Box 160, 9344 Plank Road North STRAFFORDVILLE, ONTARIO Thursday, June 4, 1998 7:00 p.m. The regular meeting of Council of the Municipality of Bayham was held at 7:00 p.m. on Thursday, June 4, 1998 in the Council Chambers. Present were Mayor Max Stewart, Deputy Mayor Jack Petrie, Councillors John Nezezon, and David Mason, Administrator/Treasurer Lynn S. Buchner, and Clerk/Deputy Treasurer Lynda Millard. I. CALL TO ORDER Mayor Max Stewart called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF There was no disclosure of pecuniary interest and the general nature thereof. 3. DELEGATIONS (a) 7:05 a.m. - Gloria Stephenson was presented the 1998 Bayham Senior of the Year Award, by Mayor Max Stewart, for her past contributions as a member of the Port Burwell Marine Museum and Lighthouse Advisory Committee. Mayor Stewart also presented a congratulatory certificate on behalf of Peter North M.P.P. —Elgin. Councillor Mason added a few words of praise regarding Mrs. Stephenson's contributions to Port Burwell over the past number of years, to which Gloria Stephenson responded with a gracious thank you. (b) 7:15 p.m.—Lynn Buchner,Administrator Treasurer presented the 1997 audited Financial Statements for the former Township of Bayham. Item: 9.1(b) File: F10.3 (c) 7:30_p.m.—Steve Straub, appeared before Council to express concerns regarding proposed By-law 98-42 to regulate, restrict and prohibit the keeping of animals in the Municipality of Bayham. Item 8.2(c) (d) Ed Roloson, By-law Enforcement and Property Standards Officer,was in attendance to present Council with recommended amendments to by-laws to regulate, restrict and prohibit the keeping of animals; and to license and regulate dogs. (By-laws 98-42, 98-46). Item 8.2(c) (e) 8:00 a.m.—Brian Budarick, C.A. was in attendance to present the 1997 audited Financial Statements and Financial Information Return for the former Village of Port Burwell. UNFINISHED BUSINESS (a) Administrator Treasurer Staff Report 98048 regarding ownership of a Bickel Fire Truck. Tabled at meeting held May 21, 1998. File: V4.1 Tom Millard, Port Burwell Fire Station Chief, was in attendance requesting that ownership of the 1932 Bickel Fire Truck be retained for local use by the Fire Department for parades and special occasions within the Municipality. He stated that the volunteers were willing to make improvements to the vehicle. Councillor Nezezon stated that the transfer of ownership should have been dealt with by the Transition Board of the former Township of Bayham and Villages of Port Burwell and Vienna, and that any costs associated with the desired improvements would require Council approval prior to commitment. 98-443 Moved by J. Petrie "WHEREAS the restructuring Order as approved by the Minister on May 15, 1997 states that the assets of the former municipalities will become the assets of the new municipality; AND WHEREAS the Council of the Municipality of Bayham is desirous of safeguarding the assets of the former municipalities for the best interests of all ratepayers within the Municipality; THEREFORE BE IT RESOLVED THAT the 1932 Chevrolet Bickle Fire Truck remain as a municipal-owned vehicle to ensure that its use is in accordance with the best interests and benefit of all ratepayers of the Municipality of Bayham consistent with all other assets owned by the former municipalities." Disposition: Motion Carried Unanimously (b) Changes to be made to By-law 98-34 Establishing&Regulating By-law for the Bayham Fire Department prior to presentation for third reading and enactment. No action taken. File: P12.1 (c) Changes to be made to By-law 98-42, to regulate, restrict and prohibit the keeping of animals, or By-law 98-46, to license and regulate dogs, prior to presentation for third reading and enactment. No action taken. Steve Straub, voiced his concerns regarding proposed By-law 98-42. Mr. Straub stated his displeasure in certain aspects of the by-law claiming it was discrimination against citizens like himself, who have, over the years, collected and presently house a variety of different animals in the more urbanized areas of the municipality. UNFINISHED BUSINESS (c) Ed Roloson, By-law Enforcement Officer advised Council that proposed amendments to the By-laws provide a re-active approach based on complaint only. An amendment to By-law 98-46 included the insertion of a section providing for removal of canine waste on public properties. Preparation of the by-laws had been made upon contact with other municipalities of similar rural/urban content. Any presently operating situations would be classed as legal, non-complying. Further public input is to be considered by staff prior to reintroduction of the by- law to Council. 3. OTHER BUSINESS No Items. 9. FINANCE, ADMINISTRATION & PERSONNEL 1.
