The regular meeting of Council of the Municipality of Bayham was held at 7:00 p.m. on
Thursday,April 15, 1999 in the Council Chambers. Present were Mayor Max Stewart,
Deputy Mayor Jack Petrie, Councillors David Mason, John Nezezon, and Cliff Evanitski,
Administrator/Treasurer Lynn S. Buchner, and Clerk Lynda Millard.
1. CALL TO ORDER
Mayor Max Stewart called the meeting to order at 7:00 p.m.

There was no disclosure of pecuniary interest and the general nature thereof.

AND THAT the application be referred to staff and the planning consultant for
review, scheduling of a public meeting and by-law preparation."

sever a parcel of land with a frontage of 25.9 metres along Plank Road, and a depth of

"THAT the County of Elgin Land Division Committee be advised that the Council
of the Corporation of the Municipality of Bayham recommends approval of Consent
Application E-25/99 by John and Patricia Ann Plug to sever a parcel of land with a
frontage of 25.9 m along Plank Road and a depth of 60.96 m to add to the adjoining
church property to the south be approved subject to the following conditions:
• Removal of the existing tobacco kiln on the severed parcel
• A copy of any survey plan prepared to be deposited with the Municipal Clerk
• Subsection 3 of Section 50 of the Planning Act,R.S.O. 1990 shall be imposed
with regard to merging title with the adjacent church property."

of the Corporation of the Municipality of Bayham recommends approval of Consent
Application E-26199 by Paul and Sheila Franklin to sever a parcel of land measuring
37.8 m by 39.32 m to add to the adjoining church property to the east be approved
subject to the following conditions:
• A copy of any survey plan prepared to be deposited with the Municipal Clerk
• Subsection 3 of Section 50 of the Planning Act,R.S.O. 1990 shall be imposed
with regard to merging title with the adjacent church property."

THAT the County of Elgin Land Division Committee be advised that the Council of
the Corporation of the Municipality of Bayham recommends approval of Consent
Application E-31/99 by Jacob Dyck and the Estate of Elizabeth Dyck to sever a lot
with a frontage of 83.32 m along Highway#3 (Talbot Line) by a depth of 81.3 m
proposed to create one new residential building lot subject to the following
conditions:
• Payment of$500 cash in lieu of park land dedication
• A copy of any survey plan prepared to be deposited with the Municipal Clerk
• Access to both the retained and severed parcels must be to the satisfaction of the
Ministry of Transportation."

"WHEREAS the Council of the Corporation of the Municipality of Bayham desires
to promote,expand and enhance the economic development and tourism within the
municipality;
AND WHEREAS the Council considers it expedient to establish a committee whose
responsibility shall be to develop programs and projects for this purpose;

(f) AND WHEREAS a Striking Committee previously established by Council has
developed a mandate and terms of reference and recommended the appointment of
members to serve on the Bayham Community Economic Development& Tourism
Committee;
THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Bayham hereby approves the proposed terms of reference for the
Bayham Community Economic Development& Tourism Committee and appoints
the following members to serve for a term to expire December 31,2000:
Mayor Max Stewart (ex officio)
Councillor David Mason
Gary Wiggans
Carole Reimer(Interim Co-Chair)
Bertha Breen (Interim Co-Chair)
Alternates for Carole Reimer and Bertha Breen shall be
Henry Reimer and Richard Breen respectively
AND THAT the Committee be authorized and directed to solicit additional
members by personal contact and via newspaper advertisements and report back to
Council with recommended appointments;
AND THAT By-law 99-30,being a by-law to establish the Bayham Community
Economic Development & Tourism Committee be presented to Council for
enactment;
AND THAT the 1999 Proposed Committee Operating Budget be considered by
Council during its 1999 budget deliberations."

Works Superintendent to retain the services of the Township of Southwold for the
purpose of road line painting on County Roads for a price of$110.00 per hour plus
material;
AND THAT Council authorizes two members of the Public Works Department to
attend the annual Truck Rodeo sponsored by the Ministry of Transportation of
Ontario for a registration fee of$35.00 per participant;
AND THAT two members of the Public Works Department be authorized to attend
the C. S. Anderson School for training for a cost of$475.00 per participant plus
accommodations;
AND THAT three members of the Public Works Department be authorized to
attend the backhoe refresher course sponsored by the City of St. Thomas Public
Utilities for a cost not to exceed$360 per participant;
AND THAT Council directs Staff to advertise for tenders for the supply and
delivery of unleaded gasoline and diesel fuel for a period of 18 months commencing
July 1, 1999;
AND THAT Staff be directed to arrange and advertise for a large item spring
pickup day for a cost of$75.00 per hour."

"WHEREAS the Council of the Municipality of Bayham recognizes the importance
of Library services within the community and the need to provide those services as
economically efficient as possible;
AND WHEREAS Council has been informed that the resident patron complement
at the Vienna Library is less than 100,resulting in inefficient operation of that
library facility;
THEREFORE BE IT RESOLVED THAT the Council of the Municipality of
Bayham hereby requests that the County pursue closure of the Vienna Library;
AND FURTHER THAT Council wishes to work cooperatively with the County
Library Staff to fmd means of providing library service to the elderly or shutins that
were identified as Vienna patrons that cannot use the other library facilities located
in Port Burwell and Straffordville;
AND THAT this resolution be forwarded to Elgin County Council for their
consideration."
