Box 160, 9344 Plank Road STRAFFORDVILLE, ONTARIO Thursday,July 4,2002 7:00 p.m. The regular meeting of Council of the Municipality of Bayham was held at 7:00 p.m. on Thursday, June 20, 2002 in Council Chambers. Present were Mayor Max Stewart,Deputy Mayor Lynn Acre, Councillors David Mason, Matt Schafer and Cliff Evanitski,Administrator Kyle Kruger, Deputy Clerk Michael Graves, Chief Building Official Dwayne Daniel and Fire Chief Sam Taylor. 1. CALL TO ORDER Mayor Stewart called the meeting to order at 7:00 p.m. 2. DISCLOSURE OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF 3. APPROVAL OF MINUTES Minutes of the Regular Meeting held June 20, 2002 2002-290 Moved by C. Evanitski Seconded by L. Acre "THAT the minutes of the regular meeting of the Municipality of Bayham held June 20, 2002 be approved." Disposition: Motion Carried Unanimously 4. DELEGATIONS None. 5. Disposition: Motion Carried Unanimously COUNCIL MINUTES -108 - July 4,2002 5. INFORMATION ITEMS (continued) (c) Deb Travis Port Burwell Recreation Society correspondence regarding Tub Daze. File C06 2002-292 Moved by M. Schafer Seconded by L. Acre "That the correspondence dated June 3,2002 from Deb Travis,Port Burwell Recreation Society be received; AND THAT Council approves use of the east beach by the Port Burwell Recreation Society and the Otter Valley/Port Burwell Optimist Club for Tub Daze celebration activities to be held August 2,3 and 4,2002, including beer tent, subject to meeting the requirements of the Municipal Alcohol Policy including those listed on the Outdoor Special Occasion Permit Application, and also subject to: • the applicable municipal building permit and/or sign permit be obtained from the Chief Building Official and the necessary inspections undertaken; • all required permit fees be paid to the Municipality of Bayham; • providing the municipality with proof of certification for the pyrotechnician who will be responsible for the fireworks; • providing the municipality with proof of liability insurance to cover all events including naming the municipality as an additional insured; • obtaining the necessary approvals from the Ontario Provincial Police and the Bayham Fire Chief; THAT all other terms and conditions of the rental agreement remain in effect; THAT the clean up of the east beach area and any costs thereof,be the responsibility of the organizations; THAT arrangements be made with the Public Works Superintendent to provide Staff assistance as regular duties permit; AND THAT the Council of the Municipality of Bayham designates this event as a Community Festival." Acre "THAT the Council of the Municipality of Bayham share the cost of grade preparation, granular shoulder and base asphalt on Bayham Drive between Clearview Drive, and the train tracks on a 50/50 basis with the Town of Tillsonburg." Disposition: Motion Carried Unanimously (c) Elgin St. Thomas Health Unit request to use Trans Canada Trail for Relay. 2002-295 Moved by D. Mason Seconded by M. Schafer "That the Municipality of Bayham grant permission to the Elgin St. Thomas Health Unit to conduct a Trail Relay through the Bayham Trans Canada Trail." Acre "THAT the Council of the Municipality of Bayham purchase rope and floatation devices from Southwestern Pool & Spa for use at the East Beach in Port Burwell." Disposition: Motion Carried Unanimously (e) Staff Report D2002-33 regarding a request for encroachment—Port Burwell Variety 2002-297 Moved by L. Acre Seconded by M. Schafer "THAT staff be directed to consult with the B.I.G. Group regarding any concerns they may have and then prepare the appropriate by-law and agreement to enter into an encroachment agreement with the owners of the property at 41 Robinson Street for the consideration of Council." APPLICATION (a) Staff Report DR2002-07 regarding Sproul Municipal Drain, Extension and Branch"A" 2002-298 Moved by L. Acre Seconded by M. Schafer THAT the Council of the Municipality of Bayham receive staff report DR2002-07; AND THAT the Municipality proceed with the report; AND THAT the Council meeting be adjourned in order to hold a Public Meeting pursuant to the provisions of the Drainage Act." Disposition: Motion Carried Unanimously 2. Declaration of Pecuniary Interest and the General Nature Thereof None. 3. Engineer Presentation John Spriet, Engineer presented the report dated May 17, 2002 4. Public Comments Gerry Wood asked a question regarding the underground water and erosion. 5. Council Comments and Questions Councillor Mason asked about control of erosion Councillor Evanitski asked about response from the Department of Fisheries and Oceans. 6. Adjournment The public meeting was adjourned at 7:40 p.m. 7. Disposition of Item 2002-299 Moved by L. Acre Seconded by M. Schafer That in accordance with Chapter 14, Sections 44 to 46 of the Drainage Act, the Council of the Corporation of the Municipality of Bayham hereby adopts the report No.97099 dated May 17,2002 as prepared by Spriet Associates, and referred to as the Sproul Municipal Drain Extension and Branch "A" AND THAT upon adoption of the aforementioned Report,Provisional By-law No. 2002-049 be given first and second reading; AND THAT Staff be directed to set a date for the first sitting of the Court of Revision, and distribute copies of the Provisional By-law and Notice of the time and place of the first siting of the Court of Revision to the affected parties."
