A special meeting of Council of the Municipality of Bayham, was held at 7:00 p.m. on
Wednesday, January 19, 2000 in Council Chambers. Present were Mayor Max Stewart, Deputy
Mayor John Nezezon, Councillors David Mason,and Cliff Evanitski,Administrator Kyle Kruger
and Clerk Lynda Millard. Councillor Mathew Schafer was absent.
The purpose of the meeting was to discuss concerns raised by property owners on Heritage Line
east of Garner Road in regard to the proposed System of Sewage Works.
1. CALL TO ORDER
Mayor Max Stewart called the meeting to order at 7:00 p.m.
2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL
NATURE THEREOF
Kyle Kruger, Administrator,read a letter submitted by Councillor Schaffer,noting that
since he owns property east of Garner Road, beside the proposed sewage drain, he may
be viewed to have a conflict of interest, and requested to be placed on record that he has
chosen to withdraw his involvement from any present or future discussion, attend or take
part at any meeting when a decision or vote is taken in support of, or rejection of the
petition submitted.
3. CORRESPONDENCE & DISCUSSION
Petition submitted by property owners on Heritage Line east of Garner Road regarding
proposed System of Sewage Works.

Brian Rachar and Robert VanDen Eeckhout,spokespersons noted that sixteen of the
property owners abutting Heritage Line between Garner Road and Tollgate Road affected
by the proposed system of sewage works are opposed to being included in the project.
They stated that their properties are larger than those within the Hamlet, septics are
working properly, and their water is not contaminated by nitrates. They noted that until
recently,they had been unaware that this section was to have been included, and they do
not consider themselves within the boundaries of the Hamlet of Straffordville.
Concerns were raised that the depth required for installation of the sewage works could
jeopardize the existing water wells, and that any problems with contamination of wells
would not be resolved for a long period of time.
The question was raised whether the Municipality would support and submit a request to
have this area withdrawn from the original grant funding application.
Kyle Kruger,Administrator, responded that the Development Freeze in Straffordville,
imposed by the Ministry of the Environment is still currently in place,and that density,
not necessarily failing septics is the issue. He noted that this area was included in the
process, and although application for withdrawal is possible, it might jeopardize the
Municipality's ability to meet the requirement that the problem be fully resolved by the
installation of the sewage system.

The Administrator also added that if withdrawal of the area proceeds and a problem
should arise in the future there would be no funding assistance and owners would be
required to pay the full 100% of costs to address any problems.

"THAT confirming By-law 2000-09 be read a first, second and third time and
finally passed."
