Box 160, 9344 Plank Road STRAFFORDVILLE, ONTARIO Thursday, July 6,2000 7:00 p.m. The regular meeting of Council of the Municipality of Bayham, was held at 7:00 p.m. on Thursday,July 6, 2000 in the Council Chambers. Present were Mayor Max Stewart,Deputy Mayor John Nezezon, Councillors David Mason, Matt Schafer and Cliff Evanitski. Also present were Acting Clerk Margaret Underhill, Deputy Clerk Maureen Beatty and Treasurer Suzanna Mantel. 1. CALL TO ORDER Mayor Max Stewart called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF There was no disclosure of pecuniary interest and the general nature thereof. 3. APPROVAL OF MINUTES Minutes of the Regular Meeting held June 22, 2000 2000-343 Moved by J. Nezezon Seconded by C. Evanitski "THAT the minutes of the regular meeting of the Municipality of Bayham held June 22,2000 be approved." Disposition: Motion Carried Unanimously 4. DELEGATIONS (a) 7:05 p.m.-Deb Travis,representing the Port Burwell Recreation Board appeared to answer questions about the planned Tub Daze Events in Port Burwell. Item 6.2(a) (b) 7:20 p.m.—Theresa Kelly,representing the Elgin County Marketing Alliance, appeared to promote their efforts in advertising Elgin County as a rural tourism destination. Item 9.2 (a) (c) 7:35 p.m.--Henry & Carole Reimer, George & Edith Peaker, and Alan & Sylvia Wittet, appeared to express their concerns and pose questions regarding OPA# 88 and a granted consent application on property located in Concession 10,Part Lot 14,presently owned by Diane Tasker. Disposition: Motion Carried Unanimously (a) Minutes of the Bayham Community Policing Committee meeting held May 24, 2000. File: C06 (b) Township of Ashfield request for support for a Province-Wide Moratorium on Liquid Manure Facilities. File: C10 2000-345 Moved by C. Evanitski Seconded by J.Nezezon "WHEREAS the Council of the Corporation of the Municipality of Bayham hereby supports the resolution of the Township of Ashfield requesting a Province-wide moratorium on liquid manure facilities; AND WHEREAS the Council of the Corporation of the Municipality of Bayham is concerned about intensive livestock operations and their effect on the environment; THEREFORE the Council hereby imposes a moratorium on the construction of any new liquid manure facilities or intensive livestock operations pending the adoption of a nutrient management plan currently being prepared by Cumming Cockburn Limited; AND THAT Staff be directed to take the necessary steps to effect the moratorium, immediately." Mason "THAT the Council of the Municipality of Bayham hereby approve the acquisition of an upgraded generator, being Option No. 3 in Staff Report F2000-24 for installation within the proposed pumping station to be located adjacent to the municipal office subject to approval from Emergency Measures Ontario for a change in scope to the Joint Emergency Preparedness Program (JEPP) Grant; AND THAT staff be directed to submit the necessary request to Emergency Measures Ontario for approval." CORRESPONDENCE&REPORTS (a) Correspondence from Mike Elliott, OCWA, regarding Vienna Sewage Project tender results and Recommendation on Award for Contract No. 8 File E09 2000-354 Moved by J. Evanitski "WHEREAS the Council of the Municipality of Bayham has reviewed the prices submitted by the three (3) tenderers on June 21,2000 for the construction of the Vienna Sanitary Sewers for the Municipality under Contract No. 8 of Project Nos. 88-1338-01 and 88-1350-01: AND WHEREAS Council is in agreement with the recommendations submitted by their Consulting Engineers, and OCWA; NOW THEREFORE BE IT RESOLVED by the Council of the Municipality: 1. THAT the lowest tender, received from D'Amore Construction Limited in the tender amount of$3, 422, 034.50 for the construction of the Vienna Sanitary Sewers is hereby accepted; and 2. THAT the Ontario Clean Water Agency be so advised and requested to prepare the necessary contract documents for execution in order to award Contract No. 8; and 3. THAT the construction of the Vienna Sanitary Sewers be undertaken as expeditiously as possible and that in this regard the Ontario Clean Water Agency is hereby requested to issue,prior to the formal execution of contract documents, a letter authorizing D'Amore Construction Ltd. to commence work on the construction of the Vienna Sanitary Sewer works; AND THAT By-law 2000-63,being a by-law to authorize the Mayor and Acting Clerk to execute the Contract No. 8 agreement documents with D'Amore Construction Limited for the construction of the Vienna Sanitary Sewers be presented to Council for enactment."
