COUNCIL MEETING MINUTES
January 8, 2015

7:00 P.M.
The regular meeting of the Council of the Municipality of Bayham was held on Thursday,
January 8, 2015 in the Council Chambers. Present were Mayor Paul Ens, Deputy Mayor Tom
Southwick, Councillors Randy Breyer, Wayne Casier and Ed Ketchabaw, Administrator Paul
Shipway and Clerk Lynda Millard.
Planning Coordinator/ Deputy Clerk Margaret Underhill and Chief Building Official / Drainage
Superintendent Bill Knifton were in attendance to present their respective reports.
1. CALL TO ORDER
Mayor Ens called the meeting to order at 7:00 p.m.
2. DISCLOSURES OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF
(a) Deputy Mayor Southwick declared an interest in item 5(c)ALUS delegation as he is
participating in the ALUS program and a Board Member of the Long Point Region
Conservation Authority Board.
3. REVIEW OF ITEMS NOT LISTED ON AGENDA
(a) Addendum— In Camera item regarding litigation or potential litigation.

5. DELEGATIONS
(a) 7:05 p.m. LAUREN MILLIER, MILLIER, DICKENSON, BLAIS re Municipality of
Bayham Economic Development Opportunities Initiative Plan
Lauren Millier provided information regarding Municipality of Bayham Economic
Development Opportunities Initiative Plan with a power point presentation. She outlined
the objective of the plan to foster a business environment supporting economic growth,
opportunities such as agricultural, tourism and industrial land development and
recommendations including ecopark development and housing analysis.

THAT the presentation from Lauren Millier from Millier, Dickenson, Blais
regarding Municipality of Bayham Economic Development Opportunities Initiative
Plan be received for information;
AND THAT Council adopt the Municipality of Bayham Economic Development
Initiatives and Opportunities Plan.

(b) 7:30 p.m. CLIFF EVANITSKI, LONG POINT REGION CONSERVATION
AUTHORITY re 2015 Draft Budget
Long Point Region Conservation Authority General Manager Cliff Evanitski presented
the 2015 Draft Budget.
Mr. Evanitski commented on Provincial Transfer and Municipal Levy compared to Total
Revenue and suggested that municipalities request, by way of such venues as the
Western Wardens Caucus, increased provincial funding to Conservation Authorities from
Provincial Ministers at ROMA and AMO.

THAT the Long Point Region Conservation Authority 2015 Draft Budget be
received for information;
AND THAT Council of the Municipality of Bayham support the Long Point Region
Conservation Authority 2015 Budget as presented.

re ALUS (Alternative Land Use Services)
Long Point Region Lands and Water Technician, Kyle Mauthe was in attendance to
discuss Alternative Land Use Services.

Mayor Ens called the Public Meeting to order.

No disclosures of pecuniary interest were declared.
CHAIRMAN'S REMARKS ON THE PURPOST OF THE MEETING
The purpose is to consider Spriet Associates Engineer's Report#212102 dated November
10, 2014, as received by the Clerk of the Municipality of Bayham on December 1, 2014.
John M. Spriet provided an overview of the Magyar-Dielman Drain report.
PUBLIC PARTICIPATION
There were no questions or comments from the public.
Councillor Casier expressed concerns around the stability of the ground and
questioned the viability of a drain on stone.
Mr. Spriet responded this would be similar to a French drain which uses gravel or rock
in the trench.

Councillor Casier questioned when the drain work would be conducted to which Mr.
Spriet responded it would be quicker in the summer however not an issued to do the
work in the winter.

Magyar-Dielman Drain.

THAT in accordance with Section 78 of the Drainage Act, Council of the
Corporation of the Municipality of Bayham hereby adopts Spriet Associates
report#212102 dated November 10, 2014, referred to as the "Magyar— Dieleman
Drain" report;
THAT Provisional By-law#2015-005 be given first and second reading;
THAT the Clerk be directed to distribute copies of the Provisional By-law and
Notice of the time and place of the first sitting of the Court of Revision to the
affected parties pursuant to Section 46 (2) of the Drainage Act;
AND THAT a date of February 5, 2015 at 8:00 pm be set for the first sitting of the
Court of Revision.

2015 and By-Law 2015-003 being a By-law to authorize borrowing from time to
time to meet current expenditures during the fiscal year ending December 31,
2015 be presented to Council for enactment.

(a) By-Law 2015-002 Being a By-Law to provide for an interim tax levy for the
Municipality of Bayham
(b) By-Law 2015-003 Being a by-law to authorize borrowing from time to time to meet
current expenditures during the fiscal year ending December 31, 2015
(c) By-Law 2015-004 Being a by-law to further amend By-Law 2012-057 authorizing
agreements between the Municipality of Bayham and Stewardship Ontario for the
Industry Stewardship Plan including provision of funding for Municipal hazardous or
special waste services
(d) By-Law 2015-005 Being a by-law to provide for Drainage Works in the Municipality
of Bayham known as the Magyar-Dielman Drain (first and second reading only)

(a) Discussion re Wheelhouse
Deputy Mayor Southwick requested discussion as the Wheelhouse Committee is looking
for approval as they are prepared to go forward to place the Wheelhouse at the site of
the Marine Museum.

Mayor Ens attended the potential site and met with the Wheelhouse Committee. It was
determined that not a lot of the parking space would need to be utilized.

THAT information regarding the Wheelhouse be received;
AND THAT the request from the Port Burwell Historical Society to place the
Wheelhouse on municipal property at the Marine Museum be referred to staff to
prepare a report.

(b) Consideration of appointments to Elgin County Land Division Committee.

THAT Brent Stewart be appointed as Muncipality of Bayham representative to the
Elgin County Land Division Committee;
THAT Paul Shipway be appointed as Municipality of Bayham administrative
representative for the Elgin St. Thomas Public Health Healthy Communities
Partnership;
AND THAT Mayor Paul Ens and Brenda Gibbons be appointed as Municipality of
Bayham Council and staff representative to Doors Open East Elgin.
