The location of these are mainly located in the villages of Port Burwell and Vienna. The estimated service population is less than 2000 with 820 fully metered service connections. A booster pump station is located on the transmission main to Vienna. This pump operates when the pressure drops to activate the pump which would normally occur during fire flows or main line flushing. C-07 / D09 Rodenburg Roll # 3401-000-005-05500 SUBJECT: Consent Application E6/17, E7/17 and E8/17 Rodenburg BACKGROUND: Consent applications E6/17, E7/17 and E8/17 were received from the Elgin County Land Division Committee submitted by Marinus Rodenburg proposing to sever three parcels: Parcel "A" area of 4000 m2 (1 acre) containing a house, shed and steel barn, Parcel "B" area of 3040 m2 (0.75 acre) containing a silo and foundation to be removed; and Parcel "C" area of 3040 m2 (0.75 acre); and retain the agricultural lands with lot area of 22 ha (54.4 acre). Property is known municipally as 11185 Culloden Road, west side south of Best Line in the hamlet of Corinth. The subject lands are designated "Agriculture" and "Hamlet" on Schedule "Al" Municipality of Bayham: Land Use of the Official Plan and zoned Agriculture (A1) and Holding Hamlet Residential (HR(h1/h4)) on Schedule "B" Zoning By-law No. Z456-2003. Elgin County Land Division Committee will consider the application on February 22, 2017. DISCUSSION: The proposal suggests severing the house, shed and barn from the farm parcel, the area being included in the hamlet boundary of Corinth. As well as, the creation of two additional building lots is proposed south of the house lot. The planner's memorandum dated February 7, 2017 analyzes the applications subject to the Elgin County Official Plan, Bayham Official Plan and Zoning By-law policies. The applications meet the criteria for the creation of lots within the urban boundary of Corinth subject to the recommended conditions. We have completed our review of the consent application submitted by Marinus Rodenburg for lands located in the hamlet of Corinth at 11185 Culloden Road, west side and south of Best Line. The applicant is requesting consent to create three new residential lots and to retain the remaining agricultural land. The lands are designated "Agriculture" and "Hamlet" on Schedule "Al" Municipality of Bayham: Land Use of the Official Plan of the Municipality of Bayham. The lands are zoned Agricultural (A1) and Holding Hamlet Residential (HR(h1/h4)) on Schedule"B" in Zoning By-law Z456-2003. 2. The existing lands are used for agricultural purposes. There is one existing dwelling, a metal barn/shed, a barn, a small shed and an old silo and barn foundation. The applicant seeks to create three new lots along Culloden Road and one retained agricultural lot, with dimensions and area of: • Parcel "A" with a lot frontage of 50 m (164 feet), lot depth of 80 m (262 feet) and an area of 4,000 m2 (1 acre), including an existing dwelling, a shop/metal building of 254.8 m2 (2742 ft2) and a small shed; • Parcel "B" with a lot frontage of 38 m (124 feet), lot depth of 80 m (262 feet) and an area of 3040 m2(0.75 acre), including an old silo and barn foundation to be removed; • Parcel "C" with a lot frontage of 38 m (124 feet), lot depth of 80 m (262 feet) and an area of 3040 m2 (0.75 acre); • The retained agricultural lands will have a lot frontage of 418 m (1370 feet); lot depth of 405 m (1328 feet) and lot area of 22 ha (54.4 acre), including an existing barn approximately 14 m west of proposed Parcel "A". 3. Section E1.2.3 of the Elgin County Official Plan indicates that consents may be allowed where they are consistent with the Provincial Policy Statement 2014(PPS), the County Official Plan, and the local Official Plan, the following paragraphs outline relevant aspects of these documents. 4. The eastern portion of the subject lands are located in the hamlet of Corinth to which "settlement area" policies apply. The criteria for conditional approval of new lots by consent are outlined in Section E1.2.3.1 — General Criteria of the County Official Plan. The approval authority must be satisfied that the proposed lots meet the following criteria: a) fronts on and will be directly accessed by a public road that is maintained on a year-round basis; The lots front onto Culloden Road, a public road that is maintained year-round. b) does not have direct access to a Provincial Highway or County Road, unless the Province or the County permits a request for access; Access to Culloden Road, an Elgin County road, will require a Municipal Road Access permit. c) will not cause a traffic hazard; The road is flat and straight and the speed limit is reduced within the hamlet. d) has adequate size and frontage for the proposed use in accordance with the local municipal Zoning By-law; The proposed lots meet all the frontage and setback regulations of the Zoning By-law. e) notwithstanding d) above, where a zoning by-law amendment or minor variance is required, approval of such amendment or variance shall be included as a condition of the approval of the consent; A Zoning By-law amendment will be necessary for removal of holding provisions on the lands and will be included as a condition of approval. The oversized shop/metal building will be addressed through Zoning By-law amendment approval. f) can be serviced with an appropriate water supply and means of sewage disposal, provided there is confirmation of sufficient reserve sewage system capacity and reserve water system capacity within municipal sewage services and municipal water services; The applicant must provide lot assessments for soils (septic) and installation of wells with water quality and quantity testing results to provincial standards are required, including testing of the existing well on Parcel "A". g) will not have a negative impact on the drainage patterns in the area; The Drainage Superintendent of the Municipality of Bayham recommends that a Petition of Drainage be required to connect to the Corinth Drain. h) will not restrict the development of the retained lands or other parcels of land, particularly as it relates to the provision of access, if they are designated for development by this Plan; There is enough remaining frontage to access the agricultural lands. i) will not have a negative impact on the significant features and functions of any natural heritage feature; in this regard, lots should be restricted in size in order to conserve other lands in larger blocks for natural heritage purposes; IBI Group Professional Services(Canada)Inc.is a member of the IBI Group of companies IBI GROUP MEMORANDUM 3 Municipality of Bayham—February 8,2017 There are no significant natural heritage features associated with the subject lands. j) will not have a negative impact on the quality and quantity of groundwater available for other uses in the area; The applicant must provide lot assessments for soils (septic) and installation of wells with water quality and quantity testing results to provincial standards are required, including testing of the existing well on Parcel "A". k) will not have an adverse effect on natural hazard processes such as flooding and erosion; There are no natural hazards designations areas on the lands. I) conform with the local Official Plan; and, The proposed must conform to local Official Plan and this is addressed in a separate section of this memorandum. m) will conform to Section 51 (24) of the Planning Act, as amended The proposed conforms to this section. 6. Section 8.7.1 of the Bayham Official Plan states that consents may only be granted by the Elgin County Land Division Committee and that the local Municipality, the Municipality of Bayham in this instance, shall provide comment on all consent applications. The severed lands are designated "Agricultural" and "Hamlet" in the Bayham Official Plan. The western portion of the proposed residential lots are located in the Agriculture designation, however, according to policies in Section 8.2.1 Boundary Interpretation the boundaries of all land use designations as depicted on Schedule"Al"Land Use are approximate.The proposed residential lots appear to encroach into agricultural designation as depicted on Schedule"Al" but the boundaries are approximate, therefore the proposed conforms to the Official Plan policies. 7. Bayham Official Plan Section 4.4.2.2 sets out the policies for Consent of residential uses in "Hamlet" designations. Consideration of the criteria of the Section follows: a) Consents shall be granted only in areas where the minor,or no extension of any municipal service would be required. Any services required in a consent should be satisfactory to the appropriate approval authority; The proposed lots require private water and septic services to provincial standards. b) Consents should be granted only when the land fronts on an existing public road, which is of a reasonable standard of construction; The proposed lots front on the existing public road (Culloden Road) which is of reasonable condition to allow for access to the subject lands. c) Consents should have the effect of infilling in existing developed areas and not of extending the Hamlet area unduly; The proposed lots infill in the existing hamlet area. Lot assessments provided by the applicant will be required as described above. e) Direct access from major roads should be restricted and residential lots should, where possible, have access only from internal residential roads; The proposed lots front on a public road deemed appropriate for access. f) Consents should not be granted for land adjacent to a road from which access is to be obtained where a traffic hazard would be created because of limited sight lines on curves or grades; No traffic hazard is anticipated as the road is straight and flat. g) Consents should be granted only when the creation of the lot will not interfere with subsequent access to interior lands; The retained agricultural lands will have 183 m of remaining access to the north and 237 m to the south therefore adequate access opportunity is maintained to the retained farm lands. 8. The Agriculture(Al)zone in By-law Z456-2003 allows for farm uses.The retained agricultural parcel meets all the frontage and setback regulations in the Al zone. The Hamlet Residential (HR) zone allows for residential uses. The proposed residential parcels meet all the frontage and setback requirements of the Zoning By-law. The shop/metal building on "Parcel A" is not in compliance, as the maximum floor area for an accessory building in the HR Zone is 75 m2 or 8% lot coverage, whichever is less and the existing shop/metal building has an area of 254.8 m2. Should the applicant wish to keep the oversized barn/shed on Parcel "A" they will need Zoning By-law approval. Section 3.3 Holding Zones requires an amendment to the Zoning By-law in order to remove a Holding Zone. The subject lands, that are within the hamlet boundary, currently have a zoning of Holding Hamlet Residential (HR(hl/h4). The purpose of the holding zones regulating the subject lands are as follows: a) h1 Purpose: To ensure public health and safety, an agreement with the Municipality, or the satisfying of conditions of severance, which address impacts of new development to the applicable proposed water supply system and/or sewage treatment and disposal system; and which may include issues relating to water capacity, water quantity, water quality, and financial costs will be required prior to the removal of the"h1" zone symbol. d) h4 Purpose: To ensure parcels of land do not become landlocked, proof of access to a public right-of-way by the proponent will be required prior to the removal of the "h4" zone symbol. The applicant must apply for a Zoning By-Law amendment in order to remove the Holding (hl/h4)zone regulations. The Act amends the Planning Act, the Development Charges Act, 1997, the Housing Services Act, 2011 and the Residential Tenancies Act, 2006. Inclusionary Zoning Inclusionary zoning would help to serve more people in need of housing by increasing the supply of affordable units based on local/municipal needs. When proclaimed, the Planning Act will give municipalities the option of requiring affordable housing units as part of residential developments. The government plans to consult on a proposed regulation for inclusionary zoning before the Planning Act amendments are proclaimed. When proclaimed, the inclusionary zoning framework will provide that: • A municipal assessment report is to be prepared prior to adopting official plan policies for inclusionary zoning, subject to any criteria set out in regulation, which is to be reviewed every five (5) years. • Municipal inclusionary zoning requirements must be set out in municipal official plan policies. • While inclusionary zoning by-laws cannot be appealed to the Ontario Municipal Board, except by the Minister, appeals of typical zoning matters, such as building height and density, are permitted even when used as measures and incentives. • Municipalities may permit affordable housing units to be located on another site, subject to criteria set out in regulation. • Municipalities cannot accept cash in lieu of affordable units. .../2 -2- • Municipalities may use section 37 of the Planning Act(building height and density in exchange for community benefits) in combination with inclusionary zoning, subject to criteria set out in regulation. • Landowners must enter into agreements with the municipality that are to be registered on title and enforceable against subsequent owners to ensure the units remain affordable over time. • The Minister is provided with regulatory authority to exempt certain developments from inclusionary zoning. • Municipalities must establish procedures for the administration of affordable housing units so that they remain affordable over the long term and for reporting on affordable housing units. Secondary Suites Secondary suites are a potential source of affordable rental housing and could allow homeowners to earn extra income. As noted in my letter dated November 1, 2016, the ministry is working on a number of initiatives to support the creation of second units, including through the Promoting Affordable Housing Act, 2016. When proclaimed, changes to the Development Charges Act, 1997 will require municipalities to exempt development charges for second units in new homes. This could help reduce the cost of constructing second units in new homes by exempting such developments in the same manner as second units in existing homes are exempted. These changes would also require enabling regulatory amendments that may be proposed in the new year. It is the second-largest bargaining unit under the Canada Post umbrella; representing members who work in post offices in towns, reserves and villages throughout rural Canada. We are in touch with over 6 million rural customers on a regular basis. Most often we are the only federal presence and the hub of the community. CPAA members, 95%of them women, operate 3,260 post offices across Canada; 566 of these offices are in your province. We write to you today to share our concerns over the Federal Government Standing Committee on Government Operations and Estimates' (OGGO) report regarding Canada Post, released on December 13, 2016. If you have not seen it yet,you can access the report at the following web address: http://bit.ly/OGGO_EN Amongst the many recommendations made by the Committee,most of which we support,we note the absence of a recommendation on postal banking. In your province alone 44% of the communities do not have a financial institution,yet they have a corporate post office. Often your constituents have to travel long distances to receive banking services. If your citizens have to travel out of town for banking services, it is almost certain that they will also patronize other businesses in that town or city, thereby losing earning opportunities from your own town's businesses. We at CPAA strongly feel that the resurrection of the postal bank, which was closed in 1969 when large banks were expanding in rural Canada, is a perfect fit for Canada Post. More importantly for the businesses and the citizens of your community, it is a means to ensure access to financial services. You may remember that prior to the OGGO's report, the Government had set up a Task Force to examine the challenges of Canada Post and to provide options for the future of the Corporation. The Task Force report', which preceded the OGGO's report, mentioned that 39% of Canadian businesses would use a postal bank. It also mentioned that 38% of Canadian citizens would use a postal bank. 1 http://bit.ly/tpsgc According to the 2011 Census, Canada's rural population consisted of 6,329,414 citizens. What bank could not succeed with 38%of that number of customers? The Liberal Government first announced $230 million in investments for natural gas expansion in 2014, and we still haven't seen a single cent of that money spent. Meanwhile, the government's announcement at this week's conference amounts to a cut of $130 million from the original promised investment. What's more, I question the government's commitment to the future of natural gas in Ontario. Last May, The Globe and Mail reported on a leaked copy of the Climate Change Action Plan that was debated within cabinet. The document detailed a plan to phase out the use of natural gas for home heating in a little more than a decade. While the Liberal Government immediately denied that they had any plan to phase out natural gas once the document was made public, comments made by the Minister of Environment and Climate Change Glen Murray suggest otherwise. On May 12, 2016, Glen Murray was quoted as saying in the Legislature "home heating in the future is going to have to come from sources other than natural gas." The time for action and investment in natural gas infrastructure is now. Ontario has already missed out on business investment opportunities because of a lack of natural gas infrastructure. An Ontario PC government would make investing in natural gas infrastructure an immediate priority. Attached in Appendix "A" is a summary of the portfolio performance for the year 2016. All investments listed are short-term, meaning the Municipality can withdraw funds at any time; the exception being the municipal drain/water debentures held. The municipal drain/water debentures portion of the portfolio is minor (less than 10%). The majority of the Municipality's investments (90%) are with The One Investment Program, a joint program administered by Local Authority Services Limited (LAS) and CHUMS Financing Corporation. These entities are wholly owned subsidiaries of Association of Municipalities of Ontario (AMO) and the Municipal Finance Officers Association (MFOA) respectively. All of the Municipality's funds in The One Fund are invested in the Bond Portfolio which is comprised of treasury bills, guaranteed investment certificates and government bonds. The above noted consultant team fees include pre-tender facility assessments, mould remediation assessments/reports, pre-tender design, tender design, and project management services in the amount of$121,808.41+HST. As a result of in year efficiencies this amount has been netted out of the 2016 Surplus presented in Report TR 08/17, which in-turn preserves the $150,000 2017 Facility Reserve transfer, in its entirety, for future projects. Beyond the above, and the positive feedback received to date about the rehabilitated Straffordville Community Centre the following has also been realized: 1) All costs for the Straffordville Community Centre Rehabilitation project have been accounted for in the 2016 Year End calculations. a. The Reserve chart within Report TR 07/17 demonstrates 2016 Year End Reserve levels fully accounting for the Straffordville Community Centre Rehabilitation Project. Does not include year-end surplus transfers to reserves or proceed from sale allocations, which will further increase reserve levels. 2) Proceeds from sale were not required to fund any of the works, as was authorized within the July 26, 2016 resolution of Council, and can instead be allocated to Reserves. During RFT 16-04 specific outdoor facility related amenities were costed including the following: 1) Digital Signage - $22,000 a. Design attached hereto as Appendix 'A' 2) Landscaping - $10,833.93 a. Sod, and greenery around digital signage, flag poles, Lion's statue and river rock around drainage outlets. Includes removal of two trees and trimming of one. 3) Parking Lighting - $5,690.00 a. 30 Ft. wood pole with 3x87W LED Flood Lights on a photocell b. Minor asphalt improvements, specifically around accessible parking spots, will be conducted in 2017 and funded from the Public Works Operating Budget. 4) Three (3)flag pole array- $5,000 5) Three (3) Outdoor Security Cameras - $7,000 a. mounted on the SCC monitoring the parking lot and parkland areas As a result of the avoidance of expenditures from the 2016 Proceeds from Sale and the 2017 Facility Reserve allocation during the SCC project, staff respectfully recommend Council consider funding the above noted expenditures from the 2017 Facility Reserve Allocation. SUBJECT: 2016 Q4 VARIANCE REPORT BACKGROUND: The Q4 (fourth quarter) financial reports are provided for Council's fiduciary review. This report provides a summary of current revenues and expenditures to December 31, 2016 and variances to the operating budget. In addition, a year-end reserve report and 2016 sale of asset report are also provided. DISCUSSION: Operational departmental variances are noted within the attachments and all capital programs were substantially completed in 2016. The 2016 operating and capital year brought several positive operational results from cost reductions, to new revenue, cost recovery initiatives, and improved procurement. The Municipality is still exposed to risks in the upcoming year which include: foreign exchange fluctuations for materials and supplies, interest rate risk, municipal road drain work, weather and winter maintenance. SUBJECT: 2016 SURPLUS ALLOCATION PURPOSE: To approve allocation of the 2016 operating surplus of$187,956.62 through reserve transfers. BACKGROUND: The 2016 financial statements have been drafted by the Treasurer and an operating surplus of $187,956.62 is estimated for 2016. Section 290 (4) (b) of the Municipal Act requires that any surplus from a previous year be included as an estimated revenue within the current budget. If this process is followed each year, during years where large fluctuations in surpluses occur, large tax rate fluctuations may also occur. Therefore, it is common practice for municipalities to allocate their annual surplus to reserves. ATTACHMENTS: 1. Appendix A: 2016 Surplus Transfer Report RECOMMENDATION 1. The engine in the grader recently failed and reached its end of life. DISCUSSION The Municipality has previously rebuilt the transmission and in 2016 installed new tires on drive axles of the 1986 Grader. The hydraulic system has been reviewed in addition to the moldboard and all appear in good condition. The grader currently has 13,525 hours on it. It is the opinion of Public Works staff that the utility and condition of the grader merits consideration of a replacement engine. Public Works staff have sourced two engine replacement prices: 1) New Equipment Company - $14,500+HST a. 1,000 Hours/12 Month Warranty i. Additional 1,000 Hours/12 Months @ $1,310 b. Quote includes transfer of clutch and any part transfers from the old engine. 2) Strongco London - $25,595.05+HST a. 2,000 Hours/24 Month Warranty In addition to replacement Public Works staff considered: 1) Contract shoulder grading; 2) Hire standby contractor for winter/as needed grading; 3) Rent a grader when needed for specific use; Ultimately Public Works determined replacement of the engine would maintain current service levels and would be a sound investment in an important piece of equipment. The Treasurer confirms the availability of funds from the Equipment Reserve. RECOMMENDATION 1. THAT Report CAO-05/17 re 1986 Champion Grader be received for information. 2. AND WHEREAS Section 268(1) of the said Municipal Act provides in part that every municipality with authority to sell land shall pass a by-law establishing procedures governing the sale of land. AND WHEREAS the Municipality of Bayham passed By-law No. 2015-021 to establish a procedure governing the sale of municipal owned land. AND WHEREAS the Council of the Municipality of Bayham is desirous of selling property owned by the Municipality and has completed procedures pursuant to By-law No. 2015-021 for the sale of the subject lands. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICPALITY OF BAYHAM ENACTS AS FOLLOWS: 1.
