TOWNSHIP OF BAYHAM
BY - LAW NO. 1$$1
BEING a By -Law to appoint certain officers in and for the
Township of Bayham for the year 1976.
BE IT THEREFORE ENACTED by the Municipal Council of the Township
of Bayham in regular session assembled: -
1. That Wilfred Harper and Roger Casier shall be Valuators
of Livestock and Poultry killed by dogs to act independ-
ently of each other, provided however that where the
value of livestock or poultry killed shall be in excess of
Two Hundred Dollars ($200.00) they shall act together and
both affix their signatures to the report and shall be
paid at the rate of $4.00 per hour and .20¢ per mile for
the use of their automobile.
2. That Gibson, Lintnn & Toth shall be Township Solicitors,
3. That Hugh Ketchabaw shall be Drainage Commissioner at a
salary of $4.50 per hour and .20¢ per mile for car.
4. That Miller Wood shall be collector of dog tax with
remuneration to be 1/3 of fees collected plus $100.00
for car allowance.

WHEREAS the Municipal Act, provides that these appointments be made;

Whereas
the Council of the
Township
of Bayham
(hereinafter called
the "Municipality")
deems it
necessary to borrow the sum
of $ 350)000. to meet, until the taxes are collected, the current
expenditures of the Municipality for the year;

Therefore the Council of the Township of Bayham
hereby enacts as follows:
1. The Head and the Treasurer are hereby authorized on behalf of the Municipality to
borrow from time to time by way of promissory note from CANADIAN IMPERIAL BANK
OF COMMEROE a sum or sums not exceeding in the aggregate = 3 50 , 000.
to meet until the taxes are collected the current expenditures of the Municipality
for the year, including the amounts required for the purposes mentioned in subsection
(1) of Section 329 of the Municipal Act, and to give on behalf of the Municipality
to the Bank a promissory note or notes sealed with the Corporate Seal and signed by
the Head and Treasurer for the moneys so borrowed, with interest at such rate
as may be agreed upon from time to time with the Bank.
2. All sums borrowed pursuant to the authority of this by-law, as well as all other sums
borrowed in this year and in previous years from the said Bank for any or all of tht
purposes mentioned in the said Section 329, shall, with interest thereon, be a charge
upon the whole of the revenues of the Municipality for the current year and for all
preceding years as and when such revenues are received.
3. The Treasurer is hereby authorized and directed to apply in payment of all sums
borrowed as aforesaid, together with interest thereon, all of the moneys hereafter
collected or received either on account or realized in respect of taxes levied for the
current year and preceding years or from any other source which may lawfully be
applied for such purpose.

THE CORPORATION OF THE TOWNSHIP OF BAYHAM
BY - LAW NO. 1887
Being a By -Law to provide that in the year
1976 a levy be made before the adoption of
the estimates for the year.
WHEREAS the Council of the Township of Bayham deems it expedient
to ma ke a levy in the year 1976 before the adoption of the estimates.
THEREFORE THE COUNCIL OF THE TOWNSHIP OF BAYHAM ENACTS AS FOLLOWS:
1. That in the year 1976, before the adoption of the estimates, a
levy shall be made on the whole of the assessment for real property
according to the last revised assessment roll a sum not exceeding
50 percent of that which would be produced by applying to such
assessment the total rate for all purposes levied in the preceding
year on residential real property of public and separate school
supporters. 01
2. That in the year 1976, before the adoption of the estimates, a
levy shall be made on the whole of the business assessment according
to the last revised assessment roll a sum not exceeding 50 per cent
of that which would be produced by applying to such assessment the
total rate for all purposes levied in the preceeding year on
business assessment of public and separate school supporters.
3. The respective amounts to be levied under the provisions of
paragraphs 1 and 2 of this by-law are:

4. The rate to be levied under the provisions of paragraph 1 and 2
of this ,by-law to produce the amounts set out in paragraph 3 to this

6. In default of payment of the first instalment of taxes or any
part thereof by the day named therein for the payment thereof, the

penalty for non-payment of and shall be added to every tax instalment
or part thereof remaining unpaid on the first day following the last

day of payment of each such instalment and thereafter an additional
charge of one per centum (lip) shall be imposed and shall be added to
every such tax instalment or part thereof remaining unpaid on the
first day of each calendar month in which default continues up to
and including December of this year.
S. It shall be the duty of the Tax Collector immediately after the
several dates named in Section 5 to collect at once by distress or
otherwise under the provisions of the statutes in that behalf all such
tax instalments or parts thereof as shall not have been paid on or
before the respective dates provider aforesaid, together with the
said percentage charges as they are incurred.
9. The tax collector not later than 14 days prior to the date that
the first instalment is due shall mail or cause to be mailed to the
address of the residence or place of business of each person a notice
setting out th% tax payments required to be made pursuant to this
by-law, the respective dates by which they are to be paid to avoid
Penalty and the particulars of the penalties imposed by this by-law
for late payment.
10. Taxes shall be payable to the Corporation of the Township of
Bayham and shall be paid to the Collector at the Municipal Office.
11. The Collector and Treasurer be and are hereby authorized to accept
part payment from time to time on account of any taxes due and to
Live a receipt for such payment, provided that acceptance of any sl.ich
payment shall not affect the collection of any percentage charge

imposed and collectable under section 5 in respect to non-payment of
taxes or of any instalment thereof.
12. When tenants of lands owned by the Crown or in which the Crown has
an interest are liable for payment of taxes and where any such tenant
has been employed either within or outside the municipality by the same
employer for not less than thirty days, such employer shall pay over to
the Collector or Treasurer on demand out of any wages, salary or other
remuneration due to such employee the amount then payable for taxes
under this by-law and such payment shall relieve the employer from any
liability to the employee for the amount so paid.

BY-LAW NO. 18$$
BEING A BY-LAW to set out regulations respecting the issuance
of building; permits.
WHEREAS Subsection 2 of Section 5 of The Building Code Act,
197., empowers municipal councils to pass by-laws and regulations
respecting bi.zilding permits;
NOW THEREFORE, the Council of The Corporation of the
Toimship of Bayham enacts as follows:
Section 1 SHORT TITLE
1.1. This By-law may be cited as "The Building By -Law".
Section 2 PERMITS
2.1. CLASSES OF PERMITS
2.1.1. Classes of Permits with respect to the construction

and demolition of buildings shall be as set out in Schedule "A" to

this By-law.
2.2. APPLICATION FOR PERMIT
2.2.1. To obtain a permit the owner or his authorized
agent shall file an application in writing by completing the
prescribed forms available at the offices of the municipality .
2.2.2. Except as otherwise permitted b,r the chief
official, every application shall
(a) identify and describe in detail the work and occupancy to be
covered by the permit for which applicationNis made;
(b) describe the land on which the work is to be done, by a
description that will readily identify and locate the
building lot;
(c) be accompanied by complete plans and specifications ,as
described in Subsection 2.3.;
(d) state the valuation of the proposed work and be accompanied
bar the required fee;

(e) state the names, addresses and telephone numbers of the owner,
architect, engineer or other designer and constructor;
(f) be accompanied, where applicable, bir a written acknowledgement
of the owner that he has retained the architect or professional
Engineer to carry out the field review of the construction, as
described in Section 2.4 of the Regulations, and;

(g) be signed by the ovmer or his authorized agent who shall
certify the truth of the contents of the application.
2.2.3. An application for a permit may be deemed to have
been abandoned and cancelled 6 months after the date of filing,
unless such application is being seriously proceeded with.
2.3. PLANS, SPECIFICATIONS AND INFORTIATION
2.3.1. Sufficient information shall be slbmitted with each
application for a permit to enable the chief official to determine
whether or not the proposed work will conform with the Act, the
Regulations thereunder and any other applicable law.
2.3.2. Plans shall be drawn to scale upon paper, cloth. or
other durable material.
2.3.3 • Plans, specifications and information furnished
with the application shall be in numbers as prescribed by the
municipality.
2.3.4. Unless otherwise permitted by the chief official,
site plans shall be referenced to a current plan of survey,
certified b-1,- a registered ontario land serve; or, and a copy of
such survey shall be submitted.
2.4 APPROVAL IN PART
2.4-1. When, in order to expedite work, a permit for a
norti on of the building is desired prior to the issuance of a
permit for the whole project, application shall be made and fees

paid for the complete project, and complete plans and specifications
covering the portion of work for which immediate approval is desired
shall be filed with the chief official.
2.4.2. Should a permit be issued for part of a blailding the
holder of such permit may proceed but the municipality gives no
assurances that permits required for the remainder of the project
will be granted.
Section 3 FEES
3.1. Fees for a required permit shall be in accordance with
schedule "A" to this By-law.
3.2. Where the fees are based on the cost or valuation
of the proposed work, such valuation stall mean the total cost of
all work regulated by the permit including cost of professional
and related services.
The chief official shall place a valuation on the
cost of work and if the permit applicant or holder disagrees with
this valuation, the prescribed fee shall be paid before the issue
of the permit. Upon completion of the work, if the actual cost of
the work was less than the valuation placed by the chief official,
an audited statement may be submitted detailing the cost of
component parts of the work. The chief official shall,
statement contains the cost of all component Darts of the work upon
which the valuation was required to be based, value the work in
accordance with this statement and issue the appropriate refund.
In the case of the non -commencement of any project
and upon written request, the chief official shall determine the
amount of refund of permit fees, if any, that may be returned to
the permit holder, in accordance wi th Schedule "Bit to this By -Law.

Section 4 NOTIFICATIONS
The owner or his authorized agent shall notify the
chief official at least two business days in advance of the stages
construction specified in Section 2.10 of the Regulations.
Section 5 All bar -laws inconsistent with *this by-law are hereby
deemed to be repealed.

A. The fees that may be refunded shall be a percentage of
the fees payable under this b,r-lavi, as follows.

Being a bT-law to set the maximum fees for hunting licenses in the Township
of Bayham commencing in the ?rear 1976.
WHEREAS Section 39, Subsection 1 of. the Game & Fish Act, Chapter 186 R.S.O.
1970 provides that any municipality may pass by-laws for issuing and fixinp,
the maximum number of licenses to hunt, during the over season, pheasants,
rabbits and foxes and .for charging such fees therefor as may be authorized
by the Minister;
NOW THEREFORE the Council of the Corporation of the Township of Bayham
enacts as follows:
1. That no person shall hunt pheasants, rabhits or fox within the Township
of Bayham in the County of Elgin until a license for that purpose has
been obtained and such license to be in addition to anif other license or
permit required by law of the Federal or Provincial Governments.
2. The Clerk of the Toirnship of Bair -am or other person or persons appointed
.from time to time b-7 the Council shall issue and sell the following:
a) During and after the -open pheasant season - For non-resident of the
Municipality, a fee not greater t' an five dollars (15.00) with an
issuing fee not greater than fift,,7 cents ( 501) .for a total not greater
than five dollars and .fifty cents (,15.50) .
3. The license issuer is hereby authorized to charge the following fee for
resident licenses.-

the County of Elgin are non -reciprocal during the pheasant season, but
are reciprocal for rabbits and fox upon closing of the pheasant season.
6. In this By-law, the T-rords "Resident of the Township" means any person who
is a resident within the Township of Fayham and Villages of Vienna and
Port Piirwell.
7. In this Ry -law, the words "Non -Resident of the Township" means an -'r person
who does not reside within the To —ship of Payham and Villages of Vienna
and Port Burwell.
8.A minimum of 200 licenses must be available for use of non-residents of
i.;he Tovinship, with no restrictions on the n,,Lmber of resident licenses.
9. Townshin licenses are not valid on Crown lands, land -owner agreement
properties, and Provincial hunting areas.
10. That all previous By-lai�7s passed bT,T the Township of Ba;fham, which are
inconsistent herewith, be and the same are hereby repe'aled..
11. This by-law shall come into force upon approval by the Minister.

WHEREAS under the provisions of The Municipal Act, R.S.O.
1970, Chapter 284, Section 410, The Corporations of adjoining
municipalities may enter into an agreement for the maintenance and

repair of any highway forming the boundary between such municipalities,

whereby each of them may undertake for a period of not exceeding ten
years, to maintain and keep in repair any portion of such highway.
AND WHEREAS the parties hereto have entered into an agreement

dated the 6th day of May, 1975 for the general maintenance of boundary roads.
AND WHEREAS it is deemed expedient that certain improvements be
carried out in accordance with the recommendations contained in the
letter from the Canadian Transport Commission dated January 27th, 1976
subject to the cost sharing hereinafter set forth.
NOW THEREFORE this agreement witnesseth that in consideration of
the premises and mutual covenants and agreements hereinafter contained'
the parties hereto agree each with the other as follows:
I. The Township of Bayham shall arrange with the Canadian Natiortel 1':
Railway for extended crossing width to 26 feet and 2 flashing
signal lights and bell and widening of the road to 22 feet with
shoulder width of 2 feet in accordance with the requirements
of General order E4 of the Board of Transport Commissioners of
Canada.
2. The Township of Bayham shall account for and have full control and
supervision over all the construction and improvements to the said
railway crossing on the Boundary road and any improvements to the road.

3. The Town of Tiilsonburg shall reimburse the Township of Bayham
for 50% of the municipality's share of the costs in aforesaid
construction at the C.N.R. crossing on the Boundary Road between
the municipalities upon invoices being submitted by the Township
to the Town; said costs being those actually incurred for all
labour and materials, and for machinery rentals as set out in current
M.T.C. Schedules, and for the municipalitie's share of construction
costs as submitted by the Canadian National Railway and/or the
Canadian Transport Commission.
4. The Town of Tiilsonburg shall reimburse the Township of Bayham
for 75% of the municipalities' share of signal maintenance costs
as submitted by the Canadian National Railway.and/or the Canadian
Transport Cgpunission.
5. This agreement shall continue in force and shall be binding
upon the said municipalities until the First day of .January
A.D. 1984.
6. This agreement shall became effective and binding on the said
municipalities when confirmed by By -Law of the Council of each
of the said municipalities, and such by-laws with a copy of
this agreement attached shall be registered in the Registry Office
of each registry devision in which such highway or any portion
thereof is situated.
WITNESS the Corporate Seals of the said Corporations and the
hands of the respective Heads and Clerks.

TOWTSHIP OF BAYHAM
Being a b:, -law to adopt the assessment on which the taxes shall be levier',
for the year 1976, to lever the taxes for the year 1976 and to provide for
the collection thereof.
WHEREAS by action of the Province of Ontario, provision was made for the
making of the assessment of the Municipality by the Province of Ontario
Assessment Commissioner, prior to the 30th. day of September 1970 as the
assessment on which the rate of taxation for the yoar 10.76 should be levied;
AND WHEREAS the assessment roll containing the assessment made as aforesaid
has been revised, corrected and passed b,, `the Assessment Review Court for the
said Township of Bayham for the year 1976.
AND WHEREAS no revisions were made by the County Judge;
AND WHEREAS it is necessar;r and expedient to levy on the whole rateab'le
property accordin _, to the last revised assessment roll of the said Toimshin
the sum of $955,10.00 for the general purposes of the said Tovmship for
the current year, for the payment of the County rate for the current year,
and for the purposes of defraying part of the expenses of Public, Separate
and High School education, and other purposes;
THEREFORE THE COUNCIL OF THE CORPORATION OF TATE TOi-9TSHIP OF RAYHAM EFACTS
AS FOLLOWS:
1. That the assessmmt contained in the assessment roll of the Township
of Bayham as made pursuant to Province of Ontario Regulations, and as
revised, corrected and passed by the Assessment Review Court be and they''
same is hereby adopted and confirmed as the assessment on which the rate of
taxation for the year 1976 shall be levied.
2. That the said assessment roll be and the same is hereby adopted and
confirmed as the last revised assessment roll for the said Townshin.
3. That, for the purpose of providing the sum of $447.0$0.00 for the
general purposes of the Corporation, including the amount required for
County purposes and other purposes for the current year, a rate of 79.299
mills on the dollar be and the same is hereby levied for the gear 1976 upon
the whole of the said assessment of the Township according to the last
revised assessment roll, except that on assessment of $6,037,335.00 a
reduction of 15%, shall be made.
4 • That in addition, for the purpose of providing the sum of $483,411-00
for Public, Separate and High School Education_ purposes for the clarrent year

Municinal Drains and to raise the sum
of $6,928-51 to pay t'7erfor.
WHEREAS the above mentioned drains were constructed under the provisions of
the Drainage Act, and according to the several by-laws of the municipality,
providing for such construction, and according to the various reports of t' -c
Township Engineers made thereon.
AND WHEREAS it is provided by the said reports, by-laws and Drainage Act,
that the Municipality of the Township of Bayham, shall Maintain the said
Drainage works, at the expense of the land and roads in the said Township
in any way assessed for the construction thereof, in the portions accord-
inF.7 to srch assessment, until such assessments or portions t?^ereof, be varied.

cost of the said repairs and exnerses incidental thereto, which amount in
all to $6,928.51 and the Lands and Roads assessed, and the amounts of the
assessments thereon res �ectivel�r upon which the assessments and proportions
horeb r made are fixed, appear Ripon attached Schedule of Assessments, whic'
said Schedule is a part, of this by-law.
OD 111HER_EAS it is deemed expedient to levy the amounts in one hear.
NOVI THEREFORE the Municipal Council of the Corporation of the Township of
Bayham enacts as f ollolvis :
I. That for the purpose of paging the said repairs and efI-Terses incidental
thereto or for repaying into the General Funds of the Municipality the amount
or cost thereof the sum of $5,776.01 the amount charged against the land of
the drainage works, and now assessable for Maintenance, the following total
special rates and amounts shall over and above all other rates, be assessed
levied and collet'ted, in the same manner and at the sarft time as other taxes
are levied and collected upon and from the undermentioned lots or oarts'of
lots as specified in the attached scredille of assessments it the present
hear 1976.
2. That for the purpose of paying the stun of:3'908.11 the amount charged
against said roads of the Muricinalit-�r, and $254.39 the amount charged
against other Municipalities for the aforesaid purpose, accounts shall be
levied against the roads of the Municipality and against the other
