The regular meeting of Council of the Municipality of Bayham,was held at 7:00 p.m. on
Thursday, September 21, 2000 in Council Chambers. Present were Mayor Max Stewart, Deputy
Mayor John Nezezon, Councillors David Mason and Mathew Schafer, Administrator Kyle
Kruger and Clerk Lynda Millard. Councillor Cliff Evanitski was absent.
L CALL TO ORDER
Mayor Stewart called the meeting to order at 7:00 p.m.

There was no disclosure of pecuniary interest and the general nature thereof.
3. APPROVAL OF MINUTES
Minutes of the Public Meeting concerning a new Official Plan held August 23,2000

4. DELEGATIONS
(a) 7:05 p.m.—Mark Conway, Associate,Dillon Consulting Limited presented the draft
Port Burwell Assessment and Management Strategy report. Mr. Conway outlined and
expanded on the Project Purpose being:
(a) Clarification of ownership and tenure pattern
(b) Evaluation of liabilities
(c) Evaluation of assets,including development potential
(d) Evaluation of Port Burwell's economic role, locally and regionally
(e) Recommendations for municipal action
Mr. Conway recommended the Option of a Three-way Partnership for a New Marina
Development funded by the"SuperBuild"Program,based on:
(a) Little potential to generate new revenues under municipal control
(b) Unsuccessful under federal government management
(c) Transfer of ownership does not solve operation/finance issues

AND THAT Council supports acknowledgement of those who worked diligently
organizing the sesquicentennial celebrations on behalf of the Municipality;
AND THAT Council directs Staff to make appropriate arrangements to hold a
Volunteer Appreciation Evening at the Bayham (Straffordville)Community Centre
on Saturday, October 28,2000 at 7:00 p.m."

(c) Application submitted by Harry and Grace Schipper to change zoning on property
described as Part Lot 5, Concession 8, (Culloden Road)from the Agricultural(Al)
designation to a Rural Residential(RR) designation to meet the requirements imposed by
the Municipality in a County of Elgin Land Division Committee Application for Consent
in regard to a surplus farm dwelling.

described as Part Lot 5, Concession 8, (Culloden Road)from the Agriculture(Al)
designation to the Rural Residential (RR) designation to facilitate the severance of a
surplus farm dwelling be accepted and referred to Staff and Cumming Cockburn
Ltd. for preparation of a by-law and scheduling of a public meeting."

(a) Councilor Schafer expressed concern for the Calton Line (County Road #45) and Plank
Road(County Road #19) intersection in the wake of yet another vehicle accident.

"WHEREAS there continues to be automobile accidents at the corner of Calton
Line (County Road#45) and Plank Road (Hwy# 19) causing considerable danger
to the health, safety and well-being of public road users,even though a warning
light has been installed;
AND WHEREAS the Council of the Municipality of Bayham is desirous that such
danger to the public be minimized;
THEREFORE BE IT RESOLVED THAT the Council of the Municipality of
Bayham petitions the County of Elgin to consider viable options and undertake
appropriate measures to remedy this safety hazard. "

Infrastructure Program(OSTAR).

"WHEREAS the Council of the Municipality of Bayham (the"Municipality)
has reviewed the Ontario Small Town and Rural Development and infrastructure
Program ("OSTAR") application guide related to application procedures to obtain
funding for water and sewage works;
AND WHEREAS Council is in agreement with the recommendations of OCWA to
apply under Option 2 of the OSTAR program;
AND WHEREAS Council understands that a letter of intent and a Council
resolution is required to be submitted by October 6,2000 in order to apply for
funding under Option 2 of the OSTAR program;
NOW THEREFORE BE IT RESOLVED by the Council of the Municipality of
Bayham:
1. THAT the Municipality considers the poor water quality in the communities
of Straffordville and Eden their highest public health and safety concern; and
2. THAT the Municipality will be applying for funding assistance under Option
2 of Round One(1)of the OSTAR program to construct the necessary trunk
watermains, communal water distribution systems and water storage to
supply acceptable water to the communities of Straffordville and Eden; and
3. THAT the Municipality will be submitting the required letter of intent and
Council resolution by October 6,2000; and
THAT the Municipality will be submitting the required application and business
case on or before January 31,2001."
