment hearing for consideration of Minor Variance Applications A- 02/17 and A-03/17 be adjourned at 6:41 p.m. AND THAT in accordance with the regulations of the Planning Act, Notices of Decision be circulated by the Secretary-Treasurer accordingly.
