Reeve R. Green presides with Deputy Reeve M. Stewart and Councillors R. Sandham, M. Schafer and J. Volkaert in attendance . Moved by: M. Stewart and Seconded by: R. McNeil..acknowledgement of letter re comments on election act changes Mr. Arthur Vanderspaillie meets with Council to discuss possible shoreline protection of his propoerty at Lot 15, Conc. 1, when furthur work is being done eaSterly from Port Burwell. The County of Elgin may be doing some work at the Little Otter Creek to protect the County Road. Cou 4l will look into costs, grants and financing. Mr. Harold Dennis meets with Council'to report on fire matters. Mr. Arba Hollingsworth meets with Council to report a problem on garbage being dumped along the lake at Lot 22, Conc. 1. Sgt. B. Crane and Cpl. D. Kleinevic of the O.P.P. meet with Council to review and discuss matters of mutual concern. Mr. Jesse Dennis meets with Council to report on his duties as representative on the Long Point Region Conservation Authority. He also reports that the south west abutment of the Wilson Bridge has collapsed and suggests that some repairs be made or the bridge removed, as it is used by snowmobilers and recreation vehicles. The bridge is too narrow for use with farm machinery. Messrs. Wayne Taylor and Paul Millard meet with Council to discuss a taxation and assessment problem with their property at Lots 14-15 on East St., P1. 205. Deputy Reeve Stewart and Councillor Schafer will accompany them to the Regional Assessment Office to attempt to resolve the matter. Moved by: R. Sandham and Seconded by: J. Stewart and Councillors R. Sandham, M. Schafer and J. Volkaert in attendance. The purpose of the meeting is to complete the appointments and other matters from the meeting of January 9th. Moved by: R. Sandham and Seconded by: J. Volkaert That the following persons be appointed to the Calton Cemetery Board for the years 1978, 79, 80: A. McDowell............Carried Moved by: M. Sandham That this special meeting of.,Council now adjourn............Carried Reeve Clerk 1427 Council Chambers, Straffordville, January 23, 1978 A special meeting of Bayham Township Council is held this evening for the purpose of holding a public meeting for Amendment No. 4 to the Official Plan for the East Elgin Planning Area. Reeve R. Green presides with Councillors R. Sandham, M. Schafer and J. Volkaert in attendance. Ms. E. Howson is in attendance representing James F. MacLaren Ltd., and B. Wolfe as representative to the East Elgin Planning Board. The meeting is opened at 8:00 P.M. and at 8;45 no one had come forward with any comments. Moved by: J. Volkaert and Seconded by: R. Council Chambers, Straffordville, March 13, 197$ A special meeting of Council is held this afternoon, Reeve R. Green presiding. Deputy Reeve M. Stewart and Councillors R. Sandham, M. Schafer and J. Volkaert are in attendance. The purpose of the meeting is to review the erosion problem along Lake Erie immediately east of Port Burwell, the 197$ road estimates and other matters. Reeve Green, Councillor Schafer, Clerk Petrie had attended at Port Burwell on Friday March 10th. to examine the shoreline property between Port Burwell and the Little Otter Creek. Reeve Bradfield of Port Burwell and County Engineer Moore along with property owners A, Vanderspaillie and J. McCord were also in attendance. Port Burwell is prepared to extend the breadwall easterly to their Village limits. The County is interested in work to protect the County Road at the Little Otter Creek, Mr. Vanderspaillie is interested in protecting his property to the east of the Creek. Mr. McCord has no property abutting the Lake Erie shoreline.; The Clerk is instructed to write Messrs. Chas and Victor Goberis to inform them as to the assistance available under the Shoreline Property Protection Act, and as to their interest in protecting their property. 1433 Council reviews the proposed road construction program. Gibbons as road superintendent be accepted with regret, effective March 15, 1978... .,.,.Carried Mr. James Gibbons meets with Council and indicates his willingness to assume the road superintendent's position on a probationary period to be six months. He also feels that Bayham, Port Burwell and Vienna should have a member on the Elgin County Board of Education instead of the present system where the several representatives are elected from the East Elgin Area. He also informs Council of funding to be made available through the Long Point Region Conservation Authority for erosion control. Mr. Jos. Burwell meets with Council to request permission to re build his burned residence on the same location as before. The Health Unit and building inspector have requested that a new location be used to allow for the required distance between the well and field bed, and a satisfactory set back from the road allowance. Council also requests the change in location to allow for road improvements in the future without interference with the new residence, and advises Mr. Burwell to make his application to the Health Unit for his field bed accordingly. Messrs. C. DeKraker, G. Naswetter and J. Seimen meet with Council to inquire as to the reason for the Brownsville Fire Dept, not responding to a fire at Mr. DeKraker's property in accordance with our agreement. Reeve Green had inquired as to the reason and had found that there was a malfunction in the telephone system and that the fire call had not been received. Mr. Doug Kember meets with Council to request road improvements to his recently purchased property at Lot 2, Conc. 5. M. A special meeting of Council is held this morning for the purpose of attempting to resolve the problem concerning Lots 14 and 15, East St. west side, Plan 205, owrt,:ed by Wayne Taylor. Due to a split assessment having been placed on the propertyftapproximately 1960, a tax certificate issued at the time of purchase indicated taxes for only half of the property. Reeve R. Green presides with Deputy Reeve M. Stewart and Councillors R. Sandham, M. Schafer and J. Volkaert in attendance. Also present are I. Linton, solicitor for the Municipality, W. Hopkins of the Regional Assessment Office, Wayne Taylor, Warner Taylor, Paul Millard (arrived late) and G. Jenkins , solicitor for the Taylors and Millard. Mr. -Jenkins presents the facts pertaining to the purchase and request for a tax certificate and issuance of same on behalf of has clients. Mr. Hopkins explains that the property is the subject of an appeal to the Assessment Review Court and he is not at liberty to discuss the assessment for this reason. He explains that the assessment was split in 1960 with 50% of the land and buildings assessed to Ronald Howe and 50% of the land and buildings assessed to Clarence Howe. A copy of the tax certificate is produced which shows it to have been issued for the grtion assessed to Ronald Howe onlyl the request having been made in the name of Ronald Howe. The deed for the property is praduced showing the entire property to be in the name of Ronald Howe. Council offers to forgive the unpaid balance of 1976 taxes with penalty accrued to date, and the 1977 taxes with penalty to February 9, 1977, being the date *' a notice of arrears was forwarded to Mr. Wayne Taylor. Mr. Jenkins requests that a commitment be given from Council that they will not offer any objections to a severance application should one be made to divide the subject property in accordance with the former assessment. Council feels that they cannot give such a commitment as the property would be too small to accomodate two septic systens and two wells. Gibbons, road superintendent meets with Council to review the condition of roads. There is now some improvement after severe frost damage during the past few weeks. Mr. Hugh Ketchabaw, drain inspector, meets with Council,to report that several drains are in need of repair because of blowouts during the spring -run-off Mr. Wm. Palmer meets with Council to request an amendment to the by-law covering the Seghers sub -division to allow him to build a garage less than six feet from the side yard line as required in the by-law. Council will consider this at the next regular meeting. Mr. Douglas Kember meets with Counil to request road improvements to his property at Lot 2-3, Con. 5, as discussed at the meeting in April. Council explains that as other property owners have been required to rough grade road allowances where building is done on unimproved roads, they should require the same in this circumstance. Mr. Kember agrees, howver, as he has a four wheel drive vehicle, he will probably not do any of this work for approximately two years. Reeve R. Green presides with Deputy Reeve M. Stewart and Councillors R. Sandham, M. Schafer and J. Volkaert in attendance. Moved by: J. Volkaert and Seconded by: M. Stewart That the minutes of the regular meeting of Council held May 1, 1978, having been examined by the members are hereby approved and the Reeve's signature -,authorized on same .... .....Carried The following delegations are received: Howard Rolosonrequests that gates be placed at the transfer station at Lot 16, Conc. 5, and regular hours for receiving game established, in order to maintain a more orderly site. This matter has been discussed before and a meeting will be arranged with Port Burwell, Vienna, and Mr. McCaig to further discuss the matter. Messrs Wm. Hollywood and Henry Weibe to request that the road between Lots 5 and 6, Conc. 1, remain closed to vehicular traffic. A request has been received to open this road with minor maintenance. Council agrees that the roadway will be left in its present unmaintained condition. Mr. Ray Alward to further explain his correspondence on the Mitts Municipal Drain. He presents photos of the Mitts property during the spring runoff and the high water which stands on this property. Council will have the fire department flush out the drain to see if there is any blockage in the tile. The drain inspector is to remove some tile to see if there is roots blocking same. Mr. Alward also feels that the filling of the lands at Lot 16, Cone. S. G, has blocked a natural waterway and will contribute to further problems in the future. Mr. Wry. Pumputis requests the road allowance between N. G. and Conc. E� leading to his property be closed for approximately 600 feet. He has contacted the other landowners involved and they have no objections. When a proper description is received, the Clerk will proceed with the advertising to close same. Mr. John Vereitis requests the clearing of stumps etc. from the road allowance between 8oncessions 9 & 10, through Lots 14 and 15, in order to open the road. As this will service only one property, Council advises Mr. Vereitis that in accordance with past policy if he will rough grade the road to the road superintendent's specifications, the Township will gravel and maintain same.as a regular part of the Township road system. Mr. Hugh Ketchabaw reports on the progress being made in the repairs of several municipal drains. He reports that the Pollick has been completed and that the pond at the Lapenas Property on the Deli Drain should now be cleaned of the sand flushed from the tile. He is instructed to hire a drag line and complete this work. Messrs K. Emerson a0A C, Racz,representing the Village of Vienna, request the Council to give future consideration to rebuilding and hard surfacing Centre Street between Pearl and the Second Cons. Road in Vienna (boundary road) and the closing of the Chute Hill which is deteriorating beyond economical rep4Lr. While the current road budget is committed, Council will consider this request in 1979. Mr. Alphonse Lamers requests permission to place a mobile home on a permanent foundation at the entrance to his trailer park at Lot 12, Conc. 2. This trailer is to be the residence of the park care- taker, and would become a permanent residence. Council will consider this matter later in the meeting and advise Mr. Lamers of their / decision. 1441 Jas. Gibbons, road superintendent, meets with Council to discuss road matters. He is experiencing difficulty in obtaining calcium for the road dust control as he requires it. The road at Lots 16, ' 17, Conc. 10, is now started and the hard surfacing of streets in Straffordville and Eden expected shortly. Council directs Mr. Gibbons to proceed with the reconstruction of the road between Concessions 1 and 2 as quickly as possible. The plans for the Leach Bridge are reviewed and the Clerk instructed to have T11r. Vallee call for tenders on the structure only. This will be subject to approval by the Township of Norfolk also. McCaig represents the St. Thomas Sanitary Collection Services Ltd. Mr. McCaig reportsthat a total of 77 containers have been removed from the transfer station to date. The total for the year under our contract is 11+1. Reeve Green suggests that gate be installed at the transfer station. Mr. McCaig suggests that the gates be installed and gradually work towards closing them at night. A sign should be installed to inform the public of the hours which the station will be open. Mr. McCaig is requested to have gates • installed as soon as possible. The 81erk is instructed to advetise the hours which the transfer station will be open to the public. As of July 3rd., the station will be oven Monday, Wednesday and Saturdays from 10:00 A.M. to 8:00 P.M. The fire dept. has flushed out the drain and reports that perhaps the the is not large enough to accomodate water in a period of heavy runoff. The clerk is instructdd to approach the M.T.C. about enlarging the culvert under Hwy 19, and the drain inspector to dig out tiles south of the 5th. Conc. road to see if there are tree roots in the tile. Mr. Ken Thompson, representing Gargill Grain Co. meets with Council to discuss the proposed purchase of land in Lot 23, Conc. 8, and the construction of a corn drying facility. Should the project be commenced it will be necessary to have the Ridge Read upgraded to accomodate heavy traffic at all times during the year. Council is quite receptive to the idea of the plant and will upgrade the road, however, it is not possible to guarantee that there will no problems during the spring. Reeve Green also expresses concern that the residential uses surrounding the land should be protected as much as possible by constructing the plant in such a location to minimize the inconvenience to the tesidences. Mr. Ross Harrison meets with Council to present an information pamphlet on assisted housing for senior citizens by the Elgin St. Thomas Housing Authority. With an agreement, seniors from Bayham will be accomodated in Oontario Housing units, with the municipality paying'Ti% of the operatinj7 deficit of the unit. Mr. Wm. Maguire, chairman of the Norfolk Township roads committee is in attendance and indicates his approval of the Westeel Rosco tender, and inviting tenders for the above to be opened September 7th. Mr.'J. Chrastina meets with Council to indicate that he will sell land to the Township for the Leach Bridge project, however as approximately 2 acres will be severed by the new road and will be unecoonomical to retain, he requests the Township purchase this extra land. Council agrees to Mr. Chrastina's suggestion and requests the Clerk to have the agreements to p7_zrchase land prepared.OQn..ers Pihooker and Zamecnik & Horvath are not present. It is understood that a similar situation will arise with a severance being created in Mr. Pihooker's land. Mr. Gordon Pickergill representing the Township of Norfolk will report to his Council of the problems encountered this evening. Mr. James Gibbons reports on the progress of the several road projects. Mechanical problems have been encountered which has slowed the progress. He requests that Council give consideration to the purchase of a sander for the 1978-79 winter. Tenders will be advertised for opening at the October meeting of Council. Notices having been mailed to the several parties involved in the Bartley and Todd Municipal Drains advising them of Court of Revision to be held this evening, and no appeals having been received, the Court of Revision is not held. Council has the necessary by-law ready for passing at this meeting and it will be circulated as soon as can be arranged by the Clerk. Matheson of the Ministry of the Environment meets with Council to review the necessity of severs for the Village of Straffordville. There being an ample supply of potable water, it is the feeling that a water pipe line should not be necessary unless the present supply becomes polluted. P--ir. Matheson reports that there has been no problems reported by the Health Unit. There is approximately 4 to 6 Feet between the the beds and the water table. On sandy soil such as in Straff ordville, this will filter most pollutants with the exception of nitrates. ?'sir. Matheson will have tests conducted to determine the nitrate level in our water. He feels that with minimum lot sizes of 15,000 soft., there is little chance of problems develoning. If water ssrstem is necessar-v provincial assistance would start after a cost of $1,100. per average lot, and for severs after a cost of $1,100. per average lot. Also, under these circum- stances, it is possible that an amendment to the East Elgin Official Plan might be investigated to allow subdivisions larger than 10 lots as presently limited in the Plan without municipal services. Mr. Matheson recommends that the larger lot sizes be adhered to as it is not known how far it may be necessary, to go to find a dischape stream, and the considerable cost to be associated with a collectiol and storage lagoon on the sandy soil. Mr. Germaine Seghers meets with Council to request a review of the Pollick Drain report of 1957. He feels that his land is overly assessed for any benefits received. Gibbons, formerly road superintendent, meets with Council prior to leaving for a winter vacation in Florida. Council presents Mr. Gibbons with a watch in appreciation for the gears of service given to the Township. Oliveria meet with Council to discuss a problem with the Coyle Municipal Drain. While the drain appears to be working, the the portion is not of sufficient capacity to aderivatel-f drain the properties involved. Carried lerk Council Chambers Straffordville, Ontario December 4, 1978 The regular meeting of Council for the month of December is held this evening. This being the inaugural meeting of the Council for the years 1979-80, the proper oaths and declarations are subscribed by the members. Reeve R. Green welcomes the returning councillors and Ms. Sandra Sandham, She is the first lady councillor in Bayham. Also, the fact that Councilor R. Sandham has been returned makes the husband and wife the first such combination in Bayham. Reeve Green would like to see our road program continued with some hard surfacing each ear. the townline road with Malahide should have some work this year. Re completion and submission of the zoning by-law should be of early priority. The expansion of the community centre facilities should be examined carefully before any committment is given. Continuing support for the ball clubs and recreation committee is recommended. In addition to Reeve Green, present are Deputy Reeve M. Stewart and Councillors R. Sandham, S. Sandham and M. Schafer. Appeals of taxes under Section 636A. of the Municipal Act, and for adjustments allowed by the Assessment Review Court are heard by Council. (listing of appeals atthe bottom of minutes) Mr. James Gibbons reports on road progress. He requests a Jack for use in the township garage to replace the one presently in use as it is not dependable. He is given permission to purchase a Jack at an approximate cost of $1,000. Messrs. Manford Brooks and Wm. Bates meet with Council to complain about the issuance of a building permit for the construction of an industrial building in the residential section of Richmond. In the absence of a restricted area by-law Council and/or the building inspector has no valid g*unds for refuding the permit. Mr. Isaac Fehr meets with Council to request permission to locate a mobile home on his premises at Lot 117, Conc. 6, for the use of his son. Council informs him that this is contrary to our by-law which prohibits the use of mobile homes as permanent residences other than in mobile home parks. Mr.'Ken Walker meets with Council to request assurance that a building permit can be issued at Lot 16, Conc. 8. (McDowell), if the lot is sold for residential purposes. He presents drawings which show that fill will be necessary to raise a portion of the lot approximately 8 feet. Council agrees that a building permit will be issued if the requirements of the health unit and the Conservation Authority are met. Mr. Harold Dennis meets with Council 160 report on fire matters. He expresses concern that wood stoves and fireplaces are being hooked to chimneys which are not properly equiped for them. In many cases the chimneys have not been used for some years and can cause fire damage if not properly maintained. Mr. Wm. Underhill meets with Council to reports on various building projects and renovations being carried out under the Ontario Home Renewal Plan, Deputy Reeve Stewart and Councilor Schafer report on the seminar they have attended on Downtown Revitalization. Reeve R. Green presides with Deputy Reeve M. Stewart and Councillors R. Sandham, S. Sandham and M. Schafer in attendance. Reeve K. Emerson and Councillor A. Goethals represent Vienna and Councillor V. Bates represents port Burwell. The tenders are reviewed and with the addition of landfill costs estimated to be approximately 140 tons per month for collection and 100 tons at the transfer station. These estimates have been received from St. Thomas Sanitary Collection Services Ltd. The total costs are now: TedCaghill $8.33 collection $2.78 Land fill $11.11 per cap.
