CORPORATION OF THE
TOWNSHIP OF BAYHAM
BY-LAW NO. 2054
BEING a by-law setting remuneration for members of Council.
WHEREAS by virtue of Sec. 3$$ (1) of the Municipal Act R.S.O.
1970 as amended, Municipal Councils may pass by-laws for pay-
ing the members of Council an anuual remuneration.
AND WHEREAS the Council of the Township of Bayham deems it
necessary to pass such a by-law.
THEREFORE BE IT ENACTED by the Municipal Council of the
Corporation of the Township of Township of Bayham.
1. That the Reeve may be paid such sums from time to time as
directed by Council not to exceed in any calendar year in
aggregate, Five Thousand Dollars ($5,000.00).
2. That the Dieputy-Reeve and Councillors may be paid such sums
from time to time as directed by Council not to exceed in
any calendar year in aggregate, Four Thousand Dollars
($1}, 000-00).
3. All by-laws inconsistent with the provisions of this by-law
are hereby repealed.
4. This by-law shall be effective from January 1st., 1980.

Therefore the Council of the TOWNSHIP of BAYHAM
hereby enacts as follows:
1. The Head and the Treasurer are hereby authorized on behalf of the Municipality to
borrow from time to time by way of promissory note from CANADIAN IMPERIAL BANK
OF COMMERCE a sum Or sums not exceeding in the aggregate $ 1 , 000, 000.
to meet until the taxes are collected the current expenditures of the Municipality
for the year, including the amounts required for the purposes mentioned in subsection
(1) of Section 332 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest at such rate
as may be agreed upon from time to time with the Bank.
2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums
borrowed in this year and in pre,. sous years from the said Bank for any or all of the
purposes mentioned in the said Section 332, shall, with interest thereon, he a charge
upon the whole of the revenues of themMunicipality for the current year and for all
preceding years as and when such revenues are received.
3. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

BEING a By-law to amend By-law No. 2051 appointing
certain officers of the municipality commencing December
BE IT ENACTED BY THE MUNICIPAL COUNCIL OF THE CORPOR-
ATION OF THE TOWNSHIP OF BAYHAM
1. THAT Section 3 of Township of Bayham By-law No.
2051 be repealed and the following substituted
therefore.
3. THAT Hugh Ketchabaw shall be Drainage Commissioner
at a salary of $7.25 per hour and $0.30 per mile
for the use of his automobile.

WHEREAS the Villages of Springfield, Vienna and Port Burwell and the
Townships of Bayham, Malahide and South Dorchester have presented
their nominees to the East Elgin Planning Board for appointment by
the Council of the designated municipality (being the Council of the
Township of Bayham) .

THE CORPORATION OF THE TOWNSHIP OF BAYHAM
BY - LAW N 0 . 2060
Being a By-law to provide that in the year
19$1 a levy be made before the sdoptinn of
the estimates for the year.
WHEREAS the Council of the Township of Bayham deems it expedient to
make a levy in the year 1981 before the adoption of the estimates.
THEREFORE THE COUNCIL OF THE TOWNSHIP OF BAYHAM ENACTS AS FOLLOWS:
1. That in the year 1981, before the adoption of the estimates, a
levy shall be made on the whole of the assessment for Real property
according to the last revised assessment roll a sum not exceeding
50 percent of that which would be produced by applying to such
assessment the total rate for all purposes levied in the preceding
year on residential real property of public and separate school
supporters.
2. That'in the year 1981,before the adoption of the estimates, a
levy shall be made on the whole of the Business Assessment according
to the last revised assessment roll a sum not exceeding 50 per cent
of that which would be produced by applying to such assessment the
total rate for all purposes levied in the preceding year on
business assessment of public and separate school supporters.
3. The respective amounts to be levied under the provisions of
paragraphs 1 and 2 of this by-law are:

4. The rate to be levied under the provisions of paragraph 1 and 2
of this by-law to produce the amounts set out in paragraph 3 to this
by-law is seventy (70) mills.
5. The dates of payment of taxes under this by-law shall be as
f ollows :
Due Date of Ist. Instalment: March 16
Due Date of 2nd. Instalment: June 15
6. In default of payment of the first instalment of taxes or any
part thereof by the day named therin for the payment thereof, the
remaining instalment or instalments shall forthwith become payable.
7. A percentage charge of one and one quarter per centum (11o) shall
be imposed as a penalty for non-payment of and shall be added to every

tax instalment or part thereof remaining unpaid on the first day
following the last day of paymsgt of each such instalment and there-
after an additional charge of one and one-quarter per centum (1� )
shall be imposed and shall be added to every such tax instalment or
part thereof remaining unpaid on the first day of each calendar
month in which default continues up to and including December of this
year.
$. It shall be the duty of the Tax Collector immediately after the
several dates named in Section 5 to collect at once by distress or
otherwise under the provisions of the statutes in that behalf all
such tax instalments or parts thereof as shall not have been paid on
or before the respective dates provided aforesaid, together with the
said percentage charges as they are incurred.
9. The tax collector not later than 14 days prior to the date that
the first instalment is due shall mail or cause to be mailed to the
address of the residence or place of business of each person a notice
setting out the tax payments required to be made pursuant to this by-
law, the respective dates by which they are to be paid to avoid
penalty and the particulars of the penalties imposed by this by-law
for late payment. •�
10. Taxes shall be payable to the Corporation of the Township of
Bayham and shall be paid to the collector at the Municipal Office.
11. The Collector and Treasurer bg and are hereby authorized to
accept part payment from time to time on account of any taxes due and
to give a receipt for such payment, provided that acceptance of any
such payment shall not affect the collection of any percentage charge
imposed and collectable under section 7 in respect to non-payment of
taxes or of any instalment thereof.
12. When tenants of lands owned by the Crown or in which the Crow;
has an interest are liable for payment of taxes and where any such
tenant has been employed within or outside the municipality by the
same employer for not less than thirty days, such employer shall pay
over to the Collector or Treasurer on demand out of any wages. salary
or other remuneration due to such employee the amount then payable
for taxes under this by-law and such payment shall relieve the employer
from any liability to the employee for the amount so paid.

BEING a By-law to authorize the Reeve and Clerk to execute
an agreement with Arnoldus Vanderpas and Barbara Vanderpas
to allow the use and maintenance of certain buildings at
Lot 9, S. Gore encroaching on the road allowance between
Concession 5 and the South Gore.
BE IT ENACTED BY THE MUNICIPAL COUNCIL OF THE CORPORATION
OF THE TOWNSHIP OF BAYHAM
1:. That the Reeve and Clerk be and are hereby authorized
to execute an agreement between the Corporation of
the Township of Bayham and Arnoldus Vanderpas and
Barbara Vanderpas to allow the use and maintenance
of certain buildings at Lot 9, S.Gore, which encroach
on the road allowance between Conc. 5 and the South
Gore.
2. That the said Agreement shall be attached to and
designated Schedule 1, forming a part of this by-law.

BARBARA VANDERPAS, his wife, of the same

hereinafter called the OWNERS,
OF THE SECOND PART.
WHEREAS the Owners are the registered owners of lands
and premises in the Township of Bayham, in the County of Elgin,
being more particularly described in Schedule "A" attached hereto.
AND WHEREAS there are located two greenhouses on part

of Lot 9 in the Gore, the most south,-�rly walls of those green-
housai� encroaching on thef road allowance between Concession 5
and the South Gore as shown outlined on the attached Plan of
Survey.
AND WHEREAS the Owners have requested the Township to
allow the use and maintenance of the said encroachments for such
period of time as the said buildings remain in their ri!ent
location.

such use and maintenance would not be against the public interest.
NOW THEREFORE THIS AGREEMENT WITNESSETH that in
consideration of the premisef; and the sum of ONE ($1.00) DOLLAR
of lawful money of Canada now pa--' to the Township by the Owners,
the receipt whereof is hn----eby acknowledged, the Parties hereto
agree as follows:
1. The Owners shall be allowed :he use and maintenance or
thosf portions of the greenhouses which encroach on the road

the attached Plan of Survey. Provide", that the use and main-
tenance of such portion shall at all times be at the Owner's
risk.
2. The Owners, their successors and assigns, as owners
and occupiers from time to t.m.- of the said lands described in

save harmless th^ 14ownship o` and from all costs, losses, and
damages which th:i township rray suffer, be at or be put to for
or by reason of or on account of the existence or the said

3. This Agreement shall be binding upon the Owners, their

of the lands and premises described in Schedule "A" attached

with the said lands and premises and bind the owners and occupiers
thereof from time to time.

Fuhrmann. The new purchaser had a Survey done and for your
information we enclose herewith a photocopy of same. You
will note that the two greenhouses on the property encroach
approximately 1/6th of a foot on the road allowance between
Concession 5 and the South gore in Lot 9. The purchaser's
solicitor has requested that an encroachment agreement be
entered into between the vendors and the corporation of the
Township of Bayham permitting the encroachments by the green-
houses to remain as long as the greenhouses remain standing.
We would appreciate it if you would advise us as
to the Township's position on such an Encroachment Agreement.

BEING A BY-LAW TO AMEND SCHEDULE "A" of By-law No. 1926,
as amended by By -Law No. 1978, regulating water rates from
the Elgin Area Water System.
WHEREAS By -Law No. 1926 is a By-law to regulate the supply-
ing of water and prices for water from the Elgin Area Water
System Project.
AND WHEREAS Schedule "All of By-law No. 1926 has been amended
by By -Law No. 1978.
AND WHEREAS it is now necessary to further adjust the prices
charged for the supply of water.
NOW THEREFORE BE IT ENACTED BY THE Council of the Corproation
of the Township of Bayham:
That Schedule "A" of By -Law No. 1978 is hereby repealed.
That the following be designated Schedule "A" of By-law No.
1926 and be effective from January 1, 1981.
SCHEDULE "A"
RATES FOR WATER SOLD FOR DOMESTIC AND COMMERCIAL PURPOSES
1. Each consumer shall pay, for every metered service, a
minimum bill of $18.00 every 13 week period and shall
be allowed to use 6000 gallons of water during the
period without further charge.
Water used during the period in excess of 6000 gallons
will be billed at the rate of $2.90 per 1000 gallons.
2. A late payment penalty of 5% will be charged.

make application to the Minister of Housing for approval
of the aforementioned Amendment No. 12 to the Official
Plan of the Fast Elgin Planning Area.
3. THAT this By-law shall not come into force or take effect
until approved by the Mihister of Housing.

BEING a by-law to authorize the purchase of land at Lot 165 S.G., for use as
a Township Works garage and to provide for payment of same.
WHEREAS a certain property located at Lot 16, S.G., in the Township of Bayham
has been offered for sale by the Victoria & Grey TrustCTpany under Power of
Sale by virtue of default in payments of a mortgage held by that Company.
AND WHEREAS the Council of the Township of Bayham has had an appraisal of the
aforesaid property carried out by Century 21 Real Estate Limited to determine
the market value of the said property, said appraisal determining a fair
market value of the subject property to be One hundred and eighty -three
thousand dollars ($183,000.).
AND WHEREAS the Council of the Corporation of the Township of Bayham made an
offer of One hundred and sixty-five thousand dollars ($165,000.) for the
aforesaid property to Anderson & Benner Limited and Ron Phillips Real Estate
as agents for the Victoria & Grey Trust Cerny Limited on the 4th day of
March, 1981, subject to the Ministry of Transportation & Communications
approving the Township's application for supplementary subsidy allocations
to assist in the property purchase.
AND WHEREAS the Ministry of Transportation & Com<rxmications has approved the
Township's application for supple ,cntary subsidy allocation.
AND WHEREAS THE Victoria & Grey Trust.Company has accepted the offer of the
Township of Bayham on March 9, 1981, to close on May 6, 1981, which offer
has been subsequently amended to May 15, 1981.
THEREFORE THE COUNCIL OF THE COPRORATION OF THE TOWNSHIP OF BAYHAM ENACTS AS
FOLLOWS:
1. THAT this Council authorize the Reeve and Clerk to execute such documents
as may be necessary to provide for the purchase of property at Lot 16,
S.G., in the Township of Bayham and further described as Part 3 of
Registered Plan 11R1675; from the Victoria & Grey Trust Company under
Power of Sale vested with that Company.
2. THAT the purchase price of the aforesaid property be One hundred and
sixty -five thousand dollars ($165,000.) payable One thousand dollars ($1,000,),
at the time of the offer of purchase and One hundred and sixty-four
thousand dollars ($164,000.) on closing of the transaction.
Provided however, it is recognized that certain fixtures have been
removed and are subject to repair and/or replacement at the expense
of the Victoria & Grey Trust Company for which the sum of Twenty
thousand dollars ($20,000.) is withheld by the Township of Barham at
the closing of the transaction and is provided for in an agreement
dated May 29, 1981, said agreement being Schedule "A" to this by-law.
3. THAT the purchase price of One hundred and sixty-five thousand dollars be
considered ONe hundred and forty-one thousand, eight hundred and
fifty dollars ($141,850.) as land and buildings of the road
department for Ministry subsidy purposes and Twenty-three thousand,
one hundred and fifty dollars ($23,150.) as the cost of the living
quarters and not subsidized by the Ministry.
4. THAT the aforesaid purchase price of One hundred and sixty=five
dollars ($165,000.) be raised as follows:
(a) Forty-four thousand, seven hundred and fifty dollars, ($44,750.)
from the sale of surplus properties now utilized by the Township
Road department.

been returned and the same shall be installed, and all damage
to doors or other parts of the structure shall be repaired.
The Township shall maintain an accurate accounting of all of
its expenditures in this regard and shall carefully review
all accounts for work submitted. All of these accounts will
be paid by the Township in due course.
3. Upon the completion of the work, and the building
being in the same or equal condition as it was when the agreement
of purchase and sale was signed, the various accounts shall
be totalled and the Township shall pay to Victoria & Grey the
remaining amount of Twenty Thousand Dollars ($20,000.00) owing
on the agreement of purchase and sale less the total of the
said accounts. In the event that the repairs, etcetera amount
to more than Twenty Thousand Dollars ($20,000.00), the Township
shall not be entitled to make any further claim against Victoria
& Grey.
4. The Township shall arrange for completion of all
of the work in an expeditious manner with the intent that
everything shall be done within a period of approximately two
months; the Township however shall not be responsible for any
delays beyond two months arising from any matter or thing beyond
its control.
5. Victoria & Grey shall be entitled at all reasonable
times to inspect the work and the accounts submitted for same
in order to satisfy themselves that the work has been fairly
done and the accounts are fair and reasonable.
6. Victoria & Grey shall not provide a Bill of Sale
to the Township for the various returned fixtures on the closing
of this transaction, however it is hereby acknowledged that
the Township shall have good title to the said fixtures and
Victoria & Grey hereby indemnifies the Township against all
manner of claims or demands of any kind which may be made against
the Township with respect to title or ownership of the said
returned fixtures.
7. It is agreed that the Township may take possession
of the premises on Friday, May 29th, 1981 in order to secure
the same by repairing doors, changing locks, etcetera and such
possession shall be without prejudice to requisitions on title.
The Township shall insure the premises as of May 29th, 1981.
The transaction shall be closed on Tuesday, June 2nd, 1981.
B. All matters in difference in relation to this agree-
ment shall be referred to the arbitration of a single arbitrator,
if the parties agree upon one, otherwise to three arbitrators,
one to be appointed by each party and a third to be chosen
by the two first named before they enter upon the business
of the arbitration and the award and determination of such
arbitrator or arbitrators, or any two of such three arbitrators,
shall be binding upon the parties hereto and their respective
executors, administrators, successors and assigns.
WITNESS the corporate seals of The Corporation
of the Township of Bayham and Victoria & Grey Trust Company,
duly attested by the hands of its proper signing officers.

CORPORATION OF THE

BY- LAW NO. 2079
BEING a By-law to prohibit the obstructing, encumbering, injuring
or fouling of highways or bridges in the Township of Bayham.
WHEREAS The Municipal Act, R.S.O. 1970, Section 460, provides that
the councils of all municiapalities may pass by-laws for prohibit-
ing or regulating the obstructing, encumbering, injuring or fouling
of highways and bridges etc.
THEREFORE the Council of the Corporation of the Township of Bayham
enacts as follows:
1) No person shall obstruct, encumber, injure or foul any highway
or bridge under the jurisdiction of the Township of Bayham.
2) No person shall throw, place or deposit any dirt, filth, glass,
handbills, paper or other refuse, or the carcass of any animal
on any highway or bridge under the jurisdiction of the
Township of Bayham.
3) No person shall use the ditches or travelled portion of any
roadway as a headland or for the continuous turning of farm
machinery or the planting of any crops.
4) No person shall deposit fill or install culverts for access to
property without the prior approval of the Road Superintendent,
and all unauthorized installations may be removed at the
owner's expense.
5) No person shall erect any fence upon an opened road allowance
and any such fence may be,removed from the road allowance with-
out substitution, compensation or liability for damages.
6) No possessory title can be acquired by continuous past use,
fencing, cultivation or other use of any unopened road
allowance.
7) Township road operations may be carried out without prior
notice to owners of abutting land and without liability for
damages to crops encroaching on Township road allowances.
8) -Any person contravening the provisions of this By-law shall
be liable on the conviction thereof to a fine of not more
than One Thousand Dollars ($1,000.) exclusive of costs at the
discretion of the convicting magistrate.

for the year 1981, to levy the taxes for the year 1981 and to provide for
the collection thereof.
WHEREAS by action of the Province of Ontario, provision was made for the
making of the assessment of the Municipality by the Regional Assessment
Commissioner, as the assessment on which the rate of taxation for the
year 1981 should be levied.
AND WHEREAS the assessment roll containing the assessment made as aforesaid
has been revised, corrected and passed by the Assessment Review Court for
the said Township of Bayham for the year 1981.
AND WHEREAS no revisions were made by the County Judge;
AND WHEREAS it is necessary and expedient to levy on the whole rateable
property according to the last revised assessment roll of the said
Township the sum of $1,317,673. for the general purpose of the said Township
for the current year, for the payment of the County rate for the current
year, and for the purposes of defraying part of the expenses of Public,
Separate and High School education, and other purposes;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF BAYHAM ENACTS
AS FOLLOWS:
1. That the assessment contained in the assessment roll of the Township
of Bayham as made pursuant to Province of Ontario Regulations, and as
revised, corrected and passed by the assessment Review Court be and the
same is hereby adopted and confirmed as the assessment of which the rate
of taxation for the year 1981 shall be levied.
2. That the said assessment roll be and the same is hereby adopted and
confirmed as the last revised assessment roll for the said Township.
3. That, for the purpose of providing the sum of $526,651. for the
general purposes of the Corporation, including the amount required for
County purposes and other purposes for the current year, a rate of 87.946
mills on the dollar be and the same is hereby levied for the year 1981
upon the whole of the said assessment of the Township according to the
last revised assessment roll, except that on assessment of $6,480,688.

6. The Clerk shall prepare and deliver the Collector's Roll to the
Tax Collector on or before the 16th, day of August, 1981.
7. All taxes and other special rates shall be paid in the office of the
Tax Collector or Treasurer of theTownship of Bayham.
8. Taxes shall become due and payable one-half on or before September 15,
1981, and one-half on or before December 15, 1981. Penalties for non-
payment when due and discounts for prepayment of taxes shall be as provided
for in Township of Bayham By-laws, (penalties at the rate of one and one
quarter per cent per month commencing the first day of default of payment,
and discounts at the rate of one-half p6r cent per month for each month for
which--pre-payment is made), subject also to the provisions of By-law
No. 1697.
9. The Collector shall have the privilege of mailing the tax notices
to the several taxpayers of the Township at their last known address.

AND WHEREAS it is desirable to make a pro rata assessment and levy pursuant to
the said Drainage Act, upon the land and roads assessed for the construction of
the aforesaid drains, so as to provide for and raise the cost of the said repairs
and expenses incidental thereto, which amount in all to $16,113.77 and the
Lands and Roads assessed, and the amounts of the assessments thereon respectively
upon which the assessments and proportions hereby made are fixed, appear upon
attached Schedule of Assessments, whj.�.:h said Schedule is a part of this by-law.
AND WHEREAS it is deemed expedient to levy the amounts in 1981.
NOW THEREFORE the Municipal Council of the Corporation of the Township of Bayham
enacts as follows:
1. THAT for the purpose of paying the said repairs and expenses incidental
thereto or for repaying into the General Funds of the Municipality the amount
or cost thereof the sum of $13,180.39 the amount charged against the land of the
drainage works, and now assessable for Maintenance, the following total special
rates and amounts as set out in the Schedule of Assessments attached hereto
and forming a part of this by-law, shall over and above all other rates be
assessed and levied and collected
in the same manner and at the same time as other taxes are levied and
collected upon and from the undermentioned lots or parts of lots as specified
in the attached schedule of assessments in the present year,1981.
2. THAT for the purpose of paying the sum of $1,354.67 the amount charged
against said roads of the Municipality, and $1,578.71 the amount charged against
other Municipalities, the Province of Ontario, and other Boards and
Corporations for the aforesaid purpose, accounts shall be levied against the'
roads of the Municipality and against the other Municipalities, the Province of
Ontario, and other Boards and Corporations to pay the aforesaid amounts.

BEING a by-law to amend By-law No. 2046 providing for the construc-
tion of the Weaver Branch -Todd Municipal Drain, and levying assess-
ments thereto.
WHEREAS By-law No. 2046 providing for the construction of the
Weaver Branch -Todd Municipal Drain under the provisions of the
Drainage Act, was passed by the Municipal Council of the Corp-
oration of the Township of Bayham on the 20th. day of October, 1980.
AND WHEREAS the amount specified in the said By-law as the Township
of Bayham's share of the cost for the construction of the said drain
was $25,500.
AND WHEREAS the actual cost of the work all expenses included was
$24,746.40 to which a grant of $1,090.14 has been applied to
agricultural lands leaving a net cost of $23,656.26, being $1,843.74
less than the estimated cost.
AND WHRERAS it is provided by The Drainage Act, that such surplus
funds shall be decreased in pro rata prop,.)rtions to the assessments
contained in the original By-law each year during which the deben-
tures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $1,556.78 being the amount over estimated as
assessed against lands as provided in By-law 2046 be and the
same is hereby decreased in pro rata proportions to the
assessments as contained in the said By-law No. 2046 and the
amounts are shown on the schedule of assessments hereto
attached and which form a part of this By-law.
2. That the sum of $286.96 being the amount over estimated as
assessed against roads as provided for in By-law No. 2046 be -and
the same is hereby decreased in pro rata proportions to the
roads assessed in By-law No. 2046, said amount is hereby shown
in the schedule of assessments, hereto attached and which
form a part of this By-law.
3. That the said sum of $1,843.74 shall be deducted from the amount
of the total assessments contained in By-law No. 2046 and the
debentures to be issued as provided for in By-law No. 2046 shall
be as provided for in By-law No. 2046
4. That the interest rate on the said debentures as provided for
in By-law No. 2046 shall be seventeen and three quarters per
cent ( 17 3/410) per annum.
5. This by-law comes into force on the final passing thereof,
and may be cited as the "Weaver Branch -Todd Municipal Drain
Amending By-law".

WHEREAS By-law No. 2032 providing for the construction of the Wilson
Municipal Drain under the provisions of the Drainage Act, was passed by
the Municipal Council of the Corporation of the Township of Bayham on the
2nd. day of July, 1980.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$8,200.
AND WHEREAS the actual cost of the work all expenses included was $9,432.00
to which a grant of $2,319.66 has been applied to agricultural lands
leaving a net cost of $7,112.34, being $1,087.66 less the estimated cost.
AND WHEREAS it is provided by The Drainage Act, that such surplus funds
shall be decreased in pro rata proportions to the assessments contained
in the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $1,391.16 being the amount over estimated as assessed
against lands as provided in By-law 2032 be and the same is hereby
decreased in pro rata proportions to the assessments as contained in
the said By-law No. 2032 and the amounts are shown on the schedule of
assessments hereto attached and which form a part of this By-law.
2. That the sum of $303.50 being the amount under estimated as assessed
against roads as provided for in By-law No. 2032 be and the same is
hereby increased in pro rata proportions to the roads assessed in
By-law No. 2032, said amount is hereby shown in the schedule of
assessments, hereto attached and which form a part of this By-law.
3. That the said sum of $1,087.66 shall be deducted from the amount of
the total assessments contained in By-law No. 2032 and the debentures`:
to be issued as provided for in By-law No. 2032 shall be as provided
for in By-law No. 2032.
4. That the interest rate on the said debentures as provided for in

WHEREAS By-law No. 2057 providing for the construction of the Corinth
Municipal Drain under the provisions of the Drainage Act, was passed
by the Municipal Council of the Corporation of the Township of Bayham
on the 16th. day of March, 1981.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$13,800.
AND WHEREAS the actual cost of the work all expenses included was
$15,146.92 to which a grant of $4,373.95 has been applied to agricult-
ural lands leaving a net cost of $10,772.97, being $3,027.03 less than
the estimated cost.
AND WHEREAS IT IS PROVIDED BY The Drainage Act, that such surplus funds
shall be decreased in pro rata proportions to the assessments contained
fn'the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $3,098.28 being the amount over estimated as assessed
against lands as provided in By-law 2057 be and the same is hereby
decreased in pro rata proportions to the assessments as contained in
the said By-law No. 2057 and the amounts are shown on the schedule
of assessments hereto attached and which form a part of this By-law.
2. That the sum of $71.25 being the amount under estimated as assessed
against roads as provided for in By-law No. 2057 be and the same
is hereby increased in pro rata proportions to the roads assessed
in By-law No. 2057, said amount is hereby shown in the schedule of
assessments, hereto attached and which form a part of this By-law.
3. That the said sum of $3,027.03 shall be deducted from the amount of
the total assessments contained in By-law No. 2057 and the debenture

BY - LAW NO. 2085
BEING a By-law to amend By-law No. 2074 providing for the construction
of the Gradish Municipal Drain, and levying assessments thereto.
WHEREAS By-law No. 2074 providing for the construction of the Gradish
Municipal Drain under the provisions of the Drainage Act, was passed by
the Municipal Council of the Corporation of the Township of Bayham on
the 18th. day of June,1981.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$7,600.
AND WHEREAS the actual cost of the work all expenses included was
$9,081.10 to which a grant of $1,740.54 has been applied to agricultural
lands leaving a net cost of $7,340.56 being $259.44 less than the
estimated cots.
AND WHEREAS it is provided by The Drainage Act, that such surplus funds
shall be decreased in pro rata proportions to the assessments contained
in the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $701.82 being the amount over estimated as assessed
against lands as provided in By-law 2074 be and the same is hereby
decreased in pro rata porportions to the assessments as contained in
the said By-law No. 2074 and t'ie amounts are shown on the schedule.
2. That the sum of $442.38 being the amount under estimated as assessed
against roads as provided for in By-law No. 2074, be and the same is
hereby increased in pro rata proportions to the roads assessed in
By-law No. 2074, said amount is hereby shown in the schedule of
assessments, hereto attached and which form a part of this By-law.
3.That the said sum of $259.44 shall be deducted from the amount of the
total assessments contained in By-law No. 2074 and the debentures to
be issued as provided for in By-law No. 2074 shall be as provided for
in By-law 2074.
4. That the interest rate on the said debentures as provided for in
By-law No. 2074 shall be seventeen and three quarters per cent

BEING a By-law to amend By-law No. 2073 providing for the construction
of the Ramsey Municipal Drain, and levying assessments thereto.
WHEREAS By-law No. 2073 providing for the construction of the Ramsey
Municipal Drain under the provisions of the Drainage Act, was passed
by the Municipal Council of the Corporation of the Township of Bayham on
the 18th. day of June, 1981.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$8,800.
AND WHEREAS the actual cost of the work all expense included was
$10,187.55 to which a grant of $1,794.40 has been applied to agricult-
ural lands leaving a net cost of $8,393.15, being $406.85 less than
the estimated cost.
AND WHEREAS it is provided by The Drainage Act, that such surplus
funds shall be decreased in pro rata proportions to the assessments
contained in the original By-law each year during which the debentures
have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $974.49 being the ar.6unt over estimated as assessed
against lands as provided in By-law 2073 be and the same is hereby
decreased in pro rata proportions to the assessments as contained
in the said By-law No. 2073 and the amounts are shown on the schedule
os assessments hereto attached and which form a part of this By-law.
2. That the sum of $567.64 being the amount under estimated as assessed
as assessed against roads as provided for in By-law No. 2073 be and
the same is hereby increased in pro rata proportions to the roads
assessed in By-law No. 2073, said amount is hereby shown in the
schedule of assessments, hereto attached and which form a part of
this By-law.
3. That this said sum of $406.85 shall be deducted from the amount of the
total assessments contained in By-law No. 2073 and the debenture to be
issued as provided for in By-law No. 2073 shall be as provided for in
By-law No. 2073.
4. That the interest rate on the said debentures as provided for in
By-law No. 2073 shall be seventeen and three quarters per cent

BEING a By-law to amend By-law No. 2075 providing for the construction
of the Vermeersch Municipal Drain, and levying assessments thereto.
WHEREAS By-law No. 2075 providing for the construction of the
Vermeersch Municipal Drain under the provisions of the Drainage Act,
was passed by the Municipal Council of the Corporation of the Township
of Bayham on the 18th. day of June, 1981.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$5,900.
AND WHEREAS the actual cost of the work all expenses included was
$6,247.20 to which a grant of $1,923.57 has been applied to agricultural
lands leaving a net cost of $4,323.63, being $1,576.37 less than tte
estimated cost.
AND WHEREAS it is provided by The Drainage Act, that such surplus funds
shall be decreased in pro rata proportions to the assessments contained
in the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $1,602.86 being the amount over estimated as assessed

BY-LAW NO. 2088
Being a By-law to establish a Penalty
Charge for non-payment of current taxes.
WHEREAS under the provisions of The Municipal Interest and Discount
Rates Act, 1981, a municipality may impose penalties on overdue
taxes levied in 1981.
AND WHEREAS Council deems it expedient to impose a charge on
overdue taxes.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF BAYHAM ENACTS:
1. That overdue taxes are those taxes that have been levied in
1981 and have not been paid on or before the day payment is
due.
2. That the prime rate of interest of the Canadian Imperial
Bank of Commerce, on this 20th. day of August, 1981 is
22 3/4%;
3. That the penalty charge to be imposed on overdue taxes
shall be at the rate of 24% per annum.
4. That the percentage charge as a penalty for non-payment of
taxes shall be imposed on the first day of default and on
the first day of each calendar month thereafter in which
default continues, but not after December 31, 1981;
5. That notwithstanding Chat the municipality has caused notices
to be given in accordance,with Section 303 and 521 or 521 (a)
of The Municipal Act, the clerk shall give notice of this by-
law in accordance with subsection 6 of Section 527 of The
Municipal Act;
6. That at any time within fourteen days after notice has been
mailed, delivered or caused to be delivered to the person
taxed at his residence or place of business or upon the
premises in respect of which the 1981 taxes are payable in
accordance with section 5 of this By-law, any person may pay
his 1981 taxes overdue without an additional penalty charge
as imposed by this By-law;
7. That the penalty charge imposed by this By-law shall take
effect after fourteen days from the day of giving notice in
accordance with sections 5 and 6 of this By-law;
8. That any penalty for non-payment of taxes authorized under
Section 527 of The Municipal Act shall cease to have effect
on the day the penalty charge imposed by this By-law takes :14
effect.

BEING a By-law to amend Bylaw No. 2033 providing regulations for
the installation of entrance culverts along highways in the
Township of Bayham.
WHEREAS Bylaw No. 2033 sets out the minimum diameter for entrance
culverts in the Township of Bayham and whereas it is felt that
the requirements of Bylaw No. 2033 are excessive.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
1. Entrance culverts in the Township of Bayham shall be of metal
or concrete construction and not less Cham three humdred and
four (304) millimeters in diameter and six (6) meters in
length and shall be installed under the supervision of the

News, a Newspaper published tri -weekly in the Town of Tillsonburg.
AND WHEREAS NOTICE OF THIS HAS BEEN POSTED up for at least one month,
in six of the most public places in the immediate neighbourhood of
the said unopened road allowance;
AND WHEREAS the Council for the said Corporation has heard in person
or by his counsel, solicitor or agent, all persons claiming that

BEING A BY-LAW TO AMEND BY-LAW NO. 2055, which authorized the
I borrowing of $1,000,000.00.
WHEREAS By -Law No. 2055 provided for the borrowing of the sum of
one million Dollars ($1,000,000.00) to meet current expenditures
for the year 1981 until the collection of the taxes for the year

THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
BY - LAW NO. 2095
A By-law to raise $500,000.00 to aid in the construction of
drainage works under The Tile Drainage Act, 1971.
The Council, pursuant to The Tile Drainage Act, 1971, enacts
as follows:
1. The Corporation may from time to time, subject to the
provisions of this by-law,borrow on the credit of the Corp-
oration such sum not exceeding in the whole $500,000.00, as
may be determined by the council and may in manner herein-
after provided, issue debentures of the Corporation for the
amount so borrowed as provided in the Act, payable to the
Treasurer of Ontario at the Parliament Buildings, Toronto,
which debentures shall reserve the right to redeem the
debentures at any time on payment of the whole of principal
and interest owing at the time of such repayment.
2. Where an application for a loan under the Act is approved
by the council and the inspector df drainage has filed with the
clerk an inspection and completion certificate, the council may
include a sum, not exceeding the amount applied for or 75% of
the total cost of the drainage work with respect to which the
loan is made, in a debenture payable to the Treasurer of Ont-
ario in accordance with the Act, and may approve of the Corp-
oration lending the said sum to the applicant.
3. A special annual rate shall be imposed, levied and
collected over and above all other rates upon the land in
respect of which the money is borrowed, sufficient for the pay-
ment of the principal and interest as provided by the Act.

THE CORPORATION OF THE
TOWNSHIP OF BAYHAM
BY - LAW NO, 2093
A By-law to raise $300,000.00 to aid in the construction of
drainage works under The Tile Drainage Act, 1971.
The Council, pursuant to The Tile Drainage Act, 19719 enacts
as follows:
1. The Corporation may from time to time, subject to the
provisions of this by-law,borrow on the credit of the Corp-
oration such sun not exceeding in the whole $500,000.00, as
may be determined by the council and may in manner herein-
after provided, issue debentures of the Corporation for the
amount so borrowed as provided in the Act, payable to the
Treasurer of Ontario at the Parliament Buildings, Toronto,
which debentures shall reserve the right to redeem the
debentures at any time on payment of the whole of principal
and interest owing at the time of such repayment.
2. Where an application for a loan under the Act is approved
by the council and the inspectoV of drainage has filed with the
clerk an inspection and completion certificate, the council may
include a sum, not exceeding the amount applied for or 75% of
the total cost of the drainage work With respect to which the
loan is made, in a debenture payable to the Treasurer of Ont-
ario in accordance with the Act, and may approve of the Corp-
oration lending the said sues to the applicant.
3. A special annual rate shall be imposed, levied and
collected over and above all other rates upon the lard in
respect of which the money is borrowed, sufficient for the pay-
ment of the principal and interest as provided by the Act.

Bayham in the County of Elgin,
TO WIT: Clerk of the Township of
Bayham make oath and say:
1. On the Nineteenth day of November, 1981, the Council
of the Township of Bayham passed a by-law for borrow-
ing money to be lent for the construction of drainage
works, being No. 2095 and entitled "A By-law to raise
money to aid in the construction of drainage works
under The Tile Drainage Act, 1971", a copy of which
certified by me is attached hereto as an exhibit to
this my affidavit and marked exhibit "A".
2. A certified copy of By-law No. 2095 was registered
in the registry office for the Registry Division of
Elgin No. 11 on the Twenty-fifth day of November,
1981.
3. No application or action to quash the by-law has been
made or brought.

WHEREAS By-law No. 2056 providing for the construction of the Meuller,
Branch A Municipal Drain under the provisions of the Drainage Act, was
passed by the Municipal Council of the Corporation of the Township of
Bayham on the 16th day of March, 1981.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$4,600.
AND WHEREAS the actual cost of the work all expenses included was
$6,604.75 to which a grant of $100.51 has been applied to agricultural
lands leaving a net cost to $6,504.24, being $1,904.24 more than the
estimated cost.
AND WHEREAS IT IS PROVIDED BY The Drainage Act, that such deficit funds
shall be increased in pro rata proportions to the assessments contained
in the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $1,259.24 being the amount under estimated as assessed
against lands as provided in By-lqw 2056 be and the same is hereby
increased in pro rata proportions to the assessments as contained in
the said By-law No. 2056 and theamounts are shown on the schedule
of assessments hereto attached and which form a part of this By-law.
2. That the sum of $645.00,.being the amount under estimated as assessed
against roads as provided for in By-law No. 2056 be and the same is
hereby increased in pro rata proportions to the roads assessed
in By-law No. 2056, said amount is hereby shown in the schedule of
assessments, hereto attached and which form a part of this By-law.
3. That the said sum of $1,904.24 shall be added to the amount of the
total assessments contained in By-law No. 2056 and the debenture
to be issued as provided for in By-law No. 2056 shall be as provided
for in By-law No. 2056.

4. That the interest rate on the said debentures as provided for in
By-law No. 2056 shall be seventeen and three quarters per cent
(17 3/4%) per annum.
5. This By-law comes into force on the final passing thereof, and may
be cited as the "Meuller Branch A Municipal Drain Amending By-law"

of the No. 1 Municipal Drain, and levying assessments thereto.
WHEREAS By-law No. 2078 providing for the construction of the No. 1
Municipal Drain under the provisions of the Drainage Act, was passed
by the Municipal Council of the Corporation of the Township of Bayham
on the 20th, day of August, 1981.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$38,800.
AND WHEREAS the actual cost of the work all expenses included was
$39,296.08 to which a grant of $11,052.86 has been) applied to agricultural
lands leaving a net cost of $28,243.22, being $10,556.78 less than the
eistimated cost.
AND WHEREAS IT IS PROVIDED BY The Drainage Act, that such surplus funds
shall be decreased -in pro rataproportions to the assessments contained
in the original By-law each year during, which the debentures have to run
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:

That the sum of $10,627.93 heing
the amount over estimated as assessed
against lands as provided in By-law
2078 be and the same is hereby

decreased in pro rata proportions
to the assessments as contained in
the said By-law No. 2078 and the
amounts are shown on the schedule
of assessments hereto attached and
which form a part of this By-law.
2.
That the sum of $71.15 being.the
amount under estimated as assessed
against roads as provided for in
By-law No. 2078 be and the same
is hereby increased in pro rata
proportions to the roads assessed
in By-law No. 2078, said amount
is hereby shown in the schedule of
assessments, hereto attached and
which form a part of this By-law.
3.
That the said sum of $10,556.78
shall be deducted from the amount of
the total assessments contained
in By-law No. 2078 and the debenture
to be issued as provided for in
By-law No. 2078 shall be as provided

BEING a By-law to amend By-law No. 2049 providing for the construction
of the Ketchabaw No. 2 Municipal Drain, and levying assessments thereto.
WHEREAS By-law No. 2049 providing for the construction of the Ketchabaw
No. 2 Municipal Drain under the provisions of the Drainage Act, was
passed by the Municipal Council of the Corporation of the Township of
Bayham on the 7th day of January. 1981.
AND WHEREAS the amount specified in the said By-law as the Township of
Bayham's share of the cost for the construction of the said drain was
$13,400.
AND WHEREAS the actual cost of the work all expenses included was
$20,429.17 to which a grant of $5,940.72 has been applied to agricultural
lands leaving a net cost of $14,488.45, being $1,088.45 more than
the estimated cost.
AND WHEREAS IT IS PROVIDED BY THE Drainage Act, that such deficit funds
shall be increased in pro rata proportions to the..assessments contained
in the original By-law each year during which the debentures have to run.
THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF BAYHAM:
1. That the sum of $191.45 being the amount under estimated as assessed
against lands as provided in jy-law 2049 be and the same is hereby
increased in pro rata proportions,to the assessments as contained in
the said By-law No. 2049 and the amounts are shown on the schedule
of assessments hereto attached and which form a part of this By-law.
2. That the sum of $897.00 being the amount under estimated as assessed
against roads as provided for in By-law No. 2049 be and the same
is hereby increased in pro rata proportions to the roads assessed
in By-law No. 2049, said amount is hereby shown in the schedule of
assessments, hereto attached and which form a part of this By-law.
3. That the said sum of $1,088.45 shall be added to the amount of the

1. PURPOSE
The purpose of this Amendment is to reduce an area designated
as Conservation Lands shown on Schedule 'A' of Amendment 7A
to the East Elgin Official Plan.
2. LOCATION
This Amendment applies to the area adjacent to the eastern
limits of the Town of Aylmer in the Township of Malahide.
The area is commonly known as the Brown Conservation Area
and is located in part of Lot 13 (86) and part of Lot 14 (87)
N.T.R. Concession VII in the Township of Malahide.
3. BASIS FOR THE AMENDMENT

The area designated as Conservation Lands in connection with
the Brown Conservation Area on Schedule 'A' of Amendment 7A
to the East Elgin Official Plan is far in excess of the actual
holdings of the Catfish Creek Conservation Authority. As a
result, many privately owned properties including existing
rural commercial, agricultural, institutional and rural
industrial land uses have been inadvertently encompassed by
this conservation designation. Since it is intended that
these private properties are to be zoned in accordance with
their current use and performance standards in the Township
of Malahide Zoning By-law, a conformity problem has been
identified between the aforementioned by-law and the East
Elgin Official Plan as.*amended.
The effect of this Official Plan Amendment, therefore, will
be to reduce the area designated as Conservation Lands in
connection with the Brown Conservation Area, to only those
lands currently held by the Catfish Creek Conservation
Authority.
4. DETAILS OF THE AMENDMENT
Schedule 'A', Future Land Use map to the East Elgin Official
Plan, as amended, is hereby further amended by changing from
"Conservation Lands" to "Restricted Agricultural" the areas
identified on Schedule 'A' hereto attached.

The East Elgin Planning Board is presently considering an
amendment to the East Elgin Official Plan which will affect
the area in Lots 13(86) and 14(87) between Dingle Street
and Highway No. 3 in the Township of Malahide. This entire
area is presently designated as "Conservation Lands" in the
Official Plan, as amended, ther6by rendering properties zoned
for existing agricultural, rural commercial, institutional
and rural industrial land uses as non -conforming uses.
The purpose of the enclosed Official Plan Amendment No. 7B,
will be to reduce the extent of the Conservation designation
so that it will apply only to the existing holdings of the
Catfish Creek Conservation Authority which comprises the
lands commonly known as the Brown Conservation Area. All of
the properties in this area will continue to be recognized in
the Malahide Township Zoning By-law No. 1925 in accordance .
with their existing land use. The Official Plan Amendment No.
7B does not propose a change in existing land use. The effect
of the Amendment will be to render the existing zoning on the
affected properties in conformity with the East Elgin Official
Plan.

1. THAT Amendment No. 13 to the Official Plan of the
East Elgin Planning Area,. constituting the attached
explanatory text, is hereby adopted.
2. THAT the Clerk is hereby authorized and directed to
make application to the Minister of Housing for
approval of the aforementioned Amendment No. 13 to
the Official Plan of the Last Elgin Planning Area.
3. THAT this By-law shall not come into force or take
effect until approved by the Minister of Housing.

AMENDMENT NO. 13
PURPOSE
The purpose of the Amendment is threefold and may be
expressed as follows:
i) to change the future land use designation from
'Restricted Agricultural' to 'Residential' on
two areas in the south part of the Village of
Springfield;
ii) to change the future land use designation from
'Commercial' to 'Residential' on two areas in
the central part of the Village of Springfield;
and

to change the future land use designation from
'Commercial' to 'Open Space' on one area in the
central part of the Village of Springfield.
LOCATION
This Amendment applies to the areas as shown on Schedule
"A" to this document. The location of these areas is
described below according to each of the three changes
in land use designation. %
i) Restricted Agriculture to Residential:
a) part of a lot on the west side of East Street
immediately to the south and adjacent to the
existing 'Residential' designation;
b) three lots to the south-west of the inter-
section of Superior and Clinton Streets
including one lot on the south side of
Clinton Street and two lots on the west side
of Superior Street.
ii) Commercial to Residential:
a) one lot on the north side of Main Street;
b) two adjacent lots on the north side of Broadway
Street one of which borders on the east side of
Superior Street.
iii) Commercial to Open Space:
a) several small lots at the south-west corner
of the intersection of Main and Mill Streets,
all of which are east of Detroit Street and
north of Broadway Street.
3. BASIS FOR THE AMENDMENT
i) Restricted Agriculture to Residential
The area on the west side of East Street consists
of part of a large existing residential property.
Amendment No. 11 to the East Elgin Official Plan
changed the designation of part of this property
to Residential. An oversight in Amendment No. 11
excluded the southern portion of the property
which is subject to this amendment.
The area to the south-west of Superior and Ashton
Streets covers three existing lots which are more
suitable for residential purposes due to their
size and their location with respect to existing
and adjacent residential uses to the east and
north. The lot structure in this part of the
Village is fragmented thereby reducing the-poten-
tial
he potential of these three lots for agricultural purposes.
ii) Commercial to Residential
The lots on the north side of Main Street and to
the north-east of the intersection of Broadway and
Superior Streets have always been used for resi-
dential purposes. Neither of these sites are
considered desirable for conversion to commercial
land uses due to the quality of the existing
dwellings on the properties and due to the avail-
ability of more suitable sites designated for
commercial development elsewhere in the Village.
iii) Commercial to Open Space
The existing land use at the south-west corner of
Main and Mill Streets consists of a neighbourhood
park and playground as well as a garden lot
associated with an adjacent residential land use
which is not subject to this amendment. A small
creek traverses the subject lands which constitute
an area of low relief subject to occasional,
localized flooding. This amendment, therefore,
precludes the future development of these lands for
commercial and/or residential purposes. The 'Open
Space; designation permits only accessory buildings
and structures to the existing recreational use of
the subject lands.
4. DETAILS OF THE AMENDMENT
Schedule "D', Springfield: Future Land Use map of the
East Elgin Official Plan, as amended, is hereby further
amended by changing from 'Restricted Agricultural' and
'Commercial', to 'Residential', and from 'Commercial'
to 'Open Space', those areas identified on Schedule "A"
hereto attached.

APPENDIX I
A) Meeting with the Council of the Village of Springfield
The consultant representing the East Elgin Planning
Board met with the Village Council in September, 1981,
in order to develop solutions to problems of conformity
between the Village Zoning By-law and the East Elgin
Official Plan. The Council indicated that some of the
conformity problems had already been rectified by changes
in existing land uses in the Village since the adoption
of the Zoning By-law. An agreement was reached between
the parties such that additional amendments would be
made to the Village Zoning By-law, as well as to the
future land use Schedule 'D', as amended, to the East
Elgin Official Plan. Coupcil's decision to amend the
Official Plan was based on their knowledge of existing
and anticipated land uses in the Village.
There were several reasons expressed by Council for the
redesignation of lands by this Amendment to residential.
The areas on the north side of Main Street and the north
side of Broadway Street currently support viable resi-
dential land uses and therefore, have virtually no
probability for conversion to commercial uses. Several
undeveloped commercial sites are presently available in
the Village. The area to the south-west of Superior
and Clinton Streets meanwhile, consists of three small
lots which would be more suitable for residential purposes
because of their size and location with respect to
existing residential development. Redesignation of these
lands for residential purposes is consistent with a
desirable growth direction for the Village and would
constitute completion of an existing residential neigh- *L
bourhood. For these reasons, the lands proposed for
designation to 'Residential' by this amendment have been
zoned residential by the Council in the Village's Zoning
By-law.
B) Discussions with the Catfish Creek Conservation Authority
The area proposed for designation as Open Space was
identified by the Resources Manager of the Catfish Creek
Conservation Authority after reviewing a preliminary
draft of this amendment. The situation regarding periodic
flooding was brought to the attention of the consultant
who discussed the matter with the Village representatives
to the East Elgin Planning Board. In consideration of
the existing land uses and physical characteristics of
this site it was agreed that the 'Open Space' designation
which permits parks and recreational land uses was the most
appropriate designation for these lands.

that areas so designated may be zoned in
the respective Township zoning by-laws
according to their existing land uses.
e) Amendment 18 modifies the policies of
the Official Plan which serves as the
framework for the implementation of
municipal zoning by-laws.

ments to the East Elgin Official Plan are
avcilable for public scrutiny at the various
municipal offices in the Planning Area in-
cluding:
— the Township of South Dorchester (in
lyns);
— the Village of Port Burwell;
the Township of Malahide (in Aylmer);

Township of Bayham (in Straffordville);
— the Village of Springfield.

AMENDMENT
PURPOSE
The purpose of the Amendment is to expand the hamlet
boundaries for Orwell and Straffordville in order to
accommodate recent growth in these two areas. The
Amendment also recognizes a small linear property which
has been added to the Commercial designation in Strafford-
ville due to a road closing.
LOCATION
Amendment applies to the hamlet of Orwell in the
part of Malahida- Township shown on Schedule "A"
document; and, to the hamlet of Straffordville i
central part of Bayham Township shown on Schedule
to this document.
BASIS FOR THE AMENDMENT
Both the hamlets of Orwell and Straffordville have
experienced recent residential expansion into the
surrounding agricultural areas. This growth is con-
sistent with the intent of the East Elgin Official Plan
which encourages urban land uses to locate in the
various hamlets in the Planning Area:
Growth in Orwell has extended along County Road No. 35
to the south of the existing hamlet designation. Land
uses in this area include an abattoir, a contracting
business and several residential properties. These
.land uses are desirable from a planning perspective
because they are associated with an existing hamlet;
they do not require direct access to Highway No. 3;
there are no intensive livestock uses nearby; and they
occupy the most suitable land in the hamlet with
respect to the installation of wells and on-site
sanitary waste disposal systems.
The areas added to the residential designation in
Straffordville are both adjacent to existing resi-
dential development in the hamlet. Straffordville
clearly the largest unincorporated urban centre in
Planning Area and is experiencing pressure for add-
itional residential properties. The amendment will
provide four or five estate type properties for
residential development in the hamlet.

The area added to the Commercial designation consists
of a closed road allowance adjacent to the existing
commercial area in Straffordville. The property is
presently in use for the storage of automobiles in
association with the adjacent business to the north.

changing from "Restricted Agricultural" to "Residential"

AMENDMENT NO. 16
PURPOSE
The purpose of the Amendment is to provide revised
policies for "Pits and Quarries" in the East Elgin
Official Plan in accordance with The Pits and Quarries
Control Act, 1971, and Ontario Regulation 545/71; and
to amend the "Pits and Quarries" designation on Schedule
'A' to the East Elgin Official Plan to reflect the
most recent geological information supplied by the
Ministry of Natural Resources.

BASIS FOR THE AMENDMENT

The most recent geological information compiled by the
Ministry of Natural Resources revealed a number of
incongruities with respect to areas designated as "Pits
and Quarries" on Schedule 'A' to the East Elgin Official
Plan. Several areas in Malahide and Bayham Townships
which are currently designated for "Pits and Quarries"
in the Official Plan were not determined to have sign-
ificant potential for aggregate resource material in
the mast recent geological survey and as a result, these
areas are being deleted from the "Pits and Quarries"
designation by this Amendment. Conversely, three areas
in the Township of South Dorchester and two areas in the
Township of Malahide which are currently designated
"Agriculture" and "Restricted Agricultural" in the
Official Plan have recently been identified as having
some extractive resource potential. In accordance with
The Pits and Quarries Control Act, 1971, and Ontario
Regulation 545/71, these areas have been designated
"Pits and Quarries" by this Amendment.
The Amendment also includes a new set of policies for
extractive land uses in accordance with the Mineral
Aggregate Policy for Official Plans provided by the
Ministry of Natural Resources. The new policies reflect
the most recent provincial legislation regarding pits
and quarries and they also provide a set of procedures

for amending the Official Plan and the respective
Zoning By-laws as may be required by the development of
new extractive operations.
In considering the types of land uses which should be
permitted within the "Pits and Quarries" designation,
Planning Board is of the opinion that, in addition to
pits and quarries and related uses, agricultural and
agriculturally -related uses should also be permitted.
All of the lands designated for "Pits and Quarries" by
this Amendment have been identified by the Ministry of
Natural Resources as secondary deposits of sand while
the Canada Land Inventory has categorized these areas as
Class 1 agricultural soils. As agriculture has histor-
ically been the predominant form of economic activity in
the Planning Area, and as most of those lands having
aggregate resource potentlal also have an inherently
high capability for agriculture, Planning Board is of
the opinion that the designation of lands as "Pits and
Quarries" should not pre-empt agricultural activity.
Subsection 7 of the Ministry of Natural Resources
Mineral Aggregate Policy for Official Plans lends
justification to the inclusion of agriculturally -
oriented uses within areas of aggregate resource
potential (see Appendix III).
Planning Board has also determined that while a proposal
for the opening of a new pit or quarry may comply to
the Pits and Quarries designation of the Official Plan,
there may be instances where such development is not
appropriate. Therefore, it is intended that prior to
the establishment of a new extraction operation, a
restricted area (zoning) by-law amendment should be
required. Criteria to be met prior to the amendment may
be required by the affected municipality. More spec-
ifically, extraction operations will generally be
prohibited near existing or future urbanized areas,
established farm residences, or other forms of existing
residential development.
Future protection of extractive operations and resources
from increased non -related development is ensured
through the limited number of types of land use to be
permitted within areas designated for Pits and Quarries
and also through the inclusion of policies related to
consents and new lot creations within this designation.
The basic intent is to minimize the potential for land
use conflicts which might reduce the viability of
extractive operations.
4. DETAILS OF THE AMENDMENT
i) The Official Plan of the East Elgin Planning Area is
hereby amended by deleting subsection 4.2.6 and re-
placing it with the following:
114.2.6 Pits and Quarries
4.2.6.1 The "Pits and Quarries" designation, as shown
on Schedule "A" to the Official Plan, shall
mean that the predominant use of land shall
be for the extraction and processing of
aggregate resources, including a wayside pit.
Also to be permitted in the "Pits and Quarries"
designation are agricultural and agriculturally -
related uses which do Lot limit the future vi-
ability of the site for the extraction of
aggregate resources and which are conducted
in accordance with the policies contained in
Section 4.2.2 and 4.2.3 of this Plan.
4.2.6.2 A new pit or quarry operation will not require
an amendment to this Plan provided that:
a) it is located within the area designated
as "Pits and Quarries" on Schedule "A"
to this Plan;
b) it complies with the policies of this
Plan.
4.2.6.3 All proposals for new pit or quarry operations
to be located outside of the areas designated
as "Pits and Quarries" on Schedule "A" to this
Plan will require an amendment to this Plan.
In considering an application for an amendment
to this Plan, regard shall be had to the
policies contained in subsections 4.2.6.1,
4.2.6.2, and 4.2.6.6 of this Plan.
4.2.6.4 Where lands are shown on Schedule "A" to this
Plan as being located within the "Pits and
"Quarries" designation, such designation does
not in itself constitute full and final mun-
icipal approval for the opening of a new pit
or quarry.
Every new pit or quarry operation will require
an amendment to the appropriate municipality's
restricted area (zoning) by-law.
Prior to the enactment of an amendment to a
restricted area (zoning) by-law regard shall
be had to the following matters:
a) the potential for any land use conflicts
which may be created by the proposed use,
including conflicts with the natural
environment, for example, floodplain and
hazard lands, and conservation lands;
b) the ability of local roads to accommodate
expected levels of truck traffic;
C) a site plan, complete with information as
required by The Pits and Quarries Control
Act, 1971, and any regulations made
pursuant to such Act including Ontario
Regulation 545/71, or any other pertinent
and applicable provincial legislation or
regulations;
d) the overall timing and necessity of the
operation in relation to other pit and
quarry operations in the local area.
Pit and quarry operations, including those
involving the processing of aggregate materials
at the actual extraction site, will generally
be prohibited within proximity of any adjoining
property which is:
a) designated as "Hamlet" or "Urban" as
shown on Schedule "A" to this Plan;
b) zoned for residential purposes including
estate residential purposes;
C) used for residential purposes in
association with an agricultural use
except where such residential use is
the residence of, or is owned by, the
pit or quarry operator/applicant.
4.2.6.5 All extractive uses shall satisfy the require-
ments of the appropriate regulatory agency
with respect to matters of water supply, the
taking of water, the disposal of liquid wastes
and the control of air pollution, including
noise.
4.2.6.6 Official Plan and Restricted Area (Zoning)
By-law amendments will not be required -for
wayside pits. A Township Road Superintendent,
the County Engineer, and the Ontario Ministry
of Transporation and Communications, or their
agents, may, for public road purposes, use
any land for the extraction and processing of
road -building materials for the construction
of public road purposes by use of wayside
pits. Prior to the opening of a wayside pit,
a statement that the pit, in the opinion of
the Township Road Superintendent, the County
Engineer or the District Engineer of the
Ministry of Transportation and Communications
qualifies as a wayside pit shall be forwarded
to the appropriate municipality.
4.2.6.7 In reviewing app4cations for the creation of
new lots or the alteration of existing lots,
regard shall be had to the policies contained
in subsection 6.6 of this Plan as amended. In
addition, the creation of new lots or the
alteration of existing lots which may have
the effect of reducing the viability of an
existing or potential aggregate extraction
operation will not be permitted within the
"Pits and Quarries" designation.
4.2.6.8 Where a pit or quarry operation has ceased,
the subject lands will be rehabilitated and
may only be used for those purposes specified
in subsection 4.2.6.1 of this Plan. An
application for an Official Plan amendment to
permit a use or uses other than those permitted
in subsection 4.2.6.1 of this Plan will be
given due consideration but only after doc-
umentation has been prepared and presented
by the operator, operator/applicant, which
shows that one of the following conditions
exists:
a) the subject lands have been exhausted
of all aggregate resources; or,
b) any aggregate material remaining on-site
is not capable of being extracted
economically and/or feasibly."
ii) Schedule "A", Future Land Use map of the East Elgin
Official Plan, as amended, is hereby further amended
by changing the designation from "Pits and Quarries"
to "Agriculture" and "Hazard Lands"; and from
"Agriculture" and "Restricted Agricultural" to "Pits
and Quarries" on those lands shown on Schedule "A"
hereto attached.

MINERAL AGGREGATE POLICY FOR
OFFICIAL PLANS
1. That all parts of the Province possessing aggregate resources should share the responsi-
bility for future demands; at first approximately in proportions existing under present
market patterns until new long term sources of supply can be made available based on
efficient 'Jong distance transportation systems;
2. That aggregates must be available at reasonabi- cost to the consumer including environ.
mental, transportation and energy costs;
3.. That licensed pits and quarries under provincial legislation must be recognized and
protected in official plans;
4. That the Province provide municipalities with the basic surfici.al geological information
on the location and extent of potentiatmi.neral aggregate deposits including stone, sand
and gravel;
S. That the Province in cooperation with the mu:.icipalities must identify areas of high
aggregate resource potential and define these areas required for possible future extrac-
tion adequate to meet future provincial duds;
6. That the identification, designation and protection of high aggregate resource potential
areas should occur jointly by regional/ccunty and local official plans;
7. That uses of land which would preclude the possible future extraction of aggregates
should not be permitted in required areas of high aggregate resource potential. Pro-
hibited uses would include residential, cornmercial and industrial development. Other
land uses would be permitted such as agriculture and forestry;
8. That because of time and cost const,aints, there should be special approval procedures
for wayside pits and quarries, therefo:e polici--s should be included in official plans to
allow the opening of wayside pits and quarries without amendment to the plan or its
implementing zoning by-laws;
9. That the Ministry of Natural Resources should have ultimate authority to ensure that
adequate supplies of aggregate art available for future use and official plans sbould not
be approved until they ensure that municipalities will have available their fair share of
future aggregate supplies;
10. That the Province requires rehabilitation of land after excavation either through re-
storing the land to its former use or condition or to another use or condition that is or
will be compatible with the use of adjacent land.

AMENDMENT NO. 17
1. PURPOSE
The purpose of the Amendment is to modify the existing
hazard land policies in the East Elgin Official Plan so
that they may be more applicable to existing conditions
in the Planning Area.
2. BASIS FOR THE AMENDMENT
During the preparation of Restricted Area (Zoning) By-
laws for the member municipalities of the East Elgin
Planning Area a number of 'inadequacies were identified
in the hazard land policies of the Official Plan.
These inadequacies have subsequently resulted in several
conformity problems between the Official Plan and the
approach to zoning which has been adopted by the
various municipalities in their respective restrictive
area by-laws.
With the exception of the riverine areas in the
Villages of Vienna and Port Burwell, no detailed flood
line mapping has been undertaken in the Planning Area.
The substantial areas shown as Hazard Lands on Schedule
"A": Future Land Use to the East Elgin Official Plan,
are therefore, generalized areas where the potential
for hazardous conditions may exist. Several of these
areas are associated with minor backwater tributaries
to the Otter, Silver and Catfish Creek systems. In
most cases, the only recorded evidence of hazardous
conditions is associated with occasional, seasonal and
localized flooding.
The East Elgin Planning Board has undertaken an
analysis of existing land uses in the areas now defined
as Hazard Lands. In some cases the Hazard Lands remain
as open space and natural areas, however, significant
tracts of land in the hazard designation have trad-
itionally been under agricultural production, par-
ticularly for the cultivation of animal feed and cash
crops. For this reason, and due to the lack of a
precise definition of the type, extent and location of
the hazards, the East Elgin Planning Board has deter-
mined that the most appropriate approach to zoning
these lands will be based on the existing land use.
It
In respect of the potential for hazardous conditions
in these areas, however, control over the establishment
of buildings and structures within proximity to the
various watercourses in the East Elgin Planning Area is
essential. This will be accomplished by means of the
application of 'setback formulas' in the General
Provision sections of the various zoning by-laws which
will be applicable to any proposed development in
areas where hazards may exist. The member municipalities
of the East Elgin Planning Board, in concert with the
various Conservation Authorities, have traditionally
and successfully applied the use of setbacks to
regulate development in these areas which have been
designated as Hazard Lands without the benefit of
detailed flood line mapping in the East Elgin Official
Plan.
3. DETAILS OF THE AMENDMENT
i) The Official Plan of the East Elgin Planning Area is
hereby amended by deleting subsections 4.2.4.1 and
4.2.4.2 and replacing them with the following subsections:
"4.2.4.1 Hazard Lands are areas which exhibit or
potentially exhibit a hazardous condition
as a result of their susceptibility to
flooding, erosion, subsidence, slumping,
inundation or the presence of organic soils
or steep slopes.
4.2.4.2 a) In the presence of detailed flood line
mapping the boundaries of the hazard
lands will act as guides for the
implementing restricted area (zoning)
by-laws.
b) In the absence of detailed flood line
mapping the potential hazardous areas
may be zoned to permit any of the
following uses: agriculture, conser-
vation, horticultural nurseries,
forestry, wildlife areas, public or
private parks, golf courses and other
outdoor recreational activities. In
such cases, the location of buildings
and structures for purposes other than
flood or erosion control will be
regulated through the application of
setback formulas included in the General
Provisions of the restricted area
(zoning) by-laws."
The Official Plan of the East Elgin Planning Area is
hereby further amended by deleting subsection 4.2.4.9.

SUMMARY LAND USE ANALYSIS OF HAZARD LANDS
IN THE EAST ELGIN PLANNING AREA
Two principle sources of land use information were identified
in connection with the analysis of the Hazard Lands desig-
nation in the East Elgin Official Plan. The sources in
the existing land use map, Figure 8 to the Background Study
of the East Elgin Official Plan and the Ontario Hydro Photo-
grammetric Mosaics for South Dorchester, Malahide and Bayham
Townships. Information from these sources was augmented with
selected field checks and analysis of data compiled during
the preparation of comprehensive zoning by-laws for the three
Townships over the last two years.
Several types of land uses ars differentiated on the existing
land use map including commercial, industrial, non-farm
residential, agricultural, institutional and extractive land
uses. Also shown on this map are the major woodlots and the
extent of agricultural land use in the Planning Area. In
order to determine the number, type and location of these
uses which might be affected by the Hazard Lands designation,
the existing land use map was superimposed on the Future Land
Use map, Schedule 'A' to the East Eglin Official Plan and
several land uses were identified for further analysis.
Three major land use categories including 'agriculture',
'woodlots' and 'others' were identified within the hazard
designation on the composite map. The individual land uses
within the 'others' category included non-farm residences,
mobile homes, institutional, commercial and industrial land
uses. The relative areas for each of the major land use
categories in the hazard designation were established by
totalling measurements taken from the composite map. This
information is presented for each Township and for the
Planning Area in Table 1 to this appendix.
More than half of the area (53.3%) in the hazard designation
remains as woodlots, while a large portion (42.3$), is under
agricultural cultivation. Less than 5% of the area in the
hazard designation comprises other land uses. The majority
of hazard lands in the Planning Area are in Bayham Township
where 77% of these lands remain in woodlots (Table 1).
Table 2 to this appendix provides a breakdown by Township of
land uses in the 'other' category developed for Table 1. A
total of seventy-seven (77) individual land holdings including
non-farm residential, mobile home, industrial, commercial and
institutional land uses were identified on the superimposed
maps and from the airphoto mosaics. These uses are also
itemized by type and by location with respect to the individual
drainage systems (Table 2). Land use information compiled
during the development of the Township zoning by-laws and
selected field checks were also used to establish the number
and type of these land uses affected by the hazard designation.
The analysis of existing land use in the areas generally
designated 'hazard lands' in the East Elgin Planning Area
resulted in the following series of conclusions:
1) Most of the area remains in a natural state with sub-
stantial coverage by mature woodlots;
2) Although a substantial portion of the hazard area is in
agricultural use, these areas are under the cultivation
of field crops and coo not support buildings and structures
associated with the farm operations;
3) The identification and location of individual land uses
listed in Table 2 revealed that existing buildings and
structures in the general hazard designation are
characteristically located on high ground which would
probably not be included in a more precise delineation
of the actual hazard area. A substantial number of the
non-farm residences, particularly in Bayham Township,
are situated on or near scenic vistas overlooking stream
valleys and woodlots;
4) Based on the land use information and conclusions
presented in this appendix it has been determined that
the general hazard designation (i.e.: established
without the benefit of engineered flood lines) in the
East Elgin Planning Area, is necessarily excessive in
some areas due to the general nature of this designation
in the Official Plan. Further, is has been determined
that the imposition of 'Hazard Zone' on these general
areas in the respective Township Zoning By-laws would
result in undue hardship on several existing land uses;
unnecessary cartographic and administrative problems;
and deviation from the technique now in use which relates
to the application of setback formulas to development
proposals in suspected hazardous areas.
Based on the discussion of these conclusions and the pre -
circulation of this amendment to the East Elgin Planning
Board, the Long Point Region Conservation Authority and the
Ministry of Natural Resources, a decision was reached to
regulate development in the hazard designation by means
of setback criteria included in the general provisions of
the respective zoning by-laws thereby precluding the
necessity to include precise hazard zones for these areas in
the Township Zoning By-laws.

AMENDMENT NO. 18
1. PURPOSE
The purpose of the Amendment is to add policies to the
Implementation section of the East Elgin Official Plan
in order to provide an improved framework for the -
implementation of Restricted Area (Zoning) By-laws in
the Planning Area.
2. BASIS FOR THE AMENDMENT
A significant number of existing land uses in the
Planning Area do not conform with the various land use
designations and policies of the Official Plan.
Although these uses shodld cease to exist in their
present locations over time, their present existence
necessitates the introduction of new policies to
provide direction for the development of applicable
zoning regulations. In so doing, land use conflicts
will be minimized in a consistent and equitable manner
through the enforcement of each municipality's Re-
stricted Area (Zoning) By-law.
3. DETAILS OF THE AMENDMENT
i) The Official Plan of the East Elgin Planning Area as
amended, is hereby further amended by deleting from
subsection 6.2 ZONING BY-LAW the following two
sections:
"Some existing uses of land will not meet all the
policies set out in this Plan. This situation is
recognized and notwithstanding these policies, at the
discretion of Council, such uses may be zoned in any
restricted area By-law in accordance with their present
use and performance standards provided that"
"e) where the use is discontinued, any rezoning may
only take place in accordance with the policies
and intent of this Plan."
ii) The Official Plan of the East Elgin Planning Area as
amended, is hereby further amended by adding the
following new subsection 6.2.1 to subsection 6.2
ZONING BY-LAW:
"6. 2.1
6.2.1.1 Existing land uses which do not conform with
the policies or designations of the Official
Plan may be recognized on specific sites as
permitted uses in the affected municipality's
restricted area (zoning) by-law provided they
comply with policies a, b, c, d, of sub-
section 6.2 of this Plan. In addition, uses
which conform to the policies and land use
designations of the Official Plan shall also
be permitted on these sites.
6.2.1.2 Where an existing use is discontinued, new
uses of land on these sites which do not
conform to the policies and land use desig-
nations of the Official Plan may be permitted
if they are it greater conformity with the
Plan than the existing uses. All such new
uses will be subject to an appropriate
amendment to the affected municipality's
restricted area (zoning) by-law.
6.2.1.3 Where it is not appropriate or desirable to
recognize existing land uses which do not
conform with the Official Plan in the affected
municipality's restricted area (zoning) by-
law, such uses shall be zoned in accordance
with the designations and policies of the
Official Plan. Provided these land uses
legally exist at the date, -of the passage of
the municipality's restricted area (zoning)
by-law, the land uses would be legal non-
conforming uses. Any extension, enlargements
or changes of non -conforming uses will be
subject to the provisions of The Planning
Act. "

ficial Plan. The amendments will serve the

a) Amendment 13 wile revise the Future Land
Use schedule for the Village of Springfield
by adding various properties to the
residential, designation and by including
the Village park and playground in - the
Open Space designation.
b) Amendment 15 will update the Future
land Use schedules which apply to the
homiets of Orwell and Straffordville by
showing expanded areas for these
hamlett.
c) Amendment 16 provides revised policies
for extractive operations in the East Elgin
Planning Area in accordance with the Pits
and Quarries Control Act of the Province
of Ontario. The Amendment also alters
the areas capable of providing aggregate
resources -as shown on the most recent
geological mapping provided by the
Ministry of Natural Resources.
d) Amendment 17 modifies the Hazard Land
policies of the East Elgin Official Plan such
that areas so designated may be zoned in
the respective Township zoning by-laws
according to their existing land uses.
e) Amendment 18 modifies the policies of
the Official Plan which serves as the
framework for the implementation of
municipal zoning by-laws.
Complete copies of these proposed amend,
ments to the East Elgin Official Plan are
avciilable for public scrutiny at the various
municipal offices in the Planning Area in-
cluding:
