The regular meeting of Council of the Municipality of Bayham,was held at 7:00 p.m. on
Tuesday, June 29, 1999, in the Council Chambers. Present were Mayor Max Stewart,
Councillors David Mason, John Nezezon, and Cliff Evanitski, Administrator/Treasurer Lynn S.
Buchner, and Clerk Lynda Millard.
1. CALL TO ORDER
Mayor Max Stewart called the meeting to order at 7:00 p.m.

There was no disclosure of pecuniary interest and the general nature thereof.

parcel of land described as Part Lot 14 Concession 9, on the east side of Murray Road to
facilitate the severance of a .76 ha parcel (1.89ac) for retirement purposes.

Township of Bayham Zoning By-law to change the designation of a parcel of land
described as Part Lot 14, Concession 9 on the east side of Murray Road to facilitate
the severance of an .76 ha (1.89 acre) for retirement purposes be accepted and
referred to Cumming Cockburn Limited and staff for review and scheduling of a
public meeting and by-law amendment preparation;
AND THAT conveyance of road widening be investigated by Staff."

Road.

"THAT Staff Report 99012 having reference to the proposed reconstruction of
Richmond Road and proposed construction by Cleason Hoover be received;
AND THAT in response to Mr. Hoover's request for permission to reconstruct
Richmond Road in Part Lot 115,North Talbot Road at his expense,in order to
provide access to one or more proposed development lots,Mr. Hoover be advised
that the Council of the Corporation of the Municipality of Bayham agrees in
principle with the proposed road reconstruction,subject to the following conditions:
• Detailed engineering plans are submitted for approval by the Municipality and
Long Point Region Conservation Authority showing details of
1) Road construction details, width, base, length, materials, turn around radius,
slope and angle of descent
2) Removal of vegetation
3) Erosion control
4) Storm drainage management
5) Percolation results for septic system approval and placement of field beds
• Submission of a site plan showing that all setback regulations are complied with
and placement of structure(s) on the proposed site(s),showing elevations of the
proposed dwelling(s);
AND THAT should Mr. Hoover decide to proceed with the development of the Hettie
Smuck property, a geotechnical report and sediment control plan must be submitted for
approval by the Long Point Region Conservation Authority and the Municipality;
AND THAT Mr. Hoover be further advised that in the absence of details concerning a
proposed long term care facility, no comments will be provided on that proposal."

requesting use of the back ball diamond area to park antique vehicles during Watermelon
Fest.

Committee be received;
AND THAT Council grants permission to the Straffordville Community Committee
and Optimist Club to hold the Annual Watermelon Fest on August 28, 1999 at the
Bayham Community Centre and Ball Park subject to providing the municipality
with proof of adequate liability insurance coverage to cover all events,naming the
municipality as an additional insured;
AND THAT the Committee provide the municipality with a map of the parade
route, and inform the Elgin County Manager of Engineering Services, and the OPP
of the time and location of the same."

(a) Verbal Report regarding the municipality's purchase of the former Eden Public School.
Administrator Buchner advised Council that confirmation had been received by telephone
that the offer in the amount of$ 91,000.,by the municipality to purchase the former Eden
Public School had been accepted by the Board. The closing date is August 31, 1999.

"WHEREAS the death of Deputy Mayor Jack Petrie on Wednesday,June 16, 1999,
created an immediate vacancy on the Council of the Municipality of Bayham
pursuant to Section 38(i) of the Municipal Act, R.S.O., Chapter M.45, as amended;
AND WHEREAS Section 43 of the said Municipal Act states that where a seat of a
member of Council becomes vacant,the Council shall forthwith declare the seat to
be vacant;
NOW THEREFORE BE IT RESOLVED THAT effective June 16, 1999
the Council of the Corporation of the Municipality of Bayham hereby declares the
Office of Deputy Mayor to be vacant."

Sewage Works Project be received;
AND THAT based on a review conducted by the Project Manager of submissions received
for equipment required to upgrade the Sewage Treatment Plant as set out in the
Environmental Study Report,the Project Manager is hereby authorized to award the
contract to U.S Filter Jet Tech.,in the amount of $262,981.subject to the following
conditions being met:
1. approval of a conditional Certificate of Approval by the Ministry of Environment;
2. execution of a Provincial Water Protection Fund Agreement with the Ministry of the
Environment."
