Dear Sir; -
Replying to your communication of the 29th ult.
which has reference to the request of this office to the
boxholders of Port Burwell No. l R.R. to erect their
rural mail boxes on the right hand side of the road and
to your query in regard to the onus of responsibility
for any action for damages caused by the rural mail
box being too close to the side of the road; I would
quote for your information the Departmental Law Clerk's
interpretation of the Sub Section of Section 9 of the
Post Office Act as amended oy 3-4 George V ch. 38
Section 2, which is as follows. -

In these circumstances no lies with the
Department or �.ioh the owner of the mail box for
accidents which might happen through collision with
said posts or otherwise.
IA.- The township authorities have no power whatever
to compel the removal or displacement of rural mail
boxes..
ji Should, however, any rural mail box be
inconveniently erected, the proper course for the
township authorities to follow is to petition the•
Superintendent of .,Tur& , Mail Delivery, Ottawa, who
will have the matter investigated.■
With reference to your statement that erecting
rural mail boxes on the right hand side of the road would
make it more dangerous for the rriusk mail courier to
serve them, as he is stone deaf, I cannot quits under-
stand how this would be the case as boxes erected on the

left hand side of the road necessitate the courier driving
to the wrong side of the road and halting his vehicle
in order to serve them while if they were erected on the
right aide of the road, he would not run the risk of
being struck by any oncoming vehicle. Of course, as I
explained in my circular to the boxholders, the Department
does not compel these boxholders to move their boxes as
stated but it is always the advice of this office that
whenever possible rural mail boxes be erected on the
right hand side of the road in such a position as will
allow the courier to pull up off the travelled highway
or pavement as the case might be and serve them without
dismounting from his vehicle.
I trust that this is the information that
you desire and that you will see the advisability of
the suggested action and do your utmost to convince
the boxholders to follow the change as requested by
circular to them.
