The regular meeting of the Council of the Municipality of Bayham was held on Thursday, January 22, 2015 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Tom Southwick, Councillors Randy Breyer, Wayne Casier and Ed Ketchabaw, Administrator Paul Shipway and Clerk Lynda Millard. Planning Coordinator 1 Deputy Clerk Margaret Underhill and Treasurer Lorne James were in attendance to present their respective reports. 1. CALL TO ORDER Mayor Ens called the meeting to order at 5:30 p.m. 2. DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF No disclosures of pecuniary interest were declared. 3. OTHER BUSINESS Moved by: Councillor Casier Seconded by: Deputy Mayor Southwick THAT the Council do now rise to enter into an "In Camera" Session of Committee of the Whole at 5:30 p.m. to discuss: • labour relations or employee negotiations' • a proposed or pending acquisition or disposition of land by the municipality or local board. CARRIED (b) In Camera Meeting regarding labour relations or employee negotiations, a proposed or pending acquisition or disposition of land by the municipality or local board and litigation or potential litigation including matters before administrative trubunals, affecting the municipaliy or local board. REVIEW OF ITEMS NOT LISTED ON THE AGENDA AND ANNOUNCEMENTS (a) Addendum added re Notice of Intention to pass a By -Law to stop up and close parts of a road allowance and stop up, close and convey part of a road allowance as item 10.1.1(b) 5. DELEGATIONS (a) 7:22 p.m. - RACHAEL WINTERMUTE re dog park proposal File: R00 Rachael Wintermute provided an overview of fundraising efforts to date and amount of community support received for a dog park. Moved by: Councillor Ketchabaw Seconded by: Deputy Mayor Southwick THAT the presentation by Rachael Wintermute re dog park proposal be received for information. CARRIED (b) 7:28 p.m. KAREN BECHARD re McCord Lane File: T05 Staff was directed to request the residents of McCord Land and the owner of McCord Farms meet with staff to discuss a resolution of McCord Lane ownership. CARRIED 6. ADOPTION OF MINUTES OF PREVIOUS MEETING(S) (a) Regular meeting of Council held January 8, 2015. Moved by: Councillor Casier Seconded by: Councillor Breyer "THAT the minutes of the regular meeting held January 8, 2015, be amended to reflect that Deputy Mayor Southwick declared an interest to item 5(c) as he is participating in the ALUS program and a Board Member of the Long Point Region Conservation Authority Board and adopted, as amended. X11:7:11: Page 4 of 8 Council Minutes January 22, 2015 (b) Report DS -07115 by Margaret Underhill, Deputy Clerk/Planning Coordinator re Road Allowances Concession 1 Btwn Lots 15, 16 and Concession 1 Lot 16 File: T09.CSINOS Moved by: Councillor Breyer Seconded by: Councillor Ketchabaw THAT Report DS -07115 be received for information; AND THAT By -Law 2015-009 being a by-law to stop up and close part of the unopened road allowance between Lots 15 & 16 Concession 1, north and south of Lakeshore Line be presented for enactment; AND THAT the Municipality of Bayham has no interest in the Road Allowance between Lots 15 & 16 Concession 1 south and north of Lakeshore Line (formerly known as New Lake Road) and no interest in Part Lot 16 Concession 1 being the "New Travelled Road" south of the Lakeshore Line (formerly known as New Lake Road) as set out in Bylaw 318 registered as BM5939 and shown on Plan D1071 and Reference Plan 11R6256 and the Municipality has not maintained these lands nor expended any public funds on these lands; AND THAT By-law 2015-008 being a by-law to assume and establish lands in the Municipality of Bayham, known as Csinos Road, as part of the open public highway system be presented for enactment. REPORTS TO COUNCIL (a) Report TR -03115 by Lorne James, Treasurer re LAS Fuel Program File: L03 -LAS Moved by: Councillor Casier Seconded by: Councillor Ketchabaw THAT Council direct staff to enter into the LAS Fuel Program and sign the Participation and Payment Agreement subject to confirming Dowler Karn can/cannot match the prices provided by LAS. AND THAT Council direct staff to bring forward a by-law to authorize the same. BY-LAWS (a) By -Law 2015-007 Being a by-law to authorize the execution of a site plan agreement between Roelands 1 Timmermans and The Corporation of the Municipality of Bayham (b) By -Law 2015-008 Being a by-law to assume and establish lands in the Munucipality of Bayham as part of the open public highway system (Csinos Road) (c) By -Law 2015-009 Being a by-law to stop up and close part of the unopened road allowance between Lots 15 & 16 Concession 1, North and South of Lakeshore Line, in the Municipality of Bayham, in the County of Elgin, designated as Parts 1 & 2 on the Registered Plan 11 R-9732 Moved by: Councillor Casier Seconded by: Councillor Breyer "THAT By -Laws 2015-007, 2015-008 and 2015-009 be read a first, second and third time and finally passed.
