Therefore the Council of the Township of Bayham
hereby enacts as follows:
1. The Head and the Treasurer are hereby authorized on behalf of the Municipality to
borrow from time to time by way of promissory note from CANADIAN IMPERIAL BANK
OF COMMERCE a sum or sums not exceeding in the aggregate $1,750,000.
to meet until the taxes are collected the current expenditures of the Municipality
for the year, including the amounts required for the purposes mentioned in subsection
(1) of Section 332 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest at such rate
as may be agreed upon from time to time with the Bank.
2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums
borrowed in this year and in previous years from the said Bank for any or all of the
purposes mentioned in the said Section 332, shall, with I terest thereon, be a charge
upon the whole of the revenues of the Municipality for the current year and for all
preceding years as and when such revenues are received.
3. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

BEING a Bylaw to Repeal Bylaw Z129-85
Whereas Bylaw Z129-85 was Passed by the Council of
of the Township of Bayham on th 4th day of April,
the Corporation
1985, for the
purpose of rezoning land at Lot 109, N.T.R., from Agricultural
(Al) to Institutional (I).
AND WHEREAS after certain objections, the said Bylaw was
referred to the Ontario Municipal Board.
AND WHEREAS by Order No. R 850355 the said Ontario Municipal
Board ordered that the appeal against said Bylaw Z129-85 be
allowed and the Bylaw repealed.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF
THE TOWNSHIP OF BAYHAM
THAT Bylaw Z129-85 be and the same is hereby repealed.

BY-LAW NO. 22$7
Being a By-law to provide that in the year
1986 a levy be made before the adoption of
the estimates for the year.
WHEREAS THE Council of the Township of Bayham deems it expedient to
make a levy in the year 1986 before the adoption of the estimates.
THEREFORE THE COUNCIL OF THE TOWNSHIP OF BAYHAM ENACTS AS FOLLOWS:
1. That in the year 1986, before the adoption of the estimates, a levy
shall be made on the whole of the assessment for Real property according
to the last revised assessment roll a sum not exceeding 50 percent of that
which would be produced by applying to such assessment the total rate
for all purposes levied in the preceding year on residential real
property of public and separate school supporters.
2. That in the year 1986, before the adoption of the estimates, a levy
shall be made on the whole of the Business Assessment according to the
last revised assessment roll a sum not exceeding 50 per cent of that
which would be produced by applying to such assessment the total rate for
all purposes levied in the preceding year on business assessment public
and separate school supporters.
3. The respective amounts to be levied under the provision of
paragraphs 1 and 2 of this by-law are:

4. The rate to be levied under the provisions of paragraph 1 and 2 of
this by-law to produce the amount set out in paragraph 3 of this by-law
is one hundred and twenty (120) mills.
5. The dates of payment of taxes under this By-law shall be as follows:

Due Date of 2nd Installment May 30
6. In default of payment of the first installment of taxes or any part
thereof by the day named therein for the payment therof, the remaining
installment or installments shall forthwith become payable.
7. A percentage charge of one and one quarter per centum (1k) shall be
imposed as a penalty for non-payment of and shall be added to every tax
installment or part thereof remaining unpaid on the first day following
the last day of payment of each such installment and thereafter an
additional charge of one and one quarter per centum (lk%) shall be imposed
and shall be added to every such tax installment or part thereof
remainging unpaid on the first day of each calendar month in which default
continues up to and including December of this year.

8. It shall be the duty of the Tax Collector immediately after the
several dates named in Section 5 to collect at once by distress or
otherwise under the provisions of the statutes in that behalf all such
tax installments or parts thereof as shall not have been paid on or
before the respective dates provided aforesaid, together with the
said percentage charges as they are incurred.
9. The tax collector not later than 14 days prior to the date that
the first installment is due shall mail or cause to be mailed to the
address of the residence or place of business of each person a notice
setting out the tax payments required to be made pursuant to this

this by-law, the respective dates by which they are to be paid to
avoid penalty and the particulars of the penalties imposed by this
by-law for late payments.
10. Taxes shall be payable to the Corporation of the Township of
Bayham and shall be paid to the collector at the Municipal Ofice.
11. The Collector and Treasurer be and are hereby authorized to
accept part payment from time to time on account of any taxes due
and to give a receipt for such payment, provided that acceptance of
any such payment shall not affect the collection of any percentage
charge imposed and collectable under section 7 in respect to non-
payment of taxes or of any installment thereof.
12. When tenants of lands owned by the Crown or in which the Crown
has an interest are liable for payment of taxes and where any such
tenant has been employed within or outside the municipality by the
same employer for not less than thirty days, such employer shall pay
over to the Collector or Treasurer on demand out of any wages, salary
or otherremuneration due to such employee the amount then payable
for taxes under this by-law and such payment shall relieve the empplyer
from any liability to the employee for the amount so paid.

BEING A BY-LAW TO AMEND SCHEDULE "A" of By-law No. 1926, as amended,
regulating water rates from the Elgin Area Water System.
WHEREAS By-law No. 1926 is a By-law to regulate the supplying of
water and rLtes for water from the Elgin Area Water System Project
AND WHEREAS Schedule "A" of By-law No. 1926 has: been amended by
By-law Nos. 1978, 2062, 2110, 2157,2188 and 2243.
AND WHEREAS it is now necessary to further amend By-law No. 1926
to adjust the rates charged for the supply of water.
NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF
THE TOWNSHIP OF BAYHAM.
THAT Schedule "A" of By-law No. 2243 is hereby repealed.
THAT the following be designated Schedule "A" of By-law NO.
1926 arA be effective from January 1, 1986.
SCHEDULE "A"
RATES FOR WATER SOLD FOR DOMESTIC AND COMMERCIAL PURPOSES
!. Each consumer shall pay for every metered service a minimum
bill of $25.00 every 13 week period and shall be allowed
to use 6000 gallons of water during the period without
further charge.
Water used during the period in excess of 6000 gallons will be
billed at the rate of $4.50 per 1000 gallons.
2. A late payment penalty of 5% will be charged.

BEING e by-law to establish: the Township of Bayham Award.
WHEREAS the Municipal Act R.S.O. 1980, Section 115, provides that Councils
may pass bylaws for providing fellowships, scholarsh:,.ps and other simila~
prizes.
AND WHEREAS this Council deems it expedient to establish an award to
perpetuate the memory of the Late Ronald A. Green, a councillor, deputy
reeve and reeve of this municipality between the years 1968 and 1985
inclusive.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That an award be established and known as the Township of Ba; -ham
Award.
2. That the sum of Two hundred dollar, ($200.00) be awarded annually
to certain students at the Straffordville Public School using the
County of Elgin mathematics test as a criteria, as follows:
(a) to the student in Grade 8 who attains the highest mark,
Fifty dollars ($500.)
(b) to the student in Grade 8 who attains the second highest
mark, Thj_rty dollars ($30.)
(c) to the student in Grade 8 who attains the third highest
mark, Twenty dollars ($20.)
(d) to the student in Grade 7 who attains the highest mark,
Fifty dollars ($50.)
(e) to the student in Grade 7 who attains tr.e second highest
mark, Thirty dollars f$30.)
(f) to the student in Grade 7 who attains the third highest
mark, Twenty dollars ($20.)
3. That a plaque be erected within the StrafforCville Public School
and the studentE who attain the highest mark in Grades 7 and 8
respectively have their name:: subscribed thereon each year that this
award is presented.
4. That the aforesaid plaque have set out the several years that the
late Renald A. Green was a member of Council for the Township of Bayham.

1. PURPOSE
The purpose of this Amendment is to change the land use
designation on a parcel of property from "Agriculture" to
"Rural Non-farm Area 1" in the Official Plan of the Township
of Bayham.
2. LOCATION
The area affected by this Amendment is comprised of
approximately 2.4 hectares (6 acres) and is situated at the
south-west corner of the intersection of County Road 38 and
the Road Allowance between Lots 128 and 12.5, Concession 6,
Township of Bayham.

The Canada Land Inventory of Soil Capability for Agriculture
classifies the subject lands as (combined) Class 4 and 6.
Due to this classification, the absence of specialty crop
soils and livestock farms, and the existing pattern of
development, the subject lands were identified as having
capability to support non-farm development in the Background
Study to the Official Plan of the Township of Bayham (1986).
This Official Plan Amendment is intended to be adopted
together with an implementing Zoning By -Law Amendment which
will recognize and legitimize the existing non-farm uses of
the subject lands.
4. DETAILS OF THE AMENDMENT
i) Schedule "A" Future Land Use of the Official Plan of
the Township of Bayham, is hereby amended by changing
from "Agriculture" to "Rural Non Farm Area I", those
lands outlined in heavy solid lines on the attached
Schedule "A", which schedule shall constitute part of
this Amendment.
ii) The lands subject to this Amendment and designated
"Rural Non Farm Area 1", may be used, developed and
zoned in accordance with the policies of Section 4.2.3

THE Council of the Corporation of the Township of Bayham, in
accordance with the provisions of the Planning Act, hereby
enacts as follows:
1. THAT Amendment No. 1 to the Official Plan of the Township of
Bayham consisting of the attached text and map schedules is
hereby adopted.
2. THAT the Clerk is hereby authorized and directed to make
application to the Minister of Municipal Affairs for
approval of the aforementioned Amendment No. 1 to the
Official Plan of the Township of Bayham.

PURPOSE
-1.-
The purpose of this Amendment is to change the land use
designation on a parcel of property from "Agriculture" to
"Rural Non-farm Area 1" in the Official Plan of the Township
of Bayham.
LOCATION
The area affected by this Amendment is comprised of
approximately 2.4 hectares (6 acres) and is situated at the
south-west corner of the intersection of County Road 38 and
the Road Allowance between Lots 128 and 129, Concession 6,
Township of Bayham. 4
BASIS OF THE AMENDMENT
The subject lands are situated approximately 670 metres east
of the hamlet of Straffordville at the end of a more or less
contiguous strip of existing non-farm development along
County Road 38. An existing non-farm dwelling and a
woodworking shop are situated at opposite ends of the
subject lands. These lands have historically been in
non-farm use due to poor soil conditions for agriculture.
The Canada Land Inventory of Soil Capability for Agriculture
classifies the subject lands as (combined) Class 4 and 6.
Due to this classification, the absence of specialty crop
soils and livestock farms, and the existing pattern of
development, the subject lands were identified as having
capability to support non-farm development in the Background
Study to the Official Plan of the Township of Bayham (1986).
This Official Plan Amendment is intended to be adopted
together with an implementing Zoning By -Law Amendment which
will recognize and legitimize the existing non-farm uses of
the subject lands.
DETAILS OF THE AMENDMENT
i) Schedule "A" Future Land Use of the Official Plan of
the Township of Bayham, is hereby amended by changing
from "Agriculture" to "Rural Non Farm Area I", those
lands outlined in heavy solid lines on the attached
Schedule "A", which schedule shall constitute part of
this Amendment.
ii) The lands subject to this Amendment and designated
"Rural Non Farm Area 111, may be used, developed and
zoned in accordance with the policies of Section 4.2.3
Rural Residential, as amended, and Section 4.3.6
Industrial, as amended.

THEREFORE the Council of the Corporation of the Township of
Bayham enacts as follows:
1. The entire area covered by the Official Plan of the
Township of Bayham is hereby depignated as a Site Plan
Control Area.
2. The Site Plan Control Area established by Section 1 of
this By-law shall comprise the following land use
designations as set out in By-law No. 2040, as amended
from time to time:

hereby defined as classes of development that may be
undertaken without the approval of plans and drawings
otherwise required under Section 40 (4) paragraph 2 of
the Planning Act, 1983.

4. Buildings containing twenty-five or more residential
dwelling units will require the approval of plans and
drawings required under Section 40 (4) of the Planning
Act, 1983.
5. The plans or drawings required to be submitted under
Section 40 (4) of the Planning Act, 1983, shall be
subject to the approval of the Council of the
Corporation of the Township of Bayham who shall also
determine the matters which may be required under
Section 40 (7) of the Planning Act, 1983.
6. Any Agreement entered into pursuant to Section 40 of
the Planning Act, 1983, shall be registered against the
title of the land to which it applies.
7. That By-law No. 2250, a by-law to establish a Site Plan
Control Area be and is hereby repealed.
8. This By-law shall come into force and take effect on
the date of passing thereof.

BEING a by-law to adopt the assessment on which the taxes shall be levied for
the year 1986, to levy the taxes for the year 1986 and to provide for the
collection thereof.
WHEREAS by action of the Province of Ontario, provision was made for the
taking of the assessment of the Municipality by the Regional Assessment
Commissioner, as the assessment on which the rate of taxation for the year
1986 should be levied.
AND WHEREAS it is necessary and expedient to levy on the whole rateable
property according to the last revised assessment roll of the said
Township the sum of $1,942,222. for the general purpose of the said Township
for the current year, for the payment of the County rate for the current
year and for the purposes of defraying part of the expenses of Public,
Separate and High School education and other purposes:
THEREFOR THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF BAYHAM ENACTS
AS FOLLOWS:
1. THAT the assessment contained in the assessment roll of the Township
of Bayham as made pursuant to Province of Ontario Regulations, be
and the same is hereby adopted and confirmed as the assessment of
which the rate of taxation for the year 1986 shall be levied.
2. THAT the said assessment roll be and the same is hereby adopted and
confirmed as the last revised assessment roll for the said Township.
3. THAT, for the purpose of providing the sum of $799,758. for the
general purposes of the Corporation, including the amount required
for County purposes and other purposes for the currept year, a rate
of 126.253 mills on the dollar be and the same is hereby levied -for
the year 1986 upon the whole of the said assessment of the Township
according to the last revised assessment roll, except that on
assessment of $6,741,298. a reduction of 15% shall be made.
4. THAT in addition, for the purpose of providing the sum of $1,142,464.
for Public, Separate and High School education purposes for the
current year the following mill rates be and the same are hereby
levied for the year 1986 upon the respective portions of the said
assessment of the School Supporters of the said Township according
to the last revised assessment roll, as indicated hereunder: -

7. All taxes and other special rates shall be paid in the office of the
Tax Collector or Treasurer of the Township of Bayham.
8. Taxes shall become due and payable one-half on or before August 29,
1986 and one-half on or before November 29, 1986. Penalties for
non-payment when due and discounts for prepayment of taxes shall be
as provided for in Township of Bayham By -Laws, (penalties at the rate
of one and one quarter per cent per month commencing the first day of
default of payment, and discounts the rate of one-half per cent
per month for each month for which pre -payment is made), subject
also to the provisions of By -Law No. 1697.
9. The Collector shall have the privilege of mailing the tax notices to
the several taxpayers of the Township at their last known address.

BEING a By -Law to establish a Penalty
Charge for Non - Payment of Current
Taxes and to provide for Interest to
be added to Tax Arrears.
WHEREAS under the Provisions of the Municipal Act, R.S.O.
1980, a municipality may impose penalties on overdue
taxes in 1986;
AND WHEREAS, a municipality may impose an interest charge
on tax arrears;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN-
SHIP OF BAYHAM ENACTS:
(1) THAT overdue taxes are those taxes that are levied in
1986 and are not paid on or before the day payment is
due;
(2) THAT tax arrears are taxes that are due and unpaid
after December 31st. of the year in which they were
levied;
(3) THAT the penalty charge to be added to overdue taxes
and the interest charge to be added to tax arrears
shall be fifteen per cent (15%) per annum.
(4) THAT the percentage charge as a penalty for non-
payment of current taxes shall be imposed on the
first day of default and on the first day'of each
calendar month thereafter in which default
continues, but not after December 31, 1986;
(5) THAT the Corporation shall give notice of the
penalty rate to be imposed under Sections 3 and 4
of this by-law in accordance with Subsection 6 of
Section 386 of the Municipal Act, R.S.O. 1980,
Chapter 302;
(6) THAT the Treasurer shall add to the amount of all
tax arrears due and unpaid, interest as specified in
Section 3 of this b -law at the rate of one and one
quarter per cent (1 %) per month for each month or
fraction thereof from the day this by-law takes
effect;
(7) THIS by-law shall take effect on March 1, 1986.

of vehicles passing over same, be imposed on certain
bridges in the Township of Bayham:
THEREFORE BE IT ENACTED BY THE MUNICIPAL COUNCIL OF THE
TOWNSHIP OF BAYHAM AS FOLLOWS: -
1. The limit of the gross weight of any vehicle or combination
of vehicles, passing over certain bridges in the Township
of Bayham, shall be in accordance with Schedule "A" attached
hereto and forming part of this By -Law.
2. That notice of such limit of gross weight, legibly printed,
shall be posted up, in a conspicuous place, at each end of
each bridge respectively.
3. That this By -Law shall come into force and effect upon being
approved by the Ministry of Transportation & Communications
and upon signs being duly installed. A

Re: Load Limit Bylaw
Township of Bayham
As per our meeting and discussion on June 19, 1986,
the following points were discussed.
(1) The load limit bylaw has expired. A new bylaw
should be passed as soon as possible. The
previous load limits should be used except for
the Tillsonburg townline structure. The
townline structure limit should be reduced to
two tonnes.
Even though the road south east of Richmond is
signed as being closed, traffic can still travel
over the bridge. Accordingly, the bylaw should
also cover this structure.
(2) Load limit signs should be erected at each end
of the structure and at each of the last
intersections before the structure.
(3) It is recommended that structures 3, 11, 12 and
15 be physically closed by a fence or fence and
gate. The closure points would be at the last
entrance before the structure.
If a gate is used, then it should be padlocked,
with a key given to the farmer(s) who owns land
on both sides of the structure. In such cases,
it may be advisable to purchase property on one
side of the structure and legally close the
structure(s).

WHEREAS the Township of Bayham and Town of Tillsonburg have
entered into an agreement for the maintenance and repair of
certain portions of the Highway forming the Boundary Road
between the said Municipalities under the provisions of The
Municipal Act, R.S.O. 1980, Section 268, and it is now
necessary to ratify and confirm the said agreement, and to
authorize the Reeve and Clerk to execute the same.
THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM ENACTS AS FOLLOWS: -
THAT the Agreement between the Township of Bayham and Town
of Tillsonburg dated the 3rd. day of July, 1986, a true copy
of which agreement designated as Schedule 'A' is hereto
attached, and forms a part of this By -Law, be and the same
is hereby ratified and confirmed; and the Reeve and Clerk
are hereby authorized to execute the same on behalf of this
Corporation, and to affix the Corporate Seal of the Township
of Bayham hereto.

THIS AGREEMENT made in duplicate this 3rd. day of July A.D. 1986
BETWEEN the Municipal Corporation of the Town of Tillsonburg
of the FIRST PART
AND the Municipal Corporation of the Township of Bayham
of the SECOND PART
WHEREAS under the provisions of Chapter 302 R.S.O. 1980 Section 268,
the Corporations of adjoining Municipalities, may enter into an
agreement for the Maintenance and Repair of any Highway forming
the Boundary between such Municipalities whereby each of them
undertake for a term of not exceeding Ten Years, to maintain and
keepin repair any portion of such highway.
AND WHEREAS the said Municipalities have joint jurisdiction over
the Boundary Road between the said Municipalities and it is deemed
expedient to provide for the division of the said Highway so that
each Municipality may be responsible for the Maintenance and repair
of a portion of the same.
NOW THEREFORE this agreement witnesseth that in consideration of the
premises and mutual covenants and agreements hereinafter contained
the parties hereto agree each with the other as follows:
1. The Township of Bayham shall maintain, ari repair, and be respon-
sible for the Boundary Road between the said Municipalities.
2. The Township shall finance and have full control and supervision
over all the maintenance and repair undertaken on the Boundary
Road.
3. The Town of Tillsonburg shall reimburse the Township of Bayham for
50% of the costs incurred in the aforesaid maintenance and repair
of the Boundary Road between the Municipalities upon invoices
being submitted by the Township to the Town; said costs being those
actually incurred for all labour and materials, and for machinery
rentals as set out in current M.T.0 schedules. ,
4. Should construction or re -construction of any portion of the
Boundary road be requested by either Municipality, it shall only
be undertaken with the consent of both Municipalities and be
subject to an agreement for the sharing of costs as determined
at the time of request.
5. This agreement shall continue in force and shall be binding upon
the said Municipalities until the First day of July A.D. 1996 -
unless road changes or conditions warrant a new agreement.
6. This agreement shall become effective and binding on the said
Municipalities when confirmed by By -Law of the Council of each of
the said Municipalities, and such By -Laws with a copy of this
agreement attached shall be registered in the Registry Office of
each registry division in which such Highway or any portion there-
of is situate.
7. After registration of said By -Laws each Municipality shall enjoy
equal rights and responsibilities accruing from the use of the
Boundary Road.

A By -Law of the Township of Bayham to
authorize an agreement between the
Town of Tillsonburg and the Township
of Bayham for the Maintenance and Repair
of a Boundary Road

WHEREAS the Township of Bayham and Town of Tillsonburg have
entered into an agreement for the maintenance and repair of
certain portions of the Highway forming the Boundary Road
between the said Municipalities under the provisions of The
Municipal Act, R.S.O. 1980, Section 268, and it is now
necessary to ratify and confirm the said agreement, and to
authorize the Reeve and Clerk to execute the same.
THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM ENACTS AS FOLLOWS: -
THAT the Agreement between the Township of Bayham and Town
of Tillsonburg dated the 3rd. day of July, 1986, a true copy
of which agreement designated as Schedule 'A' is hereto
attached, and forms a part of this By -Law, be and the same
is hereby ratified and confirmed; and the Reeve,and Clerk
are hereby authorized to execute the same on behalf of this
Corporation, and to affix the Corporate Seal of the Township
of Bayham hereto.

THIS AGREEMENT made in duplicate this 3rd. day of July A.D. 1986
BETWEEN the Municipal Corporation of the Town of Tillsonburg
" of the FIRST PART
AND the Municipal Corporation of the Township of Bayham
of the SECOND PART
WHEREAS under the provisions of Chapter 302 R.S.O. 1980 Section 268,
the -Corporations of adjoining Municipalities, may enter into an
agreement for the Maintenance and Repair of any Highway forming
the Boundary between such Municipalities whereby each of them
undertake for a term of not exceeding Ten Years, to maintain and
keep:in repair any portion of such highway.
AND WHEREAS the said Municipalities have joint jurisdiction over
the Boundary Road between the said Municipalities and it is deemed
expedient to provide for the division of the said Highway so that
each Municipality may be responsible for the Maintenance and repair
of a portion of the same.
NOW THEREFORE this agreement witnesseth that in consideration of the
premises and mutual covenants and agreements hereinafter contained
the parties hereto agree each with the other as follows:
1. The Township of Bayham shall maintain, and repair, and be respon-
sible for the Boundary Road between the said Municipalities.
2. The Township shall finance and have full control and supervision
over all the maintenance and repair undertaken on the Boundary
Road.
3. The Town of Tillsonburg shall reimburse the Township of Bayham for
50% of the costs incurred in the aforesaid maintenance and repair
of the Boundary Road between the Municipalities upon invoices
being submitted by the Township to the Town; said costs being those
actually incurred for all labour and materials, and for machinery
rentals as set out in current M.T.0 schedules. ,
4. Should construction or re -construction of any portion of the
Boundary road be requested by either Municipality, it shall only
be undertaken with the consent of both Municipalities and be
subject to an agreement for the sharing of costs as determined
at the time of request..
5. This agreement shall continue in force and shall be binding upon
the said Municipalities until the First day of July A.D. 1996 -
unless road changes or conditions warrant a new agreement.
6. This agreement shall become effective and binding on the said
Municipalities when confirmed by By -Law of the Council of each of
the said Municipalities, and such By -Laws with a copy of this
agreement attached shall be registered in the Registry Office of
each registry division in which such Highway or any portion there-
of is situate.
7. After registration of said By -Laws each Municipality shall enjoy
equal rights and responsibilities accruing from the use of the
Bouhdary Road.

A BY-LAW to authorize the execution of an agreement

WHEREAS Section 268 of the Municipal Act, R. S. 0. 1980,
Chapter 302, provides that corporations of adjoining municipalities,
may enter into agreements for the maintenance and repair of any
Highway forming the boundary between such municipalities.
AND WHEREAS it is deemed expedient to enter into an agreement
with the Township of Bayham for the maintenance of boundary roads
as more particularly set out in the agreement hereto attached and
marked Schedule "A" to this By -Law.
THEREFORE the Council of the Corporation of the Town of
Tillsonburg enacts as follows:
1. THAT the agreement hereto attached and marked Schedule "A"
to this by-law, be and the same is hereby ratified and confirmed
and the Mayor and Clerk are hereby authorized to execute
same on behalf of the Corporation and to affix the Corporate
Seal.
2. THAT the agreement hereto attached and marked Schedule "A"
is hereby declared to be a part of this By -Law as if written
and incorporated herein.
3. THIS By -Law is passed pursuant to the provisions of Section

follows, that is to say, all that portion of boundary road
northerly from the intersection, of the road between North Gore
and Concession Eight in the Township of Malahide to the
Boundary Road between the Townships of Bayham and South West
Oxford.
2. The Township of Malahide shall build, maintain and repair, and
be responsible for the portion of the Boundary Road between the
said Townships, being more particularly described as follows, that
is to say, that portion of boundary road southerly from the inter-
section of the road btween North Gore and Concession Eight in the
Township of Malahide to a distance of about 3900 feet in Concession
Six (South Talbot Road); and that portion of the Boundary road
South of County of Elgin Road No. 42 to a distance of about 5000 ft.
3. Each Township shall finance and have full control and supervision
over all the work undertaken on its respective portion of Boundary
Road, and any subsidy which may be allowed by the Ministry of
Transportation and Communications of the Province of Ontario on
such work, shell belong to the Municipality accounting for the
Expenditure; except that any work or undertaking of a major nature
shall have the approval of the Councils of both Townships and the
sharing of costs determined between the said Townships prior to the
commencement of said work or undertaking.

4. This agreement shall continue in force and shall be binding upon
the said Townships until the First day of July A.D. 1996, unless
road changes or conditions warrant a new agreement.
5. This agreement shall become effective and binding on the said
Townships when confirmed by By -Law of the Council of each of the

attached, shall be registered in the Registry Office of each

THIS AGREEMENT made in duplicate this 3rd. day of July, A.D. 1986
BETWEEN the Municipal Corporation of the Township of Bayham
of the First Part
AND the Municipal Corporation of the Township of Malahide
of the Second Part
WHEREAS under the provisions of Section 268 Chapter 302 R.S.0.1980
the Corporations of adjoining Municipalities, may enter into an
agreement for the Maintenance and Repair of any Highway forming the
Boundary between such Municipalities, whereby each of them under-
take for a term of not exceeding Ten years, to maintain and keep
in repair any portion of such Highway.
AND WHEREAS the said Townships have joint jurisdiction over the
Boundary Road between the said Townships and it is deemed
expedient to provide for the division of the said Highway so that
each Township may be responsible for the Maintenance and Repair of
the same.
NOW THEREFORE this agreement witnesseth that in consideration of
the premises and mutual covenants and agreements hereinafter
contained the Parties hereto agree each with the other as follows:
1. The Township of Bayham shall build, maintain and repair, and be
responsible for that portion of the Boundary road, and road used
in lieu of Boundary road where no such Boundary road exists, be-
tween the said Townships, being more particularly described as
follows, that is to say, all that portion of boundary road
northerly from the intersection of the road between North Gore
and Concession Eight in the Township of Malahide to the
Boundary Road between the Townships of Bayham and South West
Oxford.
2. The Township of Malahide shall build, maintain and repair, and
be responsible for the portion of the Boundary Road between the
said Townships, being more particularly described as follows, that
is to say, that portion of boundary road southerly from the inter-
section of the road btween North Gore and Concession Eight in the
Township of Malahide to a distance of about 3900 feet in Concession
Six (South Talbot Road); and that portion of the Boundary road
South of County of Elgin Road No. 42 to a distance of about 5000 ft. j
3. Each Township shall finance and have full control and supervision
over all the work undertaken on its respective portion of Boundary
Road, and any subsidy which may be allowed by the Ministry of
Transportation and Communications of the Province of Ontario on
such work, shall belong to the Municipality accounting for the
Expenditure; except that any work or undertaking of a major nature
shall have the approval of the Councils of both Townships and the
sharing of costs determined between the said Townships prior to the
commencement of said work or undertaking.

4. This agreement shall continue in force and shall be binding upon
the said Townships until the First day of July A.D. 1996, unless
road changes or conditions warrant a new agreement.
5. This agreement si:all become effective and binding on the said
Townships when confirr,;r�d by By -Law of the Council of each of the
said Townships, and such By -Laws with a copy of this Agreement
attached, shall be registered in the Registry Office of each
registry division in which such highway or any portion thereof
is situate.
6. After the registration of such By -Laws each Township shall in-
demnify and save harmless the other from any loss or damage
arising from the want of repair of the portion which it has assumed.

PURPOSE
The purpose of this Amendment is to change the land use
designatiun un a parcel of property from "Agriculture" to
"Hamlet" in the Official Plan of the Township of Bayham.
The proposed change in land use designation will facilitate
the development of three single family dwellings within an
expanded area of the hamlet of Eden.
LOCATION
The area affected by this Amendment is
approximately 1.9 hectares (4.6 acres)
immediately east of the hamlet of Eden

BASIS OF THE AMENDMENT

The Canada Land Inventory of Soil Capability for Agriculture
classifies the subject lands as (combined) Class 4 and 6.
Localized soil conditions are characterized by imperfect
drainage for agricultural use and as such, it would appear
that a C.L.I. soil classification of 6 (six) for agriculture
is most appropriate for the subject lands.
Due to this classification, the absence of specialty crop.
soils and livestock farms, and the existing pattern of
development, the subject lands were identified as having
capability to support non-farm development in the Background
Study to the Official Plan of the Township of Bayham (1986).
This Official Plan Amendment is intended to be adopted
together with an implementing Zoning By -Law Amendment which
will regulate the proposed hamlet residential uses of the
subject lands.
4. DETAILS OF THE AMENDMENT
i) Schedule "A" Future Land Use of the Official Plan of
the Township of Bayham, is hereby amended by changing
from "Agriculture" to "Hamlet", those lands outlined in
heavy solid lines on the attached Schedule "A", which
schedule shall constitute part of this Amendment.

The area affected by this Amendment is comprised of
approximately 1.6 hectares (4 acres) and is situated on the
south side of the Road Allowance between Concessiogs 9 and 10 in
Lot 22, Concession 9 in the Township of Bayham.
3. BASIS OF THE AMENDMENT
The subject lands are situated in an aesthetic setting amidst a
heavily treed area which is associated with an adjacent stream
valley. An existing dwelling and a plumber's shop are situated
on the subject lands, while surrounding land uses consist of a
mixture of rural and urban development. There are five rural
residential uses across the road from the subject lands, and a
sixth non-farm dwelling is situated approximately 150 metres to
the west. Agricultural land uses in the immediate area consist
of field crops such as beans and corn as well as specialty crops
such as tobacco. There are no livestock operations within 300
metres of the subject lands.
The Canada Land Inventory of Soil Capability for Agriculture

BEING a By-law to amend By-law No. 2272 providing for the construction
of the Braun Municipal Drain, and levying assessments thereto.
WHEREAS By-law No. 2272 providing for the construction of the Braun
Municipal Drain under the provisions of the Drainage Act, was passed by
the Municipal Council of the Corporation of the Township of Bayham on
the 21st. day of November, 1985.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$6,270.
AND WHEREAS the actural cost of the work all expenses included was
$7,360.92 to which a grant of $759.18 has been applied to agricultural
lands leaving a net cost of $6,601.74 being $331.74 more than the
estimated costs.
AND WHEREAS it is provided by The Drainage Act, that such deficit funds
shall be increased in pro rata proportions to the assessment contained
in the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $120.64 being the amount over estimated as assessed
against lands as provided in By-law 2272 be and the same is hereby
increased in pro rata porportions to the assessments as contained in
the said By-law No. 2272 and the amonts are shown on the schedule.
2.- That the sum of $452.38 being the amount under Estimated as assessed
against roads as provided for in By-law No. 2272, be and the same is
hereby increased in pro rata proportions to the roads assessed in
By-law No. 2272, said amount is hereby shown in the schedule of
assessments, hereto attached and which form a part of this By-law.
3. That the said sum of $331.74 shall be added to the amount of the
total assessments contained in By-law No. 2272 and the debentures to
be issued as provided for in By-law NO. 2272 shall be as provided for
in By-law 2272.
4. That the interest rate on the said debentures as provided for in
By-law No. 2272 shall be ten and one half per cent (10�%) per
annum.
5. This By-law comes into force on the final passing thereof, and may
be cited as the "Braun Municipal Drain Amending By-law".

the Nevill Municipal Drain, and levying assessments thereto.
WHEREAS By-law No. 2258 providing for the construction of the Nevill
Municipal Drain under the provisions of the Drainage Act, was passed by the
Municipal Council of the Corporation of the Township of Bayham on the 1st
day of August, 1985.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$62,300.
AND WHEREAS the actual cost of the work all expenses included was
$65,697.40 to which a grant of $19,884.98 has been applied to agricultural
lands leaving a net cost of $45,812.42, being $16,487.58 less than the
estimated cost.
AND WHEREAS it is provided by The Drainage Act, that such surplus funds
shall be decreased in pro rata proportions to the assessments contained
in the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $16,790.78 being the amount over estimated as assessed
against lands as provided in By-law 2258 be and the same is hereby
decreased in pro rata proportions to the assessments as contained in
the said By-law No. 2258 and the amounts arq shown on the schedule of
assessments hereto attached and which form a part of this By-law.
2. That the sum of $303.20 being the amount under estimated as assessed
against roads as provided for in By-law No. 2258 be and the same is
hereby increased in pro rata proportions to the roads assessed in
By-law No. 2258, said amount is hereby shown in the schedule of
assessments, hereto attached and which form a part of this By-law.
3. That the said sum of $16,487.58 shall be deducted from the amount of
the total assessments contained in By-law No. 2258 and the debenture
to be issued as provided for in By-law No. 2258 shall be as provided
for in By-law No. 2258.
4. That the interest rate on the said debentures as provided for in
By-law No. 2258 shall be ten and one half per cent (10�%) per
annum.
5. This By-law comes into force on the final passing thereof, and may
be cited as the "Nevill Municipal Drain Amending By-law".

A By-law to provide for the maintenance of the Arn,
Bartley, Benner, Berdan-Cheesman, Casier, Coyle,
Crossett, Deli, Emerson, Fasseel, Freeman-Storp,
Green, Grigg, Hampton, Horvath-Blondeel, Jacko,
Juranics, Nelson, No. 1, Phillips, Pollick, C. E.
Smith, Stewart, Swance, Wallace Branch, White and
Winter Municipal Drains and to raise the sum of
$14,610.32 to pay therefor.
WHEREAS the above mentioned drains were constructed under the provisions of
the Drainage Act, and according to the several by-laws of the mun'Lcipality,
providing for such construction, and according to the various reports of
the Township Engineers made thereon.
AND WHEREAS it is provided by the said reports, by-laws and Drainage Act
that the municipality of the Township of Bayham, shall maintain the said
Drainage works, at the expense of the land and roads in the said Township
in any way assessed for the construction thereof, in the portion according
to such assessment, until such assessments or portions thereof, be varied.
AND WHEREAS in compliance with such duty, the Municipality has from time
to time, carried out certain minor repairs on the said drains.
AND WHEREAS it is desirable to make a pro rata assessment and levy
pursuant to the said Drainage Act, upon the lands and roads assessed for
the construction of the aforesaid drains, so as to provide for and raise
the cost of the said repairs and expenses incidental thereto which amount
in all to $14,610.32 to the lands and roads assessed, and the amount of
the assessments upon which the assessments and proportions hereby made are
fixed, appear upon attached Schedule of Assessments, which said Schedule
is a part of this by-law.
AND WHEREAS it is deemed expedient to levy the amounts in 1986.
a
NOW THEREFORE the Municipal Council of the Corporation of the Township
of Bayham enacts as follows:
1. That for the purpose of paying the said repairs and expenses incidental
thereto or for repaying into the General Funds of the Municipality the
amount or cost thereof the sum of $7,282.12 the amount charged against the
lands of the drainage works, and now assessable for Maintenance, the
following total special rates and amounts as set out in the Schedule of
Assessments attached hereto and forming a part of this By-law, shall
over and above all other rates be assessed and levied and collected in the
same manner and at the same time as other taxes are levied and collected
upon and from the undermentioned lots or parts of lots as specified in
the attached schedule of assessments in the present year, 1986.
2. That for the purpose of paying the sum of $521.07 the amount charged
against said roads of the Municipality, and $3,235.23 the amount charged
against other Municipalities, the Province of Ontario, and other Boards
and Corporations for the aforesaid purpose, accounts shall be levied
against the roads of the Municipality and against the other Municipalities,
the Province of Ontario, and other Boards and Corporations to pay the
aforesaid amounts.
3. That the sum of $3,571.90 be charged to the Treasurer of Ontario
under the Drain Maintenance Grants Program for repairs to drains
serving agricultural lands.

BY-LAW N0. 2 318
THE Council of the Corporation of the Township of Bayham, in
accordance with the provisions of the Planning Act, hereby
enacts as follows:
1. THAT Amendment No. 4 to the Official Plan of the Township of
Bayham consisting of the attached text and map schedule is
hereby adopted.
2. THAT the Clerk is hereby authorized and directed to make
application to the Minister of Municipal Affairs for
approval of the aforementioned Amendment No. 4'to the
official Plan of the Township of Bayham.
3. THAT no part of this By -Law shall come into force and take
effect until approved by the Minister of Municipal Affairs.
ENACTED AND PASSED this 2nd day of October, 1986.

1. PURPOSE
The purpose of this Amendment is to change the land use
designation on a parcel of property from "Agriculture" to "Rural
Residential" in the Official Plan of the Township of Bayham.
2. LOCATION
The area affected by this Amendment is comprised of
approximately 4.6 hectares (11.5 acres) and is situated in Lot
20, Concession ll,on the west side of Bayham Drive which forms
the municipal boundary between the Township of Bayham and the
Town of Tillsonburg.
3 BASIS OF THE AMENDMENT
The subject lands are situated in an aesthetic setting which is
comprised of significant stands of mature trees. An existing
non-farm residence is situated on the southern part of the
property which comprises approximately 3.5 hectares (8.5 acres).
A second non-farm residence is proposed for the northerly
portion of the property which will comprise 1 hectare (2.5
acres) pursuant to the process of severance and conveyance.
Existing land uses in the vicinity are typical of those found in
the transitional areas between urban and rural municipalities.
Two large industrial manufacturing establishments are situated
to the east and south-east of an open space buffer across Bayham
Drive immediately east of the subject lands in the Town of
Tillsonburg. The C.N.R. mainline and a large woodlot define the
southern boundary of the subject lands, while approximately 75
metres to the north, Bayham Drive intersects with the Road
Allowance between Bayham and Dereham Townships. Situated to the
west, or rear of the subject lands are cash crop fields and
additional woodlots. There are no livestock operations within
1000 metres of the subject lands.
The Canada Land Inventory of Soil Capability for Agriculture
classifies the subject lands as (combined) Class 1 and 3. There
are many factors, however, which indicate that the subject lands
have no real utility for agriculture. Among these factors are
the irregular triangular shape of the property, the heavy tree
cover and existing non-farm development on-site, and the
confined location on the subject lands amidst major
transportation arteries adjacent to an incorporated urban
municipality. As such, the subject lands have no capability for
conversion to agricultural use, nor do they exhibit the
potential to restrict existing or future agricultural uses in
the local area. Due to these circumstances, the absence of
livestock farms and the existing pattern of development in the
area, the subject lands meet the relevant criteria for
designation as a rural residential area.

This Official Plan Amendment is intended to be adopted together
with an implementing Zoning By -Law Amendment which will
recognize the existing and proposed non-farm uses of the subject
lands.
4. DETAILS OF THE AMENDMENT
i) Schedule "A" Future Land Use of the Official Plan of
the Township of Bayham, is hereby amended by changing
from "Agriculture" to "Rural Residential", those lands
outlined in heavy solid lines on the attached Schedule
"A", which schedule shall constitute part of this
Amendment.
ii) The lands subject to this Amendment and designated
"Rural Residential", may be used, developed and zoned
in accordance with the policies of Section 4.2.3 of the
Official Plan, Rural Residential policies, as amended.

application to the Minister of Municipal Affairs for

2. LOCATION
The area affected by this Amendment is comprised of
approximately 2.4 hectares (6.0 acres) and is situated in Lot
20, Concession 11, on the northwest corner of Bayham Drive and
Highway No. 3 adjacent to the municipal boundary between the
Township of Bayham and the Town of Tillsonburg.
3. BASIS OF THE AMENDMENT
The subject lands are situated on a cleared portion of land in
an area which is predominantly covered by mature tree growth.
The land is presently vacant.
Existing land uses in the vicinity include a mix of both rural
and urban land uses due to the proximity of the Town of
Tillsonburg. Two major industrial uses are located immediately
east of the property in the Town of Tillsonburg. Immediately
north and west of the subject lands there is a woodlot and south
of the site there is a mix of rural residential and agricultural
uses. There are no existing livestock operations within 500
metres of the subject lands.

for the construction of the Garnham Municipal Drain under the
provisions of the DrOinage Act, was passed by the Council of the
Township of Norfolk on the 22nd. day of April, 1985.

accordance with the provisions of the Planning Act, hereby
enacts as follows:
1. THAT Amendment No. 6 to the Official Plan of the Township
of Bayham consisting of the attached text and map schedule
is hereby adopted.
2. THAT the Clerk is hereby authorized and directed to make
application to the Minister of Municipal Affairs for
approval of the aforementioned Amendment No. 6 to the
Official Plan of the Township of Bayham.
3. THAT no part of this By -Law shall come into force and take
effect until approved by the Minister of Municipal
Affairs.

The subject lands are located in an aesthetic setting adjacent
to the upper branch of the South Otter Creek. The lands are
presently part of a 48 hectare farm holding which is divided
along its north -south axis by the creek and its associated
woodland along each bank. Lands which are not wooded are under
agricultural production and yield corn and asparagus. The
subject lands are comprised of an existing residential unit and
a kiln and will comprise approximately 1,633 square metres
pursuant to the process of severance and conveyance.
Existing land uses in the area are primarily agricultural
although south of the property there are some rural residential
uses. There are no livestock operations within 300 metres of
the property.
The Canada Land Inventory of Soil Capability for Agriculture
classifies the subject lands as (combined) Class 4 and 6. Due
to this classification and the absence of specialty crop
soil on the site, the Background Study to the Official Plan
identified the subject lands as displaying potential for
non-farm development. These circumstances combined with the
absence of livestock farms, the pattern of existing development
in the area and the lack of consolidation potential of the
existing farm holding indicate that the subject lands meet the
relevant criteria for designation as a rural residential area.

This Official Plan Amendment is intended to be adopted together
with an implementing Zoning By -Law Amendment which will recog-
nize the proposed non-farm use of the subject lands pursuant to
the process of severance and conveyance.
4. DETAILS OF THE AMENDMENT
i) Schedule "A" Future Land Use of the Official Plan
of the Township of Bayham, is hereby amended by
changing from "Agriculture" to "Rural Residential",
those lands outlined in heavy solid lines on the
attached Schedule "A", which schedule shall
constitute part of this Amendment.
ii) The lands subject to this Amendment and designated
"Rural Residential", may be used, developed and zoned
in accordance with the policies of Section 4.2.3 of
the Official Plan, Rural Residential policies, as
amended.

A BY-LAW to authorize the Peeve and Clerk to execute an
agreement with John Maxwell Alton and Amy Jeannette Alton to
provide for the continued encroachment of certain buildings on
the road allowance between Lots 25 and 26 in Concession 8.
WHEREAS John Maxwell Alton and Amy Jeannette Alton are
the owners of part of Lots 25,26 and 27 in Concession 8.
AND WHEREAS there exists an original allowance for a road-
way between the aforesaid Lots 25 and 26 which has never been
opened.
AND WHEREAS a residence and certain other buildings
have been erected and encroach on the aforesaid road allowance.
AND WHEREAS it is now deemed expedient that the Corpor-
ation of the Township of Bayham enter into an agreement with
the aforesaid John Maxwell Alton and Amy Jeannette Alton to
permit the continued encroachment of the residence and other
buildings on the aforesaid road allowance.
THEREFORE BE IT ENACTED by the Council of the Corporation
of the Township of Bayham
1. THAT the Reeve and Clerk of the Corporation of the
Township of Bayham be authorized to execute an agree-
ment with John Maxwell Alton and Amy Jeannette Alton to
permit the continued encroachment of a residence and
certain other buildings on the road allowance between
Lots 25 and 26 in Concession 8, Bayham.
2. THAT the said agreement be attached to and form
Schedule 'A' to this By-law.

hereinafter called "The Township"
OF THE FIRST PART,
JOHN MAXWELL ALTON and AMY JEANNETTE ALTON
of the Township of Bayham, in the County of
Elgin, hereinafter called "Alton"
OF THE SECOND PART.
WHEREAS Alton is the owner of a farm property
in the Township, being Parts of Lots 25, 26 and 27 in the
Eighth Concession of the said Township.
AND WHEREAS the said farm is divided by a road
allowance running in a north and south direction between Lots
25 and 26.
AND WHEREAS the house constructed by Alton some
years ago is located partly on this road allowance and certain
garages and other buildings are located either on the road•
allowance or very close to the road allowance.
AND WHEREAS the Township has maintained a culvert
towards the northerly limit of the said Lots 25 and 26 and
has undertaken certain other work with respect to a roadway
or driveway running into the Alton premises but the said road
allowance has never been incorporated into the Township road
system.
NOW THEREFORE THIS AGREEMENT WITNESSETH that for
valuable consideration the parties hereto agree as follows:
1. The house and other buildings previously erected
by Alton may continue in their present locations indefinitely,
with the proviso however that should replacements for such
buildings be required at any time in the future, the true
location of the road allowance will be recognized and proper
setbacks according to the zoning by-laws will be observed.
2. The Township will maintain the culvert under the
road allowance located close to the northerly limits of said
Lots 25 and 26, and certain snowploughing and other work will
continue as in the past, but the roadway or driveway will

remain essentially a private entrance and will not become
part of the Township road system and the Township will not
be responsible to Alton or to others as would be the case
with a public highway.
3. This agreement shall enure to the benefit of and
be binding upon the heirs, executors, administrators, successors
and assigns of the Parties hereto.
IN WITNESS WHEREOF the parties hereto have hereunto
set their hands and seals and witness the corporate seal of
The Corporation of the Township of Bayham, duly attested by
the hands of its proper signing officers.

To close and stop up part of the road
allowance known as Richmond Street
according to Plan 22 for the Village
of Richmond.
WHEREAS it is deemed expedient in the interest of the Municipal
Corporation of the Township of Bayham, hereinafter called the
Corporation, that the original road allowance set out and
described in Schedule "A" attached hereto be closed and stopped
up; and the land sold to the adjoining land owners;
AND WHEREAS notice of this By -Law has been published once a
week for four successive weeks in the Aylmer Express, a News-
paper published weekly in the Town of Aylmer;
AND WHEREAS notice of this has been posted up for at least one
month, in six of the most public places in the immediate neigh-
bourh000d of the said road allowance;
AND WHEREAS the Council for the said Corporation has heard in
person or by his counsel, solicitor or agent, all persons claim-
ing that their land will be prejudicially affected by this By -
Law and who applied to be heard.
NOW THEREFORE, the Council of the Township of Bayham enacts as
follows:
1. That upon and after the passing of this By -Law all that
portion of the 66 foot allowance for the road set out and
described in Schedule "A" attached hereto, be and the same is
hereby closed and stopped up.
2. All that part of the said road allowance herein before des-
cribed and stopped up shall be sold to the adjoining owner or
owners or any of them.
3. The Reeve and Clerk of the Corporation of the Township of
Bayham are hereby authorized to sign or execute such deeds or
documents as may be necessary to effect conveyance of that
part of the said road allowance herein before described and
which has been stopped up and closed.

BY-LAW NO. 2 329
To close and stop up part of the road
allowance known as Richmond Street
according to Plan 22 for the Village
of Richmond.
WHEREAS it is deemed expedient in the interest of the Municipal
Corporation of the Township of Bayham, hereinafter called the
Corporation, that the original road allowance set out and
described in Schedule "A" attached hereto be closed and stopped
up; and the land sold to the adjoining land owners;
AND WHEREAS notice of this By -Law has been publ. i shed once a
week for four successive weeks in the Aylmer Express, a News-
paper published weekly in the Town of Aylmer;
AND WHEREAS notice of this has been posted up for at least one
month, in si: of the most public places in the immediate neigh-
bourh000d of the said road allowance;
AND WHEREAS the Council for the said Corporation has heard in
person or by his counsel, solicitor or agent, al.l persons claim-
ing that their land will be rare.judicially affected by this By -
Law and who applied to be heard.
NOW THEREFORE, the Council of the Township of Bayham enacts as
fol 1 owl;:
1 . That Ripon and after the pissing of this By -1 nvi all that
Portion of the 66 foot n11owance for the road set out and
described in Schedule "A" attached hereto, be and the same is
hereby closed art(] stopped up.
2. All that part of the said road allowance herein before des-
cribed and stopped up shall be sold to the adjoining owner or
owners or any of them.
3. The Reeve and Clerk of the Corporation of the Township of
Bayham are hereby authorized to sign or execute such deeds or
documents as may be necessary to effect conveyance of that
pert of the said road allowance herein before described and
which has been stopped up and closed.

Re: Paul Ward, Robert Graham, Richmond Stteet in the Hamlet
of Richmond.
Dear Sir:
In conversation with Mrs. Paul Ward, I suggested she
write to Robert Graham and arrange a meeting during the School
break or , if necessary, a Saturday to discuss the closing of
part of the Street, with the Wards to occupy all of the Street
in the location of their house in exchange for all of the Street
to the East and South.
On the enclosed copy of a Sketch prepared on Nov. 27, 1981,
to illustrate the problem to the Ward5I have shown
in hatched red lines the area the Wards would like to secure if
the Stree#is closed by the Township. This would provide access
to Dykstra and to Thiessen or his successor.
Mrs. Ward was also going to contact Matt Schafer who works
some of the Graham land and Klass Thiessen.

With reference to your letter of July 3rd., I do
recall that you have called several times to discuss the
closing of the above street allowance in Richmond.
On December 1, 1983, Mrs. Ward met with Council to
formally request the road closing. This was agreed to, and
a resolution passed directing me to proceed with the closing
in accordance with the provisions of The Municipal Act.
There being several abutting owners, and the Ward
residence encroaching beyond the centre line of Richmond
Street, I requested a description of the closing (suitable
for the by-law) and suggested that.an agreement be received
from Mr. Robt. Graham that he would not exercise his right to
purchase up to the centre line of the closed street allowance.
It was my understanding that the Wards would provide the
description of the portion being closed in order to advise the
County of the intent of the Township to pass a by-law as
required by Section 443 (6a). To date I have not received this.
I received a letter from Don Houghton (copy enclosed)on
January 18th., in which he suggests the Wards contact the
abutting owners regarding the street closing. This matter has
been dormant since that time.

You will recall that I have spoken to you on
previous occasions concerning the problem that Mr. and Mrs.
Ward have in that their house is located on the right-of-way
for Richmond Street. Their house is located in part of Town-
ship Lot 112 north of the Talbot Road.
Mr. and Mrs. Ward wish to have the Township pro-
ceed to close the portion of Richmond Street occupied by them
by by-law so that the Township will eventually be in a posi-
tion to convey the property occupied by Mr. and Mrs. Ward to
them.
This problem has been hanging over the Ward's heads
for more than a year and they are anxious to have the problem
resolved.
Would you please let me know if you propose to do
the necessary work or if you wish to have me do it.
If you propose to do the work and if there is any
way that I can be of assistance to you, then please do not hesi-

RE: Closure of a portion of Richmond Street,

RE: Paul and Cherie Ward
Further to our telephone conversation of October 16,
1986 we enclose three copies of Survey Plan 11R-2681 which
survey was completed by Donald Houghton, O.L.S. on December
4, 1984 and registered in the Land Registry Division for Elgin
(No. 11) on December 11, 1984.
You will note that Mr. Houghton has shown five Parts
on the Plan. Parts 1 and 2 represent landswhich have always
been in the possession of the owners or occupants of the Ward
dwelling but which are included in the lands described in the
Deed applicable to the lands to the south of the Ward lands, that
is, the lands formerly owned by Jacob and Helena Klassen. Mr.
Ward has secured the agreement of the Klassens' successors in
title to the execution of a Quitclaim Deed by virtue of which
Paul and Cherie Ward's neighbours will release their interest
in Parts 1 and 2 in favour of the Wards. By virtue of that
Quitclaim Deed the Wards will become registered owners of Parts
1 and 2. The natural boundary between the Wards' property and
that of their neighbours to the south is a line of trees, which
line of trees is represented by the southern boundary on Part 2.
The effect of the Quitclaim Deed will therefore be to vest in
Paul and Cherie Ward property which has been theirs by possession
since the beginning of their occupancy of the house in which they
now live.
Part 3 on Plan 11R-2681 represents those lands which
Paul and Cherie Ward obtained by Deed 188424 from Nelson Ward,

Part 4 represents that portion of Richmond Street
which the Wards desire to have closed by the Township. We
also enclose a photocopy of a Surveyor's Sketch done November
27, 1981 by Donald Houghton. The said Surveyor's Sketch shows
the Wards' house as lying fully atop Richmond Street.
You will note that Plan 11R-2681 shows Part 5 as
being vested in Paul and Cherie Ward by possession.
We hope that Plan 11R-2681 provides you with that
which you need in order to stop -up that portion of Richmond
Street referred to as Part 4 on Plan 11R-2681 and, eventually,
to convey the said Part 4 to Paul and Cherie Ward.

CORPORATION OF THE
TOWNSHIP OF BAYHAM
BY-LAW NO. 2329
To close and stop up part of the road
allowance known as Richmond Street
according to Plan 22 for the Village
of Richmond.
WHEREAS it is deemed expedient In the interest of the Municipal
Corporation of the Township of Bayham, hereinafter called the
Corporation, that the original road allowance set out and
described in Schedule "A" attached hereto be closed and stopped
up; and the land sold to the adjoining land owners;
AND WHI�.REAS notice of this By -Law has been published once a
week for four successive weeks in the Aylmer Express, a News-
paper published weekly in the Town of Aylmer;
AND WIIEREAS not ice of this has been posted up for at least one
month, in six of the most public places in the immediate neigh-
I)ourh000d of the said road allowance;
AND WHEREAS the Council for the said Corporation has heard in
person or by his counsel, solicitor or agent, all persons claim-
ing that their lend will be prejudicially affected by this By-
l.aw and who appl ied to be heard.
NOW THEREFORE, tip: Council. of the Township of Bayham enacts as
follows:
1. That upon and after the passing of this By -Law all that
portion of the 66 foot allowance for the road set out and
described in Schedule "A" attached hereto, be and the same is
hereby.closed and stopped up.
2. All that pert of the said road allowance herein before des-
cribed and stopped up shall be sold to the adjoining owner or
owners or any of them.
3. 'I fie Reeve Enid Clerk of the Corporation of the Township of
Ba_ylic�m are herFhy authorized to sign or execute such deeds or
doct,menLs as may he necessary to effect conveyance of that
part of the said road allowance herein before described and
which has been stopped up and closed.
READ A FIRST, SECOND ANI) THIRD TIME AND FINALLY :PASSED THIS
18th. DAY OF DECEMBER, 1.986 .

BY-LAW NO. 2330
BEING a By-law to request the Minister of
Municipal Affairs to validate a conveyance
of Part of the North Half of Lot 22 in
Concession 2, pursuant to Section 56 of the
Planning Act, 1983.
WHEREAS it would appear that a Deed from William Gorvett and
Barbara Gorvett as Grantors to Mary Gorvett as Grantee of part
of the North half of Lot 22, Concession 2, lying North of the
Little Otter Creek, which Deed was dated April 25th, 1969 and
registered May 2nd, 1969 as Instrument No. 133471 in the Registry
Office of the County of Elgin at St. Thomas, required Ministerial
consent which was not obtained.
AND WHEREAS the Minister may evaluate this contravention of
Section 29 of the Planning Act being Chapter 296 of the Revised
Statutes of Ontario, 1960, upon request of this Council.
THEREFORE the Council of the Corporation of the Township of
Bayham enacts as follows:
1. THAT this Council requests the Minister of Municipal
Affairs and Housing to order, in respect of the land described in
the said Deed No. 133471, that the contravention of Section 29 of
the Planning Act being Chapter 296 of the Revised Statutes of
Ontario, 1960, does not have and shall be deemed never to have
had the effect of preventing the conveyance of or creation of any
interest in such land.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 18th.
