COMMITTEE OF ADJUSTMENT
MINUTES
6:15 P.M.
February 19, 1998
The Committee of Adjustment for the Municipality of Bayham met on February 19, 1998
at 6:15 p.m. in the Municipal Committee Room to consider two applications - A/1-98,
being an application by John Krahn,Agent for George Krahn concerning property
described as Part Lot 15, Concession 3 (east side of Centre Road, south side of Light
Line)—Parts 8 and 9,Reference Plan 11R-6564); and—Al2-98, being an application by
John Krahn, Krahn Construction concerning property described as Part Lot 15,
Concession 3 (east side of Centre Road, south side of Light Line)—Part 1, Reference
Plan 11R-6564).
In attendance were Mayor Max Stewart, Deputy Mayor Jack Petrie, Councillors David
Mason and John Nezezon, Administrator-Treasurer Lynn S. Buchner, Chief Building
Official Dwayne Daniel and Secretary-Treasurer Maureen Beatty. Regrets were received
from Councillor Nesbitt.
1. CALL TO ORDER
Mayor Stewart called the meeting to Order and called for motions to appoint
Chairman,Vice Chairman and Secretary Treasurer.
2. APPOINTMENT MOTIONS
"THAT Councillor John Nezezon be appointed Chairman, Councillor David be
appointed Vice Chairman and Maureen Beatty be appointed Secretary-
Treasurer of the Committee of Adjustment."
DISPOSITION: Motion Carried Unanimously
3. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE
THEREOF
No Member of the Committee disclosed a pecuniary interest and the general
nature thereof.
4. APPLICATIONS
A-1/98 Application by John Krahn, Agent for George Krahn, Owner of Part Lot 15,
Concession 3,East side of Centre Road, South side of Light Line to permit a
13.4 m setback as opposed to the required 15 m setback for a single family
dwelling which has already been constructed.

5. STAFF REPORT
The Chief Building Official indicated that the variances applied for of 1.6 metres
on each of the subject building lots resulted from an error in measurement. He
assured the Committee that the applicant was aware of the required 15 m setback
requirement as stated on the building permits,but the error was in no way a
deliberate disregard for the regulations.
6. PRESENTATION BY APPLICANT
Mr. John Krahn arrived at 6:35 p.m. and apologized for the error which resulted
in the variances. He assured the Committee that he would be more cautious to
ensure conformity to the zoning by-law regulations.
7. PUBLIC COMMENTS
No members of the public were in attendance to discuss the application.
8. COMMITTEE QUESTIONS AND DISCUSSION
Committee members generally discussed the minor variance guidelines and basis
for consents. All members believed the measurement error was not deliberate and
believed the variances to be minor in nature.
9. DECISION OF COMMITTEE
Moved by J. Petrie
Seconded by M. Stewart
"THAT the application (A-1/98) by John Krahn,Agent for George Krahn,
pursuant to Section 45 of the Planning Act for a minor variance to allow:
$ Relief from the Front Yard Setback requirement to 13.4 metres (43.93
feet) as opposed to the required 15 metres (49.21 feet) on Part Lot 15,
Concession 3, east side of Centre Road, south side of Light Line, (Parts 8
and 9,Reference Plan 11R-6564 be approved;
AND THAT the applicant be cautioned to ensure that all measurements
comply with the zoning by-law regulations for any future construction as
Penalties Section 1.11 of the Municipal Official Plan may be exercised at
Council's discretion."
Disposition: Motion Carried Unanimously

pursuant to Section 45 of the Planning Act for a minor variance to allow:
