BEING A BY-LAW TO AMEND BY-LAW 2004-015
BEING A BY-LAW TO SET WATER AND SEWER
RATES IN THE MUNICIPALITY OF BAYHAM
WHEREAS the Municipal Act 2001, S.O. 2001, c. 25 as amended provides that the Council of a
local Municipality may by by-law provide for imposing upon owners or occupants of land who
use sewage works a sewage service rate, and;
WHEREAS the Municipal Act 2001, S.O. 2001, c. 25 as amended provides for imposing rates,
regulating, metering, measuring and collection frequencies and methods for water and sewer
rates;
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to amend by-
law 2004-015 to provide for reduced rates for subsidiary dwelling units;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT Section 2.08 of By-law No. 2004-015, as amended, be and the same is hereby
repealed and replaced with the following:
2.08 "Dwelling Unit" means a single family residence, duplex, triplex, mobile home,
apartment, or any structure that is designed for occupation as the residence of one or more
persons, including dependents or domestic employees of a member of the family, whether or
not rent is paid for the occupation of any part of such residence, and whether or not the land
on which the residence is situated is zoned for residential use, and "dwelling unit" includes
any such residence that is to be constructed as part of the arrangement relating to a
conveyance of land.
2. THAT By-law No. 2004-015, as amended, be and same is hereby further amended by
inserting the following as Section 2.16:
2.16 "Subsidiary Dwelling Unit" means a structure, part of a structure, premise or room that
is supplementary to the primary property use, rented for residential purposes regardless of
rental terms, and includes rooms in a bed and breakfast establishment, boarding home
establishment, hotels, and motels.
3. THAT By-law No. 2004-015, as amended, be and same is hereby further amended by
inserting the following as Section 4.121:
4.12.1 Notwithstanding Sections 4.11 and 4.12 herein, Subsidiary Dwelling Units shall be
exempt from the base rate charge described in Schedule "A"
4. THAT By-law No. 2004-015, as amended, be and same is hereby further amended by
inserting the following as Section 4.221:
4.22.1 Notwithstanding Sections 4.21 and 4.22 herein, Subsidiary Dwelling Units shall be
exempt from the minimum bill described in Schedule "A".
5. THAT this by-law shall come into force and effect upon its passing and shall apply to all
billing periods commencing October 1, 2011.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED this 5th Day of
July,2012.
