The regular meeting of the Council of the Municipality of Bayham was held on Thursday, May
19,2011 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Mark Taylor,

(a) 7:05 p.m. - Paul Vyse of Otter Valley / Port Burwell Optimist Club regarding "Tub
Dazet'.
Paul Vyse advised that due to the difficuþ experienced in obøining a special occasion permit,
the Optimist Club has decided not to serve alcohol at Tub Daze this year. He noted they would
be serving food and soft drinks and selling souvenirs this year.
In response to his inquiry, the Administrator advised that the extension of the group's liability
insurance would be required to cover the event.
(b) 7:15 p.m. - Jan Collins of Vienna Citizens Group regarding "Saving the Vienna Town
Hall and Vienna Park".

Jan Collins noted that the Ontario Trillium Foundation had declined to approve the recent
application to save the historic Vienna Library as per agenda inforrnation item 5(1). She added
that Council support was required to try again. The next deadlines are July I st and November
lst. She suggested business and public support would be sought through donated services as well
as cash donations.

In regard to park beautification Ms. Collins noted that there is no signage to discourage people
from driving and parking on the grass near the skate park. She requested support for placement
of five hanging flower baskets a little bigger than those purchased in 2010 estimated at about $25
each.
Ms. Collins was advised that the 2011 budget is not yet filnalized and that staffwould be
preparing a report on surplus buildings for Council's consideration.
In response to the request to place wheel rims for burn barrels, Ms. Collins was advised that the
Long Point Conservation Authority would need to approve any alterations along the creek bank
and that outdoor buming is not perrniffed except for cooking.

Councillor Southwick raised concenm over the recent number of calls and associated policing
costs for dealing with problem raccoons in urban are¿¡s.
He suggested that the Port Burwell by-law restricting fueanns be repealed and that volunteer
local licensed gun owners could be solicited to dispatch unhealthy raccoons at no cost.
Staffwas requested to look into options and report back to Council,
(d) Request to use the municipal sign regarding "Corinth Yard Sale and BBQ".
On behalf of the Corinth volunteer fundraising group, Councillor Ketchabaw suggested Council
permit use of the municipal sign to advefise a Yard Sale and BBQ.

The fourftr 2011 budget meeting of the Council of the Municipality of Bayham was held on
Wednesday, l:llfay 25,2011 in the Council Chambers. Present were Mayor Paul Ens, Deputy
Mayor Mark Taylor, Councillors Tom Southwick, Wayne Casier and Ed Ketchabaw,
fldministrator Kyle Knrger, Clerk Lynda Millard and Treasu¡er Denis Duguay.

Mayor Ens called the meeting to order at 7:00 p.m.
2. DECLARATION OF PECUNIARY INTEREST AND THE GENERAL
NATURE THEREOF

DELEGÁ.TIONS
7:00 p.m. - RayMaddox regarding "Inactive CemeteryMaintenance".
Ray Maddox presented his request for support of $10,000 in budget dollars including staff
assistance to conduct clean up and repairs to inactive Bayham cemeteries. He circulated pictures
of various cemetery sites. Proposed works would include tree and brush cutting, cleanup and
removal, boundary fence repairs, monument repairs, leveling and surface cleaning. He noted that
limestone marker surface cleanìng can be done with a solution of 50Yo each vinegar and water
followed by a thorough flushing with clear water, as the vinegar itself is corrosive. He raised
safety concems regarding the retaining wall at the Old Eden cemetery. Mr. Maddox suggested
that work be rotated throughout the three wards until all are improved.
Council requested that a proposed work plan be submitted with cost estimates for their
consideration.
Council was supportive of a reduction of $5,000 for 2011
3. 20ll DRAF'T BUDGET
(a) 2011 Draft Budget as previously circulated.
The Treasurer identified revisions that had been made to the draft budget.
The Administrator provided a list of municipal properties. Surplus properties are to be identified
for the next budget meeting.
As the operating budget currently is at a l4o/o increase over 2010, possible areas for reductions
were discussed.

Suggestions for reductions included the following:
Council travel was reduced by $1,000;
Policing reduced by $2,500;
Building Services - training reduced by $1,000
conferences reduced by $500;
BIL Enforcement salaries reduced by $10,000;
Roads - clearing-other reduced by $5,000;
Cemetery improvement reduced by $5,000.
Staffresponded to inquiries from Council members as appropriate.
Following further discussion, súaffwas directed to provide recommendations for further
reductions to lower the tax rate increase to IYo.
The next budget meeting was set for Monday, June 6th at 7:00 p.m.

MTO announces support for the collection of municipal bridge data
At the recent ROMA/OGRA Combined Conference, the Honourable Kathleen Wynne, Minister
of Transportation, stated her continued support for the assessment of municipal bridge
infrastructure needs across Ontario and encouraged municipalities to apply to OGRA for
funding.
ln March 2010, the Ministry of Transportation (MTO) entered into an agreement with OGRA and
provided $750,000 in funding to help Ontario municipalities collect and report data on the extent
and condition of bridge structures.
This funding enabled over 175 municipalities to contribute bridge structure data for input into
OGRA's Municipal DataWorks (MDW). There are now a total of 300 municipalities with bridge
data in MDW.
MTO is providing an additional $300,000 for OGRA to assist municipalities collect and input
bridge structure data into MDW. Through this funding and the efforts of the OGRA, it is
anticipated that the number of municipalities with bridge data in MDW will increase to 385.
OGRA President John Curley stated "We are pleased with MTO's announcement to extend
funding and support for this project. These funds will allow us to get a better picture on the
condition of bridge structures across Ontario and maintenance requirements."
'We encourage OGRA member municipalities who have not submitted bridge data to apply for
funding by June 15,2011 to have their data inputted into MDW.' said Joe Tiernay, OGRA
Executive Director. "Our hope is to lead the way for improved municipal infrastructure planning
and allocation of resources across Ontario."
Details on how to apply for funding can be found on the OGRA website at www.ogra.org.
The mandate of the Ontario Good Roads Association is to represent the infrastructure interests
of municipalities through advocacy, consultation, training and the delivery of identified services.

Minimum Maintenance Standards Litigation - Status Report

Background
Last year all heads of Council received a letter advising that a legal challenge had been
filed to have the Minimum Maintenance Standards (MMS) declared null and void. The
letter requested municipalities consider contributing to a Litigation Fund to fight the
application. I am pleased to report that many municipalities have contributed to the fund
and we are proceeding with our opposition to this application. lf your municipality is still
considering the request please let me know at your earliest convenience as to whether
funds will be forthcoming.
This memo is intended to keep all municipalities informed as to the progress to date on
this important matter.
Discussion
OGRA has retained J. Munay Davison, Q.C. of the law firm, Paterson, MacDougall, LLP
as our legal counsel to represent your interests. Mr. Davison is very knowledgeable in
the area of Minimum Maintenance Standards having volunteered his time and expertise
in the development of the initial standards and the 5 year review that was recently
undertaken.
Our counselfiled an application with the courts to grant OGRA intervenor status. The
opposing counsel did not object to this application and the court issued an order adding
OGRA as intervenor on October 8, 2010.
A MMS Litigation steering committee made up of representatives from the Ontario Good
Roads Association; the Ontario Municipal lnsurance Exchange (OMEX);the Regional
Municipality of York; the Province of Ontario; the Waterloo Region Municipalities
lnsurance Pool and Frank Cowan Company Limited met on May 25,2011 and received
an update from our legal team.
The plaintiffs Counsel has filed a motion for the production of all documents associated
with the creation of the original Minimum Mainterrance Standards.

Our litigation team is supporting two motions filed by the Crown. The first being to limit
the scope of the hearing to the standards that were in effect at the time of the accident

Superior Court to the Divisional Court. ln the Superior Court only one judge presides,
while at Divisional Court three judges preside. Our legal team feels that this move
would be advantageous to our position.
All the above referenced motions are currently scheduled to be heard on June 13'2011.
A further update will be issued subsequent to that hearing.
We previously advised that the Ontario Trial Lawyers Association was going to seek
intervenor status. They have not done so to-date however we anticipate that they will
do so later.
At this time there is a possibility that the application will be heard in the fall of this year,
however the prevailing opinion suggests that it might not be heard until spring of 2012.

For years, the Ontario Family Fishing Weekend Committee has been asking the
Province of Ontario to increase this popular event to a full week to run in
conjunction with the National Fishing Week. Last year was the first year we
had nine days of licence-free fishing. Thanks to partnerships with many
nongovernment organizations, such as the Ontario Federation of Anglers and
Hunters, this is the second year that Canadian residents have the opportunity
to fish licence-free in Ontario for a full week.
This summer, Ontario Family Fishing Week is scheduled from Saturday, July 2
to Sunday, July LO, 2OLL During this week many fish festivals, clinics, or
conservation and educational activities may be held in your area.
Would you please help us publicize the 2011 Ontario Family Fishing Week in

yourself? ln addition, please consider "declaring" these dates as Ontario

a) Barn Quilt Meeting: Each municipalityhas asked to submit 12-15 photos of
potential locations forbarn quilt posters. Each should show the view from the road and
include the 911 number. C.Buchanan reported that very few photos have been
submitted for consideration so far.
b) May 27 \Mallenstein School Tour: At 10:00 am C.Buchanan and student staff will
host a school tour at the Marine Museum and after lunch, J.Woon and student staff will
host them at the Edison Museum.
c) Doors Open Registration: L.Millard will submit our registration forms.
d) Flagpole painted: L.Millard reported that the flagpole cannot be lowered but
committee members will examine it to see if cutting the bolts at the bottom would
allow for it to be lowered.

Summer Student Staffing: C.Peters and C.Buchanan interviewed 4 boys and 8
girls, all of whom were pretty good. Only 2 applicants had previous experience
with us, and one of them, Julianne Cema, was rehired and will be initiallyrotating
between the two sites. She will work at the Ligbthouse on May 14 during the Blues
Fest. At the Edison Museum Hannah Howey and Kala Ferris were hired. At the
Marine Museum Nathan Underhill and Janine Zylstra were hired. Our preferred
candidate for the "supervisory role" has accepted an alternate job, so L.Millard will
repost for this position. R.Maddox suggested that if one of our current students
demonstrates strong supervisory skills this year that we should offer them the
position of supervisor for 2012. Committee members agredwith this suggestion.
Shunpiker Tour: The beautiful weather on May 8 brought out record numbers of
visitors. There were approximately 700 names on the "sign-in" sheet at the Marine
Museum, however many chose not to sign in. It came to our attention that many of
the visitors had been to the \Mind Interpretive Centre, which was not open. Next
time there is a Shunpiker Tour to our are4 we should anange to have it open as
well.
7. NE\il BUSINESS:
a) NavyBlues Fest: B.Hickey & C.Buchanan will open Marine
Museum and student Julianne Cema will open lighthouse at
l1:00 am on l;Ù..4:ay 14 during NavyBlues Fest until 6:00 pm. The
regular $2 admission fee will be charged.
b) 150th Anniversary of Vienna Anglican Church: All members
of Museums Bayham are invited to attend St.Luke's Anglican
Church's 150th anniversary on May 29,2}ll at 4:00 pm. Those
planning to attend are asked to rsvp to M.Schafer
ms chafer@amtelecom. net.
c) Oxford Rifles shoulder Flashes: Ian Raven, of the Elgin
Military Museum, has advised that our two "Oxford Rifles"
shoulder flashes need to be secured under glass, as they are very
valuable. The Chairman & Vice-Chairman agreed to plan a
remedy for this situation.
d) Sandwich Board Enhancement: R.Bradfield requested that our
current sandwich board sign, which reads "Museum Open" be
enhanced to read "Marine Museum Open".
e) Original Bathtub Racer: The original bathtub, which sailed
across Lake Erie is falling apart. As this is a valuable part of our
local history, B. Hickey will approach Ed Mathews to see if he
will rebuild hepair it for display purposes.

New Business Continued:
Ð Storage of Reference Books: The Marine Museum has several
fine reference books that are stored away and not available for
patrons to use. R.Bradfield requested that a designated bookcase
be provided for our reference books.
g) Cleaning of Museums: Members have noticed cobwebs and
dust at both sites and wondered if they had actually undergone
spring-cleaning yet. B.Hickey will check with the Municþality
to see if this has been done.
h) Damage to Storage Shed: Heavy winds have damaged shingles
on the roof of the storage shed beside the lighthouse. B.Hickey
will contact the municipalityto request that PIV staffmake the
necessary repairs. It was noted that R.Bradfield recently replaced
both the front and back doors on the shed.
Ð Photo Cell Repairs: The photocell switch that automatically
turns the lighthouse's lights on & offisn't working and the lights
have been burning continuously. It was moved by J.Woon and
seconded by R.Bradfield that C.Buchanan contact the original
electrician to return and make the re,pairs. Motion Carried.j) Abandoned Cemetery Committee News: R.Maddox reported
that the "Abandoned Cønetery Committee" will be repairing
fencing and lifting some stones. They are also seeking training
on cleaning mould from tombstones.
k) EON Training Session: EON is planning a "Student Training
Session" for Sat. June 1l at the County building. Mike Baker and
others will provide instruction.

Tonight's activity was a guessing game. Everyone selected a partner. Each person was to
write a famous person's name on a card and tape it to their partner's back. Each member
was to introduce themselves and provide a personal fact to their contact. This allows you
to ask one question about the name on your back. After about l5 minutes of networking a
couple of people managed to correctly guess their mystery person.

The date should read June 21. Also Marion Rogers will be speaking instead of Rainey to
item 6 - Port Burwell Theatre. Doug Lester asked to discuss Wi-Fi on the beach. All in

at this event. Lynn has some tickets. Advanced tickets are $5 cheaper then at the door.
June 21 will be a Business after Nine to celebrate the Summer Solstice at Schooners
Galley in Port Burwell. It will be a Hawaiian theme so plan on dressing up.
Tub Daze. Fireworks are the Sunday night and the beer tent is still in question.
A fall Business after Five is still in the works. Contact Lynn if you would like to host.

Port Burwell Theatre
Marion Rogers introduced the idea of having professional and community theatre in Port
Burwell. She has contacts with Buddy Brennan and John Snowden who are interested and
capable of bringing professional theatre productions to the area with as little as two
months of preparation. What is required is a steering committee to get things started and
then a board of directors. Volunteers will be needed for all the behind the scenes work.
Noel Hayes volunteered for the steering committee.
Other business
Wi-Fi on the beach - Doug Lester said it would be approximately $30 a month for
activation and asked if the OVCC should have it again this year. The OVCC applied for
funding from the municipality but no information will be available until after the
municipal budget meeting. Bob Lozon raised the motion for the OVCC to sponsor the
Wi-Fi on the beach. Seconded by Doug Lester. All in favour. Bob Lozon will contact the
service provider.
Ojibwa- Ian Raven said that an engineering meeting is scheduled for May 4,2011to
discuss the timeline and determine if the project is still on schedule. Cheques are being
written and the main tasks now are mostly trying to meet all the rules and regulations.
Jabez Therapy Ranch - There is a fundraising Yard Sale at No Frills in Aylmer June 41h
starting at 7:00am. Email Arn is you have anything you would like to donate.

Post Offices - Jan Collins said she read an article about the closing ofrural Post Offrces.
A rural Post Office could be closed once the Post Master retires. Jan expressed her
concerns about how difücult it would be to do business without a local Post Office. Doug
Lester suggested that this issue would be a great topic of conversation at a breakfast
meeting and asked Lynn if she could schedule a breakfast meeting this fall with Joe
Preston.

following the announcement of non-compliance by a member to comply with the
reporting requirements prior to the seat being declared vacant;
AND WHEREAS Section 80 of lhe Municipal Elections Acf sets out the penalty to
municipal election candidates who have not complied with the financial reporting
requirements provides for the automatic vu¡cancy of the seat on Council and the
candidate being deemed to be ineligible to be elected or appointed to any position
covered by the Municipal Elections Act until after the next municipal election;
AND WHEREAS there is a discrepancy in the standard to which elected representatives
are being held to between the provincialand municipal levels ín relation to the penalty
for non-compliance for election financial reporting;
AND WHEREAS the penalty to municÍpal candidates appears to be far beyond what
would appear to be fair and reasonable, considering that the sentence could amount to I
years of ineligibility to be elected or appointed;
NOW BE lT RESOLVED THAT the Council of the Corporation of the Township of Head,
Clara & Mada supports the position of the Municipality of Elizabethtown-Kitley and
strongly requests:
THAT the Province of Ontario immediately amend the Municipal Elections Act to ensure

Every person shall keep every front yard free and clear of any equipment or material
relating to Renewable Energy Projects including, but not limited to, Ground and/or Pole
Mounted Sola¡ Photovoltaic@V)Systems, Wind Facilities or any other like equipment.
And whereas Council has received confirmation of an individual:s intention to install
large ground mounted solar systems on a vacant lot in a residential area in the
municipality;
And whereas the Town of Thessalon has been advised by the Ministry of Municipal
Aftairs and Housing that the Green Energy and Green Economy Act, 2009 made
amendments to the Planning Act, most notably the addition of a new section 62.0.2 which
exempts renewable enerry projects from most land use planning instruments under the
Planning Act, including municipal ofFrcial plans and zonlng, site plan control, interim
control and holding by-laws, thus eliminating the need for a property owner proposing a
renewable energyproject to seek an official plan amendment or a change to a zoning by-
law, among other matters;

Act, 2009, Council is sensitive regarding the impact such installations will have on
adjacent properly owners who will be in extremely close proximity to such proposed solar
systems;
Now therefore be it resolved that the Council of the Corporation ofthe Town of Thessalon
hereby petitions the Government of Ontario through the Minister of Energy and
Infrastructure to reconsider the provisions of the Green Energy and Green Economy Act,
2009 and to address the provisions having regard for the negative impact created by the

I would like to update you on the recently announced P3 Canada Fund Round Three
application intake.
As part of the Round Three intake, PPP Canada has requested that applications from Ontario be
directed to fnfrastructure Ontario (IO) who will administer the program and assist applicants
as required throughout the process.
IO has built a strong relationship with Ontario municipalities through its successful Loan
Program and has vast experience in AFP/P3 project delivery that will be of value to
municipalities as theyreview potential projects for submission to the P3 Canada Fund Round
Three Intake.
The focus of the P3 Canada Fund has been on economic growth, supporting a cleaner
environment and building stronger communities. Collectivel5 PPP Canada received more than
80 applications from across Canada in Rounds One and Two of the program. Projects involved
green enetgy, water, wastewater, transportation and more.
A comprehensive program guide is available online. It describes the tlpes of projects and
applicants that are eligible for support through the P3 Canada Fund, as well as the process used
by PPP Canada to identiff P3s for support through the program. The guide and application are

WE'RE ALWAYS ASKED ... WHAT CAUSES CRASHES? HERE ARE 1,950 ANSWERS
(Elgin County) - ln a recent wrap up of the week 16-24 May, 201 t here is what we
found in Western Region. Officers found and arrested 36 drunk drivers and located 27
others who registered in the'\Marn" range along with 2 folks driving while prohibited from
law to do so. ln addition to this OPP charged 60 persons for failing to yield to traffic,
another 43 with careless driving and 1, 383 for speeding. We charged 16 persons with
racing legislation and charged 134 other persons for not wearing their seat belts.
Additionally 249 drivers were charged during the Distracted Driving Campaign.
"lt's quite disturbing that 36 people would take the lives of innocent people into their own
hands and drive impaired." - Traffic and Marine lnspector Wayne Burke. Everyone who
condones impaired driving, careless driving, speeding, non seat-belt compliance or
distracted driving is equally responsible for injury and deaths on area roads.
The Ontario Provincial Police encourages everyone to be vigilant in reporting bad or
illegal driving actíons immediately. The best way to reduce injury and death on our
highways is for everyone to work together. Road safety is everyone's business and it
begins well before the vehicle is ever turned on.
Anyone of these 1,950 offenders could have easily injured or killed another motorist or
pedestrian during this week. Thankfully, offícers were able to enforce and educate the
need for voluntary compliance of allthe road safety rules. Before you turn the car on
next time, ask yourself; Am I part of the problem or the solution to highway safety?

June is Seniors' Month, a time to celebrate and honour seniors - their knowledge, experience
and the contributions they make every day in commun¡ties across the province. Ontario's 2011
theme, Live lt Up, emphasizes the benefits of active, engaged living at any age.
Seniors' Month is an excellent opportunity to let Ontarians know what our government is doing
to help ensure Ontario remains one of the best places in the world in which to grow older.

Purpose
This report is to recommend approval of a Development Agreement with Nariender Grewal.
Bacþround
Nariender Grewal is proposing to sever four (4) lots on Sand¡own Road in the Village of Straffordville. One
condition of the severances is to enter into a development agreement for municipal sewer services, being an
extension is required to service the four proposed lots. An application to the Ministry of Environment for the
Certificate of Approval of the sanitary sewer extension is currentþ in process.
Current Status
Staffhave reviewed the final drawing as prepared by Cyril J. Demeyere Limited and are satisfied with the
presentation of the proposed works. Mr. Grewal has secured a contractor to perform the works and is now ready
to enter into the agreement with the municipality. The final drawing is attached to the agreement as Schedule
"C". The required security deposit will be collected fromMr. Grewal priorto the commencement of
construction.

WHEREAS Section l l of the Municipal Act, 2001, R.S.O. 2001, c.25 as amended provides that a
lower tier municipahty may pass by-laws respecting public utilities, including sanitary sewage
collection.
AND \ilHEREAS Nariender Grewal is the owner of lands in Part Lot 123, Concession NTR,
being Parts 1,2,3 & 4 on Registered Plan 11R9274, in the Village of Straffordville in the
Municip ality of B ayham.
AND WIIEREAS the said owner has made applications for consent to create four village
residential building lots (County of Elgin Land Division Committee Applications F,65109,F,66109,
F,67109 and E68/09).
AND WHEREAS the County of Elgin Land Division Committee has granted the subject
applications, subject to conditions including the condition that the owner execute a se\ryer services
development agreement for the lots.
AND \ryHEREAS prior to development occurring on the subject lands, certain services, namely
installation of sanitary sewers and the completion of satisfactoryplans, are required.

Hereinafter called the "Municipality''
OF THE SECOND PART
WHEREAS the Owner represents that he is the registered owner of the lands and premises in Part
Lot 123 Concession NTR, Village of Straffordville, in the Municipality of Bayham, in the County
of Elgin, being more particularly described in Schedule "4" attached hereto (hereinafter called the
"said Lands');
AND WHEREAS the Owner is desirous of subdividing a portion of the said Lands as more
particularly set out on a plot plan marked as Schedule "B" attached hereto showing the lots to be
created;
AND WHEREAS a Consent to Sever was granted by the County of Elgin Land Division
Committee on July 22, 2010 for applications E65/09,F,66109,F,67109 and E68/09 conditional
upon (inter alia) the entering into of an agreement dealing with services for the lots to be created;
NOTV THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the sum of
TWO DOLLARS ($2.00) of lawful money of Canada now paid by the Municipality to the
Owner, the receþt and sufficiency whereof is hereby acknowledged, the Owner covenant and
agree with the Municipality to do and perform at their own expense the following matters and
things:
Municipal Engineer
1. 'Wherever the phrase "Municipal Engineer" is used throughout this Agreement, it shall
mean the Municipality's Chief Building Official, the Municipality's 'Water/ïVastewater
Superintendent, or the Municipality's Manager of Public 'Works or such other person as
the Council of the Municipality may from time to time appoint to deal with the
administration of this Agreement.

2. The following Schedules are hereby declared to form part of the Agreement between the
parties:

3. The Owner shall apply for a Zoning ByJaw amendment (removal of holding symbol) as
required by the Notice of Decision for Consent. The arrangements contemplated in this
Agreement are conditional upon removal of the holding provision. The Municipality
agrees to consider the proposed application in the context of these arrangements.
Access
4. Access to the lots to be created shall be at the location applied for and approved by the
Municipal Engineer. The maximum width of a drivewaymeasured along the street line to
serve a residential use shall be nine (9.0) metres (30 feet).
As-Constructed Drawings
5. The Owner shall provide for the Municipality records "as-constructed" drawings to the
satisfaction of the Municipality for municipal services installed by the Owner. These
drawings shall be submitted in a satisfactory form prior to the release of any performance
bond or security required by this Agreement.
Plans and Specifications
6. Plans and specifications for all works and services herein required to be done by the
Owner shall be first submitted to the Municipal Engineer in a form satisfactory to him
and such work shall not be coÍrmenced until the Municipal Engineer has received such
plans and specifications and has expressly authorized, in writing, such work to
coÍtmence. All works and services shall be constructed and installed strictly in
accordance with the said plans and specifications, all to the satisfaction of the Municipal
Engineer. The Owner agrees to construct all services and provide other requirements that
will be known only after the details of the engineering design are submitted to the
Municipality. The Municipal Engineer may require, in writing, such variance from such
plans and specifications as may be required by conditions which may be disclosed as the
work progresses, and by sound engineering practice. The works and services required to
be done by the Owner, including but not limited to engineering and restoration works,
shall be wholly at the expense of the Owner except as may be otherwise herein expressly
provided.

Sanitary Sewers

a. Sanitary sewers shall be constructed of such size, type, position and extent as are
shown on the plans and specifications provided in Schedule "C" that have been
approved by the Municipal Engineer. Any material changes to be made to these plans
and specifications shall require approval by the Municipal Engineer in writing, such
approval not to be unreasonably withheld. Storm sewers, if required by the
Municipality shall be constructed of such size, type, position and extent as are shown
on the plans and specifications approved by the Municipal Engineer or otherwise
required by him in writing. The Municipal Engineer may require this work to be done
by a contractor whose competence is approved jointly by the Municipal Engineer and
the Owner, at the expense of the Owner. It shall be the responsibility of the Owner to
provide a satisfactory outlet for said storm sewers, if required, and sanitary sewers
(which for the purpose of this Agreement, shall mean the nearest approved Municipal
sewer outlet).
b. Sanitary sewers, with sanitary private drain connections shall be constructed to the lot
line of the subject lands.
c. Storm sewers including catch basins and connections, if required by the Municipalit¡
shall be provided and connected as shown on the approved plans and specifications.
d. If the works lead to the installation of storm or sanitary sewers, to be assumed by the
Municipality, located on easements over private property (including land owned by the
Municipality that is not a road allowance), all sanitary sewer manholes shall be located
in a location acceptable to the Municipal Engineer in order to facilitate maintenance of
the sanitary sewer system by the owner, and all storm sewer manholes shall be placed
in easily accessible areas if not placed in paved parking lots or driveways.
e. The Owner agrees to notiff their consulting engineer in the event that any existing
sewer or drain is encountered during the progress of construction. The Owner further
agree to have its consulting engineer investigate the matter and comply with the
recommendations of its consulting engineer as approved by the Municipal Engineer's
Department with respect to the sewer or drain encountered, such as connecting the
existing sewer to a new sewer being constructed or into another existing sewer, at no
cost to the Municipality. Adequate se\ryer easements are to be provided to the
Municipality if necessary. The Owner shall also ensure that there is no intemrption to
any subsurface drainage flow because of construction on the site that would have an
adverse affect on neighbouring properties. Should such an intemrption occur, the
Owner shall carry out any necessary remedial work to correct the problem as
recommended by its consulting engineer and to the satisfaction of the Municipal
Engineer, at no cost to the Municipality.
f. Connection charges are payable before any dwelling unit is connected to the public
(sanitary) serryer system. Such charges are payable prior to issuance of a building
permit, in accordance with the fees and charges in force and effect at the time of
application for such building permit.

Sewer Ownership
8. The Owner acknowledges and agrèes that the Municipality will not accept ownership nor
allow connections of any tlpe until the works are completed to its full satisfaction, and
such determination is at the sole discretion of the Municipality.
Grading and Drainage Plans
9. The Owner shall prepare and deposit with the Municipality a grading and drainage plan
approved by the Municipal Engineer showing the final grades of all roadways, Any lands
designated for drainage works and all drainage facilities shall be indicated on such plan to
the satisfaction of the Municipal Engineer. The Owner shall agree to carry out or cause to
be carried out the recommendations of the grading and drainage plans, which shall form
part of this Agreement as Schedule "C".
Roads
10.
a. The Owner, or their consulting engineer, shall ensure that any proposed excavation,
construction, entrance or exit installation, demolition, etc. will not interfere with or be
in conflict with location and/or depth of any existing underground facilities, including
sewers, pipelines, mains on street allowances or private rights-of-way, services, meter
and regulator installations, valve boxes, cathodic protection test points, etc. In
instances of apparent conflict, the Owner, or their consultant, shall obtain field locates
from the appropriate commission, utility or agency.
b. All streets and walkways, if any, shall be graded, including fill or excavation as
required by the Municipal Engineer to their full width of the allowance before any
building permit will be issued and the approved road allowance grades from sheet line
to street line shall be maintained at all times to the grades and levels and to the
specifications and requirements and to the satisfaction of the Municipal Engineer until
the date of passing of the by-law assuming the said streets and walkways.
Inspection and Completion of Works
11. Upon the completion of required off-site works, the Owner shall cause a Certificate of
Completion to be delivered to the Municipality in the following form:

For good and valuable consideration now paid by the Corporation of the Municipality of
Bayham (hereinafter called the "Municipality"), the receipt and stfficiency of which l/we
hereby aclvtowledge, I/we hereby certify that the municipal services constructed pursuant
to the Agreement between the Municipality and Nariender Grewal, Registered as
Instrument No.and pertaining to the property lonwn municipally as
have been:
inspected during construction in accordance wíth standard engineering practice; and

Building Permits
12. No applications shall be made for building permits and no building permit will be issued
until the following materials have been received by the Municipality's Engineer:
a. A survey prepared by a qualified Ontario Land Surveyor showing all necessary
setbacks in compliance with ZoníngBy-laws;
b. a grading and drainage plan approved by the Municipal Engineer showing the final
grades of all lands and roadways.
c. all permits and authorizations have been obtained by the Owner at its expense;
d. the Security has been lodged with the Municipality;
e. other conditions to be considered by the Council and listed here.
Security
13. Before applying for any building permit, or commencing any works on Municipal lands
including road allowances, the Owner shall provide the Municipality with performance
security as follows to be held by the Municipality until all of the obligations of the Owner
have been discharged:
a) ln relation to sanitary sewer services, in the amount of
$22,000.00 (Twenty-two Thousand Dollars)
b) kr relation to road reconstructior/restoration, in the amount of
$2000.00 (Two Thousand Dollars)
The security may be in the form of cash or an irrevocable letter of credit from a chartered
bank. In the case of cash, the Municipality shall hold funds in a non-interest bearing
account. In the case of a letter of credit, the form and content of it shall be satisfactory to
the Municipality.
Default
14. In the event of Owner's default (as determined by the Municipal Engineer), it is
specifically anticipated by the parties that the Municipality will, at its sole discretion,
contract for completion of all required works, services and other obligations, such that all
expenses including administration shall be conducted without cost to the Municipality. In
the event that the funds available by means of the security are insufficient to permit the
completion of all remaining works and services, these shall be completed according to
priorities identified by the Municipality. In the event that the Municipality determines
that all works and services cannot be completed with available funds, the Municipality
may, in the alternative, defer completion at its discretion, pending more favourable
proposals, tenders or completion arrangements. The Municipality has no obligation to
complete works for which funds are not available and the Owner on their behalf and on

behalf of their heirs, successors and assigns, releases the Municipality from any liability
in connection with arrangements for completion.
Workplace Safety and Insurance Board Coveraee
15. The Owner agree that they shall at their own expense procure and carry or cause to be
procured and carried and paid for, fulI Worþlace Safety and lnsurance Board (WSIB)
coverage for all workers, employees, servants and others engaged in or upon any work
undertaken pursuant to this Agreement for which such coverage is required by law.
Insurance
16.
(a) The Owner agrees to maintain insurance or require their contractors to
insurance in sufficient amount and description as will protect the Owner
Municipality from claims for damages, personal injury including death,
claims from property damage which may arise from the Owner's operations pursuant
to this Agreement, including any act or omission of the Owner's agents or employees
while engaged in any activity pursuant to this Agreement and such coverage shall
include all costs, charges and expenses reasonably incurred for any injury or damage.
(b) In addition to the foregoing, the Owner covenant and agree that:
(Ð The limits of liability for Personal Injury, Bodily Injury and Property Damage
combined shall be for not less than Two Million ($2,000,000.00) Dollars for
each occurrence.
(iÐ All policies shall provide that they cannot be cancelled, allowed to lapse or be
materially changed (to the detriment of the Municipality) without at least thirty
(30) day's notice to the Municipality by registered mail.
(iiÐ The Municipality shall be named as an added insured and the policy shall
include a provision for cross liability.
Construction Liens
17.
(a)The Owner shall comply with all of the provisions of the Construction Lien Act.
R.S.O. 7990, c. C.30, as amended from time to time and without limiting the
generality of the foregoing, shall hold in its possession all the statutory holdbacks
and any additional funds required to be held by the said Act. These holdbacks and
funds shall not be disbursed except in accordance with the Act.
The Owner shall, at their own expense, within ten (10) days of receiving written
notice from the Municþality to do so, pay, discharge, vacate, and obtain and
register a release of all charges, claims, liens and all preserved or perfected liens,
made, brought or registered pursuant to the Construction Lien Act, R.S.O. 1990, c.
C.30, which affect any lands of the Municipalit¡ including public highways and
road allowances, and which arise out of the performance of this Agreement by the
Owner and their servants, employees, agents, contractors and subcontractors.
The Owner shall indernniff and hold harmless the Municipality from all losses,
damages, expenses, actions, causes of actions, suits, claims, demands and costs
whatsoever which may arise either directly or indirectly by reason of any failure,

neglect or refusal by the Owner to comply with the Construction Lien Act, R.S.O.
1990, c. C.30, and arising out of the performance of this Agreement by the Owner
and their servants, employees, agents, contractors and subcontractors.
(d) The Manager of Public Works for the Municipali$ may at any time, authorize the
use of all or part of the securities required pursuant to this Agreement, including
cash deposit or letters ofcredit:
(Ð to pa¡ discharge, vacate, and obtain and register a release of all charges,
claims, liens, and all preserved or perfected liens, made, brought or registered
pursuant to the Construction Lien Act, R.S.O. 1990, c. C.30, which affect any
lands, including public highways and road allowances of the Municipality in
the event the Owner default on the performance of this section; and
(ii) to pay to the Municipality any amounts owing to it pursuant to this section.
Indemnification
18. The Owner shall indemniû and save harmless the Municipality against all losses,
damages, claims, actions, demands, suits, costs and interest incurred which arise directly
or indirectly from anything done in connection with this Agreement, whether in
performance of, outside of or contrary to this Agreement.
Other
19. Entry into this Agreement with the Owner shall in no way fetter legislative or
administrative discretion of the Municipality or of any of its officers or staff with regard
to the approval or administration of any matters in connection with any development on
the said Lands.
20. The Owner understands and agrees that there shall be no work performed except in
conformity with all applicable by-laws and Provincial and Federal legislation and
regulations, and this Agreement does not exernpt the Owner from any applicable statute,
regulation, or code of any legislative, administrative, or governmental authority, and the
owner shall obtain and pay for all permits.
Notice to Subsequent Owner
21. The owner agrees that any payments made or works installed pursuant to this agreement
shall not be deemed to be development charges of any sort whether under the provisions
of the Development Charges Act or a byJaw thereunder, or pursuant to any front-ending
provisions of that Act. It is further agreed that the Owner shall not make any claims
whatsoever against the Municipality or any other land owner of any lands for a
contribution or reimbursement in any way for any monies expended by the Owner to
effect the works.
Registration
22. The Owner, at his expense, shall register this Agreement on title to the Lands. The
Owner shall cause a duplicate registered copy and a Solicitor's Certificate to be delivered
to the Municipality in the following form:

ownership of the Municipality and this Agreement shall enure to the benefit of and be
binding upon the appropriate authority and its successors and assigns.
Assignment

Expiry
25. In the event that no construction of the sanitary sewer connection has commenced within
five (5) years from the date of registration of this Agreement the Municipality ma¡ at its
option, on one month's notice to the owner, declare this Agreement to be subject to re-
negotiation, whereupon the Owner agrees that it will not undertake any construction on
the said lands until this Agreement has been re- negotiated.
Separate Covenants
25. All of the provisions of this Agreement are intended to be construed as covenants and
agreements as though the words importing such covenants and agreements were used in
each separate clause hereof. Should any provision of this Agreement be adjudged
unlawful or not enforceable, it shall be considered separate and severable from the
Agreement and its remaining provisions as though the unlawful or unenforceable
provision had not been included.
Municipality' s Expense
26. The Owner shall reimburse the Municipality for expenses incurred in the preparation of
the Development Agreement upon execution of the agreement.

At the previous meeting of Council, it was requested that a program be initiated to provide for a registry
of volunteers who would respond to individuals reporting sick raccoons, instead of a police response. It
had been mentioned that there was a similar form of service from the MNR previously.
Staff contacted the MNR for information on any programs and for input on any legislative issues. Staff
were informed that in the past, MNR supplied licenced trappers names, who may not have charged for
services due to the value of pelts. It was noted this may not be a practice available for sick raccoons since
the pelts would of little of no value.
ln regard to legislation, the Fish and Wildlife Conservation Act would be the background authority for
dealing with sick wildlife.
The Fish and V/ildlife Conservation Act allows landowners to defend their property from certain species
of wildlife, which could include destroying a diseased raccoon which may transmit disease to household
pets or livestock.
Section 31 Subsections 1-5 of the Fish and Wildlife Conservation Act state in part:
Protection of property
31. (1) If a person believes on reasonable grounds that wildlife is damaging or is about to damage the
person's property, the person may, on the person's land,
(a) harass the wildlife for the purpose of deterring it from damaging the person's property; or
(b) capture or kill the wildlife.
Agents
(2) The person may use an agent to harass, capture or kill the wildlife under subsection (1) if the agent
has the authorization of the Minister or belongs to a class of agents prescribed by the regulations.
Scope of Authority
(4) A person who harasses, captures or kills wildlife under this section shall not harass, capture or kill
more wildlife than is necessary to protect the property.
Unnecessary suffering.
(5) A person who harasses, captures or kills wildlife under this section shall not cause it unnecessary
suflering.

A landowner can have an agent act on their behalf. Agents must specifically be authorized by MNR or
fall under one of the classes prescribed in Section ß2 of Ontano Regulation 665-98 (Hunting):
132. (I) The following classes of agents are prescribed for the purposes of subsection 31 (2) of the Act:
1. Trappers licensed under Ontario Regulation 667198 (Trapping).
2. Employees or agents of a member of the Ontario Society for the Prevention of Crueþ to Animals
under the Ontario Societyfor the Prevention of Cruelty to Animals Act.
3. Members of a lando\ryner's immediate family acting on behalf of the landowner on the
landowner's own land.
4. Persons whose business is primarily the business of removing nuisance wildlife if they harass
wildlife or if they capture and release it if it is capable of being released.
5. Employees or agents of a municipality whose responsibilities relate to wildlife control.
Q) An agent described in paragraph 2 or 3 of subsection (1) who is using a firearm must have the
qualifications necessary to obtain an outdoors card under subsection 4 (2).
(3) Despite subsection (1), if the Minister is of the opinion that a person is not harassing, capturing or
killing wildlife in a humane way or in accordance with the regulations, the Minister may notiff the person
in writing that he or she shall no longer act as an agent.
Therefore, it has been suggested that possessing a hunting or firearms licence is not suffrcient to act as an
agent on behalf of a landowner.
If the persons referred to as volunteers are to be agents of the Municipality, they may be able to act on
behalf of a landowner. However, there are a number of considerations where an individual is appointed
an agent of the municipality, as the municipality is then responsible for the agent and their actions. Staff
confirmed some issues that would need to addressed with the municipal solicitor including:
- persons appointed would need to be subject to municipal control and direction (likely a contract of some
sort)
- Direction and confirmation regarding training, qualifications and supervision (Occupational Health and
Safety)
- Municipal insurance ramifications
- Workers Compensation ramifications
It may well be that the general qualifications cited by Council at its May l9th meeting would be
sufficient, however it would appear that more inquiries with certain agencies would be recommended.
Of note perhaps, staffhave been contacted by several additional Nuisance Animal Control companies that
operate locally. It has been suggested that referral to these companies can continue, to appropriately deal
with nuisance animals. OPP should only be contacted when there is an immediate public safety concern.

Background
Past practice has been when a charitable group approaches the municipality for lottery licensing
the first time, the group's Application for Lottery Licensing Eligibility is provided to Council for
information purposes.
Staff Comments
Attached to this mernorandum is the Straffordville Community Committee's Application for
Lottery Licensing Eligibility and supporting documentation.
The group has been in existence for l3 years and is in process of becoming incorporated as a
non-profit organzation in the Province of Ontario. Their incorporation is expected in the next
few weeks. The group intends to participate in raffle t¡pe lotteries as a means of fundraising for
their community activities.

1) The Board of Directors shall serve without pay and consist of 3-7 members.
2) Boardmembers shall serve a one year minimum and up to a four years tenn.

The Vice-Chair shall assume the duties ofthe Chair in case of the Chair's

The Secretary shall be responsible for the minutes of the Board, keep all
approved minutes in a minute book, and send out copies of minutes to all.
The Treasurer shall keep record of the organtzation's budget and prepare
financial reports as needed.
IV) Committees
1) The board may appoint standing and ad hoc committees as needed.
1) Regular meetings shall be held once per month or at the call of the Chair.
2) Special meetings may be held at any time when for by the Chair or a
majority of the Board members.
3) Three days notice in advance shall be provided at least.

l) A majority of Board members constitutes a quorum. In absence of a
quorum, no fonnal action shall be taken except to adjourn the meeting to a
subsequent time.
2) Passage of a motion requires a simple majority.

1) Any member of the Board who has a financial or personal interest with any
matter before the Board, of such nature that it prevents or may prevent that
member from actingon a matter in an impartial manner, will offer to the

The Municipality of Bayham water system is operated in accordance with
provincial regulations.
The following is the criteria used:
. Use of Accredited Labs:
Analytical tests to monitor the water quality are conducted by a laboratory
audited by the Canadian Association for EnvironmentalAnalytical
Laboratories (CAEAL) and accredited by the Standards Council of Canada
(SCC). Accreditation ensures that the laboratory has acceptable laboratory
protocols and test methods in place. lt also requires the laboratory to provide
evidence and assurances of the proficiency of the analysts performing the
test methods.
. Operation by Licensed Operators:
The water distribution system is operated and maintained by the
Municipalities competent and licensed staff. The mandatory licensing
program for operators of drinking water facilities in Ontario is regulated under
the Ontario Water Resources Act (OWRA) Regulation 128104. Licensing
means that an individual meets the education and experience requirements
and has successfully passed the certification exam.

The Municipality follows a sampling and analysis schedule required by the
OWRA Regulation 170103, the Ontario Drinking Water Standards. More

To ensure the protection of the public's health and operational excellence, the
Municipality adheres to the guidelines and procedures developed by the

Section I - lntroduction:
This report is a quarterly summary of water quality, published in accordance with
Ontario's Drinking Water Protection Regulation. lt includes important information
regarding the source of water, analytical test results, and how these compare to
the standards set by the Province.
Section 2 - Compliance With Provincial Requlations:
The Richmond Community Water System is operated in accordance with
provincial regulations.
The following is the criteria used:
. Use of Accredited Labs:
Analytical tests to monitor the water quality are conducted by a laboratory
audited by the Canadian Association for Environmental Analytical
Laboratories (CAEAL) and accredited by the Standards Council of Canada
(SCC). Accreditation ensures that the laboratory has acceptable laboratory
protocols and test methods in place. lt also requires the laboratory to provide
evidence and assurances of the proficiency of the analysts performing the
test methods.
. Operation by Licensed Operators:
The Richmond Water System is operated and maintained by the
Municipalities competent and licensed staff. The mandatory licensing
program for operators of drinking water facilities in Ontario is regulated under
the Ontario Safe Drinking Water Act. Licensing means that an individual
meets the education and experience requirements and has successfully
passed the certification exams.

The Municipality follows a sampling and analysís schedule required by the
Ont. Regulation 170103 and the Ontario Drinking Water Standards. More

WHEREAS the Municipality of Bayham acquired property for the purpose of improving and/or
widening the municipal road known as Soper Road;
AND WHEREAS the Municipality of Bayham subsequently conveyed part of the said parcel of
land designated as Partz on Plan 11R-9304.
AND \ilIIEREAS the Council of the Municipality of Bayham desires to establish the remainder
of the said parcel of land as part of the open public highway system of the Municipality pursuant
to Section3l(2) of theMunicipal Act,200l, S.O.2001, c.25,as amended.
TIIEREFORE THE COT]NCIL OF THE CORPORATION OF THE MT]NICIPALITY OF
BAYIIAM ENACTS AS FOLLO\ilS:
1. THAT the parcel of land listed below and situated in the Municipality of Bayham in the
County of Elgin be and the same are hereby assumed and established as part of the open
public highway system of the Municipality of Bayham:

Being a By-law to designate an area to which the water works shall be provided
and to establish fees to recover the cost of said works.
The Municipal Council of the Corporation of the Municipality of Bayham enacts as follows:

WATER WORIß FEE BY.LAW
PART I
INTRODUCTORY MATTERS
Definitions
1. In this by-law,
"Corporation" means The Corporation of the Municipality of Bayham;
"fee" means the water fee imposed under Section 6;
"immediate benefit" means an immediate benefit that accrues to owners or occupants of
land and derived or derivable immediately from upon completion of the construction of
the water works;
"land" means the land designated in subsectionaQ) and includes lands, tenements and
hereditament, and any estate or term therein, and any right or easement affecting them;
"lot line" means the boundary line of a lot;
"water connections" means a water line which extends from a water main abutting a lot to
the lot line and to which a private water pipe is connected or is capable of being
connected from a building on the lot;
"lot" means a parcel or tract of land,
(a) which is the whole of a lot on a registered plan of subdivision so long as such
registered plan is not deemed pursuant to subsection 50(a) of the Planning Act no|
to be a registered plan of subdivision, or
(b) which is all of the land held or owned under distinct and separate ownership from
the ownership of the fee or equity of redemption in abutting land;
By-Law 2011-046 A By-Law to designate an area to which

"water works" means those works for the improvement of transmission of water referred
to as the Water Infrastructure project undertaken in 2009 and2010, and includes water
lines, pumping stations, forcemains, appurtenances, and water connections.
Administration of Bylaw
2. (1) The administration of this by-law, is assigned to the
Treasurer.
Previous Actions Confirmed
3. The Municipal Council of The Corporation of the Municipality of Bayham hereby
confirms the establishment and construction of water works in respect of the land by By-
law Number 20ll-046.
Construction Authorized
4. (l) The construction of the water works is authorized for the benefit of the lands
receiving municipal water services in the Municipality of Bayham.
(2) The land mentioned in subsection (l) is hereby designated as land to which
accmes an immediate benefit from the construction of the water works.
Capital Cost
5. (1) In this Section,
(a) "water works" includes watermains and water connections to the lot line ,
all to serve the land referred to in section 4 of this by-law
(2) The amount of $2,122,252.00 is hereby approved and adopted for the purposes of
this by-law as the capital cost of the water works.
(3) The amount of $611,972.78 is the portion of the capital cost of the works that is
the share of the owners and occupants of land in the benefitting area mentioned in
Section 4.

PART II
PAYMENT AND COLLECTION OF FEE
Imposition of Fee
6. (1) A water works fee is hereby imposed on each lot or block or part thereof referred
to in Section 4 and on the owners and occupants from time to time of such lot,
block or part thereof in the amount of $ 855.91 for their share of the capital cost of
the water works.
(2) The fee imposed under subsection (1) shall be due and payable annually, the first
payment of which shall be in20I1 and the final payment of which shall be in
2020 as provided in this by-law.
Payment of Fee
7. (1) Every occupant of land who is not the o\ryner of the land is liable to pay the fee it
under the terms of occupation between the occupant and the owner, it is the
obligation of the occupant to pay the fee that is payable in respect of the land
under this by-law.
(2) Despite subsection (1), every owner of land, whether or not the owner is the
occupant of the land at the time that the fee becomes payable in respect of the land
under this by-law, is liable to pay the fee.
Exemption from Fee
8. (l) Except as provided in subsectiorr(2), no land is exempt from a fee imposed under
this by-law by reason only that it is exempt from taxation under the Assessment
Act.
2) Land belonging to the Corporation, whether occupied for the purposes thereof or
unoccupied but not when occupied by a tenant or lessee who is liable to taxation,
is exempt from a fee under this by-law.
3) Lands currently undeveloped will be exempt from this by-law.
4) Despite subsection (3), where lands exempted as undeveloped are subsequently
subject of development application(s), the fees are pursuant to Section 6(1) shall
become due and payable at issuance of a building permit, provided such
development occurs within ten (10) years from the date of passage of this by-law

(a) The calculation of such fees will be the same as those paid
by the owners in Port Burwell and Vienna in the immediate benefit
area, and shall be adjusted in accordance with the Construction
Price Index annually at the first day of January in each year in
accordance with the Construction Price Statistics.
Collection of Fee
9. (1) The Treasurer is authorizedto send a notice or cause it to be sent by ordinary mail
on or before June 3l20II in respect of the fee imposed under Section 6 to the last
known address of the residence or place of business of a person mentioned in
Section 7.
(2) The notice shall specifr,
(a) the amount of the fee that is due and payable annually;
(b) the number of years during which the fee is payable if not commuted by a
lump sum payment in cash;
(c) the day by which payment of the fee is due;
(d) the person from whom the fee is due;
(e) the land in respect of which the fee is due and upon which the fee is a lien
and charge;
(Ð the lump sum payment in cash that is required to commute the fee;
(g) the day by which payment of the lump sum is due in order to commute the
fee; and
(h) the place or places where such payments may be made;
and shall state that, if the fee or any portion thereof remains unpaid after the due
date, the amount unpaid will be entered upon the tax collector's roll and collected
in the same way as municipal taxes are collected.
(3) The day specified in the notice by which payment of the fee is due and payable
shall be no earlier than the 10th day and no later than the 30th day following the
day notice is first given in accordance with this by-law.

(4) If the amount pursuant to Section 6 of this by-law or any portion thereof remains
unpaid after the day mentioned in a notice under clause (2Xg), the Clerk is
directed to enter the amount mentioned in clause (2)(a) upon the tax collector's
roll annually starting in2}ll before June 30 each year and the tax collector is
directed to collect s¿une, as nearly as may be, as municipal taxes are collected.
(5) Despite subsection (4), so long as the owner or occupant of the land is liable for a
fee imposed under this by-law,
(a) the owner or occupant may apply in writing, before October 31 in any year
following 20lI to commute the remainder of the fee for a lump sum
payment in cash;
(b) the amount of the lump sum payment shall be calculated using an interest
rate which is I percent below the prime rate offered by the Corporation's
bank to the bank's most credit-worthy borrowers for prime business loans
on the first banking day of the year in which the application is made;
(c) a notice shall be mailed on or before November 30 of the year in which the
application is made to the address of the residence or place of business of
the owner or occupant specifring the lump sum payment in cash that is
required to commute the rate, the day by which such payment is due, and
the place or places where such payment may be made; and
(d) the lump sum payment shall be due and payable on or before December 31
of the year in which the application is made.
Collection by Distress
10. If the fee or any part thereof remains unpaid after the due date, the amount unpaid may be
collected by distress upon the goods and chattels ofsuch o\ilner or occupant.

PART III
LOT SEVERANCES AND ADDITIONAL WATER MAINS
Apportionment
I l. (1) Despite any other provision of this by-law, if a new part or parcel of land is
created within the whole or existing part of a lot in respect of which a fee has been
imposed under this by-law,
a) a water works fee shall be imposed on each new part or parcel provided
such parcel is created within ten (10) years of the passage of this byJaw;
and
b) the revenue from the fee imposed under this section, if not required for
payment of any part of the outstanding capital cost of the water works,
shall be used for future capital improvements of the water works.
(2) The Treasurer shall recommend the fee under subsection (1) to the Council.
(3) The Clerk shall give the owners of the parts into which the land is divided at least
14 days notice by mail of the time and place the Council will consider the
recommendation regarding the fee under subsection (1).
(4) In determining the fee the Council,
c) may afford the owners mentioned in subsection (3) an opportunity to be
heard before making its recommendations, and
(b) shall have regard to the effect of the water works on each part into which the
parcel of land is divided and such other matters as the Council considers
appropriate.
(5) The Council shall consider the recommendation of the Treasurer but the decision of the
Council with respect to the imposition of fee under subsection (1) is frnal.
(6) The by-law imposing the fee shall be filed with the Clerk and thereafter the fee shall be
imposed and collected in accordance with the by-law.

(7) The Treasurer may establish and maintain a reserve fund and pay into it the
revenue mentioned in clause (lxb) that is not required for payment of any part of
the outstanding capital cost of the water works.
(8) The provisions of Section 4I7 of the Municipal Act, 2001 apply to a reserve fund
mentioned in subsection (7).

16. The Mayor and the proper officers and employees of the Corporation are hereby
authorized and directed to execute under the Corporation's seal and deliver such
documents and take such actions as are necessary or advisable to carry out the intent and
provisions of this by-law as it exists from time to time and this shall be sufficient
authorþ for so doing.

AND 'IüHEREAS Nariender Grewal is the owner of lands in Part Lot 723, Concession NTR,
being Parts 1,2,3 & 4 on Registered Plan 17R9274, in the Village of Straffordville in the

AND WHEREAS the County of Elgin Land Division Committee has granted the subject
applications, subject to conditions including the condition that the owner execute a sewer services
development agreement for the lots.
AND \ilHEREAS prior to development occurring on the subject lands, certain services, namely

\MHEREAS the Owner rqlresents that he is the registered owner of the lands and premises in Part
I-ot 123 Concession NTR, Village of Straffordville, in the Municipality of Bayham, in the County
of Elgin, being more particularly described in Schedule "4" attached hereto (hereinafter called the
"said Lands");
AND WHEREAS the Owner is desirous of subdividing a portion of the said Lands as more
particularly set out on a plot plan marked as Schedule "8" attached hereto showing the lots to be
created;
AND WHEREAS a Consent to Sever was granted by the County of Elgin Land Division
Committee on July 22,2010 for applications E65/09,F,66109,F,67109 and E68/09 conditional
upon (inter alia) the entering into of an agreement dealing with services for the lots to be created;
NO\M THEREFORE THIS AGREEMENT V/ITNESSETH that in consideration of the sum of
TWO DOLLARS ($2.00) of lawtul money of Canada now paid by the Municipality to the
Owner, the receipt and sufficiency whereof is hereby acknowledged, the Owner covenant and
agree with the Municipality to do and perform at their own expense the following matters and
things:
Municipal Engineer
1. Wherever the phrase "Municipal Engineer" is used throughout this Agreement, it shall
mean the Municipality's Chief Building Official, the Municipality's 'Water/IVastewater
Superintendent, or the Municipality's Manager of Public 'Works or such other person as
the Council of the Municipality may from time to time appoint to deal with the
administration of this Agreement.

2. The following Schedules are hereby declared to form part of the Agreement between the
parties:

3. The Owner shall apply for aZorung By-law amendment (removal of holding symbol) as
required by the Notice of Decision for Consent. The arrangements contemplated in this
Agreement are conditional upon removal of the holding provision. The Municipality
agrees to consider the proposed application in the context of these arrangements.
Access
4. Access to the lots to be created shall be at the location applied for and approved by the
Municipal Engineer. The maximum width of a drivewaymeasured along the street line to
serve a residential use shall be nine (9.0) mehes (30 feet).
As-Constructed Drawings
5. The Owner shall provide for the Municipality records "as-constructed" drawings to the
satisfaction of the Municipality for municipal services installed by the Owner. These
drawings shall be submitted in a satisfactory form prior to the release of any performance
bond or security required by this Agreement.
Plans and Specifications
6. Plans and specifications for all works and services herein required to be done by the
Owner shall be first submitted to the Municipal Engineer in a form satisfactory to him
and such work shall not be commenced until the Municipal Engineer has received such
plans and specifications and has expressly authorized, in writing, such work to
coÍrmence. All works and services shall be constructed and installed strictly in
accordance with the said plans and specifications, all to the satisfaction of the Municipal
Engineer. The Owner agrees to construct all services and provide other requirements that
will be known only after the details of the engineering design are submitted to the
Municipality. The Municipal Engineer may require, in writing, such variance from such
plans and specifications as may be required by conditions which may be disclosed as the
work progresses, and by sound engineering practice. The works and services required to
be done by the Owner, including but not limited to engineering and restoration works,
shall be wholly at the expense of the Owner except as may be otherwise herein expressly
provided.

Sanitary Sewers

a. Sanitary serr'lers shall be constructed of such size, type, position and extent as are
shown on the plans and specifications provided in Schedule "C" that have been
approved by the Municipal Engineer. Any material changes to be made to these plans
and specifications shall require approval by the Municipal Engineer in writing, such
approval not to be unreasonably withheld. Storm sewers, if required by the
Municþality shall be constructed of such size, type, position and extent as are shown
on the plans and specifications approved by the Municipal Engineer or otherwise
required by him in writing. The Municipal Engineer may require this work to be done
by a contractor whose competence is approved jointly by the Municipal Engineer and
the Owner, at the expense of the Owner. It shall be the responsibility of the Owner to
provide a satisfactory outlet for said storm sewers, if required, and sanitary sewers
(which for the purpose of this Agreement, shall mean the nearest approved Municipal
sewer outlet).
b. Sanitary sewers, with sanitary private drain connections shall be constructed to the lot
line of the subject lands.
c. Storm sewers including catch basins and connections, if required by the Municipality,
shall be provided and connected as shown on the approved plans and specifications.
d. If the works lead to the installation of storm or sanitary se\ryers, to be assumed by the
Municipality, located on easements over private property (including land owned by the
Municipality that is not a road allowance), all sanitary se\ryer manholes shall be located
in a location acceptable to the Municipal Engineer in order to facilitate maintenance of
the sanitary sewer systern by the owner, and all storm sewer manholes shall be placed
in easily accessible areas if not placed in paved parking lots or driveways.
e. The Owner agrees to notiff their consulting engineer in the event that any existing
sewer or drain is encountered during the progress of construction. The Owner further
agree to have its consulting engineer investigate the matter and comply with the
recoÍrmendations of its consulting engineer as approved by the Municipal Engineer's
Department with respect to the sewer or drain encountered, such as connecting the
existing sewer to a new sewer being constructed or into another existing sewer, at no
cost to the Municipality. Adequate sewer easernents are to be provided to the
Municipality if necessary. The Owner shall also ensure that there is no intemrption to
any subsurface drainage flow because of construction on the site that would have an
adverse affect on neighbouring properties. Should such an intemrption occur, the
Owner shall carry out any necessary remedial work to correct the problem as
recommended by its consulting engineer and to the satisfaction of the Municipal
Engineer, at no cost to the Municipality.
f. Connection charges are payable before any dwelling unit is connected to the public
(sanitary) sewer system. Such charges are payable prior to issuance of a building
permit, in accordance with the fees and charges in force and effect at the time of
application for such building permit.

Sewer Ownership
8. The Owner acknowledges and agrèes that the Municipality will not accept ownership nor
allow connections of any gpe until the works are completed to its full satisfaction, and
such determination is at the sole discretion of the Municipality.
Grading and Drainage Plans
9. The Owner shall prepare and deposit with the Municipality a grading and drainage plan
approved by the Municipal Engineer showing the final grades of all roadways. Any lands
designated for drainage works and all drainage facilities shall be indicated on such plan to
the satisfaction of the Municipal Engineer. The Owner shall agree to carry out or cause to
be carried out the recommendations of the grading and drainage plans, which shall form
part of this Agreement as Schedule "C".
Roads
10.
a. The Owner, or their consulting engineer, shall ensure that any proposed excavation,
construction, entrance or exit installation, demolition, etc. will not interfere with or be
in conflict with location and/or depth of any existing underground facilities, including
sewers, pipelines, mains on street allowances or private rights-of-way, services, meter
and regulator installations, valve boxes, cathodic protection test points, etc. In
instances of apparent conflict, the Owner, or their consultant, shall obtain field locates
from the appropriate commission, utility or agency.
b. All streets and walkways, if any, shall be graded, including fill or excavation as
required by the Municipal Engineer to their full width of the allowance before any
building permit will be issued and the approved road allowance grades from street line
to street line shall be maintained at all times to the grades and levels and to the
specifications and requirements and to the satisfaction of the Municipal Engineer until
the date of passing of the by-law assuming the said streets and walkways.
Inspection and Completion of 'Works
11. Upon the completion of required off-site works, the Owner shall cause a Certificate of
Completion to be delivered to the Municipality in the following form:

Instrument No.and pertaining to the property lmown municipally as
have been:
inspected during construction in accordance with standard engineering practice; and

Building Permits
12. No applications shall be made for building permits and no building permit will be issued
until the following materials have been received by the Municipality's Engineer:
a. A survey prepared by a qualified Ontario Land Surveyor showing all necessary
setbacks in compliance with ZoningByJaws;
b. a grading and drainage plan approved by the Municþal Engineer showing the final
grades of all lands and roadways.
c. all permits and authorizations have been obtained by the Owner at its expense;
d. the Security has been lodged with the Municipality;
e. other conditions to be considered by the Council and listed here.
Security
13. Before applying for any building permit, or commencing any works on Municipal lands
including road allowances, the Owner shall provide the Municipality with performance
security as follows to be held by the Municipality until all of the obligations of the Owner
have been discharged:
a) In relation to sanitary selver services, in the amount of
$22,000. 00 (Twenty-two Thousand Dollars)
b) In relation to road reconstruction/restoration, in the amount of
$2000.00 (Two Thousand Dollars)
The security may be in the form of cash or an irrevocable letter of credit from a chartered
bank. In the case of cash, the Municipality shall hold funds in a non-interest bearing
account. In the case of a letter of credit, the form and content of it shall be satisfactory to
the Municipality.
Default
In the event of Owner's default (as determined by the Municipal Engineer), it is
specifically anticipated by the parties that the Municipality will, at its sole discretion,
contract for completion of all required works, services and other obligations, such that all
expenses including administration shall be conducted without cost to the Municipality. In
the event that the funds available by means of the security are insufficient to permit the
completion of all remaining works and services, these shall be completed according to
priorities identified by the Municipality. In the event that the Municipality determines
that all works and services cannot be completed with available funds, the Municipality
may, in the alternative, defer completion at its discretion, pending more favourable
proposals, tenders or completion arrangements. The Municipality has no obligation to
complete works for which funds are not available and the Owner on their behalf and on

behalf of their heirs, successors and assigns, releases the Municipality from any liability
in connection with arrangements for completion.
Worþlace Safet], and Insurance Board Coveraee
15. The Owner agree that they shall at their own expense procure and carry or cause to be
procured and carried and paid for, fuIl Worþlace Safety and Insurance Board (V/SIB)
coverage for all workers, employees, servants and others engaged in or upon any work
undertaken pursuant to this Agreement for which such coverage is required by law.
Insurance
16.
(a) The Owner agrees to maintain insurance or require their contractors to maintain
insurance in suffrcient amount and description as will protect the Owner and the
Municipality from claims for damages, personal injury including death, and for
claims from property damage which may arise from the Owner's operations pursuant
to this Agreement, including any act or omission of the Owner's agents or employees
while engaged in any activity pursuant to this Agreement and such coverage shall
include all costs, charges and expenses reasonably incurred for any injury or damage.
(b) In addition to the foregoing, the Owner covenant and agree that:
(Ð The limits of liability for Personal Injury, Bodily Injury and Property Damage
combined shall be for not less than Two Million ($2,000,000.00) Dollars for
each occurrence.
(iÐ All policies shall provide that they cannot be cancelled, allowed to lapse or be
materially changed (to the detriment of the Municipality) without at least thirty
(30) day's notice to the Municþality by registered mail.
(iiÐ The Municipality shall be named as an added insured and the policy shall
include a provision for cross liability.
Construction Liens
t7.
(a)The Owner shall comply with all of the provisions of the Construction Lien Act.
R.S.O. 1990, c. C.30, as amended from time to time and without limiting the
generality of the foregoing, shall hold in its possession all the statutory holdbacks
and any additional funds required to be held by the said Act. These holdbacks and
funds shall not be disbursed except in accordance with the Act.
The Owner shall, at their own expense, within ten (10) days of receiving written
notice from the Municipality to do so, pay, discharge, vacate, and obtain and
register a release of all charges, claims, liens and all preserved or perfected liens,
made, brought or registered pursuant to the Construction Lien Act, R.S.O. 1990, c.
C.30, which affect any lands of the Municipalit¡ including public highways and
road allowances, and which arise out of the performance of this Agreement by the
Owner and their servants, employees, agents, contractors and subcontractors.
The Owner shall indemnifu and hold harmless the Municipality from all losses,
damages, expenses, actions, causes of actions, suits, claims, demands and costs
whatsoever which may arise either directly or indirectly by reason of any failure,

neglect or refusal by the Owner to comply with the Construction Lien Act, R.S,O.
1990, c. C.30, and arising out of the performance of this Agreement by the Owner
and their servants, employees, agents, contractors and subcontractors.
(d) The Manager of Public 'Works for the Municipality may at any time, authorize the
use of all or part of the securities required pursuant to this Agreement, including
cash deposit or letters ofcredit:

pursuant to the Construction Lien Act, R.S.O. 1990, c. C.30, which affect any
lands, including public highways and road allowances of the Municipality in
the event the Owner default on the performance of this section; and
(ii) to pay to the Municipality any amounts owing to it pursuant to this section.
Indemnification
18. The Owner shall indemniff and save harmless the Municipality against all losses,
damages, claims, actions, demands, suits, costs and interest incurred which arise directly
or indirectly from anything done in connection with this Agreement, whether in
performance of, outside of or contrary to this Agreement.
Other
19. Entry into this Agreernent with the Owner shall in no way fetter legislative or
administrative discretion of the Municipality or of any of its officers or staff with regard
to the approval or administration of any matters in connection with any development on
the said Lands.
20. The Owner understands and agrees that there shall be no work performed except in
conformity with all applicable by-laws and Provincial and Federal legislation and
regulations, and this Agreement does not exempt the Owner from any applicable statute,
regulation, or code of any legislative, administrative, or governmental authorit¡ and the
owner shall obtain and pay for all permits.
Notice to Subsequent Owner
21. The owner agrees that any payments made or works installed pursuant to this agreement
shall not be deemed to be development charges of any sort whether under the provisions
of the Development Charges Act or a by-law thereunder, or pursuant to any front-ending
provisions of that Act. It is further agreed that the Owner shall not make any claims
whatsoever against the Municipality or any other land owner of any lands for a
contribution or reimbursement in any way for any monies expended by the Owner to
effect the works.
Registration
22. The Owner, at his expense, shall register this Agreement on title to the Lands. The
Owner shall cause a duplicate registered copy and a Solicitor's Certificate to be delivered
to the Municipality in the following form:

23. The covenants, agreements, conditions and undertakings herein contained on the part of
the Owner shall run with the Land and shall be binding upon the Owner and upon the
Owner's heirs, executors, administrators, successors and assigns, as owner and occupiers
of the Land from time to time and shall be appurtenant to the adjoining highways in the
ownership of the Municipality and this Agreement shall enure to the benefit of and be
binding upon the appropriate authority and its successors and assigns.
AssiEnment
24. Neither party is permitted to assign rights and obligations under the Agreønent without
the permission from the other, which shall not be un¡easonably withheld.

Expiry
25. In the event that no construction of the sanitary sewer connection has commenced within
five (5) years from the date of registration of this Agreement the Municipality ma¡ at its
option, on one month's notice to the owner, declare this Agreement to be subject to re-
negotiation, whereupon the Owner agrees that it will not undertake any construction on
the said lands until this Agreement has been re- negotiated.
Separate Covenants
25. All of the provisions of this Agreement are intended to be construed as covenants and
agreements as though the words importing such covenants and agreønents were used in
each separate clause hereof. Should any provision of this Agreement be adjudged
unlawful or not enforceable, it shall be considered separate and severable from the
Agreement and its remaining provisions as though the unlawful or unenforceable
provision had not been included.
Municipality' s Expense
26, The Owner shall reimburse the Municipality for expenses incurred in the preparation of
the Development Agreement upon execution of the agreement.

BY-LAW NO. 2011-048
A BY.LAW TO CONFIRM ALL ACTIONS OF
THE COTJNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF BÄYHAM FOR THE
REGULAR MEETTNG HELD JUNE 2,2011
WHEREAS under Section 5 (l) of the Municþal Act,200l S.O. 2001, Chapter 2í,thepowers
of a municþal corporation are to be exercised by the Council of the municipality;
AND WHEREAS under Section 5 (3) of the Municþal Act,200l, the powers of Council are to
be exercised byby-law;
A¡{D WIIEREAS the Council of the Corporation of the Municþality of Bayham deems it
advisable that the proceedings of the meeting be confirmed and adopted by byJaw.
THEREFORE TIIE COTJNCIL OF THE CORPORATION OF THE MI]NICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1,. THAT the actions of the Council of the Corporation ofthe Municipality of Bayham in
respect of each recommendation and each motion and resolution passed and other
action by the Council at the regular meeting held June 2,2011 is hereby adopted and
confirmed as if all proceedings were expressly embodied in this by-law.
2. TIIAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are
hereby authorized and directed to do all things necessary to give effect to the action of the
Council including executing all documents and afhxing the Corporate Seal.
READ A FIRST, SECOND AND THIRD TIME and finallypassed this 2"dday of June,
2011.
