Dear .Sir.
On the thirteenth day of november on
returning home from Mr Leitch,s house where I h
been getting my milk .1 had the misfortune to
fall into the ditch which is along side the
streetand which has no protection at all.
this ditch is very dangerous and is about3 feet
deep and there is no light or railing to warn
anyone of its presence,this fall kept me from
thursday evening till the following tuesday
morning causing me to lose considerable money.
I could not put my foot to the ground till mond
morning . I am advising you that I am going to
Some on the council for damages .

To the Secretary of the Polioe Tillage of Port Burwell, and
To the said Police Village.
T-" LOTiCE that on Thursday the Thirteenth dar of
-November about Seven o'clock in the evening the undersigned
A.A.3ates, was proceeding along Addison Street, in that
part of the Township of 3ayham, which is included in the
Polioe Village of Port Barwell, at a point where a Street
which the undersigned is informed to be Te.uVeon Street,
runs off of Addison Street in an easterly direction.
At the point wnere the said side street debouches into
Addison ;treet, on the masterly side of the said Addison
Street, there exists a ditch running along the Southerly side
of the said side street which the undersigned believes to be
Tennyson Street and which ditch runs from the westerly limit
of Chatham street westerly until it reaches Addison Street
and the said ditch projects about ten feet Onto Addison Street.
The undersigned A.A. Bates was proceeding -Northerly along
Addison Street with the intention of turning ::aet onto said
side Street, which he believes to be 11eiayson Street and the
Street Dots@ unlighted at the point in question and said ditch
which 1s about three feet deep being unprotected although the
same projects onto Addison Street . The said undersigned
fell in the said ditch, sprained his ankle, wan otherwise
Injured, was unable to pursue his ordinary business, which
is that of a Barber and still suffers from the result of the
said injury.
The undersigned.claime that the injury to himself was
000asioned by the existence of the said ditch, which was neglig-
ently allowed by the Township of Beyham or the Police Village
of Port Burwell to be and remain unprotected in any way wbateo-
ever and by reason of there being no sight at the point in
question.
The undersigned A. A. Bates claims damages
for the injury to himself, the amount of which he cannot at
present ascertain as he is not yet aware whether or not he
will completely recover therefrom.
