HomeMy WebLinkAboutBayham Council Minutes 1965TOWNSHIP Council Minutes 1965 Township Office, Straffordville, Jan. lith. 1965 Pursuant to adjournment of Dec. 15th., the council of the Township of Bayham met in regular session on the above date with all members present except Councillor Garner. Minutes of the last meeting were read, approved and signed and the following business was done. Communications received included the following. - Request for membership in the Ontario Assn. of Rural Municipalities. Requests for grants from Elgin Seed Fair, Richmond Library and Salvation Army. Re -newel of insurance was received from Mrs. Marjorie Grant on Township Hall. Appreciation for grant was received from War Memorial Children's Hospital. 1965 calendar for -Ontario Fire College was received. W A 1964 financial stater#ent and request for grant was received from lir. Harvey, Sec. Elgin Federation of Agriculture. Clerk Vallee expressed the appreciation of the Area School Board for use of room to hold meetings. Communications were received from the Annuities Branch of the Dept. of Labour, Ottawa, in respect to amending and registering the present pension plan. Miss Minnie Chandler, sent the sum of $1.00 and requested deed for her portion of sideroad now closed. In the matter of franchise of the Union Gas Co., Clerk Vallee was instructed to have a representative of the Company attend next council meeting. Clerk Vallee gave a report on tax collections of 1964 taxes and also on the revised assessment roll. Moved by Hedges Seconded by lliott- That Ross Varson be named as Bayhamts representative on the Otter Creek Conservation Authority for 1965...Carried. Moved by Hedges Seconded by Carson- That this council, havinj examined the blanket position of J. D. Vallee and others, it is herewith directed that the same be placed in Township vault...Carried. Moved by Hedges Seconded by Carson- That requisitions for school funds be filed with the #1509 #1510 #1512 :•• Township Clerk not later than March 25th, 1965,..Carried. Moved by Elliott Seconded by Hedges- That the Clerk subscribe to 10 copies of the Municipal World for council and officials... Carried. Moved by Carson Seconded by Elliott- That Tony Kennedy be named to Calton Cemetery Board for a three year term... Carried. Moved by hedges Seconded by Elliott- That the following persons be appointed to Straffordville Cemetery Board for a three year term- Grant Mitchell Croft Garnham and William Ward and that Dewey Vallee be named as council representative for a one year term...Carried. During the noon hour, Reeve Phillips was host to Councillors Official, Ex - Reeves and others at a very delightful dinner served by the iadies of the Straffordville United Church in the basement of the new church. Reeve Phillips addressed the gathering following the meal' explaining much of Township and County affairs and in particular requested close co-operation between the council and the new Township Area School Board, two of the newlt elected Trustees being present at the dinner. Others spoke briefly. Deputy Reeve Carson thanked the ladies for the very enjoyable meal and also thanked Reeve Phillips on behalf of those present. Council resumed regular session at about 2.)0 P.M. The matter of amendments to the Annuity Pension Director of the Annuities Branch, was discussed. Moved by Carson Seconded by Hedges- And resolved that By -Law No. amend By -Law No. 1363, re. Annuity Pension Plan, Plan as suggested by the 1513 being a by-law to be now read a first time. harried. Moved by Elliott Seconded by Carson- And resolved that By -Law No. 1513 be now read a second time... Carried. Loved by Hedges Seconded by Elliott- And resolved that By -Law No. 1513 be now read a third time and finally passed... Carried. Fire Chief Nevill and Fireman H. Dennis waited on the council and further discussed specifications for tendering for new fire trick. Moved by Hedge s Seconded by Carson- That the Clerk advertise for tender for a new fire truck in Daily Commercial News and tenders to close Jan. 29th. at noon. Lowest or any tender not necessarily accepted and subject to E.M.O. approval... Carried. Road Supt Tribe discussed road matters with the members and presented a request from his men for an increase in rate of pay. The council promised that this requested would be further considered at the February meeting. Moved by Carson Seconded by Elliott- that the hourly rate of pay for ordinary labourers on Winter Works Projects be $1.00 per hour...Carried. About 20 ratepayers living on the 5th. concession road east of No. 19 Hwy. waited on the council and requested work done on their road. Mr. Harold Parker was spokesman for the group. They requested some temporary measures to make their road better for the time being and also that it be included for some re -construction on the 1965 road program. They were advised that their request would be given due and careful consideration. Pursuant to adjournment of Jan. 4th. 1965, the regular meeting of the Bayham Township Council was held on the above date with all members present and Reeve Phillips presiding. Minutes of the last meeting were read, approved and signed and the following business was done. Hospital and Sanatoria notices were read and discussed. Requests for membership in several associations were received. Requests for grants were received from East Elgin Fair Bozvd and St.John AZkiAJ Approval was received from 'Mr. Dernier of the Dept. of Highways for new street lighting along No. 19 Highway in Straffordville. In a letter regarding replacement of wooden structure at mileage 32.35 C.P.R. Port Burwell Subdivision, the Superintendent advised this Township to contact the Secretary of Board of Transport Commissioners re. same. A request for membership was received from LERDA. Advice was received that a conference on regional development was being sponsored by the Dept. of Economics and Defelop¢ment in Toronto Feb.15-17. A report of the Assessor on equalization of the new Township Public School Area was received showing Bayham's share determined at 70.265%. A request was received by the council, signed by six regular employees, to have the present pension plan replaced by the OMERS plan. Reeve Phillips reported on his meeting with Mr. Millman of the Dept. in respect to this matter. Appreciation for grants were received from Elgin Seed Fair and Salvation Army. A special meeting of the Bayham Township Council was held on the above date with all members ,present and Reeve Phillips presiding. The meeting was held to consider further the matter of a Durchase of additional fire truck and also road expenditure for 1965. Present also were Fire Chief Nevill and several volunteer firemen as well as Major Pratt of E.M.O. at St. Thomas. Fire Chief Nevill made a recommendation to council that the tender of Mar.Sh Pumps for equipment and Pearce Motors for chassis be accepted. This was thoroughly discussed by the members. The Board of transport Commissioners advised that a suinmission had been requested from the G.P.R. regarding wooden structure over tracks at mileage 32.35 Port Burwell Subd. A participation certificate was received from OMERS. Clerk Vallee advised that the old road allowance between lots 19 and 20, Con.$ had been derided one half to Miss Chandler and one half to Mr. Fendricks. The council was advised that claims for damages had been received from Frank Juhasz for mail box and from Douglas Matthews for damage to car. These were refered to the insurance company. Requests were received for grant to Tillsomburg Fair amd membership in the Elgin County Mutual Fire Aid Assn. Underwood Ltd, advised of an adjustment in cost for servicing Calculator machine Comaunications were received from the County Engineer in respect to authorizat- ion of movement of utility poles re. Development Road. A request to participate in harvest workerst camps was received from the Tobacco Harvest Workers Co-Ordinating Committee. Several notices were received in respect to hospital and sanatoria patients. Advice was received from the Emergency Measures Branch that the application for purchase of additional fire fighting equipment had been refused owing to funds for same being used up for the fiscal year. The Clerk was instructed to take this matter up with Major Pratt to have a new application submitted as soon as possible. Mr. Grant Brown, Solicitor for High School Board, advised that the Ontario Municipal Board had set date of May 7th. 1965 at 11.00 A.M. to hear a Motion to determine whether the Board §as Durisidiction to hear appeal of the Village of Vienna from the award of the arbitrators. Roads subsidy was received in an amount of $17,482.30 as balance for 1964. The Clerk advised that no appeals had been received respecting Garnham drain by-law. Copies of County of Elgin By -Laws Nos. 1$$3 and 1887 were received setting out Bayham's equalized assessment at $$,755,163 and levying the sum of $81,755.07 for 1965. Two petitions were received for drainage in Eden and one in lots 6 & 7, Con.10. A letter was received from 14'r. E. G. Cochrane, Cemetery Counsellor of the Dept. of Health, respecting four abandoned cemeteries. Information,with a request for approval or otherwise, was received from the County in respect to formation of a County Public Library System. This was lkid over by council to a future meeting. Notice was received of a training course for fire chiefs April 27 and 28. Several bulletins were received from LERDA# A copy of Hy -law No. 807 of the Township of Middleton was received and approval of same was requested of the Bayham Council. This by-law provided for the with- drawal of Middleton's portion from the Bayaham Township School Area. Dept. of Highways approval was received for box culvert plans for lots 21 qnd 22, North Gore. Tenders were called in Daily Commercial news to close Apr.15th. Otter Creek Conservatioo Authority requested a levy of $1926.00 for 1965. A petition, signed by 22 ratepayers of Eden, was received requesting paving of concession road from No. 19 Highway easterly of C.P.R.tracks. This was discuss- ed by the council. It was decided that actual paving of same would be doubtful but when drain is completed, the council would endeavour to at least make major improvements. Dereham Township Retarded Children Education Authority requisitioned the sum of. $422.44 from Bayham Township for pupils of Baytj►m for 1965. The Clerk was instrcuted to procure more information from the school board concerning this. Two accounts for Blood damage was presented to council on behalf of Mrs. Dora Girvin. The Council decided they could accept no responsibility in this matter.' A special meeting of the council of the township of Bayham was held on the above date f6r the purpose of opening . tenders on new box culvert and the consideration of budget for 1965. All members were present and Reeve Phillips presided. Engineer Doug. Vallee was present and advised that three tenders for the construction of double b&x culvert at lots 21 -22 -north gore, had been received. Clerk Vallee advise that CLM Industtries 4ad refused to install sample street lights in Straffordville unless the Township pay for the labour in connection with the indtallation. The matter was then considered in respect to the prices as received from CLM Industries, Canadian General Electric and Northern Electric. These appeared to be the same from the three companies. Council met with Mr. `'ack Rotc4kiss and reparesentatives Basil #evill, Clayton Jackson and Jack Barcla; of the Community "entre Board and discuss the matter of sidewalk on No. 19 Highway in front of Mr. Hotchkiss' property and a driveway for his use. On account of its hkighth, 11lr. Hotchkiss requested that the same be removed. The council decided that the Reeve should meet with a representative of the 1'ept. of Highways on the site before any action by the council. Drain Inspector Don. Chute met briefly with the council and discrossed some drainage problems. He also expressed his appreciation to the Bayham Township Fire Dept, for prompt service at his barn fire. Minutes of the last meeting were read, approved and signed and the following business was done. The following were among the communications received; - Several notices of patients in hospitals. Ontario Municipal Board approval of By -Law No. 1520 for Garnham Drain, Ontario Municipal Order respecting Casper O'Geil assessment appeal fixing assessments as follows for 1964 taxes. - Roll No. 120 - Land $450. The Township of Bayham was 9rdered to pay costs of reporting in an amount of $75.00. A letter was received from Solicitor Linton, setting out, the difficulty in obtaining a good title to sale of lots along Talbot Street,north end of Township lour x.26, S.T.R. and recommending that a plan of subdivision be made before other sales are approved, Several transfers of property were approved by the Community Planning Branch. A letter requesting membership was received from LERDA, and also a report on the past six months activities. Port Dover council requested support by resolution for a breakwater wall. No action taken. Notices were received in respedt to Ontario Municipal Assn. Convention and also one for Ontario Mayors and Reeves. By letter from County Engineer R.G. Moore, the County Road Committee had accepted the responsibility of supervision of construction of Dev. Road # 7$5. A copy of letter was received from Mr. Gordon Pratt of Elgin EMO advising that purchase of additional fire pumper had been approved at cost of 17,919,47. Advise was received that the Griffins Corner to Houghton Townline Road had been designated as Development Road No. 785. A letter, dated May 20th. was received from the Secretary of Centennial Advis- ory Committee setting out the amount of grant to be paid. Dept. of Highways approvals were received as follows; - By -Law No. 1517 - total approval 176,000.60 By -Law No -1518 - " " 12,500.00 By -Law No. 1521 - " " 35,000.00 The Sebretary •of Board of Transport Commissioners requested advice as to whether 6ayham Township would accept installation costs of 12J% and maintenance costs of 50% for proposed automatic crossing protection at lot 17, Conc. 4 & 5. A copy of Dereham Township By -Law No. 2052 was received requesting Bayham Town- ship support for same. C.P.R. Superintendent requested a meeting at the site of wooden overpass at lot 13, Conc. 1 and 2. A copy of Referee's report (supplementary) and as approved by Dept. of Educati&nl setting an additional two mills on former Viehna-Bayham Township School Area assessment for the years 1965 and 1966 was received. Eden Community Centre Board requested usual grant of $200. for sidewalks. Notice was received of Trench Excavators seminar for Inspector to be held at London on rune 22nd. A communication, dated May 5/65 and handed to Clerk ofi June 7th. pertaining to street light assessments and signed by eleven owners living along Talbot Street South, lot 126, was read to council. It was noted that the assumptions in this letter were considerably in error. At 1.30 P.M. the Engineer's report on the Phillips drain was read. Interested parties present were Walter Nelson and C.D.Phillips, Engineer Dodd was also in attendance and read the report. The report was discussed in considerable detail and ldid over for further conerideration. Reeve Phillips reported onhis meeting with Dept. of Highways Mr. Shannon in respect to sidewalk in front of J. Hotchkiss property and his later discussion of same with Mr. Hotchkiss. This was discussed further by council and agreed to have Councillors Hedges and Garner meet with Community Centre Board on same. Fire Chief Nevill met briefly with the Council and for neer fire truck. He was authorized to have same advised of chassis problem remedied. Communications received included the following. - A verbal complaint was received respecting growth of weeds and swwet clover at Second and Third Str� ets in Straffordville. The Clerk was instructed to advise the Weed Inspector of this matter. Ontario Municipal Board Notice of hearing of Leon Regan assessment appeal to be held at St. Thomas, on Sept. 30th. 1965 at 2.00 P.M. Completed agreement for Development Road No. 7$5 was received from the Minister of Highways together with work order No. D.R. 785-1 for $196,780.00 From the County Agricultrual Office, information respecting Farmstead and Rural Improvement Centennial Project, with request to appoint 3 members to committee. Per Capita grant was received in an amount of $6,268.20. Bulletins were received from LERDA. A letter was received from Solicitor Linton enclosing a copy of report from Mr. MacDougall in respect to the Prouse settlement. A letter was received from Ontario Water "esources Committee regarding indust- rial wastes. Mr. Harold Garner was authorized to attend Ontario Municipal Convention in Toronto, and Clerk to send for reservation for him. A report on Crossett Drain was received from Dereham Township and report on Moeseberger Drain (1965) was received from Engiseer Dodd. A resolution respecting Educational costs was received from Town of Whitby. This was not endorsed.. A claim for damages by roadside spraying was received from Miss Catherine McDowell and forwarded to insurance agents for attention. A memorandum was received from the Minister of Highways reppecting the cutting of hay along Highways and Township roads. Mr. -Ted Fielder, Centennail Field Representative, requested advice on the name of Chairman of local Centennial Committee. Council to try to have appointment for August meeting. At 11.00 o'clock A.M., the report on the Dereham Township Crossbtt Drain was read. No interested parties being present. Pursuant to adjournment of August 9th., the regular meeting of the Council of the Township of Bay ham was held on the above date with all members present and Reeve Phillips presiding. 11inutes of the last regular meeting were read, approv- ed and signed and the following business was done. Communications received included the following, - Advice from Insurance adjusters that the claim of Mtss Catherine McDowell had not been allowed. A letter was received from "'r. Clarke of I)ept . of Highways respecting damage to car of. Mrs. Sofalvi on No. 19 Highway. Re-newals for several insurance policies were received from Hamilton., Ward & Cathers. } A letter was received from Canadian Underwriters Assn, adviseing of thei. courtesy service for testing new fire fighting equipment. Mr. Ker, Chairman of the Elgin County United Appeals Committed advised by letter of the method of handling the county appeal this year and requested Council's support. This was filed. Notices of patients in hospitals were discussed. 0 839 The Ontario Municipal Board advised by registered notive, that the appeal s of Mr. C. R. Alward would be heard at Eleven o1clock on Sept. 29th. instead of at Ten o' clock of same day. Advice was received that the Provincial Treasurer had approved purchase of Tile Drainage debentures as follows; - Peter Driedger ---- $1600.00 John Wali Jr. ------ 2800.00 Notice was received from Select Committee on Conservation Authorities re. filing r of briefs for committee consideration by Oct. 15th. 1965. Several bulletins were received from LERDA. Action on Crossett Drain By -Lasa No. 1527 was withheld by the Ontario Municipal Board pending further progrees by Dereham Township, Ontario Municipal Bard approval and Order was received in respect to the Mooseberger Drain By -Law No. 152$, The Clerk gave a report on costs of additional street lighting along No. 19 Highway in Straffordville the same total costs being $6031.50 compared to the original estimate of $709LOO, The Clerk reviewed that matter of election officials with the members. A letter was received _from C.P.R. advising of their wish to .bolish position of caretaker at Straffordville and remove buildings. Information was received from the Dent. of Municipal Affairs in regards to dinter works Incentive Program for 1965-1966. A letter was received from Board of Transport gommissioners advising of require- ments re. flashing lights at C.P.R. Crossing on Dev. Rd. No, 785. Pursuant to adjournment of Sept. 7th., the regular meeting of the Bayham Town- ship Council was held on the above date, Reeve Phillips being absemt for part 3 of the meeting. 1 Moved by Hedges Seconded by Garner- That Dep.Reeve Carson preside in the absence of Reeve Phillips...Carried. Minutes of the last meeting were read, approved and signed and the following business was done. Communications received included the following; - Hospital botices re. indigent patient's, Several bulletins from LERDA Fleet insurance re-newal was received from Hamilton, Ward & Cathers, A report on Green Drain costs was received from Dereham Twp, The Dept. of Highways reported that under By -Law No. 1521, the sum of $1500.00 had been approved for Maintenance. A letter dated Sept. 24th. was received from the Dept. of Municipal Affairs advising of co-ordination and integration of provincial pension plans with the Canada Pension Plan, The Office of The Fire Marshall advised that the week of Out. 3 to 9 had been designated as fire prevention week. The Treasurer of Ontario advised that approval and been granted for the purchase of $3,300, of Tile Drainage Debentures in respect to Maurice Donck. Letters dated Sept. 9th. from C.P.R. and Sept. 29th, from Board of Transport Commissioners respecting wooden structure at lot 13, Cone. 1 & 2 were received and discussed by council. The Clerk was instructed to request more time for council to consider the matters contained in the above letters, Clerk Vallee advised that Notice had been served on him on Sept. 30th. of action by Village of Vienna against the Township of Bayham in the matter of an award made by referee A. D. McColl, Public School Inspector, on the formation of the Bayham To School Area, same to be heard on Tuesday, Oct. 12th. at 10.A.M. before the County Judge at St. Thomas. Mrs. basil Hotchkiss waited on the council and requested improvements to the road to their farm as the School Board had declined to operate bus over this road on account of condition of same. Hotchkiss sireroad to Huber farm afnd Mrs, Hotchkiss advised accordin 1 g y...Carried. At 2.00 P.M., Engineer Dodd read the report on Eden Drain No.2 with about 1$ interested persons present. Much discussion with several questions was held on the matter. Several expressed their opinion as against the drain. Explanation was given for proceedure of removing names from the petition. When given a chance to do so, none signed a paprr to withdraw from the petition and no one added teir name to same. It was decided that a majority for benefit on the petition were in Unp favour of this drain being proceeded with.,_ Engineer Moore of the County of Elgin advised that a drain was a must for his new road west in the village, Moved by Hedges Seconded by Garner- That the report of John Dodd, O.L,S, for Eden Drain No. 2 be adopted and Clerk prepare by-law for same to be debentured over a 10 year period..,Carried, Mr. T. S. Caldwell and 3 other representatives from the Dept, of Highways met with the members and discussed the matter of a Road Programming study for the Township. Consulting Engineer Vallee was also present. Moved by Elliott Seconded by Carson- That this Council Zequest the Dept. of Highways to approve of a Township Road Programming Study for Bayham Township.,.Carried, Moved by Hedges Seconded by Garner- That the Road Program Co-Ordinating Committee consist of Bayham Township Councul, Township Road Supt,, District Municipal Engineer, and Program Studies Engineer of Dept, of Highways..,Carried, Council adjourned briefly for a meeting of the Co-Ordinating Committee, Clerk Vallee reported on the matter of American Marsh Pumps Ltd. filing papers of bankrupcy and advised that nothing had been done on the chassis delivered to their plant on Sept. 3rd. Also that Solicitor Linton was working on arrangements to have this chassis released to the Township, Fireman Harold Lennis veported on his activities in the matter. Moved by Hedges Seconded by Elliott- That owing to cancellation of American Marsh Pump contract, this council authorize, subject to E.R.O. approval, the purchase of equipment for fire truck from King Seagrave of Woodstock in accordance with their tender submitted..,Carried, Fireman Dennis was authorized to make minor adjustments or additions if deemed atviseable to procure satisfactory equipment. Mr. Uyle Grant waited on the council and requested that the street ad4oining his garage property on the south be closed and that he be permitted to procure part ar all of came as it was presently being used as his car lot. A copy of letter from C.P.R. to Board of Transport Commissioners was received setting forth detailed costs for installation of flashing lights signals at C.P.R. crossing at Lot 17, Conc. 4 & 5. A grant of $520.56 was received for Chute Dra%n subsidy. Final payment of Unconditional grant was received in an amount of $6268.20. A letter was received from Mr. McDowell, Norfolk County Engineer, regarding erection of stop signs in Bayham along Norfolf County Road No. 30. Dept. of Highways approval was received for By -Law No. 1534 for expenditure of $7,500. on Roads and Bridges. G. Duncan Black Limited advised of &;kof office site. The sun of $3,015.25 was received as Dept. of Highways share of installat on of new Street lights along No. 19 Highway in Straffordville. Mr. Lee Ball, by letter, requested that street to his property from Talbot Street be opened and properly maintained. A receipt with letter of appreciation was received from War Memorial Hospital at London, for recent grant. A request for tentative approval of an expenditure of upwards of $100,000.00 by the Bayham Township Area School Board for an addition to Straffordville School was laid over to January meeting of new council. King Seagrave Ltd. advised that delivery of new fire truck was expected by the end of January. A memorandum of Rules of Procedure for by-lasw passed under Section 30 of The Planning Act, was received from The Ontario Municipal Board. Referees' reports covering settlement respecting withdrawal of Middleton and Dereham portions of North tayham school section, advising that no adjustment be made, was received from the respective School Inspectors. Mr. Kostuch explained in detail, the matter of the Committee requesting a proposal from a consulting engineer, to assist in a detailed study of the ten- year needs of the Township Road System, Consulting Engineer Vallee submitted a proposal on behalf of Jewitt, Dodd & Vallee, dated October 13, 1965, to undertake this study a� a proposed upset limit of $6,500.00, traffic counting and final printing of report to be extra.
