Carried Council reconvened at 1:30 P.M. and met with Mr. Les Shackelton to conduct the auction of tax registered properties as advertised in the Tillsonburg News, one parcel only being offered. 1240 At 2:00 P.M. the parcel of land being Lot 26, Gray Street, S/S Plan. 258, Village of Eden was auctioned and sold to Mr. Jerry Neville for the stio of $275. ( see by-law No. 1814. below) Messrs. Allan Ladbrooke and Reg. Walters of the Ministry of the Environment met with Council to discuss the proposed water supply and distribution to residents along No. 19 Highway between the Villages of Port Burwell and Vienna as petitioned in November of 1973 Mr. David Causyn met with Council to apply for the position of dog - tax collector for 1974. .Moved by: B. Schafer That the Ministry of the Environment be requested to prepare a preliminary report for the supply and distribution of water to the residents along Highway No. 19 between the Villages of Port Burwell and Vienna, with consideration being given to the extension of the water service northerly to the Hamlet of Straffordville, together with advice ob methods of financing........Carried [A Moved by: R. Council agreed to have some repairs done when the weather allows. Mr. M. Gibbons meets with Council to discuss the 1974 road programe and report several bad spots in the roads with the fast release of the frost. Representatives of Gilchrist Building Systems and the Straffordville Lions Club were to meet with Council at this time to discuss the final accounts for the community centre building. However, no representatives from either of the above attended. Mr. Gene Schmeltz met with Council to discuss the municipality taking over a right of way to his property as a public road. Mr. Schmeltzt reasons for this being that some repairs were necessary to the hydro sertice on his property and because of the distance and the hydro regulations for service over private property as opposed to public property there would be a great difference in the cost. Council agreed to consider this request, however made no decision or committment at this time. Mr. Doug Dennis met with Council to request assistance in the maintenance of a turn around on his property(being the end of a road) for school busses and others who enter this road ignoring the dead-end sign. Council were sympathetic with Mr. Dennis and will be in contact with the Elgin County Board of Education the establich a policy for sharing of costs for this and similar situations in the future. Mr. Harold Dennis, fire chief, met with Council to request permission to purchase new hose for the fire department. Permission was granted for the purchase with the costs when ascertained to be include in the 1974 fire dept. budget. Chief Dennis reported that the mobile adios which had been giving trouble had now been serviced and that new aerials extending over the tanks would be required. Permission to purchase was granted. Howey met with Council to discuss the proposed new street leading to the school grounds. Information was exchanged on the proposal and it is expected that the construction will be completed by September -l. Mr. Roy Stewart met with Council to discuss the status of the property owned by Mrs. June Stewart located at the corner of N0. 19 Hwy. and Erie Street. The existing building encroaches on Erie Street. Council advised him that there is no intention on the part of this Council to object to the present location of the building, however, in case of demolition for any reason the by-laws existing at that time would have to be adhered to. She requested that the Township clean the pond as a part of the maintenance on the drain. The Clerk is to find out from John B. Dodd Ltd. if there was a specific request that the drain be constructed in such a manner that it went through the pond and the approXimate cost to put tale around the pond. Members of the Elgin County Board of Education met with Council to discuss the bui4i.ng of the public ro d through Lot 4, Main St. Mr. Harold Galloway, Chairman, Mr. Robt. Howey, vice Chairman, Mr. Frank Pinee, member, Mr. Bruce McGregor, Bus, Administrator, Mr. Earl McMaster, building supervisor, and Mr. Wm. McKay, Board Solicitor. The Board agreed to use the fill on the site to level Lot 4: After leveling they would grade the road to the point of gravelling. Council accepted this offer. The finishing of the road was discussed If tar & chips are acceptable and can be completed in 1974, The Township will pay the costs from Main St. to (but not including) the school parking lot. If the work is not done in 1974, and hot mix is used the work will be 50-50 for costs between the Board and Twp. If tar & chips are used in the future the work will be paid for by the Twp. The Clerk was instructed to arrange for a meeting amoeng the engineers, contpactor and Mr. McKenzie. Mr. Lyle Grant met with Council to further explain the survey as received from John. Weston and the correspondence from Brown and Brown concerning their title problems. Mrs. Vivian Norman met with Council to inquire into the possibility of receiving title to a property to which she has attained prescription rights. Members of the Elgin County Board of Education met with Council to further discuss the proposed street and entrance to their property from Main St. Manford Brooks met with Council to discuss the opening of John St. in Richmond and the donation of land from his holdingifor a street allowance. The Clerk was instructed to prepare an agreement setting out the responsibilities of Mr. Brooks and Council for the street opening. Moved by: B. Wolfe and Seconded by: R. A r] 10763 Council Chambers, Straffordville August 21, 1974 Record of proceedings of the Board of Negotiation held into the Expropriation of the lands of Clara Marshall. The Board convened at 10:30 A.M. Messrs. Ferguson and Heaman represent the Board of Negotiation. Reeve J. Dennis, Councillor B. Wolfe and Clerk J. Petrie with I. R. Linton, Q. C. reprsent the Township of Bayham. Miss Clara Marshall with B. Johnston represent Miss Marshall. Mr. Ferguson as Acting Chairman explains the operation of the Board of Negotiation giving a brief history of the formation and purpose of the Board. The Expropriation of the subject lands being Lots 6&7 south of Second Street and Second Street as closed was dated March 4, 1974. The Plan* of Expropriation was filed March 13, 1974. The Notice of Expropriation was served on April 15, 1974. The Valuation Date as accepted by Miss Marshall was April 15, 1974, The Offer to Purchase accompanying the Notice of Expropriation was $6,500. Mr. Linton presented the case for the Municipality offering as evidence the valuations received in the amount of $6,500. reaffirming the offer. Mr. Johnston presented the case for Miss Marshall offering as evidence the sales of the McDonald to DeVoss @ $7,500. and Glencree to Bechard @ $1,500. ( the sales being subsequent to April 15) as being a proper basis for setting the value of the subject lands. He requested the Board to consider $10,000. for the value of the subject lands plus $3,000. for injurious affection to her remaing properties to the North of Second Street and to the West of West Street., plus all her expenses to date. The parties were invited to adjourn to caucus to reconsider their respective offers. Upon resumption of the proceedings, the Municipality incresed its offer to $$,000. including the costs of the claimant. The Chairman recommended that` the land values be $1.,325. for part one and $1,600. for part two as shown on the Plan of Expropriation with the Municipality] being responsible for the legal fees of the claimant plus interest at 6% from April 15, 1971. The Board recommended that no compensation be paid for injurious affection. The Chairman once again reminded the parties that this recommendation was not binding and if not acceptable the matter would have to be resolved by the Land Compensation Board. The members of the Board then excused themselves leaving the parties to further discuss the matter. The parties then conferred in cudcus with a further offer being made by Miss Marshall to settle for $9,500. plus all her costs to date plus 6% interest from the time the Municipality has first made use of her lands (considered as 4uly, 1973, The Municipalit offered Miss Marshall $$,925. for land plus her legal expenses (approximately 500.) and appraisal costs, and interest for one year at 6%. Settlement was reached with the Municipality and Miss Marshall agreeing to the following: Land $8 925. plus interest @ 6% for one year, plus appraisal costs of approximately $300. plus the legal costs as presented by Mr. Johnston. Mr. Linton was instructed by the Municipality to have the matter 4-1-- wablaw of the Expropriation completed as quickly as possible. If so, the residents,of the subdivision were opposed to it. Council replied that while it had been considered, it was not necessary and nothing would be done about it in the near future. The matter of a catch basin and drain from the Bartlett property to connect with the Straffordville Municipal Drain was discussed. It was agreed that if the property owners pay the cost of the tile, the Township will provide the necessary catch basin and install the the and connect to the outlet. Moved by: V.
